In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment to the post(s) of Assistant Hindi P ropagation Officer under School Educa tion Department, Government of Mizor am, namely :- 1.Short Title and(1) These Rules may be called the Mizoram Education and Human Resources CommencementDevelopment Department (Group ‘B’ post) Recruitment Rules, 2012. (2) They shall come into force from the date of their publication in the Official Gazette. 2.ApplicationThese rules shall apply to the posts specified in Column 1 of the Annexure-I annexed to these rules. 3.Number of posts,The number of the said post(s), their classification, Pay Band and classification, pay bandGrade pay/pay scale attached thereto shall be as specified in columns 2 and grade pay/pay scaleto 4 of the said Annexure-I. 4.Method of recruitment,The Method of recruitment, age limit, qualifica tion and other ma tters age limit,rela ting to the sa id post(s) shall be as specified in columns 5 to qualifications, etc14 of the aforesaid Annexure-I Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram from time to time. 5.DisqualificationNo person- (a ) who has entered int o or contracted a marr iage with a person having a spouse living; or - 2 - Ex-273/2012 (b) who, having a spouse living, ha s entered into or contracted a marriage with any other person, shall be eligible for appointment to t he said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any such person from the operation of this rule. 6. Training andEvery Gover nment servant r ecruited under these rules shall undergo Departmentalsuch training or pass such Departmental Examination as may be Examinationpres cribed from time to t ime. 7.Powers to transferNotwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the right and power to tra nsfer a ny officer so r ecr uited under thes e rules to a ny other post or position which is equivalent in rank or gr ade. 8.Power to relaxWher e the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing andin consultation with the Mizoram Public Service Commission through the Department of Personnel and Administrative Reforms, relax any of the provisions to these rules wit h respect to a ny class or category of persons. 9.Reservation and otherNothing in these rules s hall affect reservation, relaxation of age concessionslimit and other concessions required to be provided for the Scheduled Castes/the Schedu led Tribes and ot her ca tegor ies of persons in accordance with the orders issued by the C entral Government or the Government of Mizoram from time to time in this regard. 10.Repeal and SavingAll rules pertaining to these posts framed by the Government of Assam and Government of Mizora m under Notification No. A. 12018/6/2003-P&AR(GSW) dated 6.7.2004 Issue No. 253 dated 17.8.2004 stand hereby repealed. AN ACT to amend the Lai Autonomous District Council (Land Holding and Settlement) Act, 2002 (hereinafter referred to as the Principal Act). Be it enacted by the Lai Autonomous District Council in the Fifty Ninth year of Republic of India as follows :- 1.Short Title, Extend and Commencement. (1)This Act may be called the Lai Autonomous District Council (Land Holding and Settlement) (Amendment) Act, 2008. (2)It shall ha ve the like ext ent as the Principal Act. (3)It shall come into force fr om the date of publication in the Mizoram Gazette. 2.Amendment of Section 2. In the Principal Act, under clause (k) of Section 2, the words, “for the pur pose of this Act” shall be inserted between the words “includes” and “an Institution.” 3.Amendment of Section 3. P. Singthanga, Secr etary to the Govt. of Mizoram, District Council Affairs Department. AN ACT to amend the Lai Autonomous District Council (Land Holding and Settlement) Act, 2002 (hereinafter referred to as the Principal Act). Be it enacted by the Lai Autonomous District Council in the Fifty Ninth year of Republic of India as follows :- 1.Short Title, Extend and Commencement. (1)This Act may be called the Lai Autonomous District Council (Land Holding and Settlement) (Amendment) Act, 2008. (2)It shall ha ve the like ext ent as the Principal Act. (3)It shall come into force fr om the date of publication in the Mizoram Gazette. 2.Amendment of Section 2. In the Principal Act, under clause (k) of Section 2, the words, “for the pur pose of this Act” shall be inserted between the words “includes” and “an Institution.” 3.Amendment of Section 3. (1)In the Principal Act, for sub-section (4) of S ection 3, the following shall be substituted, namely :- - 2 - Ex-276/2011Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. C/500 (4) “Permit Holder” is a person to whom a permit has been given for construction of a house or other non-agricultural purposes such a s Stone Quarry, Shop, Market. The permit shall be valid for three years only if the permit holder does not make use of the permit within tha t period.” (2)In the Pr incipal Act, for sub-section (5) of Section 3, the following shall be substituted, namely :- (5) “Pass Holder” is a person to whom a pass ha s been given for mixed farming. The pass shall be valid for three years only, if the pa ss holder does not ma ke use of the pass within that period.” 4.Insertion of new sub-s ection (6 ) under Section 3. In the Principal Act, under Section 3, the following new sub-section (6) shall be inserted, namely :- (6) No pass or permit shall be issued to any person who is not a permanent resident of the locality.” B.
