No. NE-313(MZ) 2006-2008VOL - XLVIII Aizawl, Thursday 29.8.2019 Bhadrapada 7, S.E. 1941, Issue No. 5881.(i)These Regulations may be called the Mizoram Board of School Edu-cation (Pension) (Amendment) Regulations, 2016.(ii)They shall come into force at once.2.In section 3 of the Principal Regulations, the following shall besubstituted, namely :(i)Save as otherwise provided in these regulations, it shall apply to thewhole time regular employee of the Board appointed substantivelybefore 1st September, 2010 but shall not apply to any employee whois substantively appointed on or after 01.09.2010 and shall be gov-erned by sub-section (4) of Section 6 of the Regulations.3.In section 5 of the Principal Regulations, the second proviso shall bedeleted.4.In Section 6 of the Principal Regulations, sub-section (1) and (2)shall be substituted by the following, namely :-Short title andcommencementAmendment ofSection - 3Amendment ofSection - 5Amendment ofSection - 6 (1)A separate account called the Pension Fund of MBSE shall beopened in the State Bank of India. The Board shall contributefrom its own fund equal to 10% of Pay of each employee whoare covered by section 3 of the regulations which shall be re-viewed for increase of the rate by the Finance Committee of theBoard from time to time. The Board shall propose the remainingrequired amount for Pension/Family Pension from the allocatedGIA to MBSE for the year and shall be deposited the wholeamount to that account.(2)Any cash balance of the fund in excess of the amount not likelyto be required for use in immediate future shall be invested onthe recommendation of the Finance Committee of the Board foraugmentation of the Fund.5.After sub-section 3 of Section 6 of the Principal Regulations, a newregulation shall be added as follows, namely :-(i)Any employee who was not covered under section 3 of the Regu-lations shall contribute 10% of pay and the Board shall give matchingcontribution equal to that amount which on the recommendation ofthe Finance Committee of the Board shall be deposited for invest-ment on behalf of each of the employee as retirement benefits. No. NE-313(MZ) 2006-2008VOL - XLVIII Aizawl, Friday, 30.8.2019, Bhadrapada 8, S.E. 1941, Issue No. 590NOTIFICATIONNo. K. 12011/14/2010-REV/749-750, the 28th August., 2019.Whereas by the Government NotificationNo. K.12011/14/2010-REV, dated 12.09.2017 published vide Mizoram Gazette Vol –XLVI, Issue no. 505dated 15.09.2017, it was notified under Section 11 (1) of The Mizoram (Land Acquisition, Rehabilitationand Resettlement) Act, 2016 (hereinafter referred to as the said “Act”) that the land specified in the scheduleindicated below was likely to be needed for the purpose namely – Acquisition of Land for construction ofProject Site of EWS Housing at Hawngtial Ram, Aizawl District as per the direction of the Hon’ble GauhatiHigh Court Judgement & Order dt.16.05.2019 in WP(C) No. 128 of 2018 (Shri Lalthanmawia & anr –vs-State of Mizoram & 3Ors.).2.And whereas by the Government Notification No. K.12011/14/2010-REV/728, dt.27.04.2019published in the official Gazette, it was notified under section 19(7) of the said Act that the 12 months periodfrom the date of issue of the Preliminary Notification was extended till 14.09.2019 or till the instant Declarationunder Section 19 is published in the Mizoram Gazette, whichever is earlier.4.Now, therefore, the Government declares under Section 19 (1) of the said Act that the said land isrequired for the public purpose specified above and as per scheduled indicated below.5.The Government now appoints the Deputy Commissioner, Aizawl District under Section 2 of thesaid Act to perform the functions of a Collector for all proceedings hereinafter to be taken in respect of thesaid land and directs him under Section 2 of the said Act to take order for the acquisition of the said land.6.The Collector shall thereupon cause the land to be measured and make a plan of the same underSection 20 of the said Act if not already done as per Section 11 of the said Act, and dispose of all objectionsand claims after causing a public notice for not less than 30 (thirty) days to the persons interested stating theGovernment’s intention of taking over the possession of the said land as per Section 21 of the said Act. Then,the Collector shall submit a Draft Award to the Government of Mizoram after fulfilling the provisions underSection 27 of the said Act.7.A plan of the same can be inspected at the Office of the Deputy Commissioner,Aizawl till the finalaward is made under Section 27 of the said Act.
