AND WHEREAS some land owners within Ka wnpui ar ea who claimed that their lands were taken over by the Railways Author ities but not included in the Award No. 1 of 2012 had approached the Hon’ble Court for inclusion of their land for acquisition . AND WHEREAS, pursua nt to t he Hon’ble Cou rt Order dt. 17.02.2015 a Fact Finding Committee was constit uted to verify the lands of t he Petit ioners i.e. Pa kunga & 6 others in WP (C)36/2017. AND WHEREAS, the Fact Finding Committee recorded that the lands of the petitioners i.e. Pakunga & 6 Ors. are actually acquired by Railway Authorit ies. Hence, Supplementary Draft Award 1 of 2019 (Kawnpui Area) was assessed for additional acquisition of land for Bairabi - Saira ng B.G. Railway line a mounting to ^ 1,67,82,546/- (R upees one crore sixty seven lakh eighty two thousand five hundred forty six) only was submitted by the District Collector, Kolasib District. No. NE-313(MZ) 2006-2008NOTIFICATIONNo. H. 11019/3/18-JERC, the 9th July, 2019.In exercise of powers conferred under Section 50 read with Clause (x) of Sub-section (2) of Section 181 of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in this behalf, the Joint Electr icity Regulatory Commission for Manipur & Mizoram hereby makes the following Regula tions to amend the Joint Electricity Regulatory Commission for Manipur & Mizoram (Electricity Supply Code) Regulations, 2013 (hereinafter referred to as “the Principal Regulations”), namely; 1.Short title and commencement (1) This Regula tion may be called the Joint Electricity Regulator y Commission for Manipur & Mizoram (Electricity Supply Code) (Twelfth Amendment) Regulations, 2019. (2) This Regulation sha ll extend to the whole States of Manipur and Mizoram and shall apply in relation to all matters fa lling within the jurisdiction of the Commission. (3) This Regulations sha ll come into force from the date of their notifications in the Official Gazette of t he concerned Sta tes. 2 . Amendment in Regulation 6 of the Pr incipal Regulations: Clause 6.28 of the Joint Electricity Regulatory Commission for Manipur and Mizoram (Electricity Supply Code) Regulations, 2013 shall be substituted as below: 6.28 In cases where MDI is insta lled the assess ment of billing of fixed char ge shall be made as per the provisions of the Tariff order. In cases where no MDI is installed, the fixed charge for excess load shall be billed at two times the rate applicable in the tariff order. The excess loa d shall be computed as below: (1) In domestic category, 70% of the difference between the actual connected load and the cont racted load; (2) In other cases difference b etween the actual connected load and the contracted load.
