Pu Lalbuatsaiha,entered into Government Service as Assistant Grade on 01.11.2985. He was promoted to Superintendent on 18.11.1992 and posted in the Higher & Technical Education (S ectt.). He wa s promoted to Under Secretary on 15. 09. 2003 and posted in Environment & Forest Department and again promoted to Deputy Secretary on 01.04.2012 and posted in PHE Department wher e he served till his sad demise. He served the Government of Mizoram for 27 years 1 month and 27 days in various capacities with utmost sincerity and devotion, and endeared himself to all his coleagues. He always proved himself to be a conscientious officer. The Government places on record its deep appreciation of the sincere services rendered by Pu Lalbuatsaiha and conveys its hearfelt sympathy and condolence to the bereaved family. L. Shor t title, extent and commencement:— (1 ) These regulations may be called t he Aiza wl Municipal Council Building Regulations, 2011. (2) They shall apply to all the areas covered by the Aizawl Municipal Council. (3) They shall come into force on such date as the Aizawl Municipal Council may notify by notification in the Official Gazette. 2. Applicability: — They shall a pply to the building act ivities given below, namely, (1 ) when a building is newly erected, to the design and construction of the building; (2 ) where the whole or any par t of a building is dismantled / repaired; (3 ) where the whole or any par t of a building is demolished, and (4 ) where alteration or addition to a building is made. 3. Definit ions :— For the purpose of these regulations, (1) ‘Act’ means the Mizoram Municipalities Act, 2007 (Act No. 6 of 2007); (2) ‘Advertising Sign’ means any surface or structure with characters, letters or illustrations applied thereto and displayed in any manner whatsoever out of doors for the purpose of advertising or to give information or to attract the public to any place, person, public performance, article or merchandise whatsoever, and which surface or structure is attached to or forms part of or is connected with any building, or is fixed to a tree or to the ground or to a ny pole, screen, fence or hoar ding or displayed in space; (3) ‘Alteration’ means a cha nge from one occupancy to another, or a structural change or change of any component of the buildings; (4) ‘Apartment’ means a building arranged/intended /designed for occupation by families independent of each other for the pur pose of sale or lease to individua l families; (5) ‘Approved’ means appr oved by the Aizawl Municipal Council or any officer or person to whom appr opriate power has been delegated by the Aizawl Municip al Council; (6) ‘Applicant’ means every person who applies to the Aiza wl Municipal Council for permission under these regulations; (7) ‘Area’ in relation to a building means the superficies of a horizontal section t hereof made at the plinth level inclusive of the external wa lls and of such portions of the party walls as belong to the building; (8)‘ Balcony’ means a horizontal projection of a building including hand-rail, ba lustr ade or a parapet to serve as a passage or a sitting out place; (9) ‘Bas ement or Cella r ’ means the lower storey of building below or partly below ground level; (10) ‘Building’ means any structur e constr ucted for whatsoever purpose and of whatsoever materials and every pa rt thereof, whether used as hu man habitation or not and includes foundations, plinths, walls, floors, roofs, chimneys, plumbing and building services, fixed platforms, verandah, balcony, cornice or projection, par t of a building or anything affixed thereto or any wall enclosing or int ended to enclose any land or space a nd signs and outdoor display structures, monuments, memorials or any contriva nce of permanent natur e/stability built under or over ground. For the pur poses of these regula tions, buildings are divided into three typ es, namely,a) Multi-storied building mea ns a building ha ving a height of 15 metres or more. b) Special building mea ns a building such as educational, assembly, institutional, industr ial, stor age, ha zardous and mixed occupancies with any of the aforesaid occupancies ha ving covered area more than 500 sq. metres. (i) Ordinary building : Or dinary building means a building constructed with first class wooden posts, RCC posts up to the skirting level of the ground floor, wooden plank floor, ba mboo or tile or sheet wall and thatched or GCI (galvanized cor rugated iron) sheet roof covering; (ii) Semi-Permanent (Semi-Pucca ) Building: Semi-perma nent (s emi-pucca) building means a building constructed with RCC (reinforced cement concrete) column footings, RCC columns and RCC beams of p re-designed dimensions and specifica tions upto a height not exceeding 7.5 metres having timber flooring, brick/ concrete block masonry wall up to skirting level, AC s heet or bamboo walling above skirting, timber roof truss with G.C.I. sheet roofing; (iii) Perma nent Building : Permanent building means- (a) a building constructed with RCC foundation, column, beam, floor, roof a nd brick walling, or (b) a building constructed with steel structural members. (11) ‘Building, Height’ of ’ means — (i) in t he case of flat roofs or hip type roofs, the vertical distance fr om the ground floor to the highest ter race level; (ii) in case of pitched roofs, the vertical distance from the ground floor up to the point where the external surface of the outer wall int ersects the finished surface of the sloping r oof; (iii) in case of multi-storeyed buildings constructed on a slope having mult iple gr ound floor levels, the vertica l dista nce between any ground floor level and the corresponding highest point of the building directly above it. (iv) Architectur al features serving no other function except that of decoration shall be excluded for the pur pose of taking heights. T he height of the building shall be taken up to the terrace level for the purpose of fire sa fety requirements. (12) ‘Canopy’ means a projection from the face of the wall over an entry to the building at the lintel or slab level provided that - (i) it shall not project over the set back line; (ii) it shall not be lower than 2.3 metres when measur ed from ground, and (iii) there shall be no structur e on it and the top sha ll rema in open to the sky. (13) ‘Chajja’ means a projection or horizontal structure overhang usually provided over opening of external walls to provide protection from sun and rain or from a rchitectural consideration; (14) ‘Coverage’ means the quotient obtained in terms of p ercenta ge by dividing the plinth areas of ground floor by plot area, i.e., Coverage = Plint h area of ground floor x 100 Plot area Ex-4/20132 (15) ‘Covered Ar ea’ means the ground area immediately above the plinth level covered by the building but does not include the space covered by - (i) garden, rockery, well and well structur es, pla nt nursery, water pool, swimming pool (if uncovered), platfor m round tree, tank, fountain and bench; (ii) drainage, cu lvert, conduit, catch-pit, gully-pit, chamber, gutter and t he like, and (iii) compound wall, gate, slide/swing door, canopy, and ar eas covered b y chajja or similar projections and sta ircases which are uncovered and open at least on three sides and also open to the sky; (16) ‘Density’ means concentration of population expressed in terms of the number of persons per hectares in a particular area; (17) ‘Drain’ means a conduit or channel for the carr iage of storm water, sewage or other used water and includes all fittings and equipments , such as manhole, inspection chambers, tra ps, gullies and floor traps used for the drainage of a building. It also includes open channel used for conveying surface water; (18) ‘Demolition’ means tota l disma ntling of an existing building; (19) ‘Drainage’ mea ns a system constructed for the purpose of r emoval of waste and su rface wa ter; (20)‘ Dwelling’ means a building or a portion thereof which is designed or used wholly or princip ally for residential pur poses for a family; (21) ‘Exit’ means a passage, channel or means of egress from any building or floor area to a street or open s pace; (22) ‘External Wall’ mea ns an outer wa ll of a building not b eing a party wall even though adjoining to a wall of another building and also means a wall abutting on an interior open space of any building; (23) ‘Floor’ means the lower surface in a stor ey on which one genera lly walks in a building, and does not include a mezzanine floor. The floor at ground level or immediately above the ground level shall be ca lled the ‘ground floor ’ and the floor above it sha ll be termed as the ‘first floor ’ with the next higher floor being termed as the ‘second floor ’ and so on; (24) ‘Floor Area Ratio’ (F.A.R.) means the quotient obtained by dividing the total covered area (plinth area) of all floors by the area of a plot, i.e., F.A.R. = Tota l covered area of all floors Plot area (25) ‘Footing’ means a foundation unit constructed in br ick-wor k, stone masonr y or concrete under the base of a wall or column for the purpose of distributing the load over a larger a rea; (26) ‘Foundation’ mea ns that part of the structure which is in direct contact with the ground and which transmits load over it; (27) ‘Gara ge’ means a building or portion thereof designed a nd used for pa rking of vehicles; Ex-4/2013 3 (28) ‘Ground Level’ means the level of the natural ground surface or the finished su rface after leveling from where erection of the building sta rts; (29) ‘Habitable Room’ means a room occupied or designed for occupancy by one or more persons for study, living, sleeping, eating, kitchen if it is used for a living r oom, but not including bathrooms, water closet compartment, laundries, corridors, cellars, attics and spaces that are not used frequently; (30)‘ Licensed Structural Engineer/ Engineer/ Architect/ TownPlanner/ Supervisor/ Group or Firm’ means a qua lified Structur al Engineer et c., who has been given licence or recognised by the Aizawl Municipal Council. An architect who is r egistered a s an ar chit ect by the Council of Architecture under the Architects Act, 1972 (20 of 1972) may be deemed to be licensed by the Aizawl Municipa l Council by vir tue of his/her r egistra tion with the Council of Architecture provided he/she enr olls himself/herself with the Aizawl Municip al Council. (31) ‘Ledge’ means a shelf-like projection, supported in any manner whatsoever, except by means of vertical su pports within a room itself but not having projection wider than one metre; (32) ‘Lift’ means a mechanically guided car, platfor m for transport of persons and materials between two or more levels in a ver tical or substa ntially vertica l direction; (33) ‘Loft’ means an intermediate floor between two floors or a r esidual space in a pitched roof, above normal floor level with a ma ximum height of 1.5 metre and which is used for storage purposes; (34) ‘Master Plan’ means the Master Plan for Aizawl a s approved by the Gover nment under the Act which shall extend to the Aizawl Municipal Council a rea; (35) ‘Mezzanine Floor ’ mea ns an intermediate floor between two floors above gr ound level; (36) ‘Open Space’ means an area forming an integra l part of the plot, left open to the sky; (37) ‘Owner’ means a person or group of persons, a company, trust, institute, registered body, State or Centr al Government Depar tments and offices under them in whose na me is vested the ownership dominion or title of the property and includes a receiver, executor or administrator, or a person who is legally empowered to construct or execute wor k on a building unit or structure or a ma nager a ppointed by any court of competent jur isdiction to have the charge of or to exercise the r ights of the owner. (38) (1) ‘Occupancy’ mea ns the function or use of the building; (2) (a) Residential A: These include any building in which sleeping accommodation is provided for normal residential pur poses not exceeding 150 sq.m floor a rea. (b) Residential B: These inclu de one or two or multi-family dwellings with residential accommodation exceeding 150 sq.m floor a rea. (c) Special Residentials: These include all lodging houses, dormitories, hostels and hotels with residential a ccommodation. (d) Educational Buildings: These include any building or par t thereof used for school, college, pr imary a nd nursery school, education or research p urpose and recreation not covered under Ins titutional. Ex-4/20134 (e) Mercantile (Commercial) Buildings: These include any building or part of the building which is used for display or sale of merchandise such as shops, stores, ma rkets etc., either whole-sale or retail, banking and financial institutions, private business houses and professional establishments of doctor s, dentists, ta ilors etc. beauty parlour, ba rber shops, new stands, milk booth, lunch counters and restaura nts. (f) Institutional (Medical) Buildings: These include any building or part thereof, which is used for purposes such a s medical or other treatment or care of persons suffering from physical or mental illness, diseases or infirmity. Buildings and structures under this use shall include hospitals, clinics, homes for the aged and infirm, convalescent homes and orphanages, mental hos pitals etc. (g) Government Buildings: These include any building or part of a building which is used for the tra nsaction of Government business, for recor ds keeping, accounts and similar purposes. Loca l Government and Semi-Government offices, cour t houses, public utility buildings including slaughter houses, jails and prisons etc. , will be covered by this us e. (h) Assembly Buildings: These include any building or part of a building where group of people (exceeding 100) congregate or gather for a musement, recreation, social, religious, patriotic, civil, travel and other purposes; for example, theatres, cinemas, assembly halls for educationa l, dramatic or theatrical presenta tion, auditorium, exhibition halls, a rt galleries, museums, librar ies. (i) Industrial Buildings: These include any building or part of building or structur e in which products or materials of all kinds a nd properties a re fabricated, assembled or processed e.g., workshops, assembly plants, laboratories, laundries, dairies, saw mills, power plants etc. (j) Stora ge Buildings: These include any building or pa rt thereof used primar ily for the storage or shelter of goods, wares or merchandise and include buildings used as warehouse, cold storage, freight depot, transit shed, store house, public gara ge, hanger, truck terminal, gr ain elevator, barn a nd stables. (k) Haza rdous Buildings: These include any building or part of a building which is used for the storage, handling, manufacture or processing of highly combustible, explosive, poisonous, irritant, toxic or noxious ma terials or products or materials producing dust. (39) ‘Parapet’ means a low wall or railing built along the edge of a floor or a r oof; (40) ‘Parking Space’ means an enclosed or unenclosed covered or open area sufficient in size to park vehicles. Pa rking spaces shall be served by a driveway connecting them with a street or alley and permitting ingress and egress of vehicles; (41) ‘Party Wall’ includes (i) a wall forming part of a building and being used and constructed to be used in any par t of the height or length of such wall for separation of a djoining buildings belonging to different owners or construct ed or a dopted to be occupied by different persons, and (ii) a wall forming part of a building and standing in any par t of the length of such wall, to a greater ext ent tha n the projection of the foot ing on one side or gr ound of differ ent owners; Ex-4/2013 5 (42) ‘Permission or Permit’ means a va lid permission or authorisation in writing by the Aiza wl Municipal C ouncil or any person a uthorised by it in this behalf to car ry out development or work regulated by these regulations; (43) ‘Plinth’ means the portion of a str ucture between the level of the ground and the floor immediately above the ground; (44) ‘Plinth Area’ means the built-up covered area measured at the floor level of the ground floor or of a ny storey; (45)‘ Plot or Site’ means a par cel or piece of land enclosed by definite boundar ies; (46) ‘Road/Street’ means any highway, street, land, pathway, alley, stairway, passageway, carriageway, foot way, square, place or bridge, whether a thor ough-fa re or over which the public have a r ight of passage or access or have passed and have access unint erruptedly for a specified period, whether existing or pr oposed in any scheme and includes all bends, cha nnels, ditches, storm water drains, culverts, sidewalks, traffic islands, roadside trees and hedges, retaining walls, fences, barr iers and railings within the street lines; (47) ‘R oom Height’ means the vertica l dista nce measured fr om the finished floor sur face to the finished ceiling surface; (48) ‘Sanctioned Plan’ means a set of plans and specifica tions submitted under these regulations in connection with a building and duly approved and sanctioned by the Aizawl Municip al Council; (49) ‘Set Back’ means the open sp ace from the proposed building to the plot bounda ries beyond which nothing can be cons tructed towar ds the boundar ies; (50) ‘Spiral Staircase’ means a staircase having treads forming continuous winding cu rve round a central point or a xis provided in the open/covered/semi-covered space; (a) Stair cover or Mumty means a str ucture with a roof over a staircase and its landing built to enclose only the stairs for the purpose of providing protection from weather a nd not used for human habitation. (51)‘ Stor ey’ mea ns the portion of building included between t he surfa ce of a ny floor and the sur face of the floor next above it, or if there be no floor above it, then the space between any floor and the ceiling next above it. (52) ‘To make Material Alterations’ means to make any modification in any existing building by way of addition or altera tion or any other cha nge which may affect the appearance, occupancy and safety of the building. (53) ‘Tota l Floor Area’ means the a rea of a ll floors of a building including habitable rooms, attic, basement and mezza nine floor; (54) ‘Tr avel Dista nce’ means the distance an occupant has to tr avel to reach the exit from the remotest point; Ex-4/20136 (55) ‘Una uthorised Construction’ means the erection or re-erection, addit ion or alteration which is not approved or sanctioned by the Aizawl Municipal Council; (56) ‘Verandah’ means a covered/semi-covered/open area with at least one side open to the out side and the floor of which is resting on the ground; (57) ‘Local Council’ means a Local Council constituted under sub-section (3) of section 23 of the Mizoram Municipalities, Act 2007 (as amended in 2009); (58) ‘Wat er Clos et’ or ‘W.C.’ means a privy with an arrangement for flushing/cleaning the pan with water; (59) ‘Wheel Chair ’ means a device used by a disabled person for mobility; (6 0) Words and expressions used but not defined in these regulations shall ha ve the same meaning and sense as in the Mizora m Municipalities Council Act, 2007 (a s amended in 2009) and the Rules made ther eunder. 4. Application for building/demolition permission:— (1) Every person, including Central and State Government Departments and Semi-Government Depa rtments/ Organisations excluding the Defence Ministry, who intends to erect, re-erect or make material/structural alterations (except internal alterations which do not affect the safety of the building) shall obtain a building permit by giving an application to the Aizawl Municipal Council in the prescr ibed for m given in Annexu re A to be pur chased from t he office of t he Aiza wl Municipal Council. The application shall be accompanied by the prescribed fees and three copies each of the documents mentioned in regula tions 5 (1) to 5(4) below. One copy each of these documents shall be returned to the applicant after issue of permission or refusal. (2) In the case of proposal for demolition of any building, application may be submitted to the Aiza wl Municipal Council on plain paper. The application shall contain proof of ownership, reason for the proposed demolition, location of the building, the date of the proposed demolit ion, the possible danger which the proposed demolition is likely to cause to the adjoining areas, if any, the over-all effect of the demolition on the loca lity, a nd No Objection Certificate (NOC) fr om the Loca l Council within whose jurisdiction the building is situated and other releva nt information. (3 ) In r egard to vertical extension of a building, for erection/ construction of mumty, overhead water tank, greenhouse or other building services within the prescr ibed set backs , no permission is required if the height of the pr oposed erection/constr uction is up to a maximum of 3 metr es.” (4 ) In the case of hor izonta l extension of a building, for addition/ext ension of building/building services up to a maximum of 1.82m (6 ft.) between two adjacent columns within the prescribed set backs, application may be made on plain paper enclosing NOC from the concerned Local Council and an attested copy of land lease; Ex-4/2013 7 Provided that, if the proposed extension is likely to affect the st ructura l safet y of the building, the Aiza wl Municip al Council shall have the power to require submission of applica tion for building permission in the usual/ prescribed manner or demand a certificate of structural safety. Provided that in case of emergency when a building is required to be immediately demolished or dismantled due to landslide etc., the Local Council concerned may give permission for demolition of the building with an intimation to the Aizawl Municip al Council. Provided further that no permission for demolit ion of a building sha ll be necessary in case of ordinary buildings except those situated along the motorable (black top) r oad. 5. Information accompanying application for building permission:— (1 ) In t he case of ordinary building , the following information shall accompany the application for building permission: (i) Ownership Title. (ii) NOC from the concerned Local Council. (iii) A certificate of structural soundness of the existing building in case of proposed addition. (iv) Receipt of Latest P roperty Tax paid. (2 ) In the case of semi-permanent building , the following information shall a ccompany applica tion for building permission: (i) Ownership Tit le; (ii) NOC from the concerned Local Council. (iii) Sketch plan and undertaking of structur al safety prepared by Aizawl Municipal Council and Technical License Holder registered under AMC. (iv) A certifica te of structura l soundness of existing building in case of proposed addit ion. (v) Receipt of Latest Property Tax paid. (3 ) In t he case of concrete building, the following infor mation shall accompany the application for building permission: (i) Site Plan (ii) Ownership title; (iii) Building Plans; (iv) NOC from the concerned Local Council; (v) Structural drawing, and (vi) Specifications. (vii) A certifica te of structur al soundness of the existing building in case of proposed addit ion. (viii) Receipt of Latest Property Tax paid. (ix) NOC shall be obtained from the Local Fire Station for building above 15m. Provided that in the case of building up to G+2 or 10 metres in height, (v) a nd (vi) above shall not be necessary if an undertaking of str uctural safety by Design Cell, Aizawl Municipal Council or by a competent technical person registered under Aizawl Municipal Council is enclosed with the application. Ex-4/20138 Provided tha t if the applicant and the LSC holder is not same, then NOC from the LSC holder countersigned by concerned Local C ouncil s hall be enclosed. In case, if the LSC holder is a deceased then Heirship Certificate shall be enclosed. (4 ) If a Local Council refuses to issue No Objection Certificate to any person for building construction as indicated in regulations 5(1) to 5(3 ) above, and if such person is aggr ieved by such refusal, he may approach the Aizawl Municipal Council by submitting an application on plain paper. On receipt of such application, the Aizawl Municipal Council shall ascertain from the concerned Loca l Council the r eason or reasons for r efusing the No Objection Certificate and make necessary investigation. Thereafter, the Aizawl Mu nicipal Council shall take a decision as to whether or not construction of building is permissible. A.R; (v) sewerage and surface drains, posit ion and sizes of septic tank and soak pit; (vi) set b acks of the building; (vii) all existing structures on t he plot, and (viii)any other particular as may be prescribed by the Aizawl Municipal Council; (6) Building plans accompanying the application shall be drawn to a scales of 1:50, 1:75, 1:100, 1:125 or 1:150. In case of exceptionally large buildings, a key plan to a scale of 1:200 shall also accompany the drawings. T he Building Plans shall : (i) include floor plans of all floor s indicating the use of each floor of the building; (ii) indicate height of the building a nd para pet; (iii) give dimensions of the projected portions; (iv) include a roof plan indica ting dra inage and roof slope in case of building proposal ha ving pitch roof(s); (v) specify the total floor ar ea of the building; (vi) include one elevation and sectional elevation in longitudinal directions indicating stairca ses, fire escape, lift well etc., and ground profile; (vii provide for parking space, where necessary; (viii)include site development and permanent structures like retaining wall, surface drain, approach road, steps etc., pertaining to the bu ilding, and (ix) include provision for a suitable rain water harvesting facility. Ex-4/2013 9 (7) Specifications :- General specifications shall indicate the types and grades of materials to be used. (8) Structural Drawings :- T he structural dra wings sha ll be prepared by a competent engineer/ structural engineer as per the r elevant provisions of the Indian Sta ndard Code of Practice as given in Annexur e F. (9) Ownership Title :- An attested cop y of la nd settlement certificate (LS C) or house pa ss or sale/ lease deed shall also accompany the application. (10) Colour Code: - The plans accompa nying t he applications shall have the colour scheme as specified in the Table given below and such colour scheme sha ll be indicated it in the legend of the plan. All plans and drawing shall be duly signed by the a pplicant and by the licensed/registered technical person who has planned and designed the same. The technical person/group/firm who signs the plans and drawings shall be responsible for supervision of the work till its completion. (12) Qualifications and Competence of Technica l Personnel :- T he qualifications and competence of the technical personnel and licence fees shall be as given in Annexur e B. (1 3) A fine ranging from rupees one thousand to rupees five thousa nd may be imposed on a technical person by a ny person authorized by the Aizawl Municipa l Council on this behalf for any of the following reasons: (i) failure to supervise construction of a building in respect of which he signs the plans and dr awings; (ii) failure to give completion certificate in the form as prescribed under Regulation 12 read with Annexure D; (iii) failure to report deviation from the sa nctioned plan as required under Regulation 13; (iv) failure to give commencement cer tificate in the form a s prescribed under Regulation 16 read with Annexur e E; Ex-4/201310 (v) preparation, on mor e than two occa sions, of plans and dr awings of a pr oject which are not in conformity with the requirements of t he Regulations, and (vi) Failure to comply with any of the Duties & Responsibilit ies of Technica l persons as stated in ANNEXURE B- 1. Provided that the technica l person concerned sha ll be given a reasona ble opportunity to explain why such fine shall not be imposed on him/her. (16) Every technical person, including a Group or Firm except Architects registered under Council of Architectur e (COA), shall make a security deposit with the Aizawl Municipal Council as follows: (a) Group/Firm ….. ‘. 30,000.00 (b) Structural Engineer ….. ‘. 15,000.00 (c) Engineer ….. ‘. 10,000.00 (d) Town Planner ….. ‘. 10,000.00 (e) Supervisor ….. ‘. 5,000.00 However, any of the enlisted Architect under Aizawl Municipal Council found to contravene Regulation 5(1 3) of Aizawl Municipal Council Building Regulation shall be informed to the Council of Architecture (C OA) for cancellation / suspension of his / her registration. Technical person or Group/Firm from outside the State of Mizoram/Non Tribal shall possess valid Inner Line Permit (ILP) with atleast 2 years validity and other necessary docu ments which includes va lid registration under AMC, work permit from the concerned Department etc. in order to provide professional expertise within the Aizawl Municipa l Council Area. In addition , Technical person or Group/Fir m from outside the St ate of Mizoram / Non Tribal s hall pa y the double of the entire License fee a nd secur ity. The securit y depos it, or the balance thereof after deduction of fine, if any, shall be reimbursed to the technical person concerned at the expir y of his/her license/r egistration. (17) Duties and responsibilities of technical personnel and applicant/owner : - T he duties a nd resp onsibilities of technical personnel and the applicant/owner sha ll be a s in Annexure B-I. Ex-4/2013 11 6. Submission of Application and Payment of Fees:— Ap p lica t ion in t he p r es cr ib ed for m a nd comp let e in all respects shall be submitted to the office of the Aizawl Municipal Council. If the applica tion is found to be in order a nd complete in all respects, the amount of fee pa yable shall be calculated under Regula tion 20 of the Aizawl Municip al Council Building Regulations, 2011 and the same shall be paid to the Aiza wl Municipal Council b y the applicant for which two copies of receipt shall be issued. The applica nt shall enclose the duplicate copy of the receipt with his application which is to be submitted to the Aizawl Municipal Council. If the application is fou nd to be not in order, the same shall be returned to the applicant. 7. Grant of Building P ermission :— (a) The Aiza wl Municipal C ouncil may grant permission or may grant permission after modification(s), based on conformity or otherwise with these regulations and shall communicate its decision to the applicant. Gr ant of permission shall be communicated to the applicant in the prescribed form given in Annexur e C. A copy thereof shall be endorsed to t he concerned Local Council and the concerned technical person. Provided tha t if, within 30 days of receipt of the application complete in all respects along with a duplicate copy of receipt for pa yment of the pr escribed fee, the Aiza wl Municipal Council fails to intimate to the applica nt its refusal or sanction or any intimation, the applica tion with its plans and specifications shall be deemed to ha ve been sanctioned pr ovided the fact is brought to the notice of the Aiza wl Municipal Council in writing by the applicant within seven days. (b ) Refusal of Building Permission: If permission is to be refused, the a pplicant shall be given an opportunity to show cause why permission as sought for should not be refused in the form prescribed in Annexure C-I. A copy thereof shall be endorsed to the concerned Local Council and the concerned technical person. Provided that if the applicant did not complied to the show cause notice given within a specific period. The applica tion shall be refused in the form pr escribed in Annexure C-II. 8. Dura tion of Validity of Building Permission : — The building permission once accor ded sha ll remain valid up to one year. Fees for ext ension every year, which may for a period up to one year, shall be one-fourth of the or iginal fees pa id earlier. 9. Withdrawal of Application : — The applica nt may withdra w his a pplication at any time prior to sanction, and such withdrawal shall terminate all proceedings with r espect to such applica tion, but the fees pa id shall not be refunded. 10. Cancellation of Permit : — If, at any time after the issuance of the permit, if the Aizawl Municipal Council is satisfied that such permit was granted in cons equence of any material misr epresentation or fraudulent s tatement conta ined in the application given or infor ma tion furnished, the Aizawl Municipal Council has the right to cancel the permit and any work done or rendered sha ll be deemed to have been done without permission. Ex-4/201312 11. S u s p ens ion o f P er mit : —Building permit gra nted under these Regulations shall be deemed to be suspended in case of resigna tion by the technical person who supervises t he building work till new technical person is engaged and the Aizawl Municipal C ouncil is informed of such enga gement by the permit holder. Any wor k done during the period of suspension shall be treated as u nauthor ised construct ion. 12. Notice for commencement of building wor k :— Before the commencement of the work the owner shall give notice to the Aizawl Municipal Council in the prescribed proforma given in Annexure D indica ting the date on which he pr oposes to commence the work and the Aizawl Municipa l Council shall inspect the work within fourteen days fr om the date on which the work is to commence as indica ted in t he proforma. 13. Deviation during building construction :— For any deviation from the sanctioned plan during any stage of construction, permission of the Aizawl Municipa l Council shall be obtained by the person who has obtained permission for building cons truction and if the construction is not according to the approved plan; action shall be taken as per the provisions of the Act. Any deviation from the sanct ioned plan sha ll be immediately reported to the Aiza wl Municipal Council by the technical person who supervises the wor k of building construct ion. 14. Inspection : — The Aizawl Municip al Council sha ll carr y out inspection of t he cons truction works, from the receipt of commencement of work to the receipt of completion certifica te, at various stages of cons truction to ascertain whether the work is proceeding as per the provisions of these Regulations and the sanctioned pla n. 15. Responsibilities and powers of Local Councils:— It shall be the responsibility of the concerned Local Council to ensure general compliance with the provisions of these Regula tions by everybody in its jurisdiction. In particula r, the Local Council s hall ensu re that no person construct s a house or modifies or alters it without obtaining permission from the Aizawl Municipa l Council and that the requirements of set ba cks for front, sides a nd rear of a building ar e strict ly observed. T he concerned Local Cou ncil is, by virtue of this provision, empowered to give a stay of construction of a building for any violation of the provisions of these Regulations or the Master Plan/Zonal Development Plan or violation of the conditions of the building per mission. If a stay is given by the Local Council, a copy of the stay order shall immediately be forwarded to the Aizawl Municipal Council which may confirm or cancel the stay after necessary enquiry and verification. 16. Completion C ertifica te :— On completion of the building, the owner through the licensed engineer, registered architect etc., who has supervised the construction shall give completion cer tificate to the Aizawl Municipal Council in the form as given in Annexur e E. Ex-4/2013 13 17. Offences and Penalt ies:— Contravention of a ny of t hese regulations shall be dea lt with as per the pr ovisions of Sections 137, 374 and 386 of the Act’. 18. Unsafe Building/Structure:— Any building/struct ure reported to be unsa fe or damaged shall be examined by a technical committee to be constituted by the Aizawl Mu nicipal Council which shall ma ke a written record of its finding and recommendations. The Aizawl M unicipal Council shall, after taking the recommendations of the committee into consideration, give necessary direction to the owner or occupier to complete repairs as may be specified or to demolish the building within specified time and shall be dealt with as per the provision of Section 165 a nd 335 of the Act. Provided tha t the Aizawl Municipal Council shall have the power to get any building which has been declared as unsafe evacua ted at any time with the help of police, if necessary. 19. Architectural Control :— Any proposal for construction of a building in an important area of Aizawl city or of an impor tant monumental building or of a building in the proximity of an a rea or building of historical importance may be referred to a Committee to be formed by the Aizawl Municipal Council. T he Aiza wl Municipal Council may, after taking the recommendations of the committee into consideration, give necessary direction which shall be complied with by the p erson who proposes to constr uct such building. 20. (iii) In case an applica tion is rejected 5% of the fee due shall be retained and the ba lance s hall be r efunded to the applicant under the orders of Secretar y of the Aizawl Municipal Council. Ex-4/201314 CHAPTER -II BUILDING REQUIREMENTS 21. Requirements of sites : —Any piece of land can be used as a site for cons truction provided – (i) the proposed use conforms to the Aizawl Master Plan and Zonal Development Plan prepared under the Act; (ii) the site is properly drained or capable of being drained; (iii) the site is access ible by any means of p assage, whether priva te or public, for vehicles or for pedestrians and includes any street, and (iv) the site is not a n active hazard-prone area such as landslide, subsidences, mass movement etc 22. In cases where the streets are of the same width, then the longer/ longest side of the plot will decide the frontage and open spa ces. (iii) The minimum distance between any two or more buildings within one plot shall be 2.4 m if one of the buildings or both the buildings is/a re mult i-storied; otherwise, it shall be 1. 2m provided that in the former case where the buildings are not par allel, the average of the prescribe distance may be acceptable with a minimum distance of 1.2m. (iv) For plots a bove 13 0 sq m not fronted by a vehicular access/ a pproach, the fr ont setback shall be relaxed to 1.2m. For plots above 93sq.m and upto130sq.m, the front setback may be 0.90m. For small plots, the front setback may be relaxed to 0.6m and It may however be noted that for the various plot sizes the cor responding side and rear setba cks sha ll rema in the same. (v) In r espect of a plot situated along an existing row of commercial buildings, setbacks ma y be decided on merit of individual case after taking the recommendation of the Committee on Relaxa tion into consideration. (vi) For vertica l extension/addition of an existing building wherein any further lateral development is r estrict ed by the Regulations, the existing structural columns and non-ca ntilevered beams lying in the specified side and rear set backs may be allowed to continue in the vertical extension/a ddition. No other structure except str uctural columns and non-cantilevered beams, floor slabs a nd safety measures such as railings shall be allowed within the prescribed set back ar ea or side set back a rea. (vii) Steps or ramps cons tructed along t he existing ground profile or slope ma y be allowed in the prescribed set back areas. In addition, building services such as underground water tanks, septic t ank, soak pit, inspection chamber, etc may be allowed within the prescribed set back ar eas, pr ovided that such struct ures remain flushed with the adjoining gr ound/slope. (viii) Chajjas, sunshades and ra in gutters may be allowed to project up to 0.45m (1½ ft.) within the prescribed setback area, provided that there is a minimum of 1. 2 m wide setback on the respective side. (xi) In case of very small plots (less than 46.45 sq m) setbacks may be decided in consultation with leaders of the Loca l Council. (x) If, in the interest of the public, it becomes necessary to prescribe a larger set back (that is to say, the front, sides and rear open spaces),taking into consideration the Master Plan/Zonal Development Plan, the size of the plot, the area in which the building is situated, the height of the building or any other relevant factor, the Aizawl Municipal Council shall have the power to do so and the reason or r easons thereof shall be communicated to the applicant in writ ing. 23. Minimum plot sizes: (i) For residential : - The minimum plot size shall be 93 sq.m, with a minimum width of 8m. (ii) For commercial :- The minimum plot size shall be 50 sq.m, with a minimum width of 6m. (iii) For service, small-scale and cottage industries :- T he minimu m s ize of p lot s ha ll not b e les s than 50 sq. m. For automobile wor kshop, the minimum plot size shall be 300 s q.m. (iv) For medium industry :- T he minimum size of plot shall be 1800 s q.m. (v) For a uditorium, museum, libra ry: The minimum size of plot shall be 800 sq.m. (vi) For LIG / EWS Housing :- T he minimum plot size shall be 46.45 sq.m per unit. Explanation: For the pur pose of this regulation, ‘service industry’ means an industry which is mainly small scale and is concerned with repair, maint enance, servicing etc. and not employing more tha n 25 persons and not using power of more than 10 horse power (HP) (7.5 KW). (2) Other requir ements of Parts of Building: (a) Plinth: The plinth of any part of a building may be raised above ground level or road level so that adequate drainage of site is assured. T his ma y preferably be not less than 0.45 metre. Every int erior cour t-ya rd or gar age may be raised by a minimum of 0.15 metre above ground level and may be satisfactor ily drained. (b) Roofs: The roofs sha ll be so constructed to permit effective dr ainage of the ra in wa ter thereof by means of rain gutters and closed conduits of suit able material a nd adequate capa city, joined a nd fixed so as to ensure that rain water is properly discharged at gr ound level by pipe and dampness does not occur in any part of the walls or foundations of the buildings or those of adja cent buildings, and no spout s hould be allowed to dr ain into the road or public area or within the adjacent compound or building. For buildings with RCC roofing, water proofing material shall be used at the roof level. Any incomplete floor or completed flat roof which is accessible shall be provided with safety measures such as fencing or parapet. Ex-4/201318 27. Provision of Lift:Provision of lifts shall be made mandatory for special residential, mercantile, institutional and government or semi-public buildings having fou r floors or mor e. In counting the number of floors for provision of lift, a floor which has a s eparate and independent entr ance sha ll not be counted. 28. Exits a nd Means of Access: An exit may be a doorway, corridor, passage-way to an interna l stair case or externa l or to a vera ndah or r oof or terrace having a ccess to a street. Lift and escalator shall not be consider ed as exits. (i) Every building meant for human occupancy shall be provided with exits sufficient to p ermit sa fe esca pe of the occup ants in case of fir e or other emergencies. (ii) Exit s shall be arra nged so as to p rovide continuous means of access to the ext erior of a building or a n exterior open space leading to a street, without passing through any occupied unit. (iii) Exit s shall be so located that the travel distance on the floor shall not exceed 22 metres in the case of residential and public buildings and 30 metres in the case of commercial, industrial and other types of occupa ncy. (iv) The width of any exit shall be not less than 90 cm. 29. Other Requirements of Exits: (1) Doorways: The minimum width of an exit door way shall not be less than 90 cm. and the minimum height shall not be less t han 195 cm. (2) Stairways: (i) The minimum width of an internal staircase shall be 120 cm., except in the case of residential dwellings where the minimum width shall be 100 cm. (ii) In the case of residential buildings, the minimum width of treads without nosing shall be 25.4 cm for an internal staircase. In case of other buildings, the tread shall be 30 cm. (iii) The maximum height of riser shall be 20 cm. (iv) Handrail shall be p rovided with a minimum height of 90 cm. from the centre of the tr ead. (3) Fir e escape or exter na l stairs: All buildings with Ground + three floor s shall have a t least one fire escape other than the main s tairs. In large buildings, the fire escape placements shall be dictated by the tra veling distance, the ma ximum of which should not be more tha n 22 metres. Provided that if a floor of a house has a separ ate and independent entrance, no separate fire esca pe shall be necessary for that floor . Fir e escapes sha ll be regula ted as under: (i) All fire escapes shall be directly connected to the ground. (ii) Entrance to fire escapes shall be separated and remote from internal staircase. (iii) The route to fire escapes shall be free of obstructions at all times, except a doorway leading to the fir e escape whic h sha ll ha ve the r equired fir e resista nce. (iv) Fire escapes shall be constructed of non-combustible materials. (v) It shall have straight flight not less tha n 75 cm wide with 20 cm tread and riser not more tha n 19 cm. The number of r isers shall be limited to 16 per flight. (vi) The height of hand rails sha ll not be less than 100 cm. Ex-4/2013 19 (4) Spiral Stairs (Fire Escape): The use of spiral stairca se shall be limited to low occupant load and to buildings of the height of 9 metr es unless it is connected to platfor m such a s balconies and terraces. (5) Ramps: Ramps shall be provided within or as an a ppendage to a building if required by the function of the building. In gener al, ramps shall have a minimum width of 1.5 metre a nd a maximum slop e of 1 ver tical: 10 horizontal. In sp ecia l ca ses, st eeper slopes ma y be allowed but in no case greater than 1: 6. In case of hospitals, the minimum width shall be 2.2 metre. The ramps shall be finished with non-slip surface and handrails with a minimum height of 90 cm. sha ll b e provided on t he free edges. Level p la tfor ms of at lea st 1.8 metre x 1.8 metre size shall be provided at every turn and at int ervals of at least 9.5 metre for the purpose of rest and safety. Each ramp shall ha ve at least 1.8 metre x 1.8 metre size platform at the top and bottom. Ex-4/201320 CHAPTER III STRUCTURAL SAFETY AND SERVICES 30. Structural Design:The structur al design of foundations, masonry, timber, p lain concrete, reinfor ced concrete, pre-stressed concrete and structural steel shall be carried out in accordance with Part VI - Structural Design, Section 1-L oads, S ection 2- Foundation, Section 3-Wood, Section 4-Ma sonry, S ection 5-Concr ete, Section 6-Steel of the Na tional Building Code of India, 2005 taking into consideration the Indian Standards as given in Annexur e F. 31. Quality of Materials and Workmanship: All materia ls and workmanship sha ll be of good quality confor ming generally to the accepted standards of Public Works Department of Mizoram and the Indian Standards Specifications and Codes as included in Part V-Building Ma terials a nd Part VIII - Constructional Pr actices a nd Safety of the National Building Code of India, 2005. 32. Building Services: The planning, design and installation of lifts a nd escalators shall be carried out in accordance of Part VIII - Building Services, Section 2 - Electrical Installations, Section 3-Air Conditioning and Heating, Section V - Installation of Lifts and Escalator s of the National Building Code of India, 2005. 33. Plumbing Services: The planning, design, construction and installation of water supply, draina ge and sanitation and gas supply system shall be in accordance with Part IX - Plumbing Services, Section I-Water Supply, Section 2-D rainage and Sanitation and Section 3 - Gas Supply of the National Building Code of India, 2005. A septic ta nk of appropria te capa city with soak pit or any other suit able sludge disposal system shall be provided for all water closets /latrines. Such provisions shall not be located within a r adius of 15 metr es from a wat er sou rce. A suitable r ain water harvesting facility shall also be provided in all buildings. 34. Signs and Outdoor Display Structures: (i) The display of advertising signs and building signs on buildings and land sha ll be in accordance with Part X-Signs and Outdoor Display St ructures of the National Building Code of India, 2005. (ii) The type, design and construction of street furniture including bus shelters shall be to the satisfaction of the Aizawl Municipal Council. 35. Fire Safety, Detection and Extinguishing Systems: (i) The Aizawl Municipal Council while according permission sha ll ta ke into consideration the Code of Pra ctice and Standards of Requir ements r ecommended in the National Building Code of India, 2005. (ii) All buildings in their design and construction shall generally ensure safety of life from fir e, smoke, flames and panic ar ising fr om these or similar other causes. Ex-4/2013 21 (iii) Fire protection a nd extinguishing system shall conform to accepted standards and shall be installed as r ecommended in the National Building C ode of India, 2005. (iv) Fixed fire fighting equipments shall be suitably located in all types of buildings except in residential buildings not more than 15m height a nd shall be clearly ma rked by illuminated signs. 36. Solar water heating system: A suitable solar heating system in accordance with the order/notification of the Government of Mizoram shall be installed in all buildings as s pecified by the Government which are as follows: 1) Hospitals and Nursing Home 2) Guest Houses 3) Tour ist Lodges 4) Bunga lows 5) Schools, Colleges, Training Centres. 6) Barr acks of Armed Forces and Police 7) Functional Buildings of Airports like Wa iting Rooms, Rest Rooms, Catering Units. 8) Community Centres 9) All Government Buildings which are in need of hot water. The detailed specifications, capacity etc. of the system to be installed shall be determined in the light of the guidelines issued by the Government of India. 37. Discharge of rain and waste water: (i) If, in the interest of public safety, it is necessary to discharge r ain and waste water of a building through the land of another person, the owner of such land/plot shall allow constr uction of a closed conduit in his land for discharging rain and waste water. If any damage, including excavation of earth, is caused to the property of the owner of the land through which the closed conduit is constructed, it shall be the responsibility of the per son who constr ucts the closed conduit to repa ir/ replace the damaged property and restore it to its original condition. If inspection and repair of the closed conduit is necessary, the owner of the land shall a llow such inspection and repair as ma y be necessary. If there is a ny dispute, the decision of the officer of the Aiza wl Municipal Council designated for the purpose shall be final. (ii) Cement concr ete or stone/br ick masonry sur face dr ain/closed conduit of a dequate capacity to the nearest public drain s hall be provided for pr oper disposal of surfa ce and waste water. (iii) Any buildings having cover ed area of 500sqm or minimum discharge of 1000 lts a nd above per day shall incorpor ate waste water recycling system. The recycled water should be used for non- drinking purposes. Ex-4/201322 CHAPTER IV REQUIREMENTS OF SANITARY FITTINGS IN SHOPS, COMMERCIAL OFFICES, HOTELS, EDUCATIONAL OCCUPANCY ETC. 38.Requirements of sa nitary fittings for shops and commercial offices, hotels, educational occupa ncy, institutional medical occupancy (hospitals, sta ff quarters and hostels), Government and pu blic business occupancies and offices, assembly occupancy buildings (cinema, theatre, auditor ium etc.), assembly buildings (art galleries, librar ies and museums), restaurants and factories shall be as shown in Annexure G (a) to (k). (2) Height Limitation: The height of building shall be restricted to 19m (64’4”); P rovided that if an entire floor is used as a parking space, that floor shall not be taken into account while calcula ting height subject to the condition that the total height of the building shall not exceed 22m. In case of plots smaller than 93 sq.m the height of a building shall not exceed 12. 85m (42’2") and in case of plots of size 93 to 130 sq.m the height of building shall not exceed 16m (52’6"); Provided further that staircase cover or mumty and safety inst allations shall not be taken into account while calcula ting height. Ex-4/2013 25 CHAPTER -VI FACILITIES TO BE PROVIDED FOR PHYSICALLY CHALLENGED PERSONS 40. Building Requirements: The following are the requirements to be provided for the physically challenged persons in public buildings: (1) Ramp Entrance to Public Buildings: Every public building shall ha ve at least one ramp entrance/ exit accessible to handicapped persons and it sha ll be indicated by proper signage. (2 ) Such entrance/exit shall have a minimum width of 1 metre and a maximum gra dient of 1:12. The length of r amp should not exceed 9 metres. Handr ail of the height of 0 .90 metre on both sides of the ramp may be provided. Provision for ramp may be provided to connect each floor of the public building. (3) Staircase: If a stair case can be provided for the physically handicapped persons, the r equirements shall be as follows: (a) The maximum width shall be 1.350 metres. (b) The maximum height of rise shall be 0.15 metre. (c) The minimum width of tread shall be 0.275 metre. (d) The maximum number of steps on each flight of staircase shall be 10. 41. Lift: Lift capable of accommodating sta ndard wheelchair shall be provided in any public building having G + 3 floor s and more. 42. Toilet: In public buildings where toilets are required to be provided, if the required number of toilet is one, that shall be of European-type. If the required number is more than one in a floor, a t least one shall be Eu ropean-type. The European-type toilets shall be indicated by proper signage. Ex-4/201326 CHAPT ER VII ERECTION OF TELECOMMUNICATION TOWERS43. Application: Application for erection of telecommunica tion tower shall be made in the prescr ibed application form (Annexure H). 44.Infor mation a ccompanying application for erection of telecommunica tion tower: App lication for erection of telecommunication tower shall be accompanied by the following in triplicate: (1 ) Ownership title of the plot/house on which the tower is proposed to be erected; (2 ) NOC from owner of the plot/house and from all the adjacent neighboring plots; (3 ) NOC from the concerned Local Council; (4 ) NOC from the Mizor am Pollution C ontrol Board (MPCB) for installation of generator set at the site of the t ower ; (5 ) Registration certificate from the Depar tment of Communication, Govt. of India. (6 ) Clearance from Standing Advisory Committee on Frequency Allocation (SACFA) for the proposed site. (7 ) Certificate of structural s oundness for the tower as well as the building on which the tower is to be erected from a licensed Structural Engineer under Aizawl Municipal Council. Special precaution for fir e safet y (such as fir e extinguishers) and lightning (such as lightning conduct ors) shall be provided; (8 ) Structural dra wing; (9 ) Site Plan indicating ~ (a) plot boundar ies with dimensions, (b ) position of plot in relation to neighboring streets; (c) set backs; (d) all other existing structures on the plot; (e) height of b uildings/structures on neighboring plots, and (f) type of buildings/structures on neighboring plots. (1 0) Any other information as may be r equired by the Aizawl Municip al Council. 45. Location: The telecommunication tower may be erected on a building or on the ground. 46. Type of Struct ure: The type of structure of telecommunication t ower shall be as follows: (a) Steel fabricated tower or antennae on M.S. pole; (b ) Pre-fabrica ted shelters of fiber glass or P.V.C. on the building roof top/terrace for equipment; (c) Masonry structure/shelter on the gr ound for equipment; (d) Sound proof cover, as may be necessary, to reduce the noise generated by generator to permissible level. Provided tha t the Aizawl Municipa l Council shall have the power to accept any other type of structure approved by a competent author ity. 47. Fees for erection of telecommunica tion tower: The fee for erection of telecommunication tower shall be ‘. 60,000. In case the tower is shar ed by other cellular phone operator /operators, an additional amount of ‘. 30,000 per sharing shall be charged” Ex-4/2013 27 CHAPT ER VIII MISCELLANEOUS PROVISIONS 48. Reporting of Contra vention of Bu ilding Regulations: Any person may report to the Aiza wl Municipal Council, or ally or in writing, any contr avention or suspected contra vention of any provision of these regulations. On receipt of such report, the Aizawl Municipal Council shall make necessary investigation and take act ion as may be called for. 49. Relaxation: Any provision of these r egulations may be relaxed by the Aizawl Municipal Council on the recommendation of a committee appointed by the Aizawl Municipal Council in this behalf. Provided that the buildings with an existing structural frame (befor e 2 nd May 2008) either above or below the r oad level, such floors may be allowed to be completed without any permission provided the mandator y setba cks as per plot size is mainta ined and an NOC from the concerned Local Council is submitted. Competence - The registered architect sha ll be competent to carr y out work related to the building permit as given below: (a) All plans a nd information connected with building permit; (b ) Structural details and calculation for building up to four storeys or 12.85 m in height; (c) Issuing certificate of supervision and completion for all buildings; A-3 Engineer : The minimum qualifications for an engineer shall be gr aduate in civil engineer ing/ architectura l engineering of recognized Indian or foreign university, or the Member of Civil Engineering Division/Architectural Engineering Division of Institution of Engineers (India) or the statutory body governing such profession. Competence - The licensed engineer shall be competent to carry out work related to the building permit as given below: (a) All plans a nd information connected with building permit; (b ) Structural details and calculations for buildings up t o five storeys or 16 m in height; (c) Issuing certificate of supervision and completion for all buildings; A-4 Structural Engineer : The minimum qualifications for structural engineer shall be gradua te in civil engineering of recognized Indian or foreign university, or Corporate Member of Civil Engineering Division of Institution of Engineers (India) or equivalent overseas institution and with minimum 3 year s relevant experience in structural engineering practice with designing and field work under a qualified structur al engineer OR a qualified engineer after a minimum of 3 years r elevant experience in structura l engineer ing pract ice with designing and field work and completion of the AMC examination for structural engineer. Note : The 3 years experience shall be relaxed to 2 years in the case of post-graduate degree of recognized Indian or foreign universit y in the br anch of structura l engineering. Competence - The licensed structur al engineer sha ll be competent to carr y out work related to the building permit as given below: (a) All plans a nd information connected with building permit; (b ) Structural design, details and calculations for all buildings; (c) Issuing certificate of supervision and completion for all buildings; Ex-4/2013 31 A-5 Supervisor : The minimum qualifications for a supervisor shall be diploma in civil engineering or the qualification in ar chitecture or engineering equivalent to the minimum qualifica tion prescribed for recr uitment to non-gazetted service by the Government of Mizoram plus 5 years experience in building design, construction and supervision. Competence - The registered supervisor sha ll be competent to car ry out work related to the building permit as given below: (a) All plans a nd related information connected with building permit for residential buildings on plot up to 200 sq m and up to thr ee stor eys or 10 m in height, and (b ) Issuing certificate of supervision and completion for all buildings. A-6 Engineers for Utility Services : For multi-storeyed and special buildings, the work of building and plumbing services shall be executed under the planning, design and supervision of competent personnel. The qualification for registered mechanical engineer, electrical engineer and plumbing engineers for carr ying out the work of air-conditioning, heating and mechanical ventilation, electrical installations, lifts and esca lators and water supply, drainage, s anitation and gas supply installations resp ectively shall be as given in Part 8 ‘Building Services’ and Part 9 ‘ Plumbing Services’ of the National Building Code of India, 2005 or a s decided by the Authority taking into account pract ices of the na tional p rofessional bodies dealing with the sp ecia lis ed engineering services. A-7 Group/Firm: When a group or firm comprising of qua lified structural engineer/a rchitect/engineer/ town planner/supervisor is practicing, then the qualification and competence of building work will be the combination of the individual qua lification and competence, a s given under A-2, A-3 , A-4, A-5 and A-6 resp ectively, and the group or firm sha ll be licensed by the Author ity. A-8 Town Planner: The minimum qualification for a town planner sha ll be the Associate Membership of the Institute of Town Pla nner or gradua te or post graduate degree in Town & Countr y Planning. Competence: The registered town planner shall be competent to carry out the work related to the development permit as given below: (a) Preparation of plans for land sub-division / layout and related information connected with development p ermit for all ar eas. (b) Issuing of certificate of supervision for development of land of all ar eas. Note: However, for land layouts for development p ermit a bove 5 Ha in ar ea, landscape architect shall also be associated, and for land development infrastructur al services for roa ds, water supplies, sewer age / drainage, electrification etc. the registered engineer for utility services s hall be associa ted. Ex-4/2013 33 ANNEXURE B-I DUTIES AND RESPONSIBILITIES OF TECHNICAL PERSONNEL AND APPLICANT/OWNER[Regulation 5(17) of the Aizawl Municipal Council Building R egulations, 2011) IDuties and responsibilities of Engineers, Structural Engineers, Architects, Supervisors and Groups/ Firms: (1 ) They shall be well-conversant with the pr ovisions of the Act, these Regulations and a ll relevant rules and r egulations made under the Act and sha ll prepare plans, sections, elevations and other structural details a s per the provisions of these Regulations. (2 ) They shall submit all pla ns as may be necessary together with all documents and other details which are r equired to be submitted under these R egulations. (3 ) They shall comply with all directions of the Aizawl Municipa l Council in connection with the buildings for which they have pr epared plans/ drawings expeditiously and fully. When they do not agree with such directions, they shall state their objections in writing within the stipulated time. (4 ) They shall immediately intimate corrections or other changes made by them in the plans as per direction from the Aizawl Municipal Council to the owner. (5 ) They shall not take up preparation of plans, if the same are intended to be executed in contravention of t he provisions of the Regulations. (6 ) They shall give all facilities to the Aizawl Municipal C ouncil to inspect and examine the work in progress. (7 ) They shall be held responsible for any work executed on site in contr avention of the provisions of the Regulations. (8 ) They should not deviate or allow a ny devia tion fr om the sanctioned plan in the execution of work at site. (9 ) They shall submit certificates in regard to commencement of work at site, and completion up to plinth level within 10 da ys of completion and completion certificate within 30 days after the work is completed. (1 0) They shall be deemed to have cont inued their supervision of construct ion of the building unless they have given notice in writing to the Aizawl Municip al Council that they have ceased to serve as the technical person for the building a nd shall be held responsible for the work executed up to the date of intimation. (11) The Aizawl Municip al Council may, in the case of viola tion of any of the provisions of the Act and the Regulations, take action against any technical person in accordance with the provisions of t hese Regulations. (12) If it affects the neighbour ’s land/property, the owner / offender shall be fined to borne the expenditure for demolition, repairs and reconstruction of the neighbor ’s land/property. IIDuties and Responsibilities of Applicant/Owner: (1 ) He / She shall appoint/engage a technical person as r equired under these Regulations. (2 ) He / She shall provide sa fety of workers and others during construction fr om commencement to completion. (3) He / She shall ensure that no undue inconvenience is caused to others in the course of the construction activities. (Act No 6 of 2007) as amended from time to time; b)“Ba kery” means a place where bread and cakes are made or sold, which may include confectionery; c)“Bea uty Parlour” means an establis hment pr oviding cosmetic treatments, which include hair care, facials, manicure and pedicure for men and women, and may also include massage parlour and spa; d)“Boa rd of Councilor ” means the Boa rd of Councilor s of the Aizawl Municipal Council; e)“Building” includes a house, out house, lodging house, stable, privy, urina l, shed, hut, wall (other than a boundary wall, not exceeding 3.05 metres in height), verandah, balcony, chajja, sun shed, stair case and a ny other such s tructur e, whether of masonry, bricks, wood, mud, meta l or any other material, whatsoever but does not include tempora ry shed erected on religious or ceremonial or festive occasions; f)“Cha irman” means the Chairman of Aizawl Municip al Council; g)“Factory” means a place where goods are manufactured or assembled with or without machine; h)“Hotel” means an establishment providing accommodations, meals, and other services for travelers and tourists.; i)“Food” means any substance, whether processed, partially processed or unprocessed, which is intended for human consumption and includes an article of food, being a produce of agriculture or horticultur e or animal husbandry and dair ying or aquaculture in its natural form, resulting from the growing, ra ising, cu ltivation, picking, harvest ing, collection or catching in the hands of a person ot her tha n a farmer or fisherman, genetically modified of a person other than a far mer or fisherman, genetically modified or engineer ed food or food containing such ingredients, infant food, packaged drinking water, alcoholic drink, chewing gum, and Ex-5/20132 any substance, including water used into the food during its manufact ure, preparation or treatment but does not include any animal feed, live animals unless they are prepared or processed for placing on the market for human consumption, plants, pr ior to harvest ing, drugs and medicina l products, cosmetics, narcotic or psychot ropic s ubstances.; j)“Grocery” means food grains, spices and ot her edible items for consumption. k)“Hair Cutting Saloon” means a ba rber shop for men. l)“Industry” means economic activity concerned with the processing of raw materials and manufa cture of goods in factor ies. m)“License” means License issued by the Aizawl Municipal Council for the purposes of trade. n)“Livestock” means any animal, bird or fish; o)“Lodging house” means a hotel, boarding housed for the public, rest house, or any other place where the public are admitted and provided with sleeping accommodation on payment and shall include r eligious and charitable institutions, and where meals may or may not be offered; p)“Mar ket” mea ns a place where buyers and sellers assemble to trade goods and services for money or bar ter; q)“Premises” includes lands, buildings, vehicles, tents, va ns, str ucture of any kind, str eam, lakes, drains, dit ches or places open, covered or enclosed, whether built on or not and whether public or private, and whether na tural or artificial and whether maint ained or not under statutory authority; r)“Restaurant” means a place where people pa y to eat meals, and includes a fast food stall; s)“Tea Stall” means a perma nent, semi-permanent or temporary stall or shop where small- time vendor sells tea, coffee and milk along with sna cks. t)“Tra de” mea ns any economic or business activity with or without the purpose of making profit.” u)“Wor kshop” means a place or building in which goods are manufact ured or repaired which may include motor workshop, tyre work, two wheeler workshop, furnit ure workshop, electronic and battery repairing, shoe and leather repa iring and watch repair ing. v)Words and expressions used but not defined in these r egulations but defined in the Act shall have the meanings r espectively assigned to them in the Act. 3.Authority to issue a License The authority to issue licenses in resp ects of trades or business specified in the schedule shall be the Chairman of the Aizawl Municip al Council. [Provided that the Chairma n may delegate the Chief Executive Officer or any other Officer of the Council the power to issue a license under these regula tions on his behalf a s he may deem fit.] 4.Procedures a)Every person who desires a license under these regula tions shall make an applica tion in Form No.I or II as the case may be, to be obta ined fr om the Aizawl M unicipa l Council on payment of Rs.50/- for application form; b)Every person making an application for a license shall submit 4 passport size photogr aphs along with the application F orm;Ex-5/2013 3 c)Every person applying for license shall comply with the provisions of these regulations and shall also abide by the conditions stated in the application in For m Nos. II and III as the cas e may be; d)License may also be issued outside market area, in which case preference may be given to local inhabitants. e)On r eceipt of an a pplication and subject to the provision of these regulations, a ll licenses may be issued in Form III in resp ect of items enumerated in Schedule I and S chedule II. f)The applica tion for a License should be accompa nied by the following Documents: i)No Objection Certificate from the house or land owner where the business is intended to be run; ii)NOC from Local Council; iii)Residential Certificate iv)EPIC v)Passport Size Photos (4 cop ies) vi)License/ Regist rat ion C ert ificat e from Food Lic ens ing Au thor ity, H& FW Dep tt (applicable only in case of establishments for eatable or food items or industr ies) 5.Inspection of Premises before issue of license In case the application for a license is for manufa cture, storage or sale any ar ticle of food, the authority having power to grant such a license shall inspect the premises and satisfy himself that the premises is free from sanitary defects. 6.Condit ions for opening business a)Any person desirous to open a shop or sta rt a tra de should, before opening of such shop or starting such trade, submit an application for license, complete in all respect, to the Aizawl Municipal C ouncil in accordance with the provision of these r egulations. b)Any person car rying on a ny tra de, profession or calling specified in these Regulations within Aizawl City should obtain a license for such trade, profession or calling from the Aizawl Municipal Council. [Provided that the licensee shall strictly abide by the conditions of license] 7.Any business or trading establishment not to set up without permission of the Chair ma n. a)No person shall, without the previous Permission of the Chairma n of AMC, establish in any premises, or materially a lter, enlarge or extend any factory, workshop, pr emises in which it is intended to employ steam, electricity, water or other mechanical power. b)The Chairman may refuse to give such permission if he is of opinion that the establishment, alteration, enlargement or extension of such factory, workshop or tra de premises, in the proposed location would objectionable on account of density of population, pollution, nuisance to t he public or a ny other reasons thereof. Ex-5/20134 8.Regularisation of existing trade or business establishment All existing trade or business establishment, whether petty or large-scale in nature within the area of Aizawl Municipal Council shall be regularized as per the Regulations madethereu nder. a)In case it is required, for reason or reasons of which to be recorded in writing, then such tra de or business establishment may be shifted or perma nently de-licensed as the ca se may be. b)AMC or the agency on advice from AMC shall complete such regulariza tion within 6 months of issuance of these Regulations. c)In case an a gency fails to regular ize its license within the time period of 6 months, the Chairman shall have the power to extend the time period of 3 months, but sha ll impose a penalty of up to 50 % but not less than 20 % of the license fee for such extension. If, even after such extension, an agency fails to regula rize it s license, the Chairman shall order for clos ure of the trade and the decision of the Cha irman shall be final and binding. 9.Validity of license Any license issued under these regula tions, unless suspended or cancelled shall be va lid for a period of 1 (one) year from the date of is sue. 10.Shifting of workshop and shop The Chairman shall have the power to issue direction to shift a ny workshop or shop or any tr ade premise for which a license has b een issued under these Regula tions if, in his opinion, it is necessary so to do in the int erest of public hygiene, sanitation or prevention of nuisance to the inhabitants of the neighbour hood. 11.Prohibition of Pollution of water by chemicals etc No person engaged in any prescribed trade or ma nufacture shall willfully do any a ct connected with any such trade or ma nufacture whereby the water in any such la ke, tank, reservoir, cistern, wall duct or other place for stor ing water is fouled or pollu ted. 12.License fee The annual fee in r espect of a license for trading or business in the items enumerated in Schedule I and Schedule II s hall be paid by the applicant after approva l of his application; provided that such fee is subject to revision by the Board of Councillors from time to time. 13.Renewal of license An application for renewal of a license should be submit ted before first day of the month in which the license expire, and the procedure for renewal is the same as that for granting of license. The license sha ll be deemed to be in force during the pendency of the disposal of the r enewal application; [Provided that any applica tion for renewal of a license submitted after the period pr escribed in these regula tions shall be accompa nied by a late fee of Rs.10/- for every day of delay]Ex-5/2013 5 14.Cancellation of license A license issued under the provision of these regulations shall be cancelled- a)if t he licensee fails to abide by the conditions laid down in t he license; b)if the premises of the shop has been shifted without approva l of the Chair man; c)if container for disposing garbage and refuses is not ava ilable within the premises; d)if t he licen s ee ca r r ies on or p er mit s t o b e ca r r i ed on, a ny ot h er t r a de in t he licens ed p r emi s es , except the trade mentioned in the license; e)if it becomes evident that the running of the trade ha s created a public nuisance a nd polluted the vicinity; f)if it becomes evident tha t the information submitted in Form I is a misrepr esentation of fact or mistake; g)if the licensee fa ils to display a notice board containing the natur e of ar ticles which he is exposing or offering for sale in accorda nce with the instructions issued by the AMC from time to time; [Provided that no order of cancellation shall be made unless the licensee has been given opportunity of making repr esentation] h)if it is found that the license has been sublet; i)if it is fou nd that licensee is ca rrying on his b usiness in an unapproved building. j)If it is found that licensee is not carr ying on trade/operation or keeping articles of food, in accorda nce with the Centr al Rules or the State Rules framed in exer cise of the powers conferred by the Food Safet y & Sta ndard Act 2006 and Rules & Regulations made under the said Act.. 15.Duplicate license The authority empowered t o issue a license may, for sufficient reasons, issue a duplicate license on payment of Rs. 50/- with the word “Duplica te” appearing prominently therein. 16.Identification of License An Identification number for each and every trade or license shall be issued by the Chairman. The same should be displayed prominently at the signboards erected by the licensee. In case of non- compliance, the Chairman may cancel the license. 17.Restriction in keeping bread-stuff, etc. other wise tha n in a cover receptacles No meat, bread-stuff, ca ke, sweetmeat, confectiona ry or a ny other articles of food intended or commonly used for human consumption without further preparation by cooking shall be sold, exposed, kept , or stored for sale unless t hey be kept pr operly covered or otherwise guarded in a pr oper manner so that they shall be protected from dust, dirt, and flees. 18.Power to close shop or market in case of dangerous disease The Chairma n may, for a specified time, with a view to preventing the spread of any dangerous disease, or der that any ma rket, hotel and lodging house shall b e closed, or forbid any person to attend any such mar ket, to lodge in such lodging or in such hotel. In pursuance of paragraph 11 of the Sixth Schedule to the Constitution of India, the following Rules of the Chakma Autonomous Distr ict Council which received approval of His Excellency the Governor of Mizoram on 3.1.2013 is hereby published for general information, namely :“ THE CHAKMA AUTONOMOUS DISTRICT COUNCIL ( CONSTITUTION, CONDUCT OF BUSINESS ETC.) (1) These rules may be called the Chakma Autonomous District Council ( Con- stitution, Conduct of Business etc.) (Amendment) Rules, 2012. (2) They shall come into force from the date of their publication in the official Gazette. 2. In rule 2 of the prin cipal Rules, the following definition shall be added, namely : (c) (i) “Controlling Unit” means an electronic device used for voting and record- ing of vote. (j) (i) “ Electronic Voting Machine” means electronically operated machine for use in voting. (q) (i) “Opposition leader” means a leader of the opposition members having 1/3 of the elected members from a sitting recognized or registered political party. (w) (i) “ State election Commission” means the Mizoram State Election Commis- sion constituted under clause (1) of Article 243K of the Constitution. 3. In Rule 7 after sub-rule (4) of the Principal Rules, sub-rule (5) shall be inserted namely : “(5) The superintendence, direction and control of the pr eparation of Electoral rolls for, and the conduct of the Election to the District Council shall vest in the State Election Commission”. Provided that the District Council may, by law, make provision with re- spect to all matters relating to, or in connection with , elections to the District Council. Provided further that in preparation of Electoral Rolls and conduct of Election to District Council, the State Election Commission shall exercise the rules provided in Chapter XIII to Chapter XXII of the Chakma Autonomous District Council ( Constitution, Conduct of Business, etc.) Rules, 2002 as amended from time to time. Amendment of rule 2 Amendment of Rule 7 4. After sub-rule (6) of Rule, 22 of the Principal rules, new sub-rule (7) shall be inserted, namely :- (I) “(7) There sh all be an Opposition Leader, if a single recognized or registered political party has at least 1/3 of the elected members. The Opposition Leader shall be appointed by th e Governor on th e recommendation of th e Ch ief Executive Member. (II) In sub-rule (6) of Rule 22 of the Principal Rules, the word “and” shall stand omitted and after the words Executive members “and the Opposition Leader” shall be added”. 5. In caluse (b) of sub-rule (1) of Rule 147 of the Principal Rules, for the word ‘Governor’ the words “State Election Commission”, Shall be substituted. 6. In Rule 149 of the Pricipal Rules, for the word “Governor”, the words “State Election Commission” shall be substituted. 7. In Rule 151 of the Principal Rules, for the word “Governor” the words “State Election Commission” shall be substituted. 8. In Rule 153 of the Principal Rules, for the word “Governor” the words “State Election Commission” shall be substituted. 9. In Rule 154 of the Principal Rules, for the word “Governor” the words “State Election Commission” shall be substituted. 10. (i) In sub-rule (2) of rule 156 of the principal Rules, th e words, “by ballot” shall be substituted by the words “electronic voting machine”. (ii) Sub-rule (3) of rule 156 of the principal Rules shall be substituted by the following, namely: “An Electronic Voting Machine shall be common for all the candidates and there shall be only one EVM in use at a time and place in such manner to ensure secrecy of voting.” 11. In sub rule (1) of Rule 158 of the Principal Rules, for the word “Governor” the words “State Election Commission” shall be substituted. 12. In sub-rule 4 of rule 161 of the Principal Rules, the word “Governor” shall be subtituted by the words “state election commisssion”. 13. In sub-rule (1) of rule 162 of the Principal Rules, the words wherever contain- in g in this sub-rule, “ballot box a boxes”shall be substituted by th e words “Electonic Votin g Machine or Electronic Voting Machines”. 14 Sub-rule (1)(2)&(3) of rule 163 of the prin cipal rules shall be substituted by the following, namely: “(1) Each polling station shall be provided with necessary Electronic Voting Machine by the Returning Officer. (2) Every electronic Voting Machine used at a polling station shall be packed with its over bearing labels out of the cover of the Electronic Voting Machine, marked with : Ame ndment of Rule 22 Amendment of Rule 147 Amendment of Rule 149 Amendment of Rule 151 Amendment of Rule 153 Amendment of Rule 154 Amendment of Rule 156 Amendment of Rule 158 Amendment of Rule 161 Amendment of Rule 162 Amendment of Rule 163 (a) Serial number, if any and name of constituency (b) Serial number and name of the polling station ; (c) Date of the poll. (3) The Returning Officer shall pr ovide each polling station with necessary Elec- tronic voting machines, copies of the relevant part of the electoral roll, Postal ballot papers, and instruments for stamping the offcial mark on postal Ballot papers by the electors”. 15. After rule 163, rule 164 be inserted in place of rule 163 and Sub-rule (1) (2) of rule 164 of the principal rules shall be substituted by the following, namely: “(1) The Presiding Officer in any polling station immediately before the com- mencement of the poll, shall show to all such polling agents and others may be present at such station that the Electronic Voting Machine is empty and in good order and place his seal upon it in such manner so as to prevent it being opened without breaking such seal and shall keep it so locked and sealed. (2) Where it is necessary to use a paper seal for securing the Electronic Voting Mach in e, th e Pr esidin g Officer sh all fi x in each paper seal pr ovided for th e pur - pose. He sh all also a ffix on such paper seal h is own sign atur e or seal, sign atur es or seals of such candidates or of such election or polling agents of the candi- dates, as may be pr esent. He sh all then secure and seal each Electronic Voting Machine in their presence. 16. (i) In sub-rule (1) of the rule 166 of the principal Rules, the Words “received the ballot paper” shall be substituted by the words, “is permitted for voting”. (ii) Sub rule (3) of rule 166 of th e pr in cipal rules shall be substituted by the follow- ing, namely: “On the voter ’s n ame being called out, the pollin g officer shall Clearly Instruct the voter how to use the Electronic Voting Machine for voting and also mark on left index finger nail of the voter with indelible ink”. (iii) In rule 166 of the principal rules, after sub-rule 3, sub-rule 4 shall be added namely: “4 The Presiding Officer or any oth er Officer as may be authorized by him in every Polling Station, shall keep the “Controlling Unit” on; before casting of every vote to ensure the Electronic Voting Machine is ready to record of every casting vote”. 17. Rule 168 of the principal rules shall be substituted by the following namely: “A voter shall go inside the polling compartment and record his vote by pressing appropriate button of the Electronic Voting Machine against the symbol of the candiddate he or she wishes to vote”. 18. In rule 169 of the principal Rules, the words, “ballot paper” shall be substi- tuted by the words “Electronic Voting Machine”. 19. Rule 170 of the principal; Rules shall stand omitted. 20. Rule 172 of the principal Rules shall be substituted by the following, namely: “If a person representing himself/herself to be a particular voter named On the electoral roll comes to cast vote after anoth er person has voted as such Amendment of Rule 164 Amendment of Rule 166 Amendment of Rule 168 Amendment of Rule 169 Amendment of Rule 170 Amendment of Rule 172 voter, the applicant shall after satisfactorily answering such questions as the Presiding Officer may ask, be entitle to cast a vote. The person tendering such ballot paper shall sign his name and address thereon or affix his or her thumb impression against relevant entry as in the list in Appendix VIII. Elector shall after casting vote in the voting compartment give the ballot paper to the Presiding Officer who shall place it in a cover envelope spe- cially kept for the purpose”. 21. In sub-rule (1) of rule 173 of the principal Rules, the words, “ballot paper” shall be substituted by the word, “vote”. 22. Rule 177 of the Principal Rule shall be substituted by the following, namely: “The Presiding Officer of each polling station, as soon as practicable after the close of the poll, in the presence of the Candidates or their polling agents as may be present, close the control unit to ensure that no further vote can be recorded and shall dispatch the balloting unit from the control unit, and packed the Elec- tronic Voting Machine and seal with his own seal and the seal of the candidates or their agents who may desire to affix their seals the following, namely: (a) Marked copy of the elector al roll. (b) the tendered votes’ list. (c) the envelopes referred to in rule 176 and sh all deliver such packets or parcels or causes them to be delivered to th e Returning Officer”. 23. Rule 178 of the Principal Rules shall be substituted by the following, namely: “The packets or parcels as prepared under rule 177 shall be accompanied with the statement in the form given in the appendix-XII by the Presiding Officer showing the number of votes polled and other r elated documents as may be directed by the Returning Officer”. 24. “(i) In sub-rule (1) of rule 179 of the Principal Rules, for the word “Governor” the words “State Election Commisssion” shall be substituted. (ii) In sub-rule (2) of rule 179 of the Principal rules, for the words “ballot boxes” the words “electronic voting machines” shall be substituted”. 25. In Rule 192 of the Principal Rules, the words & figures, “ Rs.25,000- (Rupees Twenty-Five Thousand) only”, shall be substituted by th e words & figur es, “Rs.1,00,000/- (Rupees One Lakh) only”. 26. Sub-rule (4) of Rule 208 of th e Prin cipal Rules shall stand omitted. 27. In sub-rule(2) of rule 209 of the Principal Rules, the words,” a ballot paper” wherever contained in this sub-rule, shall be substituted by the words, “a vote”. 28. This templa te should be shared with the CEO : Geotech and Ministry of Textiles. 2.Techno Economic Viability study :a.To critically analyse the project list generated by the Committee and identify technically feas ible pr ojects for usa ge of geotextiles. b.To determine the suitable geotech products (e.g. geogrids, geocells, geotextiles etc.) to be use in each of the identified projects. - 2 - Ex-8/2013 c.To analyse the economic via bility with cost benefit analysis. d.To coordinate with various user Departments (e.g. PWD, MoRTH, etc.) and ensure that usage of geotextiles is included in DPR and all the tenders floated by such user Departments. 3.Availa bility of Geotech in North Eastern Region :a.To check for the a vailability of requir ed geotech material in NE region, and identify the key suppliers in the region and on a pan India ba sis. b.To ensure adequate and smooth supply chain of Geotextiles material from the manufacturers in NER. 4.Establishment of institutional framework for implementing the projects :a.To ensure smooth coordination and implementation of the identified projects by identifying different stakeholders and assign responsibilities to ea ch of them. b.To develop a mechanism for inter-stakeholder coordination and establishing linkages with various manufacturers, user departments infrastructure consultants, research a gencies etc. L. SCHEDULEName of the Sanct uary : Thorangtlang Wildlife Sanctuary. Location: Thorangtlang and its adjoining areas comprising of Kawnpui ‘W’ and Darngawn ‘W’ Village areas under Bunghmun ‘W’ RD Block of Lunglei Distr ict. Area: 198 Sq. Km (including the existing Thorangtlang Wildlife Sanctuary) BOUNDARY OF EXTENDED THORANGTLANG WILDLIFE SANCTUARY North : The boundary starts at the point where Za wlpui lui meets Mar lui, it follows Zawlpui lui upstream till it reaches Ra wthingka wn (the bounda ry of Zopui and Darngawn villages). Thence, it follows Sekam lui downstream eastwards up to R. Tut. East : From Sekam lui outlet, the boundary follows R. Tut upstream till it meets the outlet of T lubing lui. South : From the outlet of Tlubing lui, it follows Tlubing lui upstream and crosses Va -awk ka wn (saddle). Obituary of Pu V. Lalpanliana, Executive Engineer (Planning), PWD

OBITUARY The Government of Mizoram has learnt with profound sorrow the sad demise of Pu V. Lalpanliana, Execut ive Engineer (Planning), Nat io nal Highway Circle-I under Chief Engineer (Highway), PWD in the afternoon of 19th December, 2012. Pu V. Lalpanliana, according to his service record, was born on 16th November, 1965. After graduation in Civil Engineering, he joined t he Government of Mizoram, Public Works Department on 6th November, 1989 and was posted as Sub-Divisional Officer (TC), Lunglei. He was promoted to the post of Executive Engineer on 9th May, 2007 and held this post t ill he breathed his last. Pu V. Lalpanliana served the Government as Sub-Divisional Officer and Executive Engineer at various places in Mizoram. The Government of Mizoram would like to place on record its deep appreciation for the services rendered by Pu V. Lalpanliana and conveyed its heartfelt sympathy to the bereaved family.
