The Utilisation Certificate (UC) will be submitted on bi-annual basis to the District Magistrate. Mizoram Factories (Amendment) Rules, 2019

No. NE-313(MZ) 2006-2008NOTIFICATIONNo.A.49011/2/2012-LE&IT/631:In exercise of the powers conferred by section 112 of the Factories Act, 1948. the Government of Mizor am is p leased to make the following rules further to amend the Mizoram Factories Rules, 2014, as follows, namely - 1 . Short title and Commencement (1 ). Thes e r ules may be called the Mizor am Fa ctor ies (Amendment) R ules, 2 019. (2 ). They shall come into force on the date of their publication in the Official Gazette. 2 . Insertion of new rule: (1). After rule 76 of the Mizoram Factories Rules, 2014, a new rule 76A shall be inserted as follows, namely- “76A. Personal Protective Equipments- (1) All workers should be mandatorily provided with Personal Protective Equipments (PPEs) as r equired under a ny of the provisions of the Act or the Rules and such PPEs shall conform to the relevant National Standa rd. T he occupiers sha ll require the workers to use such PPEs and the same shall be maint ained in proper working conditions by the occupier. No charge whatsoever sha ll be charged by the occupier from the workers for provision of such P PEs. (2) Without prejudice to the generalit y of the provisions of sub-rule (1), the various types of PPEs to which this rule shall extend for use in factories shall be as prescribed below. i.Safety Helmet- All workers who ar e likely to be exposed to any hazard which may cause head injury shall be provided with safety helmets conforming to relevant National Standards.All the workers shall be adequately tra ined on proper use of such PPEs. When work at height is being carr ied out such safety helmet shall be provided with a nape str ap. No safety helmet which has resisted an impact shall be reused. Periodic cleaning and visual inspection to check any deforma tion in size or shape shall be carried out. ii.Protective Footwear- Protective footwear should be provided to workers who are exposed to hazards which ar e likely to cause injur y to them by wa y of materials being dr opped on their feet or nail or other sharp objects penetra ting their sole. Proper disinfection shall be carried out to prevent contagious fungal infection of the skin tha t causes scaling, flaking, and itching of the affected ar eas. Proper medical car e shall be car ried out to prevent workers from suffering from ingr own na ils, metatasalgia , heel spur, hammer toes and nerve da ma ge a ft er wear ing sa fety shoe. iii.Safety Goggles and Spectacles- T he relevantNational Standardshall be applicable for eye-protection intended for use in industrial undertakings to provide protection for the eyes of the workers a gainst hazards such as flying particles and fragments, spla shing materials and molten metal’s har mful dust, gases or vapours, aerosols and radiations which a re likely to impair vision or damage the eyes. Additional eye protection over their prescription lenses shall be used ensuring tha t the protective eyewear does not disturb the proper posit ioning of the pres cription lenses. i v.Equipment for eye and face protection during welding- Relevant National Standardshall be followed for the requirements of goggles, hand shield and helmet intended to protect an operator above the shoulder from har mful radiation, spark a nd particles of hot metal dur ing welding, cutting and similar operations employing a ga s flame or electric arc. v.Gloves and P rotective Clothing- Suitable gloves, leather gauntlets and mitten conforming to relevantNational Standardshall be used for protection of hand of the workers from getting injur ed. Such pr otective gloves shall be provided where the ha nds are exposed to hazards such as those from skin a bsorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes. Suitable pr otective clothing as per relevant National Sta nda rd ava ila ble forapron (Rubberized, acid and alkali resistant) shall be used for protection of wor kers who are likely to be exposed to any haza rd which may cause injury to their skin. vi.Ear protection when exposed to noise- Protection against the effects of nois e exposu re sha ll be provided when the sound levels ex ceed the prescr ibed standards. The relevant National Standard shall be followed while selection of suitable ear protection. Periodic disinfection of reusable ear protectors shall be carr ied out to eliminate hearing loss caused by infection, discharge, pain etc. in the ea r. vii.Resp iratory Protection- Respirator y Protective equipment based on the na ture of hazard as per the relevantNational Standardshall be provided by the occupier of t he factory to the workers for their respiratory protection against dust, fu mes, gases, particulates etc. C linical examination and appropriate medical tested shall be underta ken to a void Irrita nt dermatit is, nose br idge sores, etc. because of prolong use of respirator y personal protective equipment. viii.Other Protective Equipment- Appropriate personal protective equipment based on the nature of hazards as per the relevantNational Standardshall be provided by the occupier to the workers. - 3 -Ex-522/2019 These include the following:- (a ). Safety harnesses with independently secured lifelines where protection aga inst falls cannot be provided by other appropr iate means. (b). Life vests and life preserver where there is a danger of falling into water, ( c ) . Distinguish clothing or r eflect ive devices or otherwise conspicu ously visible materia l when there in regula r exposure to danger from moving vehicles. (3) The Inspector may, having regard to the nature of the ha zards involved in work and process being carried out, order the occu pier or themana ger in writing to supply to the workers exposed to particular haza rd any personal protective equipment conforming to relevant National Standard as may be found necessary.
