Whereas it appears to the Government of Mizoram that land occupied by Security Forces at Helipad Area, Thuampui, Aizawl (herein after referred to as the “said land”) has to be acquired by the Security Forces under the Ministry of Home Affairs, Government of India in compliance with the Hon’ble High Court’s order dt.21.03.2017 in Cont. Case (C)No. 14 of 2012 with Cont. Case (C) No. 26 of 2016 (Sh. Zokailiana & 5 ors - vs-Chief Secretary & 7 ors.) And whereas land is required for the continued occupation of Security Forces which is a project falling within the purview of sub-section (2) of section 40 of the Mizoram (Land Acquisition, Rehabilitation and Resettlement and Resettlement) Act, 2016 (her einafter called the Act): Now, therefore, the Government hereby notifies under sub-section (1) of section 11 of the Act that- 1.The said land is needed for the purpose specified above; 2.The acqu isition of the said land is exempted from undertaking of the Social Impa ct Assessment studies as provided under section 9 of the Act; 3.The Deputy Commissioner/Collector of Aizawl District shall conduct Preliminary Survey of the land for the said project so as to acquire the minimum area required for the project, if not already done, as provided under section 12 of the said Act, and shall also update all records of lands within the land to be acquired within 2 (two) months from the date of publication of this Notification, prior to publication of Declaration by the Government. 4.Any person interested in any land within the notified area may file his or her objection to the Collector within sixty days from the date of publication of this notification as provided under section 15 of the said Act as regards- Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. NOTIFICATION No. K. 12011/61/2015-REV/Pt, the 4th May, 2017.In t he interest of the public, the Governor of M izoram is pleased to hereby notify for genera l information a nd compliance that the Notification issued under Section 11(4) of The Mizora m (Land Acquisition, Rehabilitation and Resettlement) Act, 2016, vide No. K. 12011/61/2015-REV dated 6.1.2016, for freezing of status of land within 100 metres of the road on both sides along the NH-54 (Aizawl to Tuipang), shall not apply to the lands for which approval for allotment or issuing of land pass was already gra nted by the Government or appropriate authority pr ior to the date of issue of the said Notification. The approved land passes which ha ve been kept pending due to the said notification a s mentioned above may, therefor e, be issued by realising ta xes on land, with interest for the period with effect from the dates of such approvals. However, the nature of the pass or ownership shall not be altered from it s condition at the appr oval stage till completion of the acquisition process. R.
