Ranbir Singh, Commissioner/Secreta ry to the Govt. of Mizoram, Socia l Welfar e Depart ment. THE MIZORAM STATE COMMISSION FOR PROTECTION OF CHILD RIGHTS RULES, 2013 1. Short title and commencement : 1)These rules may be called the Mizora m State Commission for Protection of Child Rights Rules, 2013 2)They shall come into force on the date of their publication in Mizoram Gazette 2 . Definitio ns (1) In t hese r ules, unless the context other wis e requir es:- (i)“Act ” means the Commissions for Protection of Child Rights Act, 2005 (No. 4 of 2006); (ii) “Commission” means the Mizoram S tate Commission for P rotection of Child Rights cons tituted under section 17 of the Act; (iii) “Cha irperson” means the Cha irperson of the Commission; (iv) “Member” means the member of the Commission; (v) “Schedule” means a Schedule a ppended to t hese Ru les; (vi) “Secretary” means the Secretary of the Commission; (vii) “Section” means the Section of the Act; and (viii) “Sta te Government” or “Government” means the State Government of Mizoram; (2) Subject to Section 24, of the Act , words and exp ressions used and not defined in these rules but defined in t he Act shall ha ve the meanings respectively a ssigned to them in the Act. 3 . Constitution of the State Commission : (1) There shall be constituted by the State Government, a body to be known as “ the Mizoram State Commission for the Pr otection of Child Rights” to exercise the powers conferred upon, and to perform the functions assigned to it under Chapter IV read with sub-section (1) of Section 13 and Section 24 of the Act.The Mizoram Gazette EXTRA ORDINARY Published by AuthorityVOL - XLII Aizawl, Tuesday 7.5.2013 Vaisakha 17, S.E. 1935, Issue No. 225RNI No. 27009/1973Postal Regn. No. NE-313(MZ) 2006-2008Re. 1/- per page - 2 - Ex-225/2013 (2) The composition of the commission shall be as envisaged in s ub-section (2) Section 17 of the Act. 4. Constitution of the Selection Committee : (1) The Selection Committee as referr ed to in the P roviso to Section 18 of the Act shall be headed by t he Minister, Social Welfare Department, Government of Mizoram. (2) Amongst other members, the Parliamentary Secreta ry, if a ny, to Social Welfare Department, Government of Mizoram, or in his absence, the Parliamentary Secreta ry, Political and Cabinet Depa rtment of the Government sha ll be a member of the Commit tee. (3) The State Government shall, by notification, constitute the Selection Committee for the purposes of section 18 of the Act. 5 . Eligibility for appointment as Chairperson and Other Members : Save as alr eady provided in sub-s ection (2) of S ection 17 of t he Act, no person having any past record of violation of human rights or child rights sha ll be eligible for appointment as Cha irperson or other Members of the Commission. 6 . Terms and Conditions of Service of Chairperson and the Other Members: (1) The general terms of office and conditions of Service of the Cha irperson and other Members of t he Commission shall be as laid down in section 19 and in sections 7, 8 and 9 read with section 24 of the Act. (2) Other conditions of service of the Chair person and other Members of the Commission, for which no express pr ovision has been made in these rules shall be such a s may b e determined by the State Government from time to time. 7 . Salaries and Allowances of Chairperson and Other members: (1) Save as otherwise provided in Section 20, the Chairperson of the Commission shall be paid sala ry equivalent to the sa lary of the Commissioner to the State Government and every other Member shall be pa id sala ry equivalent to that of a Secretary to the State Government; Provided that where the Cha irperson or any other Member is a retir ed Government Servant or official from any Semi-Government body, Public Sector Undertaking or recognized research institute, the salar y payable together with the pension or pensionary va lue of the terminal benefits, or both, to be received by him shall not exceed the last pay dr awn by him. (2) If the Chair person or any other Member is in service of the Central Government or any S tate Government, his salary sha ll be regulated in accordance with the rules applica ble to him. (3) Other allowances pa yable t o the Chairperson and other members of the Commission shall be such as may determined by the State Government from to time. 8 . Secretary to the Commission : Subject to section 21 of t he Act, the Commission shall have a full-time Secretary to exercise and discharge such powers and perform such duties as laid down in the Act and as specified in these Rules. 9 . Powers and duties of the Secretary : Save as alr eady pr ovided in section 21 of the Act, the Secretary shall- (i)have the power to execute all decisions taken by the Commission, in order to carr y out the powers and functions of the Commission as provided in sub-section (1) of section 13 and in section 14 read with section 24; (ii) exer cise and discha rge such powers and perform such duties as a re required for the pr oper administration of t he affa irs of the Commission a nd its day to day mana gement as mentioned in section 21; (iii) convene the meetings of t he Commission in consultation with its Chairperson and serve notices of the meetings to all concerned; (iv) take step stoensu re that the quorum required for convening a meeting of the C ommission is secured; (v) in consultation with the Chairperson, prepare the agenda for each meeting of the Commission and shall have notes prepared by the Secretaria t and such notes shall, as far as possible, be self-contained; (vi) make availa ble specific files covering the agenda items to the Commission for reference; (vii) ensu re that the agenda papers are circulated to the Members at least two clear working days in a dvance of the meeting, except in cases when ur gent attention is required; (viii) prepare the minutes of the Commission and shall execute the decisions of the Commission taken in the meeting and shall also ensure placing of the Action Taken Note on the decisions of the Commission, before the Commission in its subsequent meetings; (ix) ensu re that the pr ocedure of the Commission is followed by it in tra nsaction of it s business; (x) take up all matters with t he State Government relating to release of grants. Creation of posts, revision of pay and all a llowances, procurement of vehicles, appointment of staff, laying of annual repor t and a udit report in Mizoram Legisla tive Assembly, re-appr opriation of funds, residential accommodation, grant of permission to any officer of the Commission for deputation, and any other matter requir ing the approval of the State Government; (xi) exer cise such financial powers as are delegated to him by the Chairperson on behalf of the Commis sion; Provided that no expenditure on an item exceeding fifty thousand rupees shall be incurred without the sanction of the Chairperson; (xii) be the appointing and disciplinar y authority in respect of officers and other employees of the Commission; and (xiii) exer cise and discha rge such other powers and perform such other duties as may be assigned to him by the Chair person, as are not inconsistent with the pr ovisions of Chapter IV of the Act and are absolutely requir ed only for smooth day-to-da y funct ioning of the Commission. 1 0 . Salaries, allowances and other terms of conditions of service of the S ecretary : (1) Save as alr eady pr ovided in sub-sections (1) and (3) of Section 21 of the Act, the Salary and allowances payable to, and the other terms and conditions of service of, the Secretar y appointed for the purposes of the Commission shall be such as may be determined by the State Government fr om time to time. (2) If the Secr etary is in service of the Central Government or any Sta te Government, his sa lary shall be regulated in accordance with the rules applica ble to him. 11. Staff of the Commission : (1) Save as already provided in sections 21 and 22 of the Act , the State Government shall, from time to time and in consultation with the Commission, make available to the Commission such other officers and employees as may be necessary for the efficient performance of it s funct ions and to the extent possible as sp ecified in Schedule I appended to these Ru les. (2) The Salary a nd allowances payable to, and the other terms and conditions of service of, the other officers and employees of t he Commission shall be such a s may be determined by the State Gover nment from time to t ime. 1 2 . Functions of the Commission: (1) The Commission shall, in addition to the functions assigned to it under sub-section (1) of section 13 r ead with section 24 of the Act, perform following functions, namely - (a ) analyze existing laws, policy and pract ice to a ssess compliance with Convention on the Rights of t he Child undertake inquiries and produce reports on any a spect of policy or- 3 -Ex-225/2013 practice affecting children and comment on proposed new legislation from a child rights’ perspective; (b) present to the State Government, annually and at such ot her intervals, as the Commission may deem fit, repor ts upon the working of those safegua rds; (c ) undertake formal investigations where concern has been expressed either by children themselves or by concerned persons on their behalf, or by public at large, or in the media; (d) ensur e tha t the work of the Commission is to be directly informed of the views of children by themselves in order to reflect their priorities and perspectives; ( e) promote, respect a nd take into serious consideration t he views of children in its work and, in tha t, of all Government Departments and Organizations dealing with child; (f) produce and disseminate informa tions a bout child rights; (g) compile and analyze data on children; and (h) promote inclusion of the subject of child rights into the school cur riculum, teachers’ training and training of personnel dealing with children. (2) The Commission shall not inquire into any matter which is pending before the Central Commission or any other Commission duly constituted under any law for the time being in for ce. 13. Procedure for transaction of business : (1) The Commission shall meet regular ly in its office at Aizawl and at such time as the Chairperson thinks fit, but thr ee months shall not intervene between its last meeting and the next meeting. (2) The Commission shall ordinarily hold its meetings in its office at Aizawl but may, in its discretion, hold its meetings a t any other place in M izoram if it considers necessary or expedient to do so. (3) The Secreta ry, along with such officers a s the Chairperson may direct, shall attend the meetings of the Commission. (4) (a ) The Secreta ry shall, in consulta tion with the Chairperson, pr epare the agenda for each meeting of t he Commission and shall have notes p repared by the Secreta riat and such notes shall, as far as possible, be self-contained. (b) The records covering the agenda items shall be made readily available to the Commission for its reference. (c ) The agenda papers shall ordinarily be circulated to Members a t least two clear wor king days in adva nce of the meeting, except in cases when urgent attention is required. (5) Four members including the Chairperson shall from the quorum at every meeting of the Commission. (6) All decisions of the Commission a t its meeting shall be taken by major ity; Provided that in the case of equality of votes, the Chairperson, or in his absence the person presiding shall have and exercise a second or a casting vote. (7) If, for any reason, the Chairperson is unable to attend the meeting of the Commission, the Senior-most Member in terms of age and present in the meeting shall preside. 1 4 . Minutes of the meeting : (1) The minutes of each meeting of t he Commission shall be recor ded dur ing the meeting itself or immediately thereafter by the Secretary or by any other official of the Commission as directed by the Chairperson. (2) The minutes of meting of the Commission shall be submitted to the Chair person for appr oval and upon approval, be cir culated to all members of the Commission at the earliest and in any case, sufficiently before the commencement of the next meeting. (3) The resolutions of the Commission on every matter underta ken by it shall be recorded in the form of an opinion and dissenting opinions, if given, shall also form part of and be kept on record.- 4 - Ex-225/2013 (4) All orders a nd decisions of the Commission shall be authenticated by t he Secretary or any other officer of the Commission duly authorized by the Secreta ry with the pr ior appr oval of the Chairperson in this behalf. (5) Unless specifically authorized, no action shall be taken by t he Secr etariat of the Commission on the minutes of the meetings until the Chairperson confir m the same. (6) A master copy of the record of all meetings and opinions of the Commission shall be maint ained duly authenticated by the Secretary. (7) A copy of the minutes and opinions pertaining to each item shall be kept in the respective files for appropr iate action, a nd for convenience copies thereof with appr opriate indexing shall be kept in guard files. 1 5 . Report of Action Taken : Report of the follow-up-a ction s hall be submitted by t he Secr etary t o the Commission at every subsequent meeting indicating therein the present stage of action taken on each item on which the Commission had taken any decision in any of its earlier meetings except the items on which no further act ion is called for. 1 6 . Panel of Consultants (1) The Commission may constitute a pa nel of consulta nts for assisting the Commission in a wide range of ta sks such as investigation or inquiry, to serve on task forces or committees and for research and analysis. (2) The Commission may draw, a s consultants experts from academic, resear ch, administrative, investigative, legal or civil society groups to form the pa nel. (3) The Commission sha ll, for the purposes of empa nelment of the consultants, be governed by the guidelines framed by the Government of India in this resp ect as adapted and contained in Schedule-II to these Ru les. 1 7 . Annual Report: (1) The Commission sha ll prepa re and publish an annual report in the format cont aining such deta ils as specified in Schedule III, before the 31st day of Mar ch ever y year for submission to the State Government. (2) The Commission shall also prepare special reports on specific issues as and when necessary under the direction of the Chairperson. (3) The State Government shall cause the annual report and the s pecial reports of the Commission to be laid before the Mizoram State Legislative Assembly at the earliest. (4) The annual report shall include information on administrative and financial matter, compla ints investigated/inquir ed into, action taken on cases, deta ils of r esearch, reviews, educational and promotional efforts, deta ils and consultations, deta ils and specific recommendations of the Commission on any matter, besides any other matter that the Commission may consider warr anting inclusion in the report. (5) In case the Commission considers t hat there could be a time lag for the prepar ation of the annual repor t, it may prepare and submit a special repor t to the State Government. 18. Financial provisions : (1) Save as alr eady pr ovided in the Act, the Commission s hall maintain proper accounts and other relevant records a nd prepa re an a nnual statement of accounts in such forms a s may be notified, by order, by the State Government in consultation with the Comptroller and Auditor-Genera l of India. (2) The forms in which the budget may be prepared and forwar ded to the Sta te Government s hall be a s per formats notified for the purpose by the State Government in the F inance Department.- 5 -Ex-225/2013 (3) The budget shall, a s far a s may be, based on the account-heads as may be specified by the Government of Mizora m in the Finance Department. (4) The Commission sha ll spend su ch sums of money only as may be received by it for the pu rposes of the Act. (5) The Chairperson sha ll have all powers relating to financial transaction of the Commission, except in cases, which require prior a pproval of the State Government. (6) The Chairperson shall obtain prior appr oval of the Sta te Government in matters of creation of posts, revision of pay scales, procurement of vehicles, re-appropria te of funds fr om one head to a nother, permitting any officer of the Commission to participate in Seminars, conferences or training programmes outside the State and in respect of such other matters as may be determined by the Sta te Government, by or der. (7) The Chairperson may, subject to such conditions, limitations, control and supervision as may be specified by order; delegate his financia l powers to the Secretary; Provided tha t no such power shall be delegated in respect of incurring an expenditure on an item exceeding fifty thousand rupees without pr ior approval of the C hairperson and in respect of which no such delegation is permissible under the relevant rules governing delegation of financial powers. (8) The Chairperson shall have powers to engage any person or persons as consultant or consultants for a specific pur pose and for a specific period on the terms and conditions agreed in advance relating to honorar ium, tr aveling allowances and daily allowances. (9) The Secreta ry shall have powers to execute all decisions taken by the Chairperson or any other Member on his behalf relating to financial matters. (10) All financial powers of the Commission shall be governed by the General Financial Rules, 2005 as a mended from time to time. (b) Senior police officers (r etired) who have relevant exp erience sector s related to child rights etc. and atleast 8 years experience in investigations. (c ) Persons from civil society who at least 8 years of relevant experience in issues relating to child rights at t he field or policy level. (d) Persons/organizations having at least 8 years of relevant exp erience in research, training and docu mentation of social sector laws, policies and programmes, in the areas mentioned in the annexure. (2) For the purpose of monitor ing, evaluation, documentation and research the experts will follow set formats and checklists developed a t the State level, when specified. (3) In case of an emergent need, with approval of the Chairperson, persons other than on the panel can be engaged for a period not exceeding one month, based on their experience a nd qualifications. 6. Logistics, Out-of-pocket expenses and Professional Fees:(1)For experts: The experts may be co-opted as part of the exp ert group/committees or as p art of an inqu iry team of the Commission. The work of the experts is voluntary in natur e and no regula r payment would be made to them. T he local experts may be pa id local conveyance a llowance, honorar ium and reimbursement of incidental expenses, such as photocopy, typing expenditure, stationery etc. incurred- 7 -Ex-225/2013 towards preparation of the Report as per existing norms or in absence of any such norms, as may be determined by the State Government. (2)For Consultants : The fees for consultants would be determined in accordance with existing orders of the State Government for engagement of consulta nts. (3) The experts/consultants would be required to maintain confidentially of the assigned work and communicate their views/reports etc. to the Commission and not to any other authority inclu ding media. They will not take hospitality from any source that run contrary to the mandate of the Commission and/or the objective of their a ssignment. The Mizoram Fire Service Act, 2013 (Act No. 7 of 2013) {Received the assent of the Governor of Mizoram on the 17th April, 2013}. AN ACT To provide for the maintenance of Fire & Emergency services for the State of Mizoram; Wher eas it is expedient to provide for the maint enance of a Fire Force, and for certain other ancillary matters. It is enact ed by the State Legislature in the S ixty fourth year of the Republic of India a s follows:- CHAPTER – 1 PRELIM INARY 1 . Short title, extent and commencement: (1) This Act may be called the Mizoram Fire Services Act, 2013. (2) It extends to the whole of the State of Mizoram. (3) It shall come into force in such area on such da te as the State Government may, by notifica tion in t he Official Ga zette, direct; and the State Government ma y, by notifica tion, withdraw the operation of the pr ovisions of this Act from any such a rea. Provided that when the fir e brigade is sent to any place outside any such area this Act shall be deemed to be in force in such place for a ll purposes connected with service therein. 2 . (c ) “Fire-Station” means any post or place declared, generally or specially, by the State Government to be a Fir e-Station; (d) “For ce” means Mizor am Fire & Emergency Service personnel maintained under this Act; ( e) ‘member of fire brigade’ includes persons engaged in the Mizoram Fire & Emergency Services and Volunteers in t he Auxiliary Fire Brigade; (f) “Officer-in-charge of the Fire Station” includes when the officer-in-charge of the F ire Sta tion is a bsent from the station or una ble from illness or other cause to perform his duties, the fire officer present at the sta tion who is next in ra nk to such officer; (g) ‘Occupier ’ means a person living in, or otherwise using, any land or building owned by him, or a person who, for the time being, is paying, or is lia ble to pay, to the owner the rent or fee, or is making, or is liable to ma ke cont ractual payment to the owner for adjustment of rent or fee, or dama ges, or any por tion thereof, on account of occupation of a ny land or building, a nd includes a rent free tenant; (h) ‘Owner ’ means a person who, for the time being, is receiving the rent of any land or building or a ny part of any land or building, either on his own account or as an agent of a person, or trustee for a society for any religious or charit able purpose, or as a receiver who would receive such rent if the land or the building or any pa rt thereof were let to a tenant; (i)“Prescribed” means prescribed by rules made under this Act. CHAPTER – 2 MAINTENANCE OF THE FIRE FORCE 3 . Maintenance of Fire force: There shall be maintained by the State Government a Fire Force to be called the Mizoram Fire & Emergency Services. 4 . Appointment of Director of Fire & Emergency Services: The State Government may appoint a person t o be the Director of M izoram Fire & Emergency Services from an officer not below the rank of Deputy Inspector General of Police. 5 . Superintendence and Control of the Fire Force: (1) The Superintendence and control of the force sha ll be under the gener al control and supervision of the Director, F ire & Emergency Services and shall be carr ied on by him in accordance with the provision of this Act a nd Rules made there under. (2) The State Government may create such posts and appoint such officers as it may deem fit to assist the Director in the discha rge of his duties. (3) The Dir ector ma y with the approval of the Sta te Government delegate any of his power, functions and duties under this Act to such subor dinate officer as he may deem fit. 6 . Appointment of members of the Force: The Director or such other officer of t he force as the State Government may author ize in this behalf shall appoint members of the force in accordance with the rules made under this Act. 7 . Issue of Certificate to member of the Force: (1) Every person shall, on appointment to the force, receive a certifica te in t he prescribed form under the seal of t he Director or an officer authorized in this behalf by the State Government, and thereup on such person shall have the powers, functions a nd privileges of a member of the force under this Act. (2) The Certificate referred to in sub-section (1) shall cease to have effect when the person named therein ceases for a ny reason to be a member of the force, and on his ceasing t o be such member, he shall for thwith surrender the certific ate to any off icer empower ed to r eceive the same. (3) During any term of suspension, the powers, functions, and pr ivileges vested in any member of the force shall be in abeyance, but such member shall continue to be subject to the same discipline a nd penalties as he would have been if he had not been suspended. 8 . Auxiliary Fire Force: Whenever the State Government feels that it is necessary to augment the force, it may raise an auxiliary force by enrolment of volunteers for such ar eas and on such terms and conditions as it may deem fit. 9 . Power of State Government to make orders: The State Government may from time to time make such general or special orders as it may deem fit – (1) for providing the force with such appliances a nd equipments as it deem proper; (2) for providing adequate supply of water and for securing that it shall be availa ble for use; (3) for constructing or providing stations or hiring places for accommodating the members of the force and its fire fighting appliances; (4) for giving r ewards to persons who have given notice of fires and to those who have rendered effective service to the force on the occasion of fires; (5) for the tra ining, discipline and good conduct of the members of the force; (6) for the speedy attendance of members of the force with necessar y appliances and equipment on the occa sion of any ala rm of fire; (7) for sending members of the force with appliances and equipments beyond the limits of any area in which this Act is in for ce for purposes of fir e fight ing in the neighborhood of s uch limits; (8) for the employment of the members of the force in any rescue, salva ge or other similar work; (9) for regulating and controlling the powers, duties and functions of the director; (10) generally for the maintenance of the force in a due state of efficiency; and (11) for establis hment of Fire Station or Sub- F ire Station. 1 0 . Powers of members of the force on occasion of Fire: On the occa sion of fire in any area in which t hisAct is in force, a ny member of t he force who is in char ge of fire fighting op eration on the spot may – (1) remove, or order a ny other member of the force to remove who by his presence interferes with or impedes the operation for extinguishing the fir e or for saving life or property; (2) close any street or passa ge in or near a fire is burning; (3) for the pur pose of extinguishing fire, break int o or through or pull down, a ny premises for the passage of hose or appliances or cause them to be broken into or thr ough or pulled down, doing as little damage as possible; (4) require the authority in charge of water supply in the area to regulate the water mains so a s to provide water at a specified pressure at the place where fire has broken out and utilize the water of any stream, cistern, well or tank or of any ava ilable source of water, public or private for the purpose of extinguishing or limiting the spread of such fire;- 3 -Ex-220/2013 (5) exer cise the same powers for dispersing a n assembly of persons likely t o obstr uct the fire fighting operations as if he were an officer-in-charge of a Police Station and as such if such an assembly were an unlawfu l assembly and shall be entitled to the same immunities and protection as such an officer in respect of the exercise of such powers; (6) generally t ake such measur e as ma y appear to him to be necessary for extinguishing the fir e or for the protection of life or property; (7) require Telecom Companies to assist in tracing and recording fire ca lls. 11 . Power of Director to make arrangement for supply of Water: The Director may, with the previous sanction of t he State Government, enter int o an agreement with the authority in charge of water supply in any ar ea for securing an adequate supply of water in case of fir e, on such terms as to payment or otherwise as ma y be specified in the agreement. 1 2 . Power of Director to enter into arrangement for assistance: The Director may, with the previous sanction of t he State Government, enter int o arrangements with any person who employs and maintains personnel or equipment or both for fire fighting purposes, to secure on such terms as to payments or otherwise as may be provided by or under the a rrangements, the provision by that person or assistance for the purpose of dealing with fir e occur ring in any area in which this Act is in force. 1 3 . Preventive measures: (1) The State Government may by notification in the Official Gazette, require owners or occupiers of premises in any area or of any class of premises used for purposes which in its opinion are likely to ca use a r isk of fire, to take such precaution as may be specified in such notification. (2) Wher e a notification has been issued under sub-section (1) it shall be lawful for the Director or any Officer of the force a uthorized by the State Government in this behalf to direct the removal of objects or goods likely to cause a risk of fire, to a place of safety; and on failure of the owner or occupier to do so, the Director or such officer may, a fter giving the owner or occupier a reasonable opportunit y of making representation, seize, detain or remove such object or goods, at the expense of the owner. (3)License for letting off Rockets etc.: No person shall let off rockets or send up fire ba lloons or sell fire works within any area in which this Act is in force without license. (4)Fire prevention and fire safety of buildings: The owner or occupier of building shall make or carry out arrangements necessa ry for fire prevention and fir e safet y which shall conform to the regula tions mentioned at Clause 28, 29 and 35 of Aizawl Municipal Council Building Regulations, 2012 or any other relevant cla uses under National Building Code of India 2005. 1 4 . Place of public gathering for entertainment: (1) No building or structure of any kind shall be used for public gathering for amusement, entertainment or a ny other purposes where public may assemble, unless the owner, or occupier thereof sha ll have previously obtained a license; application for such licenseshall be made to the licensing authority who shall refer the case to the Director and t heLicensingAuthority shall grant or refuse such license as ma y be recommended by the Director. (2) (i)No license shall be granted unless the building or str ucture conforms to such rules and conditions as may be prescribed by the local authority duly constituted by the State Government for purposes of public safety; and (ii) Unless adva nce payment of such fees as may be prescribed is made.- 4 - Ex-220/2013 Explanation:Theatres, Cinemas, Circus, Fairs Mellas and such other like matters come under provision of this Section. 1 5 . Temporary structure of pandals: A person who intends to erect a tempora ry structure or pandal with roof or walls made of straw, hay, mat, canvas or other like materials for use as a place where members of the public may assemble shall apply to the Licensing authority for permission to erect such structure or pandal and such permission may be granted for a stipulated period; provided that: (i)it conforms to such conditions as may be specified by the Director; (ii) adva nce payment of such fees, as may be prescribed is made; a nd in the opinion of t he Director it is not unsafe for public gathering. CHAPTER - 3 EXPENDITURE ON MAINTENANCE OF FORCES 1 6 . Expenditure on the force: The entire expenditure in connection with the force shall be met out of the Consolidated Fund of the State, provided tha t the S tate Government may recover fr om a local authority of any a rea in which this Act is in force such contribution towards the cost of the portion of the force maintained in that area as the State Government may direct from time to time. 1 7 . Levy of Fire tax: (1) There may be levied a fir e tax on lands and buildings which a re situated in any ar ea in which this Act is in for ce and on which property tax by whatever na me called is levied by any local authority in that area. (2) The fire ta x shall be levied in t he form of a surcharge on the property tax at such rate as the State Government may, by notifica tion, in the Official Gazette, determine. 1 8 . Mode of assessment, collection etc. of Fire tax: (1) The author ities for the time being empowered to assess, collect and enforce payment of property tax under the law authorizing the local author ity of the area to levy, such tax s hall, on behalf of the state government and subject to any rule made under this Act, assess, collect and enforce payment of the Fire tax in the sa me manner as the property tax is assessed, paid and collected, and for this purpose, they may exercise all or any of the power they have under the law aforesaid and the provisions of such law including provisions relating to return, appeals, reviews, revisions r eferences and penalties shall apply a ccordingly. (2) Such portion of the total proceeds of the fire tax as the sta te Government may determine shall be deducted to meet the cos t of collection of the tax. (3) The proceeds of the Fire tax collected under this Act r educed by the cost of collection shall be paid to the State Government of Mizoram in such manner and at such intervals as ma y be pr escr ibed. 19. Fees: (1) Wher e members of the force are sent beyond the limits of any ar ea in which this Act is in force, in or der to extinguish a fire in the neighborhood of such limits, the owner or occupier of the premises, where the fire occurred or spread shall be liable to pay such fee as may be prescribed in this behalf. (2) The fee r eferred to in sub-section (1) shall be payable within one month of the service of a notice of demand by the Director on t he owner or occupier and if it is not paid within tha t period, it shall be recoverab le as an arr ear of la nd revenue.- 5 -Ex-220/2013 CHAPTER – 4 PENALTIES 2 0 . Penalty for violation of duty etc.: Any member of the force who – (a ) is found to be guilty of any violation of duty or willful breach of any provision of this Act or any rules or order made there under or (b) is found to be guilty of cowardice, or (c ) withdraws fr om the duties of his office without permission or without ha ving given previous notice of at least two months, or (d) being absent on leave fails without reasonable ca use to report himself for duty on the expira tion of such leave; the Director or any subor dinate officer empowered by the State Govt. subject to the provision of Article 311 of the Constitution of India may at any time dismiss, remove, suspend or reduce in r ank or award any of the punishment t o any member of sub-or dinate ranks in the force. However, the Secretar y, Government of M izoram, Home Depar tment reserves the right of remission of hearing appeal in ca se of natural injustice or irregular ities in the case. 2 1 . Failure to give information: Any person who without just cause fails to communicate information in his possession r egarding an outbreak of fire shall be deemed to have committed an offence pu nishable under the fir st paragraph of S ection 176 of the Indian Penal Code. 2 2 . Failure to take precautions: Whoever fails without reasonable cause to comply with any of the requirements specified in the notification issued under sub-section (1) of section 13 or of a direction issued under sub section (2) of that section shall be punishable with fine which may extend to five thousand rupees and the Director shall be competent author ity to impose such fine. 2 3 . Willfully obstructing fire fighting operation: Any person who willfully obstructs or interfer es with any member of the for ce who is engaged in fire fighting operations shall be punishable with imprisonment which ma y extend to three months or with fine which may ext end to five thousand rupees or with both. 2 4 . False Report: Any person who knowingly gives or causes to be given a false report of the out-break of a fire to any person authorized to receive such report by means of a statement, message or otherwise shall be punished wit h imprisonment for three months or with fine not exceeding five thousand rupees or with both. CHAPTER – 5 GENERAL AND MISCELLANEOUS 2 5 . Training Centres: The State Government may establis h and maintain one or more training centr es in the state for providing courses of instruction in the prevention a nd extinguishment of fire and may close down or re-establis h any such centre.- 6 - Ex-220/2013 2 6 . Bar to other employment: No member of the force sha ll enga ge in any employment or office whatsoever other than his duties under this Act unless expr essly permitted to do so by the Director. 2 7 . Transfer to other area: The Director or any officer authorized by the State Government in this behalf may, on the occasion of a fire or other emergency in any neighbouring ar ea in which this Act is not in force, order the dispatch of the members of the for ce with necessary appliances and equipments to ca rry on fire fight ing operations in such neighbouring area and thereupon all the pr ovisions of this Act and the rules made thereunder shall apply to such a rea, during the period of fir e or emergency or dur ing such period as the Dir ector may specify. 2 8 . Employment on other duties: It shall be lawful for the State Government or a ny Officer authorized by it in this behalf to employ the force in any rescue, salva ge or other wor k for which it is suit able by reason of its training applia nces and equipment. 2 9 . Liability of property owner to pay compensation: (1) Any person whose pr operty catches fire on account of any action of his own or of his a gent done deliberately or negligently shall be liable to pay compensation to any other person suffering dama ge to his property on account of any action taken under Sub - S ection 3 of Section 10 of this Act by any officer mentioned under the a uthorit y of such officer. (2) All claims under sub-section (1) shall be preferred to the District Magistr ate within 30 days from the da te when the damage was caused. (3) The District Magistrate shall, after giving the parties an opportunity of being heard, determine the amount of compensation due and pass a n order stating such amount and the person liable for the same, and the order so pa ssed shall have the force of a decree of a civil court. 3 0 . Inquiry into origin of fire and report to Magistrate: Wher e any fire has occurred within any a rea in which this Act is in force, the senior-most officer in rank among the members of the for ce in that area shall ascertain the facts a s to the origin and cause of such fire and shall make a report thereon to t he Director and to the District Magistrate ha ving jurisdiction in the place in which such fire occurs, and the District Magistra te shall in any case where he may deem fit summon witnesses and ta ke evidence in order to further ascertain such fa cts. 3 1 . Power to obtain information: Any officer of the force not below the r ank of officer in char ge of a fire station may for the pur pose of discharging his duties under t he Act r equire the owner or occupier of any building or other property to supply information with respect to the chara cter of such b uilding or other property, the available water supplies and means of access thereto any other ma terials, par ticulars, and such owner or occupier sha ll furnish all the information in his possess ion. 3 2 . Power of entry: (1) The Director or a ny member of the force author ized by him in this behalf ma y enter any of the places specified in any notification issued under section 13 for the pur pose of determining whether precautions against fire required to be taken on such place have been so ta ken. (2) Saving as otherwise expressly pr ovided in this Act, no claim shall lie against any person for compensation for a ny damage necessarily caused by any entry made under sub-s ection (1).- 7 -Ex-220/2013 3 3 . Consumption of water: No charge shall be made b y any local authority for water cons umed in fire fighting operations by the for ce. 3 4 . No compensation for interruption of Water supply: No author ity in charge of water supply in an area shall be liable to any claims for compensa tion for damage by reason of any interruption of supply of water occasioned only by compliance of such authority with the requirement specified in sub-section 4 of Section 10 of this Act. 35. Police Officers to aid: It shall be the dut y of Police Officers of all r anks to aid the members of the force in the execution of their duties under the Act. 3 6 . Information on outbreak of fire: Any person who pos sesses any information regar ding an outbreak of fire sha ll communicate the same without delay to the nearest fire station. 3 7 . Indemnity: No suit, pr osecution or other legal proceedings shall lie against any member of the force for anything which is done in good fait h or intended to be done in pursuance of t his Act or any rule or order made thereu nder. 3 8 . Power to make rules: (1) The State Government may, by notification in the official Gazette, make rules for carrying out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for – (a ) the number and grades of officers and members of the force, (b) the manner of appointment of members of the force; (c ) the service conditions of members of the force including their ranks, pay and allowances, hour s of duty and leave, ma intenance of discipline and removal from service; (d) the circumstances in which and the condition (including the levy of fee) subject to which members of t he force may be dispatched to ca rry on fire fighting operations in neighbouring a reas, (e) the conditions subject to which members of the force may be employed on rescue, salvage or other work; (f) the manner in which and the intervals at which t he processes of the fire tax levied under this Act sha ll be pa id to t he State Government; (g) the manner of service of notice under this Act; (h) the payment of rewards to persons, not being members of the force, who render services for fire fighting purposes; (i)the compensation pa yable t o members of the for ce in case of accident s or to t heir dependants in case of death while engaged on duty; (j)the employment of members of the force or use of any equipment outside the area or on specia l ser vices a nd the fee payable therefor ; and (k) any other ma tter which is to be or may be prescribed.- 8 - Ex-220/2013 Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. Repeal and Savings: If immediately before the day on which t his Act comes into for ce in a n area, there is in force in that area any law or rule having the force of law which corresponds to this Act, such corresponding law in s o far a s it relates to any ma tter for which provision has been made in t his Act shall on that day stand repealed. Provided tha t such repeal shall not be deemed to limit, modify or deroga te from the general resp onsibility of any local authority – (a ) to provide a nd maintain su ch water supply and fire hydra nts for fire fighting purposes as may be directed by the State Government from time to t ime, (b) to frame bye-laws for the regula tion of dangerous tra des, (c ) to order any of its employees to r ender a id in fighting a fire when reasonably called upon to do so by any member of the for ce, and genera lly to take such measures as will lessen the likelihood of fires or preventing the spread of fires.
