In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment to the post(s) of Soil Conservation Field Worker (SCFW) under Soil & Water Conservation Department, Government of Mizor am, namely :- 1.Shor t Title and (1) These Rules may be called the Mizoram Soil & Water Conservation Commencement Department (Group ‘C’ posts) Recruitment Rules, 2013. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application These rules shall apply to the posts specified in Column 1 of the Annexure-1 annexed to these rules. 3. Number of posts, The number of the said post(s), their classification, Pay Band and Grade classification, pa y ba nd Pay/pay scale attached thereto sha ll be a s specified in columns 2 to and grade pa y/pay scale 4 of the said Annexure-I. 4. Method of r ecruitment, The method of recruitment, age limit, qualification and other matters age limit, relating to the said post(s) shall be as specified in columns 5 to 14 of qualifications, etc- the aforesaid Annexure-I. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram from time to time. 5. Disqualification No person- (a ) who has entered int o or contracted a marr iage with a person having a spouse living; or - 2 - Ex-399/2013 (b) who, having a spouse living, ha s entered into or contracted a marriage with any other person, shall be eligible for appointment to t he said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any such person from the operation of this r ule. 6.Training and Departmental Every Gover nment s ervant recruited under these rules s hall undergo Examination. such training or pass such Departmental Exa mination as may be pres cribed from time to t ime. 7. Powers to trans fer Notwithstanding anything contained in these rules, the Governor of Mizora m, in public interest, shall ha ve the r ight a nd power to transfer any officer so recruited under these rules to any other post or p osition which is equivalent in rank or grade. 8. Power to relax Where the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing and in consultation with the Department of Personnel & Administrative Refor ms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and other Nothing in these rules shall affect reser vation, relaxation of age concessions limit and ot her concessions requir ed to be provided for the Scheduled Castes/the Schedu led Tribes and ot her ca tegor ies of persons in accordance with the orders issued by the Central Government or the Government of Mizora m from time to time in this regard. 10. Repeal and Savings - All rules pertaining to these posts fra med by the Gover nment of Mizoram under Notification No. SC. 42/75/12-15 dt. 29.8.1975 published in the Mizoram Gazette Issue No. 35 dt. 29.8.1985 stand hereby repealed. Lalhmunmawia, Inspector of Excise & Narcotics Department on 1.8.2013 at 4:30 AM. Pu C. Lalhmunmawia, Inspector of Excise & Narcotics was born on 30.12.1978 and entered into Government Service as Inspector of Excise & Narcotics on 10.01.2008. After successfully co mplet ing Basic Training at Aizawl he was po st ed at Mamit when office o f the Superintendent of Excise & Narcotics was opened in August 2008. He joined at Mamit on 21st August 2008 and had been serving there till his demise. He ser ved t he Go ver nment o f Mizo ram wit h utmo st sincer ity, enthusiasm and devot ion, proving himself an efficient and hard working officer. The Government of Mizoram places on record its deep appreciation of the sincere services rendered by Pu C. Lalhmunmawia and conveys its heartfelt sympathy to the bereaved family. H.L. Short title, extent and commencement (1) These regula tions may be called the Aizawl Municipal Council Display of Advertisements and Hoardings Regulations, 2013. (2) They shall apply to all the areas covered by the Aizawl Municipal Council. (3) They shall come into force on the date of their publication in the Official Gazette. 2 . Application (1) These Regulations shall be applicable to all advertisements within the Aizawl Municipal Council area, whether on – Land, Building, Wall, Hoarding, Frame, Post, Kiosk, a ny structure, or by any other means wha tsoever by which it is open to public view in any manner, visible fr om a public street or public place, whether moving or non-moving, (including any a dvertisement exhibited by means of cinematography). (2) These Regula tions s hall apply in general to Balloons, Banners, Direction Boards, Foot over- bridges, Gantries, sub-ways, illuminated and Non-illuminated Hoardings (including Neon signs, electronic sign boa rds, Video Display boa rds or any kind of signs.), Mobile Va ns, Passage Shelters, P osters, Signs, Tempor ary Arches, and any other means of display of advertisements. (3) However, these Regulations shall not apply to advertisements – (a) Published in newspapers. (b) Broadcast on radio or television. (c) Relating to a public meeting or to an election to the Parliament or the State Legislature or the Council or to candidature in respect of such elect ion. (d) Exhibited within the window of any building, if the advertisement relates to the tr ade, profession or business ca rried on in that building ( e) Relating to the tra de, profession or business ca rried on within the la nd or building upon or over which such advertisement is exhibited or to any sale or letting of s uch land or building or any effects therein or to any sale, entertainment or meeting to be held on or upon or in the same. (f) Relating to the name of the land or building upon or which the advertisement is exhibited or to the name of the owner or occupied of such land or building. The Boards of Councillors shall ha ve the r ight to review, amend, relax, waive or modify any of the above conditions or r estrictions. 3 . Definitions.- (1) In t hese regula tions, unles s the context other wis e requir es,— (a) “Act” means the Mizoram Municipalities Act, 2007(Act No.6 of 2007); (b) “Advertisement” means any word, model, sign, sky-sign, placar d, notice, device, audio, video, flex board or representation, whether illuminated or not in the nature of and deployed wholly or in part for the pur poses of advertising, announcement or publicity; (c ) “Agency” means an a pplicant who ma y be an individual, registered charitable or ganization, firm, partnership or a company incorporated under the Companies Act 1956; (d) “Annexures” mean prescribed forms appended in the regulations for carrying out these regulations ( e) “Boa rd of Councillors” mea ns Board of Councillor s of the Aizawl Municipal Council. (f) “Cha irman” means Chairman of the Aizawl Municipal Council (g) “Council” means the Aizawl Municip al Council constituted under the provisions of the Act.- 2 - Ex-404/2013 (h) “For m” means a for m appended to these r egulations. (i) “Hoa rding” means any surfa ce of structure erected on ground or any por tion of a roof of a building or on or a bove the parapet, with charact er, letters or illustr ations applied thereto and displayed in any manner whatsoever, out of doors, for purpose of advertising or to give information with a view to attract the public to any place, persons, public performance articles of merchandise wha tsoever. (j) “Schedule” means schedule or schedules a ppended in these regulations where va rious types of a dvertisements or hoar dings and their charges are made. (k) “Sign” means any writing (including letter, word or numeral); pictorial representation (including illustration or decoration); emblem (including device, symbol or tr ademark); flag (including banner or pennant); poster or any other figure of simila r chara cter; which: (i) is a structure or a ny part thereof, or is attached to, painted on, or in any other ma nner repr esented on a building or other str ucture; and (ii) is used to announce, direct attention to, or advertise; and (iii) is on, over or in view of a public p lace. But for the purposes of these condit ions does not inclu de: (a ) traffic or regulatory devices, legal notices, or warnings at railway crossings; (b) signs required to be maint ained by law or government or der or regulation; (c ) memor ial signs or tablets (d) any other signs as excluded by t he Chairman (2) Words and expressions used but not defined shall have the meaning as assigned to them in the Act a nd Regula tions 4 . P ermis sion of Cha irma n for display of advertisement s For erection, exhibition, fixation or retention upon or over a ny land, building, wall, hoarding, fr ame, post, kiosk or str ucture any advertisement, or display any advertisement to public view in any ma nner whatsoever, visible from a public street or public place (including any advertisement exhibited by means of cinematogr aphy), in any place wit hin Aizawl (as defined in the Act) wr itten permission of the Chairman is required. The Chairman shall not grant such permission if – (1) a license for the use of the particular site for purpose of advertisement has not been issued; or, (2) the advertisement contravenes any provisions of the Act or these Regulations; or, (3) the tax, if any, due in r espect of the advertisement has not been paid; The Chair man may not appr ove a sign or hoarding which he considers to be offensive, or when he is of the opinion that the type, position, size, appear ance, illumina tion, a nimation, cont ent, or other charact eristics of the sign or hoarding may adversely affect: (a ) the ambience of the area; or, (b) the architectural character or appearance of the building, streetscape or pr ecinct; or, (c) traffic safety 5 . Places for display of advertisements The Chairman ma y allow display of a dvertisements on any land, building, wall, hoarding, frame, post, kiosk, structure or in any manner whatsoever for public view, visible from a public street or public place, in any place within municipal area, in accordance with P art X of Signs and Outdoor Display Structures of the National Building Code of India 2005 provided that the Regulations are complied with. 6 . Prohibition of Advertisement in certain places or areas No advertisements sha ll be a llowed in the following places except allowed by the Chair man by Notification on an exceptional cases – (1) buildings of archaeological, architectural, aesthetical, historical or heritage importa nce; (2) places of worship or religious significa nce; (3) statues, minarets or pillars of heritage importance;- 3 -Ex-404/2013 (4) police stations, post offices, any government or municipa l council building/ office; (5) traffic points 7 . Prohibition of display of offensive or indecent or obscene advertisements The following natur e of Advertisements or Hoardings having offensive themes/ messages shall not be allowed:- (1) Nudit y or obscenity (2) Defa matory towards any ca ste, colour, creed, religion, nation, community, r ace or institution (3) Advertisement of dr ugs, alcohol, cigarette or any other tobacco items the advertisement of which are for the time being prohibited under any law (4) Advertisements propagating exploitation of women or child (5) Advertisement depicting cruelty to animals (6) Advertisement casting aspersion on any brand or person or trade (7) Adver tisement glorifying violence (8) Advertisement of Weapons and related items (such as firearms, firearm parts and magazines, ammunition etc.) (9) Advertisements which may be defa matory, trade libelous, unla wfully threatening or unlawfully hara ssing s tructur e of an Advertising Device (10) Advertisements which may be obscene or contain pornography or contain an “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986 (11) Advertisement linked directly or indirectly to or include descr iption of items, goods or services that are pr ohibited under any applicable law for the time being in force 8. Structures and Impediments Erections, exhibitions, fixation, retention or display or cause to be erected, exhibited, fixed, retained or displayed any advertisement shall not be allowed which: (1) Obstructs the clear vision of any traffic signal. (2) Blocks the passage, entrance or cause inconvenience of access to any building (both entry & exit) (3) Blocks the passage of light or circulation of a ir/ ventilation to any building. (4) Blocks any door, window, verandah or any s uch opening in any building (5) Blocks, conceals or inconvenience the public view of the architectural featur es of any building. (6) Blocks, conceals or inconvenience the public view of t he front of any shop or establishment in a direct or indirect manner so tha t the business behind is affected. (7) Materially obstruct s/ cover s the vision of the river, gr eenery, landsca ping or large s ize trees in the adjoining areas. The word ‘ma terially’ is important and each case will have to be examined on its own merits. The Cha irman’s decision would be final in this resp ect. (8) Dama ge, cut or otherwise harm any tree (9) The exposed part of the structure visible from the road from any angle should be aesthetically covered. (10) Block any space on any street/lane/bylane/pavement in any manner that disturbs the movement of t he traffic or pedestrians. 9 . Display of advertisement at traffic junctions (1) No illumination sign in red, orange or green colors shall be erected or maintained within a horizontal distance of 32 feet of any illuminated traffic sign. All advertising signs illuminated by a light other than a white light at a height of less t han two stories or 20 feet a bove the footpath, whichever be the gr eater height, shall be so displayed that it does not interfere with any sign or signal or control booth/equipment. (2) Signs using ‘flickering lights’ in any form shall not be allowed at traffic junctions or at any pla ce where it inter feres with the effectiveness of a traffic control device.- 4 - Ex-404/2013 “Definition” : The term ‘flickering lights’ does not cover normal illumination of hoardings or use of neon signs but, refers to fast cha nging colour lights or a series of bulbs tha t switch on and off. 10 . S ize of Hoar dings (1) The size of hoardings or a dvertisement on streets, footpath or ground, sha ll be pr oportionate to the general average width of the abutting r oad. (2) In case of hoarding on building or roof, the size of hoarding shall be as p er actual site condit ion. (3) Back to back hoardings shall be permit ted. (4) The angles or degrees of the hoa rding a long with the road line shall be fixed as per visibility demands. (5) Advertising Devices (especially placed close to parks and gar dens) s hall in no case be higher than the pr evailing tree canopy line of t he city unless allowed by the Chairman. T he advertising device should be located such that the tr imming of vegetation will be unnecessary. Structural design / erection of the hoarding (1) The hoarding irrespective of the size should be erected on steel fra mes. (2) Single pole kiosk would be preferred in. (3) The design/erection of the hoarding shall be aesthetically designed and strictly as per the structural plan approved by a licensed/r egistered Engineer/Structura l Engineer of the Council. For structur ally unstable hoardings which were in existence before implementation of t hese regulations, the agency or person owning such hoardings shall be advised to seek the views of the Council licensed/registered Engineer/Structur al Engineer. (4) Hoardings shall be allowed to be erected on a building only if it has been examined for structural stability a nd also the bu ilding has been examined on whether it can withsta nd the pressur e of the hoarding, and a certificate to that effect is produced from the Council licensed/registered Engineer/ S tructur al Engineer (5) The hoarding shall be in alignment, as far as possible, with any other approved hoarding previously erected nearby. (6) The renewal of the permission is subject to submission of str uctural stability certificate and building structural stability certificate, every year, from the licensed/registered Engineer/Structural Engineer. 12 . Height r estrictions on hoa r dings (1) When erected on gr ound, the ground clearance should be at least 8 feet and not greater than 30 feet. (2) When erected on a top of a building, the ground clearance should be a t least 8 feet. The top of the hoarding shall not be more tha n 20 feet from the terrace level. (3) When erected on wa ll/sides of a building the Chairman may fix as per convenience of the site.- 5 -Ex-404/2013 13. Minimum distance between two hoardings (1) The minimum distance between two hoardings on the same side of the road/alignment shall be maintained in such a way that the proposed hoarding will not obstruct the view of existing permitted hoar ding. (2) If a new hoarding is proposed near an existing hoarding, the decision of the Chairman shall be fina l is this respect. 14. Alignment of hoardings (1) As far as possible, uniformity of size of the hoarding and a lignment thereof in a particular loca lity/ r oad sha ll be maintained. (2) Agency or persons shall r ealign, readjust, or shift the hoardings whenever called upon by the Chairman to do so a t his own cost without claiming any compensation. 15. Projection of hoardings (1) Hoar ding str ucture on the terrace of a built up structure/ building shall not be allowed to project, in the interest of public safety, beyond the bu ilding line. (2) No new hoarding/ structure may be allowed to traverse the footpa th or a road diagonally and the convenience of the pedestria ns will supersede. 16. Display of hoardings and Advertisements An Identification number for each and every hoarding or advertisement shall be issued by the Chairman. The same should be displa yed on the top right hand c o r n e r o f e a c h h o a r di n g . I n c a s e o f no n - compliance, the Cha irman ma y demolish the hoarding by ca tegorizing it a s an una uthorized hoarding. 17 . Illumina tion of hoar dings (1) The level of luminance should not exceed a sour ce limit of 1 cd/cm2 with an operational limit of not more than 8 hours in a day (24 hours) (2) The illuminated hoardings may preferably be solar powered. (3) The illuminated hoardings in residential premises should not be blinking. 18. Special cases (1) In case of hoarding in the vicinity of a flyover, reta ining wall, fencing etc the Chairman may rela x the height r estrict ions a s the case may be. (2) The request for clubbing of the hoardings shall be considered only if the resultant single hoarding is in conformity with the standar d sizes and subject to payment of pr escribed fee as decided by the Chairman. 19. Special provisions for display of advertisements on bus stops Advertisement signs are allowed at bus stops pr ovided that they are fully integrated into the overall design of the bus shelter. This is to ensure a visua lly neat and tidy streetsca pe and to ma inta in unobstructed and sa fe pedestrian movement. Advertising a t the bu s stops will be allowed subject to the following conditions:- (1) Advertisements have to be part of the structur e and cannot be suspended or be an addition to the primary structure. (2) In case of illumina ted panels, internally-illuminated advertising panels will be preferred. (3) The Chairman may is sue sepa rate or ders/schemes of advertisement for design and installa tion of bus shelters. 20 . Specia l provisions for displa y of advertisement s on flyover and bridges Advertisements on bridges will be subject to the following restrictions, apart from the general provisions as a pplicable to other advertisements:- 6 - Ex-404/2013 (1) The ground clearance of t he advertisement shall be at least equal to the ground clearance of the br idge. (2) The maximum height of the advertisement s hall not exceed the height of the par apet of the bridge. 21. Special norms for display of advertisement on business or market premises The advertisement, such a s illuminated glow sign boxes and illumina ted/neon sign name boards on the business or market premises shall be permitted/regularized. These advertisements should confor m to the following conditions: (1) Notwithstanding any permission given for such erection, any such sign which after erection is, in t he opinion of C hairman, of such intense illumination so as to disturb occupants of the adja cent or nearby buildings shall, on the order of Cha irman, be suit ably altered or removed by the owner of the site concerned within such reasonable period as the Chairman may specify. (2) No ground s ign shall be erected so as to obstruct the free access to or exit from any building. (3) No part of the advertisement or its support str ucture shall project beyond the building on its sides. It shall also not project beyond the plot boundary. 22 . Special norms for displa y of advertisement s by floating balloons Permission for illuminated or non-illuminated advertisement by means of floating balloons can be granted subject to complia nce of conditions mentioned below: (1) The agency or person shall displa y the balloon in such a manner that it does not int erfere with or obstruct other displays of advertisements. The agency shall make necessary arrangements for monitoring the movement of the balloon during its display. (2) The agency or person shall produce No Objection Certifcate (NOC) from the Ministry of C ivil Avia tion, Government of India or Civil Aviation Depar tment, Government of Mizoram and shall observe all their rules and regulations. (3) The agency or persons sha ll be liable to pay da mages for any accident or any injur y which may be caused to any property or person by r eason of keeping the said ba lloon or the ma terial, gas or a ny device used in resp ect thereof or by reason of t he fall or otherwise of the said balloon or a ny part thereof due to storm, faulty operation, negligence, accident or any other cause whatsoever. 23.Special provisions for display of advertisements by Government Departments/public sector/a utonomous authorities If any Department whether belonging to the Central or State Government or Public Sector or Autonomous Authorities proposes to display any advertisement in their property, building, road reserve or installa tion etc. belonging to them, such department or authority shall seek the permission of the Council failing which the advertisements shall be removed without prior notice by the Chair man. 24. Special Provision for display of advertisement on vehicles Display of non-illuminated advertisements will only be allowed on each or all sides of vehicles to the following vehicles provided that a dvertisements should not obstr uct the clear visibility of driver or the passengers. Application for advertisement on vehicle need not structure designs and structural soundness certificates. ( a ) Taxis (b) School Buses and private buses (c ) City Buses (d) Pick Up/TATA 207/Boleros/Sumos/S avaris and any similar vehicles (e) Trucks/TATA 407/709 and any similar vehicles (f) Two Wheeler s/Thr ee Wheelers if any.- 7 -Ex-404/2013 Any advertising devices shall not interfere in any way with the mandatory vehicle signs, such as purp ose of the ser vice, number p la te, etc., 25 . Procedure for grant of permission for erection, exhibition, fixation, retention or display of a dvertisement s (1) Every person desiring to erect, exhibit, fix and display an advertisement shall a pply to the Chairman for permission in the For m A ava ilable in the Council Office against payment of fees of Rs. 50. The said a pplication for m duly filled in all r espects shall be submitted by the applicant in the Council Office, a gainst a proper receipt. The Chairma n may, a fter making such inspection as may be necessar y and sa tisfied of the land status and within thirty days after the receipt of the a pplication, gra nt /refuse / renew or cancel t he permission, as the case may be, in accorda nce wit h the provisions of Act, and the Regulations made thereunder. (2) Along with the application form, the following documents are required to be submitted – (a ) NOC/ allotment letter from the owner of la nd/ property and an agreement between the owner (s) of the building and the applicant. (b) Structural Stabilit y certificate of the hoarding and building (if) from a licence/registerd Structural Engineer/Engineer. (except a dvertisement on vehicles) (c ) Engineering drawing of the proposed str ucture in triplicate drawing duly signed by the Structural Engineer/Engineer. (except a dvertisement on vehicles) (d) Two copies of 6"x4" size Photograph taken from a distance of the proposed site with marking of the pr oposed hoarding ther eon. ( e) NOC from Local Council (f) EPIC or any other valid documents (g) Tribal Certificate (3) The Chairman may disapprove an advertisement among others, on the ground that, its cont ents or the manner of its display is unsuitable from the considerations of public safety, traffic hazards or a esthetic design, or otherwise offensive and in bad taste and offensive to public sentiments. (4)Validity: Every license shall be for a period of one year except in the ca se of a dvertisement on vehicles and sites used for temporary congregations including fairs, festivals, circus, exhibitions, sports events or cultural or social programmes. (5) If a ny tax on advertisements is not paid within the stipulated time after the demand notice, the same shall be recovered as arrears of tax and the permission granted shall be deemed to have been termina ted. The Chair man shall be at liberty to remove such hoardings. (6) The Chairman shall cause to mainta in a register showing the permission issued under the Act and the Regulations. 26. Removal of unauthorized Advertisements or Hoardings If a ny advertisement is erected, exhibited, fixed or retained on any land and building unauthorized and in contravention to the provisions of the Act , and the Regulations made thereunder, such advertisement or hoarding shall be removed by t he concerned advertiser/exhibitor at their own cos t failing which the Chairman, may with or without any notice may remove the structure and the expenses shall be recovered fr om the concern advertiser or exhibitor as may be decided by the Chairman from time to time. The advertiser or exhibitor shall not have the r ight to claim the removed st ructures/materials which shall automa tically be the property of the Council 27 . Tax to be paid in a dvance (1) The Tax on each advertisement shall be payable in adva nce as per the charges specified in the schedule to these r egulations. (2) All dues s hall be payable in cash.- 8 - Ex-404/2013 28 . Lic ensed or register ed a dvertisers: (1) Any individual or firm except licensed or registered advertisers or agencies shall not be allowed to undertake displa y of advertisements on behalf of other persons or agencies, but shall enroll themselves as licensed or registered advertisers with the Council by furnishing the required information, documents, security as may be determined by Chairma n and shall pay the license fee or registration fee and security deposit as may be determined by the Chairman from time to t ime. (2) Persons intending to entrust the work of displaying advertisement on their behalf shall not entr ust it to any unlicensed or unregistered advertiser. (3) A licensed or registered advertiser shall before displa ying or causing the display of a dvertisements, satisfy himself that, the tax due thereon has been paid to the Council and the Chairman’s approva l obtained thereof. (4) A licensed or registered a dvertiser shall mainta in proper record of a dvertisements displayed by him and produce the same whenever required for inspection by the Cha irman or any other officer authorized by the Chair man. 29. Post-approval (1) Within 2 da ys of erection of the hoarding, the a gency shall submit to the Council a certificate from a Structural Engineer/Engineer cer tifying that t he hoar ding has been constructed as per the specifications and engineering drawings. (2) Within 7 da ys of r eceipt of such certificate fr om the applica nt, the Council shall underta ke a field visit to the approved hoarding and check for inconsistencies or deviations. (3) In case deviations are fou nd, the agency shall be given a notice period upto 15 days to rectify the same, except in cases wher e immediat e action may b e required. (4) After the lapse of 15 days notice, if deviations are still found, the Council shall get the hoardings and the structures demolished. The processing fees and all charges shall be for feited a nd a suitable penalty may be imposed as decided by the Chairman from time to time. 30. Regularization of existing hoardings and advertisements All existing hoardings within the area of the Council shall be regula rized as per the Regulations made thereu nder. (1) In case it is required, then such hoa rdings may be re-aligned, re-adjusted, shifted or permanently removed a s the ca se may be. (2) Efforts may also be taken to maint ain uniformity of size of hoar dings on a particular r oad. (3) The Council or the agency on advice from the Council shall complete such regulariza tion within 6 months of issuance of these R egulations. (4) In case the agency fails to regula rize the hoarding within a time-period of 6 months, the Council may decide to demolish the hoarding. 31. New hoardings on the Council land or properties The Chairma n may permit the use of its land/pr operties for display of advertisements. Land/ property is a llotted to agency for display. (1) The Council shall henceforth, from time to time, identify locations on the Council property where it will allow new hoar dings to be erected. (2) After such identification, it sha ll put such locations on auct ion thr ough an open advertisement or limited advertisement (3) When auctions are not feasible, competit ive tenders may also be invited. (4) The selected agency shall be issued an allotment letter for use of the Council property/land for the purpose of advertisements. On receiving the allotment letter, the agency shall a pply to the Council for displa y of a dvertisement under the usual procedure.- 9 -Ex-404/2013 (5) The Chairma n may permit the display of advertisement to any a gency for a maximum period of 1 year on payment of land utilization charges and advertisement fees as fixed by the Chairman and on such terms a nd condit ions as deemed fit, pr ovided such advertisement fulfills the Regulations made thereunder. (6) Upon expiry of the period of the allotment letter, display of a dvertisement on the sa id site may be allowed by auctioning or by renewal or by inviting competitive tenders. 32. Duties and responsibilities of the licensed holder agency (1) The license holder shall ensure that the structure and the advertisement boar d are a esthetically designed and properly maintained at all t ime. (2) The license holder will ensure to have a valid license at all times, as laid down by these regulations. (3) It will be mandator y on the part of the a gency to display, at their cost, a civic message or any other messa ge as a nd when directed by t he Council for a period of fifteen days in a year for which no fees will be char ged. (4) The permission can be transferred with the prior permission of the Chairman and on payment of transfer fees as prescribed by the Chairman from time to time and subject to the following: (a ) In case of legal t ransfer, legal documents to prove the legal succession st atus of the transferee. (b) In case of transfer through sale, sa le document. (c ) Affidavit indemnifying the Council from a ll other claima nts. 33. Renewal Renewal of conditions of permission. (1) An application for renewal/extension of permission sha ll inva riably be made before the expiry of the period of existing permission at p ayment of Rs. 20/-. (2) Any applica tion for renewal/extension of permission s ubmitted after the expiry of the period for which permission was previously gra nted sha ll be a ccompanied by a late fee of Rs.10/- for each day of delay. The permission shall be deemed to be in force during the pendency of the disposal of the renewal application. (3) Wher e the Chairman is of the opinion that the proposed or existing site for any advertisement is not suitable in the interest of public safety, traffic hazards or aesthetics, he may reduce the number of advertisement in a particular location to avoid visua l pollution or refuse to grant any new permission or renew a ny existing permission. 34. Penalty (1) Whoever cont ravenes any of the provisions of the these regulations and t erms and condit ions on the subject or fails to comply with the order of dir ection lawfully given shall be punishable with a fine which may extend to Rs.500 and if contravention continues, a sum of R s.50 ma y be imposed for continuing offences daily or punishment with fine to be imposed by the Executive Council as per provisions of section 249 and 386 of the Act as the case ,may be. (2) Any other action including blacklisting of the defaulting agency or advertiser may also be decided by t he Chair man. 35 . Regu la tions to be availa ble for inspection a nd purcha se (1) A copy of t hese regulations shall be kept at the Council Office and du ring office hou rs shall be open free of charge for inspection by any individuals (2) The copies of the regulations shall be kept at the Council Office for sale to the public at the cost to be decided by the Chair man.- 10 - Ex-404/2013 36. Dispute and Miscellaneous Provision Any dispute arising out of erection, re-erection, exhib ition, construction and display of advertisement and hoardings shall be decided by the Council in conformity with the Act and Regulations made thereu nder. Further, all advertisement should be displayed in a proper manner taking all precautions aga inst electrocution / accidents and the Council shall not be resp onsible for a ny negligence, injury or casualty on a ny account whatsoever. The owner of the advertisement/hoar ding or owner of vehicle shall be bound to indemnify and reimburse the Council for all claims, demands, loss, charges, cost and expenses which it may have to incur or which accrue on account of infringement of any of sections and sub- sections of the Regulations. 37. Rep eal Guidelines for Advertisement, Hoarding/Signboa rd within the Town issued under Memo No.LAD-1/ 89 dated 19th Sept 1990 a nd practices followed in the past in this respect a re hereby repea led. Notwithstanding such repeal anything done or any action taken under the said guidelines and pr act ices shall be deemed to have been done or ta ken under the corr esp onding pr ovision of t he regulations. THE AIZAWL MUNICIPAL COUNCIL DISPLAY OF ADVERTISEMENTS AND ROARDINGS REGULATIONS, 2013 In exercise of the powers conferred by Section 371, of the Mizoram Municipalities Act, 2007 (Act No. 6 of 2007), the Aizawl Municip al Council do hereby makes the following regulations, namely :— 1 . Short title, extent and commencement (1) These regula tions may be called the Aizawl Municipal Council Display of Advertisements and Hoardings Regulations, 2013. (2) They shall apply to all the areas covered by the Aizawl Municipal Council. (3) They shall come into force on the date of their publication in the Official Gazette. 2 . Application (1) These Regulations shall be applicable to all advertisements within the Aizawl Municipal Council area, whether on – Land, Building, Wall, Hoarding, Frame, Post, Kiosk, a ny structure, or by any other means wha tsoever by which it is open to public view in any manner, visible fr om a public street or public place, whether moving or non-moving, (including any a dvertisement exhibited by means of cinematography). (2) These Regula tions s hall apply in general to Balloons, Banners, Direction Boards, Foot over- bridges, Gantries, sub-ways, illuminated and Non-illuminated Hoardings (including Neon signs, electronic sign boa rds, Video Display boa rds or any kind of signs.), Mobile Va ns, Passage Shelters, P osters, Signs, Tempor ary Arches, and any other means of display of advertisements. (3) However, these Regulations shall not apply to advertisements – (a) Published in newspapers. (b) Broadcast on radio or television. (c) Relating to a public meeting or to an election to the Parliament or the State Legislature or the Council or to candidature in respect of such elect ion. (d) Exhibited within the window of any building, if the advertisement relates to the tr ade, profession or business ca rried on in that building ( e) Relating to the tra de, profession or business ca rried on within the la nd or building upon or over which such advertisement is exhibited or to any sale or letting of s uch land or building or any effects therein or to any sale, entertainment or meeting to be held on or upon or in the same. (f) Relating to the name of the land or building upon or which the advertisement is exhibited or to the name of the owner or occupied of such land or building. The Boards of Councillors shall ha ve the r ight to review, amend, relax, waive or modify any of the above conditions or r estrictions. 3 . Definitions.- (1) In t hese regula tions, unles s the context other wis e requir es,— (a) “Act” means the Mizoram Municipalities Act, 2007(Act No.6 of 2007); (b) “Advertisement” means any word, model, sign, sky-sign, placar d, notice, device, audio, video, flex board or representation, whether illuminated or not in the nature of and deployed wholly or in part for the pur poses of advertising, announcement or publicity; (c ) “Agency” means an a pplicant who ma y be an individual, registered charitable or ganization, firm, partnership or a company incorporated under the Companies Act 1956; (d) “Annexures” mean prescribed forms appended in the regulations for carrying out these regulations ( e) “Boa rd of Councillors” mea ns Board of Councillor s of the Aizawl Municipal Council. (f) “Cha irman” means Chairman of the Aizawl Municipal Council (g) “Council” means the Aizawl Municip al Council constituted under the provisions of the Act.- 2 - Ex-404/2013 (h) “For m” means a for m appended to these r egulations. (i) “Hoa rding” means any surfa ce of structure erected on ground or any por tion of a roof of a building or on or a bove the parapet, with charact er, letters or illustr ations applied thereto and displayed in any manner whatsoever, out of doors, for purpose of advertising or to give information with a view to attract the public to any place, persons, public performance articles of merchandise wha tsoever. (j) “Schedule” means schedule or schedules a ppended in these regulations where va rious types of a dvertisements or hoar dings and their charges are made. (k) “Sign” means any writing (including letter, word or numeral); pictorial representation (including illustration or decoration); emblem (including device, symbol or tr ademark); flag (including banner or pennant); poster or any other figure of simila r chara cter; which: (i) is a structure or a ny part thereof, or is attached to, painted on, or in any other ma nner repr esented on a building or other str ucture; and (ii) is used to announce, direct attention to, or advertise; and (iii) is on, over or in view of a public p lace. But for the purposes of these condit ions does not inclu de: (a ) traffic or regulatory devices, legal notices, or warnings at railway crossings; (b) signs required to be maint ained by law or government or der or regulation; (c ) memor ial signs or tablets (d) any other signs as excluded by t he Chairman (2) Words and expressions used but not defined shall have the meaning as assigned to them in the Act a nd Regula tions 4 . P ermis sion of Cha irma n for display of advertisement s For erection, exhibition, fixation or retention upon or over a ny land, building, wall, hoarding, fr ame, post, kiosk or str ucture any advertisement, or display any advertisement to public view in any ma nner whatsoever, visible from a public street or public place (including any advertisement exhibited by means of cinematogr aphy), in any place wit hin Aizawl (as defined in the Act) wr itten permission of the Chairman is required. The Chairman shall not grant such permission if – (1) a license for the use of the particular site for purpose of advertisement has not been issued; or, (2) the advertisement contravenes any provisions of the Act or these Regulations; or, (3) the tax, if any, due in r espect of the advertisement has not been paid; The Chair man may not appr ove a sign or hoarding which he considers to be offensive, or when he is of the opinion that the type, position, size, appear ance, illumina tion, a nimation, cont ent, or other charact eristics of the sign or hoarding may adversely affect: (a ) the ambience of the area; or, (b) the architectural character or appearance of the building, streetscape or pr ecinct; or, (c) traffic safety 5 . Places for display of advertisements The Chairman ma y allow display of a dvertisements on any land, building, wall, hoarding, frame, post, kiosk, structure or in any manner whatsoever for public view, visible from a public street or public place, in any place within municipal area, in accordance with P art X of Signs and Outdoor Display Structures of the National Building Code of India 2005 provided that the Regulations are complied with. 6 . Prohibition of Advertisement in certain places or areas No advertisements sha ll be a llowed in the following places except allowed by the Chair man by Notification on an exceptional cases – (1) buildings of archaeological, architectural, aesthetical, historical or heritage importa nce; (2) places of worship or religious significa nce; (3) statues, minarets or pillars of heritage importance;- 3 -Ex-404/2013 (4) police stations, post offices, any government or municipa l council building/ office; (5) traffic points 7 . Prohibition of display of offensive or indecent or obscene advertisements The following natur e of Advertisements or Hoardings having offensive themes/ messages shall not be allowed:- (1) Nudit y or obscenity (2) Defa matory towards any ca ste, colour, creed, religion, nation, community, r ace or institution (3) Advertisement of dr ugs, alcohol, cigarette or any other tobacco items the advertisement of which are for the time being prohibited under any law (4) Advertisements propagating exploitation of women or child (5) Advertisement depicting cruelty to animals (6) Advertisement casting aspersion on any brand or person or trade (7) Adver tisement glorifying violence (8) Advertisement of Weapons and related items (such as firearms, firearm parts and magazines, ammunition etc.) (9) Advertisements which may be defa matory, trade libelous, unla wfully threatening or unlawfully hara ssing s tructur e of an Advertising Device (10) Advertisements which may be obscene or contain pornography or contain an “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986 (11) Advertisement linked directly or indirectly to or include descr iption of items, goods or services that are pr ohibited under any applicable law for the time being in force 8. Structures and Impediments Erections, exhibitions, fixation, retention or display or cause to be erected, exhibited, fixed, retained or displayed any advertisement shall not be allowed which: (1) Obstructs the clear vision of any traffic signal. (2) Blocks the passage, entrance or cause inconvenience of access to any building (both entry & exit) (3) Blocks the passage of light or circulation of a ir/ ventilation to any building. (4) Blocks any door, window, verandah or any s uch opening in any building (5) Blocks, conceals or inconvenience the public view of the architectural featur es of any building. (6) Blocks, conceals or inconvenience the public view of t he front of any shop or establishment in a direct or indirect manner so tha t the business behind is affected. (7) Materially obstruct s/ cover s the vision of the river, gr eenery, landsca ping or large s ize trees in the adjoining areas. The word ‘ma terially’ is important and each case will have to be examined on its own merits. The Cha irman’s decision would be final in this resp ect. (8) Dama ge, cut or otherwise harm any tree (9) The exposed part of the structure visible from the road from any angle should be aesthetically covered. (10) Block any space on any street/lane/bylane/pavement in any manner that disturbs the movement of t he traffic or pedestrians. 9 . Display of advertisement at traffic junctions (1) No illumination sign in red, orange or green colors shall be erected or maintained within a horizontal distance of 32 feet of any illuminated traffic sign. All advertising signs illuminated by a light other than a white light at a height of less t han two stories or 20 feet a bove the footpath, whichever be the gr eater height, shall be so displayed that it does not interfere with any sign or signal or control booth/equipment. (2) Signs using ‘flickering lights’ in any form shall not be allowed at traffic junctions or at any pla ce where it inter feres with the effectiveness of a traffic control device.- 4 - Ex-404/2013 “Definition” : The term ‘flickering lights’ does not cover normal illumination of hoardings or use of neon signs but, refers to fast cha nging colour lights or a series of bulbs tha t switch on and off. 10 . S ize of Hoar dings (1) The size of hoardings or a dvertisement on streets, footpath or ground, sha ll be pr oportionate to the general average width of the abutting r oad. (2) In case of hoarding on building or roof, the size of hoarding shall be as p er actual site condit ion. (3) Back to back hoardings shall be permit ted. (4) The angles or degrees of the hoa rding a long with the road line shall be fixed as per visibility demands. (5) Advertising Devices (especially placed close to parks and gar dens) s hall in no case be higher than the pr evailing tree canopy line of t he city unless allowed by the Chairman. T he advertising device should be located such that the tr imming of vegetation will be unnecessary. Structural design / erection of the hoarding (1) The hoarding irrespective of the size should be erected on steel fra mes. (2) Single pole kiosk would be preferred in. (3) The design/erection of the hoarding shall be aesthetically designed and strictly as per the structural plan approved by a licensed/r egistered Engineer/Structura l Engineer of the Council. For structur ally unstable hoardings which were in existence before implementation of t hese regulations, the agency or person owning such hoardings shall be advised to seek the views of the Council licensed/registered Engineer/Structur al Engineer. (4) Hoardings shall be allowed to be erected on a building only if it has been examined for structural stability a nd also the bu ilding has been examined on whether it can withsta nd the pressur e of the hoarding, and a certificate to that effect is produced from the Council licensed/registered Engineer/ S tructur al Engineer (5) The hoarding shall be in alignment, as far as possible, with any other approved hoarding previously erected nearby. (6) The renewal of the permission is subject to submission of str uctural stability certificate and building structural stability certificate, every year, from the licensed/registered Engineer/Structural Engineer. 12 . Height r estrictions on hoa r dings (1) When erected on gr ound, the ground clearance should be at least 8 feet and not greater than 30 feet. (2) When erected on a top of a building, the ground clearance should be a t least 8 feet. The top of the hoarding shall not be more tha n 20 feet from the terrace level. (3) When erected on wa ll/sides of a building the Chairman may fix as per convenience of the site.- 5 -Ex-404/2013 13. Minimum distance between two hoardings (1) The minimum distance between two hoardings on the same side of the road/alignment shall be maintained in such a way that the proposed hoarding will not obstruct the view of existing permitted hoar ding. (2) If a new hoarding is proposed near an existing hoarding, the decision of the Chairman shall be fina l is this respect. 14. Alignment of hoardings (1) As far as possible, uniformity of size of the hoarding and a lignment thereof in a particular loca lity/ r oad sha ll be maintained. (2) Agency or persons shall r ealign, readjust, or shift the hoardings whenever called upon by the Chairman to do so a t his own cost without claiming any compensation. 15. Projection of hoardings (1) Hoar ding str ucture on the terrace of a built up structure/ building shall not be allowed to project, in the interest of public safety, beyond the bu ilding line. (2) No new hoarding/ structure may be allowed to traverse the footpa th or a road diagonally and the convenience of the pedestria ns will supersede. 16. Display of hoardings and Advertisements An Identification number for each and every hoarding or advertisement shall be issued by the Chairman. The same should be displa yed on the top right hand c o r n e r o f e a c h h o a r di n g . I n c a s e o f no n - compliance, the Cha irman ma y demolish the hoarding by ca tegorizing it a s an una uthorized hoarding. 17 . Illumina tion of hoar dings (1) The level of luminance should not exceed a sour ce limit of 1 cd/cm2 with an operational limit of not more than 8 hours in a day (24 hours) (2) The illuminated hoardings may preferably be solar powered. (3) The illuminated hoardings in residential premises should not be blinking. 18. Special cases (1) In case of hoarding in the vicinity of a flyover, reta ining wall, fencing etc the Chairman may rela x the height r estrict ions a s the case may be. (2) The request for clubbing of the hoardings shall be considered only if the resultant single hoarding is in conformity with the standar d sizes and subject to payment of pr escribed fee as decided by the Chairman. 19. Special provisions for display of advertisements on bus stops Advertisement signs are allowed at bus stops pr ovided that they are fully integrated into the overall design of the bus shelter. This is to ensure a visua lly neat and tidy streetsca pe and to ma inta in unobstructed and sa fe pedestrian movement. Advertising a t the bu s stops will be allowed subject to the following conditions:- (1) Advertisements have to be part of the structur e and cannot be suspended or be an addition to the primary structure. (2) In case of illumina ted panels, internally-illuminated advertising panels will be preferred. (3) The Chairman may is sue sepa rate or ders/schemes of advertisement for design and installa tion of bus shelters. 20 . Specia l provisions for displa y of advertisement s on flyover and bridges Advertisements on bridges will be subject to the following restrictions, apart from the general provisions as a pplicable to other advertisements:- 6 - Ex-404/2013 (1) The ground clearance of t he advertisement shall be at least equal to the ground clearance of the br idge. (2) The maximum height of the advertisement s hall not exceed the height of the par apet of the bridge. 21. Special norms for display of advertisement on business or market premises The advertisement, such a s illuminated glow sign boxes and illumina ted/neon sign name boards on the business or market premises shall be permitted/regularized. These advertisements should confor m to the following conditions: (1) Notwithstanding any permission given for such erection, any such sign which after erection is, in t he opinion of C hairman, of such intense illumination so as to disturb occupants of the adja cent or nearby buildings shall, on the order of Cha irman, be suit ably altered or removed by the owner of the site concerned within such reasonable period as the Chairman may specify. (2) No ground s ign shall be erected so as to obstruct the free access to or exit from any building. (3) No part of the advertisement or its support str ucture shall project beyond the building on its sides. It shall also not project beyond the plot boundary. 22 . Special norms for displa y of advertisement s by floating balloons Permission for illuminated or non-illuminated advertisement by means of floating balloons can be granted subject to complia nce of conditions mentioned below: (1) The agency or person shall displa y the balloon in such a manner that it does not int erfere with or obstruct other displays of advertisements. The agency shall make necessary arrangements for monitoring the movement of the balloon during its display. (2) The agency or person shall produce No Objection Certifcate (NOC) from the Ministry of C ivil Avia tion, Government of India or Civil Aviation Depar tment, Government of Mizoram and shall observe all their rules and regulations. (3) The agency or persons sha ll be liable to pay da mages for any accident or any injur y which may be caused to any property or person by r eason of keeping the said ba lloon or the ma terial, gas or a ny device used in resp ect thereof or by reason of t he fall or otherwise of the said balloon or a ny part thereof due to storm, faulty operation, negligence, accident or any other cause whatsoever. 23.Special provisions for display of advertisements by Government Departments/public sector/a utonomous authorities If any Department whether belonging to the Central or State Government or Public Sector or Autonomous Authorities proposes to display any advertisement in their property, building, road reserve or installa tion etc. belonging to them, such department or authority shall seek the permission of the Council failing which the advertisements shall be removed without prior notice by the Chair man. 24. Special Provision for display of advertisement on vehicles Display of non-illuminated advertisements will only be allowed on each or all sides of vehicles to the following vehicles provided that a dvertisements should not obstr uct the clear visibility of driver or the passengers. Application for advertisement on vehicle need not structure designs and structural soundness certificates. ( a ) Taxis (b) School Buses and private buses (c ) City Buses (d) Pick Up/TATA 207/Boleros/Sumos/S avaris and any similar vehicles (e) Trucks/TATA 407/709 and any similar vehicles (f) Two Wheeler s/Thr ee Wheelers if any.- 7 -Ex-404/2013 Any advertising devices shall not interfere in any way with the mandatory vehicle signs, such as purp ose of the ser vice, number p la te, etc., 25 . Procedure for grant of permission for erection, exhibition, fixation, retention or display of a dvertisement s (1) Every person desiring to erect, exhibit, fix and display an advertisement shall a pply to the Chairman for permission in the For m A ava ilable in the Council Office against payment of fees of Rs. 50. The said a pplication for m duly filled in all r espects shall be submitted by the applicant in the Council Office, a gainst a proper receipt. The Chairma n may, a fter making such inspection as may be necessar y and sa tisfied of the land status and within thirty days after the receipt of the a pplication, gra nt /refuse / renew or cancel t he permission, as the case may be, in accorda nce wit h the provisions of Act, and the Regulations made thereunder. (2) Along with the application form, the following documents are required to be submitted – (a ) NOC/ allotment letter from the owner of la nd/ property and an agreement between the owner (s) of the building and the applicant. (b) Structural Stabilit y certificate of the hoarding and building (if) from a licence/registerd Structural Engineer/Engineer. (except a dvertisement on vehicles) (c ) Engineering drawing of the proposed str ucture in triplicate drawing duly signed by the Structural Engineer/Engineer. (except a dvertisement on vehicles) (d) Two copies of 6"x4" size Photograph taken from a distance of the proposed site with marking of the pr oposed hoarding ther eon. ( e) NOC from Local Council (f) EPIC or any other valid documents (g) Tribal Certificate (3) The Chairman may disapprove an advertisement among others, on the ground that, its cont ents or the manner of its display is unsuitable from the considerations of public safety, traffic hazards or a esthetic design, or otherwise offensive and in bad taste and offensive to public sentiments. (4)Validity: Every license shall be for a period of one year except in the ca se of a dvertisement on vehicles and sites used for temporary congregations including fairs, festivals, circus, exhibitions, sports events or cultural or social programmes. (5) If a ny tax on advertisements is not paid within the stipulated time after the demand notice, the same shall be recovered as arrears of tax and the permission granted shall be deemed to have been termina ted. The Chair man shall be at liberty to remove such hoardings. (6) The Chairman shall cause to mainta in a register showing the permission issued under the Act and the Regulations. 26. Removal of unauthorized Advertisements or Hoardings If a ny advertisement is erected, exhibited, fixed or retained on any land and building unauthorized and in contravention to the provisions of the Act , and the Regulations made thereunder, such advertisement or hoarding shall be removed by t he concerned advertiser/exhibitor at their own cos t failing which the Chairman, may with or without any notice may remove the structure and the expenses shall be recovered fr om the concern advertiser or exhibitor as may be decided by the Chairman from time to time. The advertiser or exhibitor shall not have the r ight to claim the removed st ructures/materials which shall automa tically be the property of the Council 27 . Tax to be paid in a dvance (1) The Tax on each advertisement shall be payable in adva nce as per the charges specified in the schedule to these r egulations. (2) All dues s hall be payable in cash.- 8 - Ex-404/2013 28 . Lic ensed or register ed a dvertisers: (1) Any individual or firm except licensed or registered advertisers or agencies shall not be allowed to undertake displa y of advertisements on behalf of other persons or agencies, but shall enroll themselves as licensed or registered advertisers with the Council by furnishing the required information, documents, security as may be determined by Chairma n and shall pay the license fee or registration fee and security deposit as may be determined by the Chairman from time to t ime. (2) Persons intending to entrust the work of displaying advertisement on their behalf shall not entr ust it to any unlicensed or unregistered advertiser. (3) A licensed or registered advertiser shall before displa ying or causing the display of a dvertisements, satisfy himself that, the tax due thereon has been paid to the Council and the Chairman’s approva l obtained thereof. (4) A licensed or registered a dvertiser shall mainta in proper record of a dvertisements displayed by him and produce the same whenever required for inspection by the Cha irman or any other officer authorized by the Chair man. 29. Post-approval (1) Within 2 da ys of erection of the hoarding, the a gency shall submit to the Council a certificate from a Structural Engineer/Engineer cer tifying that t he hoar ding has been constructed as per the specifications and engineering drawings. (2) Within 7 da ys of r eceipt of such certificate fr om the applica nt, the Council shall underta ke a field visit to the approved hoarding and check for inconsistencies or deviations. (3) In case deviations are fou nd, the agency shall be given a notice period upto 15 days to rectify the same, except in cases wher e immediat e action may b e required. (4) After the lapse of 15 days notice, if deviations are still found, the Council shall get the hoardings and the structures demolished. The processing fees and all charges shall be for feited a nd a suitable penalty may be imposed as decided by the Chairman from time to time. 30. Regularization of existing hoardings and advertisements All existing hoardings within the area of the Council shall be regula rized as per the Regulations made thereu nder. (1) In case it is required, then such hoa rdings may be re-aligned, re-adjusted, shifted or permanently removed a s the ca se may be. (2) Efforts may also be taken to maint ain uniformity of size of hoar dings on a particular r oad. (3) The Council or the agency on advice from the Council shall complete such regulariza tion within 6 months of issuance of these R egulations. (4) In case the agency fails to regula rize the hoarding within a time-period of 6 months, the Council may decide to demolish the hoarding. 31. New hoardings on the Council land or properties The Chairma n may permit the use of its land/pr operties for display of advertisements. Land/ property is a llotted to agency for display. (1) The Council shall henceforth, from time to time, identify locations on the Council property where it will allow new hoar dings to be erected. (2) After such identification, it sha ll put such locations on auct ion thr ough an open advertisement or limited advertisement (3) When auctions are not feasible, competit ive tenders may also be invited. (4) The selected agency shall be issued an allotment letter for use of the Council property/land for the purpose of advertisements. On receiving the allotment letter, the agency shall a pply to the Council for displa y of a dvertisement under the usual procedure.- 9 -Ex-404/2013 (5) The Chairma n may permit the display of advertisement to any a gency for a maximum period of 1 year on payment of land utilization charges and advertisement fees as fixed by the Chairman and on such terms a nd condit ions as deemed fit, pr ovided such advertisement fulfills the Regulations made thereunder. (6) Upon expiry of the period of the allotment letter, display of a dvertisement on the sa id site may be allowed by auctioning or by renewal or by inviting competitive tenders. 32. Duties and responsibilities of the licensed holder agency (1) The license holder shall ensure that the structure and the advertisement boar d are a esthetically designed and properly maintained at all t ime. (2) The license holder will ensure to have a valid license at all times, as laid down by these regulations. (3) It will be mandator y on the part of the a gency to display, at their cost, a civic message or any other messa ge as a nd when directed by t he Council for a period of fifteen days in a year for which no fees will be char ged. (4) The permission can be transferred with the prior permission of the Chairman and on payment of transfer fees as prescribed by the Chairman from time to time and subject to the following: (a ) In case of legal t ransfer, legal documents to prove the legal succession st atus of the transferee. (b) In case of transfer through sale, sa le document. (c ) Affidavit indemnifying the Council from a ll other claima nts. 33. Renewal Renewal of conditions of permission. (1) An application for renewal/extension of permission sha ll inva riably be made before the expiry of the period of existing permission at p ayment of Rs. 20/-. (2) Any applica tion for renewal/extension of permission s ubmitted after the expiry of the period for which permission was previously gra nted sha ll be a ccompanied by a late fee of Rs.10/- for each day of delay. The permission shall be deemed to be in force during the pendency of the disposal of the renewal application. (3) Wher e the Chairman is of the opinion that the proposed or existing site for any advertisement is not suitable in the interest of public safety, traffic hazards or aesthetics, he may reduce the number of advertisement in a particular location to avoid visua l pollution or refuse to grant any new permission or renew a ny existing permission. 34. Penalty (1) Whoever cont ravenes any of the provisions of the these regulations and t erms and condit ions on the subject or fails to comply with the order of dir ection lawfully given shall be punishable with a fine which may extend to Rs.500 and if contravention continues, a sum of R s.50 ma y be imposed for continuing offences daily or punishment with fine to be imposed by the Executive Council as per provisions of section 249 and 386 of the Act as the case ,may be. (2) Any other action including blacklisting of the defaulting agency or advertiser may also be decided by t he Chair man. 35 . Regu la tions to be availa ble for inspection a nd purcha se (1) A copy of t hese regulations shall be kept at the Council Office and du ring office hou rs shall be open free of charge for inspection by any individuals (2) The copies of the regulations shall be kept at the Council Office for sale to the public at the cost to be decided by the Chair man.- 10 - Ex-404/2013 36. Dispute and Miscellaneous Provision Any dispute arising out of erection, re-erection, exhib ition, construction and display of advertisement and hoardings shall be decided by the Council in conformity with the Act and Regulations made thereu nder. Further, all advertisement should be displayed in a proper manner taking all precautions aga inst electrocution / accidents and the Council shall not be resp onsible for a ny negligence, injury or casualty on a ny account whatsoever. The owner of the advertisement/hoar ding or owner of vehicle shall be bound to indemnify and reimburse the Council for all claims, demands, loss, charges, cost and expenses which it may have to incur or which accrue on account of infringement of any of sections and sub- sections of the Regulations. 37. Rep eal Guidelines for Advertisement, Hoarding/Signboa rd within the Town issued under Memo No.LAD-1/ 89 dated 19th Sept 1990 a nd practices followed in the past in this respect a re hereby repea led. Notwithstanding such repeal anything done or any action taken under the said guidelines and pr act ices shall be deemed to have been done or ta ken under the corr esp onding pr ovision of t he regulations. In exercise of the powers conferred by the proviso to Article 309 of t he Constitution of India, the Governor of Mizoram is pleased to make the following R ules regulating the method of recruitment to the post of Draftsma n-II fu rther to amend the Mizoram Home Guards under Home Department (Group ‘C’ posts) Recruitment Rules, 2008 notified vide No. A. 12018/48/2008-P&AR(GSW) dt. 25.8.2008 and published in the Mizoram Gazette Extraordinary Issue No. 339 dt. 29.8.2008, namely :- 1.Amendment of Rule 1(1) : Entries in Rule 1(1) short title and commencement in the Principal Shor t title and Rules, the following shall be substituted, namely :- commencement “(1) These Rules may be called the Mizoram Home Guards under Home Department (Group ‘C’ posts) Recruitment (Amendment) Rules, 2013”. (2) They shall come into force from the date of their publication in the Official Gazette. 2. NOTIFICATION No. A. 45011/1/2010-P&AR(GSW), the 5th August, 2013. In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and all ot her powers enabling him to do so on this behalf, the Governor of Mizoram is pleased to amend the Mizor am Civil Services (Combined Competitive Examination) Regula tions, 2011 (hereinaft er referred to as the Princip al Regulations) which was notified under No.A.45011/1/2010-P&AR(GSW) dated the 3rd February, 2012 and published in the Mizoram Gazette extraordinary Issue No.59 dated the 9th February, 2012, namely:- 1.Shor t title and (1) These rules may be called the Mizoram Civil Services (Combined commencement Competitive Examina tion) (Amendment) Regulations, 2013 (2) They shall come int o force from the 1st Ja nuary, 2014. 2. Amendment of (1) In the Principal Regulations, sub-clause (3) (d) of clause (ii) of Regulation 3 Regulation 3 shall be deleted. (2) In the pr incipal regulations, clause (vi) of Regulation (3) shall be substituted, namely :- “ All the successful candidates in the written examination will have to undergo Medical examination as contained in the schedule - II(A). The Medical examination shall be conducted before personal interview is held. Provided that the Medical Examination in respect of persons with disabilities will have to be conduct ed sepa ra tely taking into accou nt the nature of disabilities, in accordance with the provision of ‘ The Persons with Disabilities ( Equal opportunities, protection of Rights and full participation ) Act, 1995”. (3) In the Principal Regulations, clause (vii) of regulation 3 shall be deleted. 3. Amendment of (1) In t he Principal r egulations, the entir e provision of sub-clause (v) of Regulation 9 clause (2) of Regulation 9 shall be deleted. (2) In the Principal R egulations, sub-clause (vi),(vii) and (viii) of clause (2) of Regulation 9 shall be renumbered as sub-clause (v),(vi) and (vii) respectively. 4. PRELIMINARY EXAMINATION of Schedule-I, the following shall be substituted, namely :- " T he examination s hall consist of 2(two) papers of objective t ypes (Multiple Choice Questions and negative marking). Each paper shall carry a maximum of 200 marks of 2 hours duration. Explanation : 1. There will be penalty (Negative Marking) for every answer given by a candida te in t he objective type Question papers. 2. For each Question for which a wrong answer has b een given by the candidate, one third of the marks a ssigned to that Question will be deducted as pena lty. 3. If a candidate gives more than one answer to one Question, it will be treated a s wrong answer even if the given answer happens to be correct and there will be same penalty as above for that Question. 4. If any Question is left blank, i.e. no answer is given by the candidate, there will be no penalty for that Question." Amendment of (1) In the Principal Regulations, sub-clause (3) (d) of clause (ii) of Regulation 3 Regulation 3 shall be deleted. (2) In the pr incipal regulations, clause (vi) of Regulation (3) shall be substituted, namely :- “ All the successful candidates in the written examination will have to undergo Medical examination as contained in the schedule - II(A).
