From and out of the Consolidated Fund of the State of Mizoram, of the Consolidated Fund of the Statethere may be paid a nd applied the sums not exceeding those as of Mizoram for the first four monthsspecified in column (5) of the S chedule to this Act, amounting, of the Financial Year, 2012-2013in the aggregate, to the sum ofRupees one thounsand six (i.e. April to July, 2012) hundred sixty three crore eleven lakh sixty six thousand only for defraying the several charges which will come in course of payment for the first four months of the Financial Year, 2012- 2013 (i.e.April to July, 2012) in respect ot the services specified in column (2) of the Schedule. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLI Aizawl, Wednesday 11.4.2012 Chaitra 22, S.E. 1934, Issue No. 183 NOTIFICATION No. LA/E.COM-SSA/2012/96, the 4th April, 2012.Wher ea s t he s ubject of the alleged la ps e of SSA Uniform Grant for 2010-2011 amounting to ^ 743.16 lakh was discussed at length during the course of the Tenth Sess ion of the Sixth Legisla tive Assembly of Mizoram, Members unanimously accepted the constitution of an Assembly Enquiry Committee to enquire into the alleged lapse of SSA Uniform Grant for 2010-2011 and the authenticity of the documents presented by Dr. R. Lalthangliana, MLA to the Press on 29.2.2012. And whereas the Hon’ble Speaker, after consideration of Member ’s wishes, is satisfied that with a view to arrive at a finding or findings as to the truth of this alleged lapse of SSA fund and the authenticity of the said documents, it is necessary and expedient to constitute an Assembly Enquiry Committee. And whereas, Pu T.T. Zothansanga, MLA under Rule 205 of the Rules of Procedures, and Conduct of Business submitted his resignation from the Enquiry Committee due to health grounds. And also whereas, consequent upon the non-a cceptance of the composit ion of the Enquiry Committee by the MNF and MDF Legislature Party vide letter No. nil, dt. 2.4.2012 submitted by Pu B. Lalthlengliana, MLA. Now, therefore, in exercise of the powers conferred under Rule 202 of the Rules of Procedure and Conduct of Business in Mizoram Legislative Assembly, the Hon’ble Speaker, in supersession of Notification No. LA/E.COM-SSA/2012/93 of 29.3.2012, is pleased to make changes in the composition of the Enquiry Committee to enquire into the alleged lapse of SSA Uniform Grant for 2010 - 2011 and the authenticity of documents presented by Dr. R. Lalthangliana, MLA to the Press on 29.2.2012 as follows : 1.Pu Lalduhawma-Chairman 2.Pu B. Lalthlengliana-Member 3.Pu P.P. Thawla-Member 4.Pu R. Lalrinawma-Member 5.Pu Lalthansanga-Member 6.Pu John Siamkunga-Member The terms of reference of the Committee shall be as here under 1.To enquire into the authenticity of the documents presented to the Press by Dr. R. Lalthangliana on 29.2.2012 and to arrive at a finding or findings as to whether the documents were fabricated or not. - 2 - Ex-183/2012 2.To enquire into the allegations made by Dr. R. Lalthangliana to the Press on 17.2.2012 and 29.2.2012 that the total amount of ^ 743.16 lakh for SSA Uniform Grant for 2010-2011 had lapsed and to arrive at a finding or findings if said fund had lapsed or not. The Enquiry Committee will have the power to call for any relevant documents and persons as it deems fit. The Enquiry Committee shall submit its report to the Hon’ble Speaker within 3 (three) months. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLI Aizawl, Thursday 12.4.2012 Chaitra 23, S.E. 1934, Issue No. 184 NOTIFICATION No. A. 12018/62/2007-P&AR(GSW), the 9th April, 2012.In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and all other powers enabling him in this behalf, the Governor of Mizoram is pleased to make the following rules, namely :- PART - I GENERAL1.Shor t title a nd Commencement(1)These Rules may be called the Mizoram Food & Civil Supplies Service Rules, 2012 (2)They shall come into force with effect from the date of publication in the Official Gazette. 2.DefinitionsIn these r ules, unless the context other wise requir es - a)“Appointing Authority” means the Governor of Mizoram; b)“Authorised Permanent Strength” in relation to any gr ade mea ns the strength of permanent and specified posts in that grade; c)“Commission” means the Mizoram Public Service Commission; d)“Constitution” means the Constitution of India; e)“Duty Post” means any post specified in schedule-I and it includes temporary posts carrying the same designation and pay as any of the posts specified in that schedule and any other posts specified in schedule - II; f“Government” means the Government of Mizoram; g)“Governor” means the Governor of Mizoram; h)“Grade” means any of the Grades specified in Rule - 4; i)“Official Gazette” means the Mizoram Gazette published by the Government; j)“Schedule” mea ns s chedu le a p pended to thes e Rules; k)“Service” means the Mizoram Food & Civil Supplies Service. PART - II COMPOSITION OF THE SERVICE AND ITS CLASSIFICATION3.Initial Constitution of the ServiceThere shall be constituted a Service to be known as the Mizoram Food & Civil Supplies Service (MF&CSS) - 2 - Ex-184/2012 4.Classification of Service(1)There shall be 5(five) grades in the service namely :- Sl. No.GradePost1. Grade-I- Additional Director 2. Grade-II- Joint Director 3. Grade-III- Dy. Directors and District Civil Supply Officer or its equivalent posts 4. Grade-IV- Asst. Director/Asst. District Civil Supply Officers and Sub-Divisional Officer, FCS&CA and their Equivalent posts. 5. Grade-V- Inspector of Supplies. (2) The posts at Sl. No. 1-4 above are Group ‘A’ posts and the post at Sl. No. 5 is Gazetted Group ‘B’ post. 5.Authorised permanent strength of service(1)The authorised permanent strength of the various grades of the service on the appointed da te sha ll be as specified in Schedule-II (2)After the appointed date, the authorized permanent strength of the various grades shall be such as may, from time to time, be determined by the Government. (3)The Government may make temporary/permanent additions to the authorised permanent strength of the various grade as it may deem necessary from time to time. 6.Posting of Members of the Service(1)Every member of the service shall be posted against a duty post of the appropriate grade specified in schedule I (2)A member of the service shall be liable to be transferred to a post outside the cadre under the Government which is equivalent in rank or grade as the Governor may consider necessary. PART-III RECRUIT MENT7.Method of Recruitment(1)Appointment to any post after initial Constitution under rule 3, in the entry grade i.e. Grade V of the service sha ll be made - (a ) 30% of the total sanctioned strength by promotion on seniority-cum-merit from amongst the Sub-Inspector of Food & Civil Supply having at least 5 years regular service in the grade. (b) The rema ining 70% of the total sa nct ioned strengt h shall be filled up by Direct Recruitment from Graduates of a recognised University conducted by the Mizoram Public Service Commission failing which transfer on deputation. (c ) Out of 70% direct recruitment quota, 3% shall be reserved for persons with disabilities having requisite qualifications and as per physical requirement and functional classification identified by the Government. (2)The Commission shall conduct interview for selection to the posts for direct recruitment as per the rules laid down by the Government and shall prepare and furnish a list of all candidates recommended for appointment in order of merit to the Government. 8.Physical FitnessA candidate for direct recruitment shall be- (1)of sound health both mentally and physically and free from organic defect or bodily deformity likely to interfere with the efficient discharge of his duties. (2)required to undergo medical examination before appointment to the service. - 3 -Ex-184/2012 9.Age LimitA candidate for direct recruitment shall not be less than 18 years and not more than 35 years on the closing date for receipt of application from candidates provided that the upper age limit may be relaxed by five years in case of candidates belonging to the Schedule castes / Scheduled tribes and in respect of candidates belonging to other special categories in accordance with general or special order issued by the Central Government or Government of Mizoram of persons from time to time. 10.NationalityNo person shall be qualified for appointment to the service unless he / she is a citizen of India. 11.Disqualification(1) No persons,- ( a ) who has entered into or contracted a marria ge with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the service. Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. (c) who is serving in a Government Department and other Government undertaking shall be eligible for appointment in the service unless he / she produces a discharge certificate from his previous employer. (2) The appointing authority may institute such inquiries as he / she may deem necessary as to the particulars of any candidates in respect of nationality, age, character, conduct, antecedents etc. and if the result of such inquiry in his/ her opinion is unsatisfactory in any of these aspects, the candidates may be declared disqualified with intimation to the commission. (3) No person who attempts enlist support for his / her candidature directly or indirectly by any means, shall be appointed to the service. PART-IV APPOINTMENT TO THE SERVICE.12.Appointments(1)Subject to the provisions of sub- rule (1) of Rule 7, and subject to the availability of vacancies, appointment to grade- V of the service shall be made by the Governor in accordance with t he order of names arra nge in the list by the C ommission and shall be notified in the Official Gazet t e. (2)A person recruited under sub- rule 2 of Rule 7 shall join within 30 days from the date of issue of the order of appointment failing which and unless the Government extends the period, the appointment shall stand cancelled. 13.Probation and confirmation(1)A person recruited to the service under sub-rule 2 of Rule 7 shall be on probation for a period of two years, which may be extended for a good and sufficient reason by the Government for a further period as may be determined by the Government (2)Where a probationer has successfully completed his / her probation period or any extension thereof to the satisfaction of the Appointing Authority, he / she may be confirmed in the service. (3)If during the period of probation referred to in sub-rule (1) and sub-rule (2) as the case may be, the Appointing authority is of the opinion that an officer is not fit for regular appointment, it may in consultation with the Commission through the DP&AR, be discharge the officer from service or pass order. 14.Seniority: (1)The seniority of a member recruited under sub-rule (1) and (2) of Rule 7 shall be determined according to the order of merit list recommended by the Commission and finally approved by the Appointing Authority. (2)The inter-se-seniority of the members of the service appointed to any grade at the time of initial constitution shall be as obtained on the date of commencement of these rules; Provided that if the seniority of any such member has not been specifically determined on the said date, the same shall be determined by the Government in consultation with the Department of Personnel and Administrative Reforms, Provided further that if there is any dispute not covered by sub-rule (1) and (2) above, it shall be determined by the Government. (3)All members of the Service who were substantively appointed in any particular grade in the service at the initial constitution shall rank senior to all other members temporarily appointed to the grade of the service under Rule 7. 15.Promotion(1)GRADE-I : The post in this grade as specified in Schedule II shall be filled up by promotion from amongst the memebrs of the service in grade-II who have rendered at least 5 (five) years of regular service in that grade failing which officers on regular service in grade -II at least for a period of 3 years but have completed 20 (twenty) years of service calculated from the date of entry into Gazetted post under FCS &CA Department including Grade -V of the service. The method of promotion to this grade shall be by Selection. (2)GRADE - II : The post in this grade as specified in Schedule II shall be filled up by promotion from amongst the members in the service in grade-III who have rendered not less than 5 (five) years regular service in that grade failing which officers in the grade-III with not less than 3 years of regular service in that grade but have completed 15(fifteen) years of service calculated from the date of entry into grade-V of the service. The method of promotion to this grade shall be by Selection. (3)GRADE-III : The post in this grade as specified in Schedule II shall be filled up by promotion from amongst the members in grade-IV who have rendered not less than 5 years of regular service in the grade. (4)GRADE-IV : The post in this grade as specified in Schedule II shall be filled up by promotion from amongst the members in grade-V who have rendered not less than 5(five) years of regular service in that grade. The method of promotion to this grade shall be by Selection. 16.PayThe scale of pay attached to the various grades of the services shall be as follows which can be changed by the Government from time to time. 1)Grade - I-Pay band - 4 - Rs. 37400 - 67000 + Grade pay Rs. 8700 2)Grade - II-Pay band - 3 - Rs. 15600 - 39100 + Grade pay Rs. 7600 3)Grade - III-Pay band - 3 - Rs. 15600 - 39100 + Grade pay Rs. 6600 4)Grade - IV-Pay band - 3 - Rs. 15600 - 39100 + Grade pay Rs. 5400 5)Grade - V-Pay band - 2 - Rs. 9300 - 34800 + Grade pay Rs. 4400 PART - V MISCELLANEOUS PROVISION17.Leave Pension and other mattersIn respect of leave, pension, discipline and other condition of service not expressly provided for in these Rules, the members of the service shall be governed by the general rules applicable to the Government employees from time to time.- 4 - Ex-184/2012 18.Power to RelaxWhere the Governor is of the opinion that it is necessary and expedient to do so, he may, in consultation with the Commission and for reasons to be recorded in writing, relax by order any of the provisions of these Rules with respect to any class or categories of person provided that the case of any person shall not be dealt with in any manner less favorable to him than that provided by any of these rules. 19.Repeal and savingsOn and from the commencement of these Rules, all previous recruitment rules for the posts covered by these rules shall stand repealed. Provided that all orders made or action taken under the Rules so repealed or under any General orders a ncillary thereto shall be deemed to have been validly made or taken under the corresponding provisions of these rules. 20.InterpretationIf any question arises relating to the interpretation of these rules, it shall be decided by the Government in consultation with the Commission and DP& AR and such decision shall be final and binding. PART - II COMPOSITION OF THE SERVICE AND ITS CLASSIFICATION3.Initial Constitution of the ServiceThere shall be constituted a Service to be known as the Mizoram Food & Civil Supplies Service (MF&CSS) - 2 - Ex-184/2012 4.Classification of Service(1)There shall be 5(five) grades in the service namely :- Sl. No.GradePost1. Grade-I- Additional Director 2. Grade-II- Joint Director 3. Grade-III- Dy. Directors and District Civil Supply Officer or its equivalent posts 4. Grade-IV- Asst. Director/Asst. District Civil Supply Officers and Sub-Divisional Officer, FCS&CA and their Equivalent posts. 5. Grade-V- Inspector of Supplies. (2) The posts at Sl. No. 1-4 above are Group ‘A’ posts and the post at Sl. No. 5 is Gazetted Group ‘B’ post. 5.Authorised permanent strength of service(1)The authorised permanent strength of the various grades of the service on the appointed da te sha ll be as specified in Schedule-II (2)After the appointed date, the authorized permanent strength of the various grades shall be such as may, from time to time, be determined by the Government. (3)The Government may make temporary/permanent additions to the authorised permanent strength of the various grade as it may deem necessary from time to time. 6.Posting of Members of the Service(1)Every member of the service shall be posted against a duty post of the appropriate grade specified in schedule I (2)A member of the service shall be liable to be transferred to a post outside the cadre under the Government which is equivalent in rank or grade as the Governor may consider necessary. PART-III RECRUIT MENT7.Method of Recruitment(1)Appointment to any post after initial Constitution under rule 3, in the entry grade i.e. Grade V of the service sha ll be made - (a ) 30% of the total sanctioned strength by promotion on seniority-cum-merit from amongst the Sub-Inspector of Food & Civil Supply having at least 5 years regular service in the grade. (b) The rema ining 70% of the total sa nct ioned strengt h shall be filled up by Direct Recruitment from Graduates of a recognised University conducted by the Mizoram Public Service Commission failing which transfer on deputation. (c ) Out of 70% direct recruitment quota, 3% shall be reserved for persons with disabilities having requisite qualifications and as per physical requirement and functional classification identified by the Government. (2)The Commission shall conduct interview for selection to the posts for direct recruitment as per the rules laid down by the Government and shall prepare and furnish a list of all candidates recommended for appointment in order of merit to the Government. 8.Physical FitnessA candidate for direct recruitment shall be- (1)of sound health both mentally and physically and free from organic defect or bodily deformity likely to interfere with the efficient discharge of his duties. (2)required to undergo medical examination before appointment to the service. - 3 -Ex-184/2012 9.Age LimitA candidate for direct recruitment shall not be less than 18 years and not more than 35 years on the closing date for receipt of application from candidates provided that the upper age limit may be relaxed by five years in case of candidates belonging to the Schedule castes / Scheduled tribes and in respect of candidates belonging to other special categories in accordance with general or special order issued by the Central Government or Government of Mizoram of persons from time to time. 10.NationalityNo person shall be qualified for appointment to the service unless he / she is a citizen of India. 11.Disqualification(1) No persons,- ( a ) who has entered into or contracted a marria ge with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the service. Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. (c) who is serving in a Government Department and other Government undertaking shall be eligible for appointment in the service unless he / she produces a discharge certificate from his previous employer. (2) The appointing authority may institute such inquiries as he / she may deem necessary as to the particulars of any candidates in respect of nationality, age, character, conduct, antecedents etc. and if the result of such inquiry in his/ her opinion is unsatisfactory in any of these aspects, the candidates may be declared disqualified with intimation to the commission. (3) No person who attempts enlist support for his / her candidature directly or indirectly by any means, shall be appointed to the service. PART-IV APPOINTMENT TO THE SERVICE.12.Appointments(1)Subject to the provisions of sub- rule (1) of Rule 7, and subject to the availability of vacancies, appointment to grade- V of the service shall be made by the Governor in accordance with t he order of names arra nge in the list by the C ommission and shall be notified in the Official Gazet t e. (2)A person recruited under sub- rule 2 of Rule 7 shall join within 30 days from the date of issue of the order of appointment failing which and unless the Government extends the period, the appointment shall stand cancelled. 13.Probation and confirmation(1)A person recruited to the service under sub-rule 2 of Rule 7 shall be on probation for a period of two years, which may be extended for a good and sufficient reason by the Government for a further period as may be determined by the Government (2)Where a probationer has successfully completed his / her probation period or any extension thereof to the satisfaction of the Appointing Authority, he / she may be confirmed in the service. (3)If during the period of probation referred to in sub-rule (1) and sub-rule (2) as the case may be, the Appointing authority is of the opinion that an officer is not fit for regular appointment, it may in consultation with the Commission through the DP&AR, be discharge the officer from service or pass order. 14.Seniority: (1)The seniority of a member recruited under sub-rule (1) and (2) of Rule 7 shall be determined according to the order of merit list recommended by the Commission and finally approved by the Appointing Authority. Now, therefore, the Government declares under section 6 of the said Act that the said land is required for the public purpose specified above and as per scheduled indicated below. The Government now appoints the Deputy Commissioner, Lunglei under clause (C) of section 3 of the said Act to perform the functioins of a Collector for all procedings hereinafter to be taken in respect of the said land and directs him under section 7 of the said Act to take order for the acquisition of the said land. The Collector shall there upon cause the land to be measured and make a plan of the same under Section 8 of the said Act if not already done as per section 4 of the said Act, and dispose of all objections and claims after causing a public notice for not less than 15 days to the persons interested stating the Government’s intention of taking over the possession of the said land as per section 9 of the said Act. Then, the Collector shall submit a Draft Award to the Government of Mizoram after fulfilling the provisions under section 11 of the said Act. A plan of the same can be inspected at the Office of the Deputy Commissioner, Lunglei till the final award is made under section 11 of the said Act. AN ACT to a mend the Chakma Autonomous District Council (Village Council) Act, 2003 (hereinafter called the Principal Act) and to provide for the establishment of Village Councils and for other matters relating to village administration. PREAMBLE :- Wher eas it is expedient to provide for the establishment of Village Councils a nd their powers and for other ma tters r elating to Village administration including village police, public health and sanitation; and Wher eas by clauses (e) and (f) of sub-pa ragraph (1) of Paragra ph 3 of the Sixth Schedule to the Constitution, the District Council for an Autonomous District is empowered to make laws in respect of the esta blishment of Village or Town Committees or Councils or any other matters relating to the Village or Town Administration, Village or Town Police and Public health and sanitation. Now, therefore the District council of the Chakma Autonomous District Council (hereinafter referred to a s the District Council), in exercise of the powers conferred on it as a foresaid and of the other powers enabling it in that behalf is pleased to enact and it is hereby enacted as follows : 1.Short title, extent and Commencement: (i)This Act ma y be ca lled the Chakma Autonomous District Council (Village Councils) (Amendment) Act, 2011. (ii)It shall have like extent a s the Pr incipal Act. (iii)It shall be deemed to have come into for ce with effect from the date of its publica tion in the Official Gazette. 2.Amendment of Section 2- (1)In S ection 2 of the Principal Act , after clause (7), the following clause (7a) shall be added, namely ;- “(7a ) ‘Gram Sabha’ means a body consisting of persons registered in the electoral roll or rolls relating to a village or villages comprised within the area of the Villa ge Council”. (2)In Section 2 of the Principal Act, after clause (10), the following clause (10a) shall be added, namely ; “(10a) ‘Sta te Election Commission’ means the S tate Election Commission as constit uted for the State of Mizoram under the pr ovisions of Part IX and Part 1XA of the Constitution.” (3)In Section 2 of t he P rincipal Act, after cla use (12), the following clause shall be added,namely ; “(13) ‘Community assets’ means any property of income which by custom belongs t o or has been administered for the benefit of the villagers in common, or has been created through contribution of voluntary labour by the villagers or has been created out of Government or District Council or Village Council funds and vested with the Village Council or which has been transferred to the Village Council b y any agency whatsoever”. 3.Amendment of Section 3- After Sub-S ection (4) of t he Section 3 of the Pr incipal Act, the following Sub-Sections shall be added, namely: – - 3 -Ex-196/2012 “(5) The MDCs shall be Ex-Officio Members of the Village Councils within the territorial jurisdictions of t heir respective MDC Constituencies. However, they shall not have voting rights during no- confidence motions if any, in the Villa ge Council. (6) Not less than one of the total number of seats shall be reserved for women for the time being. (7) The conduct of elections to the Village Councils shall vest in the Sta te Election Commission. However, the Officers/ Officials to be detailed for the Villa ge Council Elections, shall be selected from the employees of the District Council”. 4.Substitution of Section 5- Section 5 of the Principal Act shall be substituted as follows, namely- “ 5 Removal of President, Vice Pr esident and Members of a villa ge council- (1)The President and t he Vice- President, if any, of a village cou ncil may be removed by a vote of No- Confidence passed by a majority of the members of the Villa ge Council, showing reasonable grounds for such motion. (2) A Member of a Village Council may be removed if he absents himself from attending Village Council meetings on thr ee consecutive occasions, when convened by the President with due intimation to t he Members. 5.Amendment of Section 6- Section 6 of the P rincipa l Act shall be substituted by the following, namely - “(6) Duration of Villa ge Council :(1 ) Every Village Council, unless sooner dissolved, sha ll continue for five years fr om the date of its first meeting appointed by the State Election Commission, provided that the existing Village Councils which have been elected before the commencement of the Chakma Autonomous District ( Village Councils)(Amendment) Act, 2011 shall continue for not more than three years. (2)The process of election t o a Village Council shall be completed before the term of the Village Council comes to an end. (3)In the case of dis solution of a Village Council, election for the new Villa ge Council shall be completed within s ix months of the date of order of dissolution”. 6.Amendment of Section 8- “(1) In sub-section(1) of section 8 of the Principal Acts, between the words ‘President’ and ‘in each village’, the words ‘ and a Vice- Pr esident’ shall be inserted. (3)In sub-section (5) of Section 8 a fter the words ‘ Executive Committee by the President ’ the words, ‘ who shall subsequently repor t the matter to the State Election C ommission’ shall be added.” 7.Amendment of Section 9 - In S ection 9 of the Principal Act, after sub-section (3), the following sub-section (4), sha ll be added, namely - “(4) The Village Council shall be accountable to the Gram Sa bha for all its funct ions, expenditure, appr oval of plans a nd appr oval of Utilization Certifica te.” 8.Amendment of Section 11 - In section 11 sub-s ection (6) and (8) of Section 11of the Principal Act, for the figures “Rs.12/”- and “Rs.10/”-, the figures’ “Rs.100/-” and “Rs. 100/”- shall be substituted respectively. 9.Amendment of Section 14 - In S ection 14 of t he Principal Act, the following Cla use sha ll be added, namely-” (1) The Executive Committee shall have the rights to interfere in Village Administration in case of Mismanagement of Village Council Funds or ma l-administration in the Villa ge Council”. 10.Amendment of Section 15 - In section 15 of the Principal Act, the following cla use sha ll be a dded, na mely- “ There shall be at least 4 (four) Village Council meetings in a year. 11.Insertion of Section 20A a nd 20B – After Section 20, of the Principal Act, following new sect ions shall be added, namely: “20A. Allocation of Functions to the Village Councils - The Governor, on the recommendations of t he Executive Committee, may allocate from time to time all or any of the functions listed in the Eleventh Schedule to the constitution, to any Village Council and demarcate the roles of the Village Council, the District Council and the State Government in t hese a r eas. 20-B Gram Sabha - (1)Every G ram Sa bha shall approve the plans, progra mmes and pr oject s for socia l a nd economic development in r espect of the village concerned before such plans, progra mmes and project s are taken up for implementation. T he Plans & Proposal so approved and the Utilization Certificate(s) thereby shall be submitted to the Local Administrative Department of t he Distr ict Council for further necessary act ion. (2)The Village Council be responsible for the identification and/or selection of persons as beneficiaries under the poverty a lleviation and other programmes. (3)Or dinarily a Gra m S abha will be convened a nd presided over by the Pr esident of t he Village Council. However, in the absence of the President or due to his incapacity to convene such meeting, the Vice Pr esident or the Secretary may convene a meeting. (4)Quor um of a Gram Sabha shall be 10 % of the total nu mber of registered voters of the village or villages concerned. (5)Every Gram Sabha shall be responsible to safeguard and preserve the traditions and customs of t he people, their cultural identity, a nd management of community assets. (6)Every Villa ge Council shall be required to obta in from the Gr am Sabha a cer tificate of utilization of funds for the plans, progr ams and project s executed by t hem. (7)The Gram Sa bha and the Village Council shall consult with the Executive Committee (a) before making any a cquisit ion of land; and (b) b efore re-settlement and rehabilitation of persons affected by such projects. (8)The recommendations of the Gram Sabha a nd Villa ge Council sha ll be mandator y for grant of concession for the exploitation of minor minerals by auction, in consultation with the Executive Committee of the District Council. (9)Subject to sub-section (1), all individual beneficiaries under various welfare and development schemes shall be selected by the Village Council. (10) There shall be at least four Gram Sabha meetings in a year. (11) The Gram Sa bha may decide that any of it s funct ions ma y be performed by the Village Council.
