Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may , having regard to the circumstances of each case specify; and 2. Whereas, the Commission has considered the circumstances in 08- Algapur Assembly Constituency in Assam, 131-Kalyanpur (SC) Assembly Constituency in Bihar , 271-Chandgad Assembly Constituency in Maharashtra, 08-Chalfilh (ST) Assembly Constituency in Mizoram, 340-Bhatpar Assembly Constituency in Uttar Pradesh, 51- English Bazar , 70-Rejinagar, and 293-Nalhati Birbhum, Assembly Constituencies in W est Bengal and 73- Moga Assembly Constituency in Punjab, and is satisfied that suf ficient number of Electronic Voting Machines are available for taking the poll in the above mentioned Parliamentary Constituencies, the polling personnel are well trained in ef ficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines; 3. Whereas by Notification No.H.11022/ 3/2012- DCA (C) dt.15.10.2012, the Governor of Mizoram was pleased to constitute a Delimitation Committee for the delimitation of MDC Constituencies in the area of Chakma Autonomous District Council. Whereas a draft proposal of the Delimitation Committee ha s been received from the Deputy Commissioner, Lawngtla i District, Lawngtlai who is also the Chairman of the Delimitation Committee vide his No.H.13029/1/2012- EO (LTI) dt.7.12.2012. Whereas the said Committee could not decide the number of new MDC Constituen- cies to be created and thus left for the decision of the Government. The Governor is pleased to decide creation of another 3 (three) new MDC Constituencies by raising the existing 17 (seventeen) MDC Constituencies to 20 (twenty) MDC Constit uencies. Now, therefore, in pursuance of the requirement contained in sub- rule (2) of rule 8 of Chakma Autonomous District Council (Constitution, Conduct of Business etc.) Rules, 2002 as amended from time to time, the Governor of Mizora m is pleased to notify the delimitation/ re-adjustment of MDC Constituencies in the Chakma Autonomous District Council, as enclosed, for information of the general public of the said District and to invite objections, if any, from them within 15 (fifteen) days of issuance of this Notification. This templa te should be shared with the CEO : Geotech and Ministry of Textiles. 2.Techno Economic Viability study :a.To critically analyse the project list generated by the Committee and identify technically feas ible pr ojects for usa ge of geotextiles. b.To determine the suitable geotech products (e.g. geogrids, geocells, geotextiles etc.) to be use in each of the identified projects. - 2 - Ex-8/2013 c.To analyse the economic via bility with cost benefit analysis. d.To coordinate with various user Departments (e.g. PWD, MoRTH, etc.) and ensure that usage of geotextiles is included in DPR and all the tenders floated by such user Departments. 3.Availa bility of Geotech in North Eastern Region :a.To check for the a vailability of requir ed geotech material in NE region, and identify the key suppliers in the region and on a pan India ba sis. b.To ensure adequate and smooth supply chain of Geotextiles material from the manufacturers in NER. 4.Establishment of institutional framework for implementing the projects :a.To ensure smooth coordination and implementation of the identified projects by identifying different stakeholders and assign responsibilities to ea ch of them. b.To develop a mechanism for inter-stakeholder coordination and establishing linkages with various manufacturers, user departments infrastructure consultants, research a gencies etc. L. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLIII Aizawl, Thursday 17.4.2014 Chaitra 27, S.E. 1936, Issue No. 149 NOTIFICATIONNo.B. 11021/11/2010-FST/388-390, the 9th April 2014.Wher eas, pa ra 3.1 (i) of t he Handbook of Forest (Conservation) Act, 1980; Forest Conservation Rules, 2003 and Guidelines & Clarification published by Government of India, Ministry of Environment & Forests clar ifies that compensatory affor estation is one of the most important conditions stipulated by the Central Government while appr oving pr oposals for de-r eservation or diversion of forest land for non-forest uses; Whereas, para 3.4 (i) of the Handbook stipulates t hat equivalent non- forest land identified for compensatory afforestation are to be tr ansferr ed to the ownership of the State For est Department and declared as reser ved/ protected forest, so that the plantation raised can be maint ained permanently; Whereas, Ministry of Environment & Forest vide letter NO.2-1/2003-FC dt.20.10.2003 stipulates that“The non-forest land which is tr ansferr ed and mutated in favour of the State Forest Department for the pur pose of compensa tory afforesta tion should be declar ed as RF /PF under the Indian Forest Act, 1927 prior to Stage-ll approval.” Whereas, the Ministry of Environment & Forests, Government of India vide F.No.8-84/2002-FC dt.3.02.2004 amended para 4.2 (i) of the guidelines issued on 20.10.2003 under Forest (Conservation) Act, 1980 that “the non-forest land which is tra nsferred and mutated in favour of the State Forest Department for the purpose of compensatory afforesta tion, should be decla red as RF/PF under the Indian Forest Act, 1927. The land shall be handed over to the User Agency after the sa me has been mutated in favour of Forest Department. Stage-II clearance shall be given after the land is mutated in favour of the Forest Depa rtment but the Nodal O fficer must report compliance within a period of 6 months and send a cop y of original notification declaring the non-forest land under Section 4 or section 29 of the Indian Forest Act, 1927, as the case may be, to the Central Government for information a nd record.” Whereas, the Sta te Revenue Department has transferred and mutated to State Environment Forest Depa rtment an ar ea of 5 6 ha. of non-forest land located at Lungdai village area in lieu of forest land diverted for construction of 132 KV Tr ansmission Line from Badarpur - Aizawl via Bairabi, Kola sib, Kawnpui and Sihphir vide notification No.L.11011/l/95-REV dt. l6.05.1996 in accordance with the provision of s ection 8(a) of the Mizo Distr ict (La nd & Revenue) Act, 1956 to be treated as Reserved forest under section 2(4) of the Lushai Hills District (House Site) Act, 1953; section 3(a) of the Mizo District (Land & Revenue) Act, 1956 and section 3(a) of the Mizo District (Agr icultur e Land) Act, 1963 and as assigned under sub-p aragraph 2 of the par agraph 3 of the Sixth Schedule to the Constitution of India. No. NE-313(MZ) 2006-2008VOL - XLIV Aizawl, Friday 5.6.2015 Jyaistha 15, S.E. 1937, Issue No. 241 DIRECTIONNo. 576/3/2015/SDR, the 21st May, 2015.Whereas, under Rules 22, 30 and 49B read with Rule 70 of the Conduct of Elections Rules, 1961, the ballot paper to be displayed on the balloting unit of the EVM, ordinary ballot papers, and postal ballot papers shall contain such particulars as the Election Commission may specify ; and 1.Wher eas, in terms of abovementioned Rules, the Commission has specified the particulars to be printed on the ballot paper to be displa yed on the balloting unit and the postal ba llot pa per, and on ba llot papers for elections from Council Constit uencies and at elections by Assembly members; and 2.Wher eas, the Commission ha s noted that there are many ca ses where candidates with same or similar na mes contest fr om the same Constit uency, and alt hough appropr iate suffixes are added to the names of ca ndidates in the event of two or more candidates ha ving sa me name, the Commission considers that additional measures are required for removing confusion in the minds of electors at the time of vot ing, and further, the Commission considers tha t photographs of candidates on ballot paper will fa cilitate the electors in casting their votes and also the ca ndidates in their campa ign: 3.Now, therefor e, after ha ving considered a ll a spects of the matter, the Commis sion, in pa rtia l modification of its existing directions under Rule 22, Rule 30 and Rule 49B read with Rule 70 of the Conduct of E lections Rules 1961, issued f rom time to time, hereby sp ecifies tha t for all elections to be held from 1st May 2015 onwards, the postal ballot papers, the ordinary ballot papers and the ballot papers to be displayed on tha ba lloting unit of EVM sha ll, in addition to the particulars as per the existing directions, also cont ain the photograph of the ca ndidates print ed thereon. The photograph of the ca ndidates shall be printed in t he panel for the name of the candidates and shall appear to the right side of the name in between the name and symbol of the ca ndidate or the column for ma rking vote/preference, as the case may be. The specification for the photograph shall be as follows:- (a ) The candidates are required to submit their recent photograph (taken during the preceding period of 3 months before the date of notification.) (ii) The photograph should be of stamp size 2 cm. X 2.5 cm. (2 cm. in breadth and 2.5 cm. in height) in white/off white backgr ound, with full face view directly facing the camera, neutral facial expression with eyes open. The photo may be in colour or black and white as ma y be convenient for the candidate. - 2 - Ex-241/2015 (iii) Photograph should be in normal clothing. Photogra ph in uniform is not permitted. Caps/hats should be avoided. Dark glasses also are to be avoided. 4. The above direction shall apply in relation to all elections to the House of the P eople, Council of Sta tes, Legislative Assembly and Legislative Council to be held hereafter. FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisory Board will be the Screening Board for placing its recommendation to the government only in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board shall have to judiciously examine the applicant’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants the Board shall have to reject outright. 3.All Board shall have its sittingat least twice in a year or as may be required and TA shall be given to the Members of the Board if the place of sitting is more than 8 (eight) kilometer from the headquarter of the member. The Secretary SAAB shall issue Meeting Notice in consultation with the Chairman by giving at least 10 (ten) days in advance to the member of SAAB. 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (Land Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any category or purpose must be submitted to the Settlement Officer or Assistant Settlement Officer if Chairman of SAAB is the Deputy Commissioner of the District. In case, Chairman of SAAB is SDO (C) or BDO or President, Village Council the application for land allotment of any category must be submitted to the concerned Chairman. 5.The Board shall make initial screening of the application with regard to location of the applied site. After a summary screening, the Board shall place the matter for demarcation of land by Surveyor, Revenue Depar tment in the pr esence of the applica nt, the concerned VC a nd neighbouring land holder, if any. Measurement of land should be accurate and NOC shall be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of Surveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. The recommendation of the meeting of Board shall be submitted to the con- cerned District Revenue Officer for further submission to the Government through the Director, Land Revenue & Settlement, Aizawl Mizoram for decision of the Government. 7.In case, there are more than one applicant for one plot or one area SAAB will make recommendation of such names in order of priority. 8.The SAAB shall have to examine whether allotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to future infrastructure development work of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended from time to time. 9.The term of the Board shall be three years.
