Vanlalthlamuana, Medical Officer, Kulikawn Hospital on 5th April, 2013 at 5:30 PM. Born on 7.12.1970, he entered into Government Service as Medical Officer on 17.2.1997 and served under the Govt. of Mizoram in Health & Family Welfa re Depa rtment a t Lawngtlai PHC and transferred to Sairang PHC and T. B. Hospital, Zemabawk on 15.7.2002. He completed P.G. in M.D. Psychiatry on 2.5.2009 and was posted at CMO Office, Aizawl West on 6.5.2009 and was later posted at Kulikawn Hospita l where he ser ved with sincerity and devotion till his demise. OBITUARY No. LA/LIB–2007/110, the 15th April, 2013.With profound grief and deep sorrow, the Government of Mizoram, Legislative Assembly has learnt the untimely demise of P u B. L a lt hlengli a na M L A o n 1 5th Ap r il, 2 0 1 3 a t 1 0 : 4 5 A. M a t C ivil Hos p it a l, Ai za wl a ft er a brief illness. Pu B. Lalthlenglia na, son of Pu Taihnawka was born on 20th April, 1947 at Farkawn, Champhai District, Mizoram. He passed HSLC from St. Anthony’s High School, Shillong in 1969, PUC from St. Anthony’s College, Shillong in 1970. He passed BA (Hons) from Shillong College in 1974, M.A. (History) M.A. (Pol.Sc) from Guwahati University in the year 1976 and 1979 respectively. Pu B. Lalthlengliana was founder of Farkawn High School in 1972. He served as teacher at Republic High School during 1977 – 1978, Lecturer and Head of Department in History at Kolasib College during 1978 – 1986. He was Programme Officer NSS, Kolasib College during 1980 – 1986. Pu B. Lalthlengliana entered politics in 1986 and joined MNF Party. He held the post of Joint Secreta ry and Secretary of MNF Genera l Headquar ters and President of MNYF. In 1993 he won the MLA seat from S ateek Constit uency through MNF ticket and again in 1998 and in 2003 from the same Constituency. He became a Minister of State and later became a Cabinet Minister from 12.1.2000. He was also Cabinet Minister during 2003 - 2008. He had been again elected M L A for t he fou r t h t ime fr om E a s t Tu ip u i C o ns t it u ency a nd held t his p os it ion t ill his dea t h. He is survived by his wife, three sons and three daughters T he Gover nment of M izor a m, L egis la t ive As s emb ly p la ces on r ecord it s a p p r ecia t ion of the invaluable services render ed by Pu B. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLII Aizawl, Thursday 11.4.2013 Chaitra 21, S.E. 1935, Issue No. 180 NOTIFICATION No. K. 12011/39/2012-REV, the 8th April, 2013.Whereas by the Government Notifica tion No. K. 12011/39/2012_REV dt. 26.10.2012 published in the official Gazette and two daily newspapers, it was notified under section 4 of the Land Acquisition Act, 1894 (Central) Act 1 of 1894 (hereinafter referred to as the “said Act”) that the land specified in the schedule appended to the said Notification was likely to be needed for the purpose namely - Acquisition of Land for construction of IBB fencing a nd appr oach roa d to BOPs within Lawngtlai District. 2.Now, therefore, the Government declares under section 6 of the said Act that the said land is required for the public purpose specified above and as per scheduled indicated below. 3.The Government now appoints the Deputy Commissioner, Lawngtlai under clause (C) of section 3 of the said Act to perform the functions of a Collector for all proceedings hereinafter to be taken in respect of the said land and directs him under section 7 of the said Act to take order for the acquisition of the said land. 4.The Collect or shall there upon ca use the land to be measured and make a plan of the same under Section 8 of the sa id Act if not already done as per section 4 of the said Act, and dispose of all object ions and claims after ca using a public notice for not less than 15 days to the persons int erested stating the Government’s intention of taking over the possession of the sa id land as per section 9 of t he said Act. AN ACT fu rther to amend the Lakher Autonomous District (Villa ge Councils) Act, 1974 (hereinaft er called the Principal Act) and (amended therein) to provide for smooth functioning and better administra tion of the Village Councils. Enacted by the Mar a Autonomous District Council in its Session in the Sixty-Fourth Year of the Republic of India a s follows:- Short title, extent1. (1) This Act may be called the Lakher Autonomous District (Village and commencementCouncils) (Amendment) Act, 2013. (2) It shall have like extent a s the Pr incipal Act. (3) It shall come into force on and from the date of its publica tion in the Mizoram Gazette. Amendment of2. F or S ect ion 2 o f t he P r in cip a l Act , t he foll owing cla u s es s ha ll b e s u b s t i t u t ed Section 2.namely:- “(a) “Community assets” means any property of income which by custom belongs to or has been administered for the benefit of the villagers in common, or has been created through contribution of voluntary labour by the villagers or has been created out of Government or District Council or Village Council funds and vested with the Village Cou ncil - 2 - Ex-175/2013 or which has been t ransfer red to the Village Council by any agency whatsoever. (b) “Constitution” means the Constitution of India. (c ) “Deputy Commissioner” means t he Depu ty Commissioner of the Saiha Distr ict. (d) “District” means the Mara Autonomous District as prescribed in Part-III of the Table appended to para 20 of the Sixth Schedule to the Constitution of India. ( e) “Dis trict Council” means the Mara Autonomous Distr ict Council. (f) “Execu tive Committee” means the Execu tive Committee of the Mara Autonomous District Council. (g) “Governor” means the Governor of Mizoram. (h) “Ly” means a customa ry fine imposed by a Village Council for refusal to contribution in the Village T larai or Vatla rai. (i) “President” means the President of the Village Council. (j) “Schedule Tribe or Tr ibes” means such tribe or tribes as are specified by t he President of India under Article 342(1) of the Constitution of India as modified by Law made by Parliament from time to time in so far as the specification pertain to the State of Mizoram. (k) “Secretary” means the Secretary of the Village Council. (l) “State” means the State of Mizoram. (m) “S ta te Election Commis sion” means the Mizor am State Election Commission as cons tituted under clause (1) of Article 243k of the Constitution. (n) “Tikhao” means any place where water supply is obtained. (o) “Tla-awpa” means a Village Crier. (p) “Tla rai or Vatlarai” means a work done collectively by the Villa gers for the common good. (q) “Tohi or Atulyu” means subsidia ry shifting or jhum cultivation. (r ) “Vic e President” mea ns the Vice P resident of the Villa ge Council. (s) “Village Assembly” means a body consisting of persons registered in the electoral roll or r olls relating to a village or villages compr ised within the a rea of the Village Council, which shall also mean ‘Gram Sabha’ for the purpose of P art-IX of the Constitution. (t ) “Village Council” means a Village Council constituted under the provisions of this Act. (u) “Voter” means a person who is entit led to vote at any election to the Mara Autonomous District Council.” Amendment of3. (1) For clauses (a), (b), (c) and (d) of sub-section (2) of section 3 of the Section 3.Principal Act, the following clauses shall be substituted namely:- “(a) for villages with 50 (fifty) houses or mor e; but not more than 100 (one hundred) houses, there shall be 5 (five) members. (b) for villages with more than 100 (one hundr ed) houses; but not more than 160 (one hundred and sixty) hou ses, there shall be 6 (s ix)memb ers. (c ) for villages with more than 160 (one hundred and sixty) houses; but not mor e than 240 (two hundred and forty) houses, there sha ll be 7 (seven) members, and (d) for villages with more than 240 (two hundred and forty) houses, ther e sha ll be 8 (eight) members.” (2) After clause (d) of sub-section (2) of section 3 of the Principal Act, the following clause shall be added, namely:- “ (e) for villages wit h less than 50 (fifty) houses, which have been in existence before the commencement of this Act, there shall be 4 (four) members.” (3) In sub-section (4) of section 3 of the Principal Act, for the words “one third or nearest”, the words “one member” shall be substituted. Amendment of4. (1) In s ub-section (1) of section 8 of the Principal Act – Section 8.(i) between t he word “President” and the words “in each”, the words “a nd a Vice President” shall be inserted. (i) for the word “They”, the words “The Pr esident” shall be substituted. (2) In sub-section (3 ) of section 8 of the Principal Act, for the word “ Every”, the words “ The Vice President or any other” sha ll be substituted. (3) In sub-section (6) of section 8 of the Principal Act, for the words “one of the members appointed by the Executive Committee”, the words “the Vice President” shall be substituted. (4) After sub-section (6) of Section 8 of the Principal Act.- (i) for the bracket and figure “(6)” shall be renumbered as “(7)” and the sub-heading, “Removal of the President”, the words “Removal of the President and Vice President” shall be substituted. (ii) in the second proviso, for the word “Secretary”, the words “Vic e President” shall be substitu ted. (ii) after clause (b), the following clause shall be added, namely:- “(c) The Vice Pr esident may be removed from his office in the same manner a s the President.” Amendment of5. In s ub-section (9) of section 10 of the Principal Act, for the brackets and Section 10.figu res “(1)” and “(2)” sha ll be renumbered a s “(i)” and “ (ii)” r espectively. Amendment of6. In section 14 of the Principal Act, between the words “ The President” and Section 14.the words “of the village”, the words “or in his a bsence, the Vice President” shall be inserted. Amendment of7. In section 22 of the Principal Act , for the word “seat” wherever it appears, Section 22.the word “site” sha ll be s ubstituted. Amendment of8. The figure appearing as “3” after sub-section (2) of section 23 of the Section 23.Principal Act shall be renumbered as “(3)”. Amendment of9. In s ection 24 of the Principal Act, between the word “ President” and the Section 24.words “and a lso”, the words “the Vice President” shall be inser ted. Amendment of the10. In the Principal Act.- Principal Act(i)for the wor d, “Lakher” wherever it appears, the word “Mara” shall be substituted. (ii) for the word, “Administrator” wherever it appears, the word “Governor” shall be substituted.
