(2 ) They shall come into force from the date of their publication in the Official Gazette. 2.ApplicationThese rules shall apply to the posts specified in Column 1 of the Annexure-I annexed to these rules. 3.Number of posts,The number of the said post(s), their classification, P ay Band and classification, pay bandGrade pay/pay scale attached thereto sha ll be as specified in columns and grade pay/pay scale2 to 4 of the said Annexure-I. 4.Method of recruitment,The method of recruitment, age limit, qualification and other matters age limit,relating to the said post(s) shall be as specified in columns 5 to 14 of qualifications, etc-the aforesaid Annexure-I. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram from time to time. 5.DisqualificationNo person, - (a) who has entered int o or contracted a marr iage with a person having a spouse living; or (b ) who, having a spouse living, has entered into or contract ed a marriage with any other person, shall be eligible for appointment to t he said post(s); - 2 - Ex-262/2013 Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule. 6.Training and DepartmentalEvery Government s ervant r ecr uited under these rules shall undergo Examination.such training or pass such Departmental Examination as may be pres cribed from time to t ime. 7.Powers to transferNotwithstanding anything contained in these r ules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officer so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8.Power to relaxWhere the Governor is of the opinion that it is necessary or expedient so t o do, he may, by order and for reasons to be recorded in writing and in consulta tion with the Mizoram Public Service Commission through the Department of P ersonnel & Administrative Reforms, relax any of the pr ovisions of these rules with r espect to any class or category of persons. 9.Reservation andNothing in these rules shall affect reservation, relaxation of age other concessionslimit and other concessions required to be provided for the Scheduled Castes /the Schedu led Tr ibes and ot her ca tegor ies of persons in accordance with the orders issued by the Central Government or the Government of Mizoram from time to time in t his regards. 10. Repeal and SavingsAll rules pertaining to these posts framed by the Government of Assam and Government of Mizor am under Notification No. A. 12018/34/2003-P&AR(GSW) dated 28.11.2003 Issue No. 366 dated 1.12.2003 stand hereby repealed. (2)They shall come into force from the date of their publication in the Official Gazette. These rules shall apply to the posts specified in column 1 of the Annexure-1 annexed to these rules. The number of the said post(s), their classification, Pay Band and Grade pay/pay scale attached thereto shall be as specified in columns 2 to 4 of the Annexure-1 as aforesaid. The method of recruitment to the said posts, age limit, qualification and other matters relating thereto shall be as specified in columns 5 to 14 of the Annexure-1 aforesaid. Provided that the upper age limit prescribed for direct recruitment may be relaxed in the case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government or the Government of Mizoram, as the case may b e fr om fr om time to t ime. No person- (a) Who has entered into or contracted a marriage with a person having a spouse living; or 1. Short title and commencement- 2. Application- 3 . Number of posts, classification, pay band and grade pay/pay scale- 4 . Method of recruitment, age limit, qualifications, etc- 5. Disqualification- (b) Who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any such person from the operation of this rule. Every Government servant recruited under these rules shall undergo such training or pass such Departmental Examination(s) as may be prescribed from time to time. Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the power to transfer any officer(s) so recruited under these rules to any other post or position which is equivalent in rank or grade. Where the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in wiriting and in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. NOTIFICATIONNo.C.31012/2/2012-DCA(L), the 20th May, 2013.In pursuance of paragraph 11 of the Sixth Schedule to the Constitution of India, the following Act passed by the Lai Autonomous District Council and appr oved by His Excellency the Governor of Mizoram on 9th Ma y, 2013 is hereby published for general information, namely :- “THE LAI AUTONOMOUS DISTRICT (VILLAGE COUNCILs) (SECOND AMENDMENT) ACT, 2013” An Act further to amend the Lai Autonomous District Council (Village Councils) Act, 2010 ( hereinafter referred to as the Principal Act). It is ena ct ed by the Lai Autonomous Dist rict Council in this s ixty third yea r of the Republic of India as follows:- 1.Short title, extent and commencement.– 1)This Act may be called the Lai Autonomous District (Village Councils) (Second Amendment) Act, 2013. 2)It shall ha ve the like extend as the Principal Act. 3)It shall come into force on the date of Publication in the Official Gazette. 2.Amendment of Section 3.- (1)In sub-section (3) of Section 3 of the Pr incipal Act, the following shall be substituted, namely; “(3)A Village C ouncil s hall be composed of members a ccording to the number of houses it contains as specified below: The Mizoram Gazette EXTRA ORDINARY Published by Authority RNI No. 27009/1973 Postal Regn. (2)After sub-section (6) of Section 3 of the Principal Act, the following sub-sections shall be added, namely; “(7)The Executive Committee may abolish a Village Council if the number of the households of t he village has become less than 50 houses due to migration or other reasons. “(8) Subject to approval of the Governor, the Executive Committee shall have power to bifu rcate the existing Village Council into two Village Councils. Provided that if t he exis ting Village Council is bifur cated into two Village Councils, the Executive Committee may make necess ary arr angement in the forma tion of that Village Council from the exis ting Village Council Members until General election is held”. 3.Insertion of new sub-section after sub-section (3) of Section 6.- After sub-section (3) of S ection 6 of the Principal Act , the following new sub- section shall be inserted, namely; “(4)All members of a Village Council shall hold office during the life of t he Village Council. Provided that in the case of mid-term election or to fill casua l vacancy, the members so elected shall hold office during the remaining term of the Villa ge Council.” 4.Amendment of Section 7.- (1) In sub-section (1) of section 7 of the Principal Act, words between’ shall be terminated’ and’ by the Executive Committee’ the words “or terminated” shall be inserted. (2) In sub-s ection (2) of Section 7 of the Principal Act, the following proviso sha ll be added, namely- “Provided that in case the Secreta ry is inconvenient to conduct election of the President and Vice President, Executive Committee ma y appoint any person or persons to conduct the said elections.” 5.Amendment of Section 9.- (1) After sub-section (1) of section 9 of the P rincipa l Act, the wor ds“If the Executive Committee thinks appropriate”shall be added.. (2) After sub-section 6 of section 9 of the Principal Act, the following sub-section shall be inserted, namely: “7)If a nd when the members of a Village Council desire to move a motion of no- confidence against the Vice President, they shall submit a notice of such motion Ex-257/20132 duly signed by themselves to the President. In such cases, the President sha ll issue order for holding of specia l meeting for the pur pose specifying the place, date and time and the meeting shall be conducted by the President. Provided that the President shall have no casting vote at the first instance in a motion of no-confidence. But in the case of equality of votes, the President shall have casting vote. Provided further that in the event of removal of the Vice President, a new Vice President shall be elected within forty eight hours from the time of removal of the Vice President”. 6.Amendment of Section 10.- In sub-section (3) of section 10 of the Principal Act, for the words, two-thirds shall be substit uted by the word “majority”.
