Whereas it appears to the Government of Mizoram that land occupied by Security Forces at Helipad Area, Thuampui, Aizawl (herein after referred to as the “said land”) has to be acquired by the Security Forces under the Ministry of Home Affairs, Government of India in compliance with the Hon’ble High Court’s order dt.21.03.2017 in Cont. Case (C)No. 14 of 2012 with Cont. Case (C) No. 26 of 2016 (Sh. Zokailiana & 5 ors - vs-Chief Secretary & 7 ors.) And whereas land is required for the continued occupation of Security Forces which is a project falling within the purview of sub-section (2) of section 40 of the Mizoram (Land Acquisition, Rehabilitation and Resettlement and Resettlement) Act, 2016 (her einafter called the Act): Now, therefore, the Government hereby notifies under sub-section (1) of section 11 of the Act that- 1.The said land is needed for the purpose specified above; 2.The acqu isition of the said land is exempted from undertaking of the Social Impa ct Assessment studies as provided under section 9 of the Act; 3.The Deputy Commissioner/Collector of Aizawl District shall conduct Preliminary Survey of the land for the said project so as to acquire the minimum area required for the project, if not already done, as provided under section 12 of the said Act, and shall also update all records of lands within the land to be acquired within 2 (two) months from the date of publication of this Notification, prior to publication of Declaration by the Government. 4.Any person interested in any land within the notified area may file his or her objection to the Collector within sixty days from the date of publication of this notification as provided under section 15 of the said Act as regards- Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. (b)Justification offered for public purpose. and also for Claims for compensation on landed properties. 5.The Additional Deputy Commissioner, Aizawl District is appointed as Administrator for the purpose of rehabilitation and resettlement of the affected families, if any. 6.No new allotment of land or change of nature of land rights, save on the order of the conmpetent court, shall be made within the affected area by authorities concerned after the date of publication of this notification. 7.Persons interested in the said land are hereby warned not to obstruct or interfere with any Surveyor or other persons employed for the purpose of the said acquisition. Any contract for the disposal of land by sale, lease, mortgage, assign change of the status of Pass or otherwise of any outlay commenced or improvement made therein after the date of publication, without the sanction of the Collector will, under sub-section (4) of section 11 of the Act, be disregarded while assessing compensation for such parts of the said land as may be finally acquired. (2)The owner, proprietor, manager, supervisor or incharge of a public transport vehicle shall notify and cause to be displayed prominently the name of the person(s) to whom a complaint may be made by a person(s) who observes nay person violating the provision of these Rules. Whoever willfully disobeys this order shall be punishable with fine which may extend to five hundred rupees for such offence under sub-section (1) of section 179 of the Motor Vehicles Act, 1988. (2)They shall come into force from the date of their publication in the Mizoram Gazette. 2.Amendment of ScheduleFor schedule of the Principal Regulations, the fol- lowing shall be substituted, namely:- SCHEDULE [See regulation 17 (1)] (A) In all cases before the District Courts, the honorarium shall be as follows : 1.For appearance- Rs. 750/- per effective hearing and Rs. 500/- for non-effective hearing subject to a maximun of Rs. 7,500/- (per case). 2.For drafting- (i)Drafting of substantive pleading such as Suit, Matrimonial Proceedings such as Divorce, Maintenance, Custody, Restitution etc., Succession, Probate, Memo of Appeal, Revision, Written Statement, Reply, Rejoinder, Replication etc.-Rs.1,200/- (ii)Drafting of Miscellaneous applications such as stay, bail, direction, exemption etc.-Rs.400/- per application subject to maximum of Rs.800/- for all applications.
