C/50NOTIFICATIONNo.12/2019-State Tax (Rate) No. J. 21011/2/2019(b)-TAX, the 14th August, 2019.In exer cise of the powers conferred by sub-section (1) of section 9 and sub-section (5) of section 15 of the Mizoram Goods and Services Tax Act, 2017 (6 of 2017), the Governor of Mizoram, on the recommendations of the Council, hereby makes the following further amendments in the notifica tion of the Gover nment of Mizoram No.l/2017-State Ta x (Rate), dated the 7th July, 2017, namely:- In the said notification, - (a) in Schedule I -2.5%,- (i)after serial number 234A and the entries relating thereto, the following serial number and entries shall be inserted, namely: - “234B 8504 Char ger or charging station for Electrically operated vehicles”; (ii)after seria l number 242 a nd the entries relating thereto, the following serial nu mber and entries shall be inserted, namely: - “242A 87 Electrically opera ted vehicles, including two a nd thr ee wheeled electric vehicles.Explanation.- For the purposes of this entry, “Electrica lly operated vehicles” means vehicles which ar e run solely on electr ical energy derived from an external source or from one or more electrical batteries fitted to such road vehicles and sha ll include E- bicycles.”; (b) in S chedule II - 6%, seria l number 206 and the entries r elating thereto shall be omit ted; (c ) in Schedule III - 9%,against seria l number 375, in the entry in column (3), after the word “inductors”, the words “, other than char ger or charging station for Electrica lly operated vehicles” shall be inserted. 2. Short title and Commencement (1 ). Thes e r ules may be called the Mizor am Fa ctor ies (Amendment) R ules, 2 019. (2 ). They shall come into force on the date of their publication in the Official Gazette. 2 . Insertion of new rule: (1) After rule 46 (a) &(b) Sub-Rules (c) & (d) shall be added incorporated after Rule 46(a) & (b) as sub-rules 46(c) & (d) and Rule 46c) “ Sanitar y napkins of adequate quantity confor ming to the Indian Sta ndards shall be provided an maintained in the Women’s toilets for their use, and the same replenished on daily basis.” Rule 46d) Disposable bins lids shall be provided within the women’s toilets for the collection of t he used napkins. The used napkins shall be disposed off as per the procedure approved by the Inspector (2) After Rule 76 a new rule 76 (A) sha ll be inserted as follows, namely- “ 76A. Per sona l P r otective E quipment- (1) All workers should be mandatorily provided with Personal Protective Equipments (PPEs) as r equired under a ny of the provisions of the Act or the Rules and such PPEs shall conform to the relevant National Standa rd. T he occupiers sha ll require the workers to use such PPEs and the same shall be maint ained in proper working conditions by the occupier. No charge what s o ever shall be charged by the occupier from the workers for provision of such P PEs. Proper medical car e shall be car ried out to prevent workers from suffering from ingr o wn na ils , metatasa lgia , heel spur, hammer toes a nd nerve damage a fter wearing safety shoe. iii.Safety Goggles and Spectacles- T he relevantNational Standardshall be applicable for eye-protection intended for use in industrial undertakings to provide protection for the eyes of the workers a gainst hazards such as flying particles and fragments, spla shing materials and molten metal’s har mful dust, gases or vapours, aerosols and radiations which a re likely to impair vision or damage the eyes. Additional eye protection over their prescription lenses shall be used-ensuring tha t the protective eyewear does not disturb the proper posit ioning of the pres cription lenses. i v.Equipment for eye and face protection during welding- Relevant National Standardshall be followed for the requirements of goggles, hand shield and helmet intended to protect an operator above the shoulder from har mful radiation, spark a nd particles of hot metal dur ing welding, cutting and similar operations employing a ga s flame or electric arc. v.Gloves and P rotective Clothing- Suitable gloves, leather gauntlets and mitten conforming to relevantNational Standardshall be used for protection of hand of the workers from getting injur ed. Such pr otective gloves shall be provided where the ha nds are exposed to hazards such as those from skin a bsorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes. Suitable pr otective clothing as per relevant National Standard a vailable for a pr on (Rubberized, acid and alkali resistant) shall be used for protection of wor kers who are likely to be exposed to any haza rd which may cause injury to their skin. vi.Ear protection when exposed to noise- Protection against the effects of nois e exposu re sha ll be provided when the sound levels ex ceed the prescr ibed standards. The relevant National Standard shall be followed while selection of suitable ear protection. APPROPRIATE AUTHORITY1.Director, Hospital & Medical Education, Govt. of Mizoram-Chairman 2.Secretary, MHIP, Mizoram-Member 3.Depu ty S ecr etary, Law & J udicia l Depart ment-Member Appropr iate Author ity shall have t he following functions : a)To grant, suspend or cancel registration of a Genetic Counselling Centre, Genetic Laboratory & Genetic Clinics. b)To enforce standards prescribed for the Genetic Counselling Centre, Genetic L aborator y & Genetic Clinics. c)To investiga te complaints of breach of the provision of this Act or the rules made there-under and take immediate action; and d)To seek and corsider the advice of the Advisory Committee, constituted under section (5), or cancellation of registration/ e)To take appropriate legal action against the use of any selection technique by any person at any place, suo moto or brought to its notice and also to initiate independent investigations in such matters. f)To create public a wareness against the practice of sex selection or pre-na tal determination of sex. g)To supervise the implementation of the provisions of the Act and Rules; h)To r ecommend to the Board and Sta te Boards modification required in the rules in accordance with changes in technology or social conditions.
