Rules regulating the method of recruitment to the post(s) of Circle Physical Education Officer under School Education Department, Government of Mizoram

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment to the post (s ) of Circle Physical Education Officer under School Education Department , Government of Mizoram, namely :- 1. Shor t Title and (1)These Rules may be called the Mizoram School Educastion Department Commencement (Group B Gazetted posts) Recruitment Rules, 2012. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application These rules shall apply to the posts specified in Column 1 of th e Annexure-I annexed to these rules. 3. Number of posts, The number of the said post(s), their classification, and the pay scale/ classification , pay band attached thereto shall be as specified in columns 2 to 4 of the said and grade pay/pay scale Annexure-I. 4. Method of r ecruitment, The method of recruitment, age limit, qualification and other matter s age limit, relating to the said post(s) shall be as specified in columns 5 to 14 o f qualifications, etc- the Annexure-I aforesaid. Provided that the age limit prescribed for direct recruitmen t may be relaxed in the case of candidates belonging to the ScheduledCastes/the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government orthe Government of Mizoram from time to time. 5. Disqualification No person-(a)who has entered into or contracted a marriage with a personhaving a spouse living; or (b) who, having a spouse living, has entered into or contracted amarriage with any other person, shall be eligible for appointmentto the said post(s); - 2 - Ex-75/2013 Provided that the Governor may , if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule. 6. Training and Depar tmentalEvery Government servant recruited under these rules shall under go Examination. such training or pass such Departmental Examination as may b e prescribed from time to time. 7. Powers to transfer Notwithstanding anything contained in these rules, the Governorof Mizoram, in public interest, shall have the right and power to transfer any of ficer so recruited under these rules to any other pos t or position which is equivalent in rank or grade. 8. Power to r elax Where the Governor is of the opinion that it is necessary or expedien t so to do, he may , by order and for reasons to be recorded in writing and in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and Nothing in these rules shall affect reservation , relaxation of ag e concessions limit and other concessions required to be provided for the Schedule d Castes/the Scheduled Tribes and other categories of persons in accordance with the orders issued by the CentralGovernment or the Government of Mizoram from time to time in this regards. 10. Repeal and Savings All rules pertaining to these post of Physical Education teache r framed by the Government of Mizoram vide Gazette NotificationNo. A. 12018/3/87-P AR(GS) dated 14.9.1990 Issue No. 99 dated 19.9.1990 stand hereby repealed. Provided that any order made or anything done or an y action taken under the rules so repealed, or under any generalorders ancillary thereto, shall be deemed to have been made, doneor taken under the corresponding provisions of these rules. In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment to the post(s) of Inspector of Sanitation under Urban Development & Poverty Alleviation Department, Government of M izoram, namely : (1)These Rules may be called the Mizoram Urban Development & Poverty Alleviation Department (Group ‘C’ posts) Recruitment Rules, 2013. (2)They shall come into force from the date of their publication in the Mizoram Gazette. 2.Amendment ofIn the Principal Rules, for Rule 8 1(a)&(b), 9(i) and 12(i), the following Rule - 8, 9, 12shall be substituted, namely :- “8.RECRUITMENT TO THE SERVICE 1(a): 80% of the total sanctioned posts shall be filled up by direct recruitment through Competitive Examination to be conducted by the Commission. (b) 20% of the total sanctioned posts shall be filled up by selection method from amongst the Officers who hold Group ‘A’ post in a substantive capa city under the Government of Mizor am by way of induction in the manner as may be prescribed by the Commission. 9.DIRECT RECRUITMENT (i) Save as provided under Rule 2 of these (Amendment) Rules, appointment to the service by direct recruitment shall be made through Competitive Examination conducted by the Commission in the manner laid down under Mizora m Civil Service (Combined Competitive Examination) Regulations, 2011. 12.APPOINTMENT BY SELECTION (i) The Governor may, in consultation with the Commission consider for appointment to the service to the extent of 20% of substantive posts of t he authorized permanent strength of the service in the manner as may be prescribed by the Commission. (2)They shall come into force from the date of their publication in the Mizoram Gazette. 2.Amendment ofIn the Principal Rules, for Rule 8 1(a)&(b), 9(i) and 12(i), the following Rule - 8, 9, 12shall be substituted, namely :- “8.RECRUITMENT TO THE SERVICE 1(a): 80% of the total sanctioned posts shall be filled up by direct recruitment through Competitive Examination to be conducted by the Commission. (b) 20% of the total sanctioned posts shall be filled up by selection method from amongst the Officers who hold Group ‘A’ post in a substantive capa city under the Government of Mizor am by way of induction in the manner as may be prescribed by the Commission. 9.DIRECT RECRUITMENT (i) Save as provided under Rule 2 of these (Amendment) Rules, appointment to the service by direct recruitment shall be made through Competitive Examination conducted by the Commission in the manner laid down under Mizora m Civil Service (Combined Competitive Examination) Regulations, 2011. 12.APPOINTMENT BY SELECTION (i) The Governor may, in consultation with the Commission consider for appointment to the service to the extent of 20% of substantive posts of t he authorized permanent strength of the service in the manner as may be prescribed by the Commission. (2 ) They shall come into force from the date of their publication in the Official Gazette. 2.ApplicationThese rules shall apply to the posts specified in Column 1 of the Annexure-I annexed to these rules. 3.Number of posts,T he nu mb er o f t he s a id p os t (s ), t hei r cla s s ifica t ion, a nd t h e p a y s ca le/ classification, pay bandattached thereto shall be as specified in columns 2 t o 4 of t he sa id and grade pay/pay scaleAnnexure-I. 4.Method of recruitment,The method of recruitment, age limit, qualification and other matters age limit,relating to the said post(s) shall be as specified in columns 5 to 14 of qualifications, etc-the Annexure-I a foresa id. Provided that the age limit prescribed for direct r ecruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram from time to time. 5.DisqualificationNo person- (a) who has entered int o or contracted a marr iage with a person having a spouse living; or (b ) who, having a spouse living, has entered into or contract ed a marriage with any other person, shall be eligible for appointment to t he said post(s); - 2 - Ex-75/2013 Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule. 6.Training and DepartmentalEvery Government s ervant r ecr uited under these rules shall undergo Examination.such training or pass such Departmental Examination as may be pres cribed from time to t ime. 7.Powers to transferNotwithstanding anything contained in these r ules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officer so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8.Power to relaxWhere the Governor is of the opinion that it is necessary or expedient so t o do, he may, by order and for reasons to be recorded in writing andin consulta tion with the Mizoram Public Service Commission through the Department of P ersonnel & Administrative Reforms, relax any of the pr ovisions of these rules with r espect to any class or category of persons. 9.Reservation andNothing in these rules shall affect reservation, relaxation of age concessionslimit and other concessions required to be provided for the Scheduled Castes /the Schedu led Tr ibes and ot her ca tegor ies of persons in accordance with the orders issued by the CentralGovernment or the Government of Mizoram from time to time in t his regards. 10. (2 ) They shall come into force from the date of their publication in the Official Gazette. 2.ApplicationThese rules shall apply to the posts specified in Column 1 of the Annexure-I annexed to these rules. 3.Number of posts,T he nu mb er o f t he s a id p os t (s ), t hei r cla s s ifica t ion, a nd t h e p a y s ca le/ classification, pay bandattached thereto shall be as specified in columns 2 t o 4 of t he sa id and grade pay/pay scaleAnnexure-I. 4.Method of recruitment,The method of recruitment, age limit, qualification and other matters age limit,relating to the said post(s) shall be as specified in columns 5 to 14 of qualifications, etc-the Annexure-I a foresa id. Provided that the age limit prescribed for direct r ecruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram from time to time. 5.DisqualificationNo person- (a) who has entered int o or contracted a marr iage with a person having a spouse living; or (b ) who, having a spouse living, has entered into or contract ed a marriage with any other person, shall be eligible for appointment to t he said post(s); - 2 - Ex-75/2013 Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule. 6.Training and DepartmentalEvery Government s ervant r ecr uited under these rules shall undergo Examination.such training or pass such Departmental Examination as may be pres cribed from time to t ime. 7.Powers to transferNotwithstanding anything contained in these r ules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officer so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8.Power to relaxWhere the Governor is of the opinion that it is necessary or expedient so t o do, he may, by order and for reasons to be recorded in writing andin consulta tion with the Mizoram Public Service Commission through the Department of P ersonnel & Administrative Reforms, relax any of the pr ovisions of these rules with r espect to any class or category of persons. 9.Reservation andNothing in these rules shall affect reservation, relaxation of age concessionslimit and other concessions required to be provided for the Scheduled Castes /the Schedu led Tr ibes and ot her ca tegor ies of persons in accordance with the orders issued by the CentralGovernment or the Government of Mizoram from time to time in t his regards. 10. Repeal and SavingsAll rules pertaining to these post of Physical Education teacher framed by the Gover nment of Mizora m vide Gazette Notifica tion No. A. 12018/3/87-PAR(GS) dated 14.9.1990 Issue No. 99 dated 19.9.1990 stand hereby repealed. Provided that any order ma de or anything done or any action t aken under the rules so repealed, or under any general orders ancillary thereto, shall b e deemed to ha ve been made, done or taken under the corresp onding provisions of these rules.
