(2) They shall come into force from the date of their publication in the Official Gazette. For the wor dings t hat appears in Regulation 1(1) of t he Principal Regulations, the following wordings shall be substituted, namely:- “These Regulations may be called the Mizoram Secretariat Service (Cadre Training) R egulations”. (4) Those Officers in the Junior Grade/Entry Grade of the Mizoram Secretariat Service who do not undergo Foundation Course or completed Refresher Course (in the case of those who had alr eady completed 5 years regular ser vice in the grade before the commencement of these regulations) will not be eligible for promotion to t he Senior Grade of Mizoram Secretaria t Service unless their not being sent for the requir ed training is attributable to the lapse on the part of the Government. T he barring of p romotion provided in this cla u se will also not be a pplicable to those who are exempted from the required training as per clause (2). (5) Arr angement of the above tr aining progr ammes every year or otherwise a s per r equir ement of t he Service sha ll be made by ATI, Aiza wl in consultation with Training Wing of DP & AR. (6) The authority for granting exempt ions fr om training not covered by clause (2) lies with the Training wing of DP & AR”. For the entries in Regulation 8 in the Principal Regulations, the following shall be substituted, namely:- “Mid Career Training for Senior Grade of Mizoram Secretariat Service Officers (1) Every officer in the Senior Grade of Mizoram Secretariat Service shall undergo a two-week Mid-Car eer Tra ining conducted in any of the institutes listed in t he Annexure. (2) Arra ngement of this two-week Mid Career Tr aining will be made by the Training Wing of DP&AR, Government of Mizoram in cons ultation with the concerned training institutes. 4.Amendment of Regulation 5 5 . Amendment of Regulation 8 Ex-109/20152 (3) Those officers who are pr omoted to the Senior Grade of Mizoram S ecr et a r ia t S er v ice a ft er a t t a in ing 5 7 yea r s of a ge will b e ex emp t ed from the above training. Amendment of Regulation 10Ex-109/2015 3 (2) The training slots a vailable in the Training Ins titutes listed at Annexure will be made available to the Officer s of Junior Administrative Gr ade and above by Tr aining Wing of DP & AR yearly but not la ter than in the month of June that year. (3) The compulsory requirement provided in clause (1) will not be applicable to those who are to retire on superannuation within 2 years. The authority for granting exemption from training not cover ed by this clause lies with the Training Wing of DP & AR”. An Ordinance further to amend the Right to Fair Compensa tion and Transpa rency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Ex-203/20152 WHEREAS the Right to Fair Compensation and Transparency in La nd Acquisition, Rehabilitation and R esettlement (Amendment) Ordinance, 2014 to amend the Right to Fair Compensation and Tra nsparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (the RFCTLARR Act, 2013) was promulgated by the President on the 31st day of December, 2014; AND WHE R E AS t he R F C T L ARR (Amendment ) Bill, 2 0 1 5 was introduced on the 24th February, 2015 in the House of the People to replace the said Ordinance and the said Bill was passed alongwith amendments on the 10th March, 2015 in the House of the People; AND WHE R E AS t he R F C T L ARR (Amendment ) Bill, 2 0 1 5 as passed by the House of the People could not be pa ssed by the Council of States and is pending in that House; AND WHEREAS the Council of States is not in session and the President is satisfied tha t circu mstances exist which render it necessary for him to take immediate act ion; Now, THEREF ORE, in exercise of the powers conferred by clause (l) of article 123 of the Constitution, the President is pleased to promulgate the following Ordinance:— 1. (1) This Ordinance may be called the Right to Fair Compensation and Tra nsparency in Land Acquisition, Rehabilitation and Resettlement (Amendment) Ordina nce, 2015. . (2) It shall be deemed to have come into force on the 31st day of December, 2014. 2. In the Right to Fa ir Compensation and Tra nsparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (her einafter refer red to as the principal Act ), for the wor ds “private company” wherever they occur, the words “private entit y” shall be substituted. 3. In the principal Act, in sub-section (2) of section 2, a fter the second proviso, the following proviso shall be inserted, namely:— “Provided also that the acquisition of la nd for the projects listed in su b-section (1) of section 10A and the purposes specified therein shall be exempted from the provisions of t he first proviso to this sub-section.”. 4. In the principal Act, in section 3,- (i) in clause(j) in sub-clause (i), for the words and figures “the Companies Act , 1956”, the words a nd figures “the Compa nies Act, 2013” shall be substituted; Short title and commencement. Substitution of certain expression throughout the Act. Amendment of section 2.30 of 2013. Amendment of section 3. 1 of 1956. 18 of 2013. (ii) after cla use(y), the following clause shall be inserted, namely:— ‘(yy) “pr ivate entity” means any entity other than a Government entity or underta king and includes a propr ietorship, partnership, company, corporation, non-pr ofit organisation or other entity under any law for the time being in force;’. 5. In the principal Act, after Chapter III, the following Chapter sha ll be inserted, namely:- “CHAPTER IIIA PROVISIONS OF CHAPTER II AND CHAPTER III NOT TO APPLY TO CERTAIN PROJECTS 10A (1). The appropriate Government may, in the public interest, by notification, exempt any of the following projects from the application of the provisions of Chapter II and Chapter III of this Act, namely:— (a) such projects vital to national securit y or defence of India and every part thereof, including preparation for defence or defence product ion; (b) rur al infra structur e including electrification; (c) affordable housing and housing for the poor people; (d) industrial corridors set up by the appropriate Government a nd its undertakings (in which case the land shall be acquired up to one kilometre on both sides of designated railway line or roads for such industrial corridor); and (e) infra structure project s including projects under public-private partnership where the ownership of land cont inues to vest with the Government: Provided that the appropr iate Government shall, before the issue of notification, ensure the extent of land for the proposed acquisition keeping in view the ba re minimum land requir ed for such project. (2) The appr opriate Government shall undertake a survey of its wasteland including arid land and maintain a recor d containing deta ils of such la nd, in such ma nner as may be prescr ibed by the appr opriate Government. 6. In the principal Act, in section 24, in sub-section (2), after the proviso, the following proviso shall be inserted, namely:- “Provided further that in computing the period referred to in this sub-section, a ny period or periods during which the proceedings for acquisition of the land were held up on account of any sta y or injunction issued by any court or the period specified in the awar d of a tr ibunal for taking possession or such period where possession has Insertion of new Chapter IIIA. In the principal Act, in section 31, in sub-section (2), in clause (h), after the words “affected families”, the words “including compulsory employment to at least one member of such affected family of a farm la bourer” shall be inserted. 8. In the principal Act, in section 46, in sub-section (6),in the Explanation, in clause (b), the words “any person other than” shall be omit ted. 9. In the principal Act, after section 67; t he following section shall be inserted, namely:— ‘67A.The Authority shall, after receiving reference under section 64 a nd after giving notice of such reference to all par ties concerned, hold the hearing in t he district where the land acquisition takes place for settlement of the objections raised in the reference.’. 10. In the principal Act, for section 87, the following section shall be substituted, namely:- “87. Where a n offence under this Act has been committed by any person who is or was employed in the Centra l Government or the State Government, as the case may be, at the time of commission of such alleged offence, the court shall take cognizance of s uch offence provided the procedure laid down in section 197 of the Code of Criminal Procedure, 1973 is followed.”. 11. In the principal Act, in section 101, for the words, “a period of five yea rs”, the words “a period specified for setting up of any project or for five years, whichever is later,” sha ll be substituted. 12. In the principal Act, in section 105,— (i) for sub-s ection (3 ), the following sub-section shall be substituted, namely:— “(3) T he provisions of this Act relating to the determina tion of compensation in accordance with the First Schedule, rehabilitation and resettlement in accordance with the Second Schedule and infr astructure amenities in accordance with the T hird Schedule shall apply to the enactments relating to Iand a cquisition specified in the Four th Schedule with effect from 1st.January 2015.”: (ii) sub-section(4) shall be omitted.Amendment of section 31. Pu R.Lalthanzauva s/o Liankhuma entered into Government service as Accountant in the Food, Civil Supplies & Consumer Affairs Department on 23.10.1986 and he was posted at DCSO’s Office, Saiha and he was transferred to the Directorate on 01.08.1989 and then to the Office of DCSO, Aizawl West on 13.8.1990. He was confirmed in the Government service on 01.05.1991. He was promoted to the post of Superintendent of Accounts on 01.05.2003 and posted to the Office of DCSO, Champhai where he joined on 07.05.2003. He was then transferred to the Office of DCSO, Aizawl East on 03.02.2004. He was again promoted to the post of Accounts Officer on 03.03.2015 and posted to the Office of DCSO, Aizawl East where he worked till his last breath. He was a conscientious and hard working Officer. The Government placed on record its deep appreciation of the sincere services ren- dered by Pu R. Lalthanzauva, and conveys its heartfelt sympat hy to the bereaved family. May his soul rest in peace. The Government of Mizoram has learnt with profound sorrow, the sad and untimely demise of Pu Lalzamliana Sailo, Superintendent, Finance Department (Establishment) on 30.04.2015. Pu Lalzamliana Sailo entered into Government Service as Assistant Grade through direct recruitment on 20.05.1988 and was posted in the Office of Deputy Commissioner of Excise. After that he was posted in Health & Family Welfare Department, DP&AR (CSW), as Private Secretary to the Opposition Leader, Office of SE, Building Circle, PWD and PWD (Secretariat). He was promoted to Junior Grade of MSS on 25.05.2012 and posted as Superintendent in the Office of Deputy Commissioner, Mamit. He was transferred and posted to Finance Department (Establishment) on 22.04.2014, where he served till his sad demise. He served the Government of Mizoram for 26 years, 11 months and 10 days in various capacities with utmost sincerity and devotion, and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment to the post(s) of Lecturer, Government Higher Secondary School under School Educa tion Department, Government of Mizor am, namely :- 1.Shor t title and (1) These Rules may be called the Mizoram School Education Depar tment Commencement (Group ‘A’ posts) Recruitment Rules, 2015. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application These rules shall apply to the posts specified in Column 1 of Annexure-I her et o a nnex ed. 3. Number of posts, The number of the said post(s), classification and the scale of pay/ classification and scale of pay Band & G rade Pay attached thereto shall be as specified in pay/Pay Band & Grade Pay columns 2 to 4 of aforesaid Annexure-I. 4. Method of r ecruitment, The method of recruitment, age limit, qualification and other matters age limit, and other relating thereto shall be as specified in columns 5 to 14 of Annexure-I qualifications Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or Government of Mizora m from time to t ime. 5. Disqualification No person- (a ) who, has entered into or contracted a marr iage with a person having a spouse living; or - 2 - Ex-214/2015 (b) who, having a spouse living, ha s entered into or contracted a marriage with any other person, shall be eligible for appointment to t he said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other valid grounds for doing so, exempt any such person fr om the operation of this rules. 6.Training and Departmental Every Gover nment s ervant recruited under these rules s hall undergo Examination. such training or pass such Depa rtmental Examination as may be pres cribed from time to t ime. 7. Powers to trans fer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8. Power to relax Where the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing in consultation with the Mizoram Public Service Commission through the Depar tment of Personnel & Administr ative Reforms, relax any of t he provisions of these rules with respect to any class or category of persons. 9. Reservation and other Nothing in these rules shall affect any reser vation, relaxa tion of age concessions limit and other concessions required to be provided for the Scheduled Castes/the Schedu led Tribes and ot her ca tegor ies of persons in accordance with the orders issued by the Central Government or the Government of Mizoram from time to time in this regard. 10. Repea l and Sa ving All Rules pertaining to the post framed by the Government of Mizoram notified vide No. A. 12018/14/80-APT/Vol-II dated 20.3.1996 and issued in the Mizoram Gazette Extraordinary Issue No. 121 dated 03.04.1996 and Notification No. A. 12018/19/2003-P&AR(GSW), dt. 08.02.2005 and published in the Mizoram Gazette Extraordinary Issue No. 32, dated 24.02.2005 stand hereby repealed. Further, School Education Department Notification No. G. 12017/2/2011-EDN, dt. 04.12.2012 also stands hereby repealed. Provided that any order made or anything done or any action taken under the rules so repealed or under any general orders ancillary thereto, shall be deemed to have been made, done or taken under the corresp onding provisions of these Rules.
