In supersession of this Department’s Notification No.B.13012/83/2010-DMR dt. 20th December, 2010 regarding constitution of State Executive Committee and in pursuance of the provision under S ection 20 of the State Disaster Management Act, 2005 in order to assist the Sta te Disaster Management Authority in the performa nce of it s functions and to coordina te actions in accordance with the guidelines laid down by the State Authority and ensure compliance of directions issued by the State Government under the S aid Act , the Governor of Mizor am is pleased to re-constitute the ‘State Executive Committee’ with the following compositions with immediate effect and until further orders : 1.Chief Secretary-Chairman 2.Secretary, Home-Member 3.Fina nce Commissioner-Member 4.Secretary, Pla nning-Member 5.Secretary, Disaster Management & Rehabilitation -Member-Secretary 2.1 Powers & Funct ions. The State Executive Committee shall be the responsible for implementation of the National Plan and State Plan and act as the coordinating and monit oring body for disaster management in the State. 2.2 Without prejudice to the generality of the provisions of sub-section (1) of Sec. 22 of t he Disa ster Management Act, 2005, the State Executive Committee may - (a ) coor dinate and monitor the implementation of t he National Plan and State P lan; (b) examine the vulner ability of the different par ts of the State to different forms of disasters and specify measures to be taken for their p revention and mitigation; (c ) lay down guidelines for pr eparation of disaster management plans by the departments of the government of the State and District Authorit ies; (d) monitor the implementation of disa ster ma nagement plans prepared by the departments of the government of the State and District Authorit ies; ( e) monitor the implementation of the guidelines laid down by the State Authority for int egrating of measures for prevention of disasters and mitigation by the depar tments in their development plans and projects; (f) evaluate preparedness at all governmental or non-governmental levels to respond to any threatening disaster situa tion or disaster and give directions, where necess ary, for enhancing such preparedness; (i)promote general education, awareness and community training in regard to the forms of disasters to which different parts of the State are vulnerable and the measures that may be taken by such community to prevent the disaster, mitiga te and respond to such disaster; (j)advise, assist and coordinate the activities of the Departments of the Government of the State, District Authorities, Statutory Bodies and other governmental and non-governmental orga nizations engaged in disaster management; (k) provide necessary technical assistance or give advice to District Authorities and local authorities for carrying out their functions effectively; (1) advise the State Government regar ding all financial matters in relation to disaster management; (m) examine the constr uction, in any local area in the Sta te and, if it is of the opinion that the standards laid for such construct ion for the prevention of disa ster is not being or has not been followed, may direct the District Author ity or the loca l authority, a s the case may be, to take such action as may be necessary to secure compliance of such standa rds; (n) provide informa tion to the National Authorit y relating to differ ent aspects of disaster mana gement ; (o) lay down, review and update State level r esponse plans a nd guidelines and ensu re that the district level pla ns are prepar ed, reviewed a nd upda ted; (p) ensu re that communication system are in order and the disaster mana gement drills are car ried out periodically; (q) perform such other functions as may be assigned to it by the State Authority or as it may consider necessary; 3.For the pur pose of, assisting and protecting the community affected by disaster or providing relief to such community or, preventing or combating disruption or dealing with the effects of any threatening disaster situation, the State Executive Committee may- (a ) cont rol and restrict, vehicular traffic to, form or within, the vulnerable or affected a rea; (b) cont rol and restrict the entry of any person into, his movement wit hin and departure from, a vulnerable or affected a rea; (c ) remove debris, condu ct sear ch and carry out rescue operations; (d) provide shelter, food, drinking water, essential provisions, healthcare and services in accordance with the sta ndards laid down by the National Authority a nd State Author ity; ( e) give dir ection to t he concerned Depa rtment of the Government of the State, and District Authority or other authority, within the local limits of the St ate to take such measures or steps for rescue, evacuation or providing immediate relief saving lives or property, as may be necessary in its opinion; (f) require any department of the Government of the S tate or any other body or authority or person in charge of any relevant resources to make ava ilable the resources for the purposes of emer gency r esponse, rescue and relief; (g) require exp erts and consultants in the field of disasters to provide advice and assistance for rescu e and relief; (h) procure exclusive or prefer ential use of a menities from a ny authority or person as and when required; (i)construct tempora ry bridges or other necessa ry str uct ures a nd demolish unsafe structur es which may be hazardous to public; - 3 -Ex-235/2019 (j)ensu re that non-governmental orga nizations carr y out their activities in an equitable and non- discriminatory manner; (k) disseminate information to public to deal with any thr eatening disaster situation or disaster; (1) take such steps as the Central Government or the State Government may direct in this regard or take such other steps as are required or war ranted by the form of any threatening disa ster situation or disaster; 4.The Chairperson of the Sta te Executive Committee shall exercise such powers and such functions as may be prescribed by the State Government and such other powers and functions as may be delegated to him by the State Authority. 5.The procedures to be followed by the State Executive Committee in exercise of its powers and its functions shall be as prescribed by the State Government. 6.The State Executive Committee may, as and when consider necessary, constitute one more sub- committee for efficient discharge of its functions. (i)promote general education, awareness and community training in regard to the forms of disasters to which different parts of the State are vulnerable and the measures that may be taken by such community to prevent the disaster, mitiga te and respond to such disaster; (j)advise, assist and coordinate the activities of the Departments of the Government of the State, District Authorities, Statutory Bodies and other governmental and non-governmental orga nizations engaged in disaster management; (k) provide necessary technical assistance or give advice to District Authorities and local authorities for carrying out their functions effectively; (1) advise the State Government regar ding all financial matters in relation to disaster management; (m) examine the constr uction, in any local area in the Sta te and, if it is of the opinion that the standards laid for such construct ion for the prevention of disa ster is not being or has not been followed, may direct the District Author ity or the loca l authority, a s the case may be, to take such action as may be necessary to secure compliance of such standa rds; (n) provide informa tion to the National Authorit y relating to differ ent aspects of disaster mana gement ; (o) lay down, review and update State level r esponse plans a nd guidelines and ensu re that the district level pla ns are prepar ed, reviewed a nd upda ted; (p) ensu re that communication system are in order and the disaster mana gement drills are car ried out periodically; (q) perform such other functions as may be assigned to it by the State Authority or as it may consider necessary; 3.For the pur pose of, assisting and protecting the community affected by disaster or providing relief to such community or, preventing or combating disruption or dealing with the effects of any threatening disaster situation, the State Executive Committee may- (a ) cont rol and restrict, vehicular traffic to, form or within, the vulnerable or affected a rea; (b) cont rol and restrict the entry of any person into, his movement wit hin and departure from, a vulnerable or affected a rea; (c ) remove debris, condu ct sear ch and carry out rescue operations; (d) provide shelter, food, drinking water, essential provisions, healthcare and services in accordance with the sta ndards laid down by the National Authority a nd State Author ity; ( e) give dir ection to t he concerned Depa rtment of the Government of the State, and District Authority or other authority, within the local limits of the St ate to take such measures or steps for rescue, evacuation or providing immediate relief saving lives or property, as may be necessary in its opinion; (f) require any department of the Government of the S tate or any other body or authority or person in charge of any relevant resources to make ava ilable the resources for the purposes of emer gency r esponse, rescue and relief; (g) require exp erts and consultants in the field of disasters to provide advice and assistance for rescu e and relief; (h) procure exclusive or prefer ential use of a menities from a ny authority or person as and when required; (i)construct tempora ry bridges or other necessa ry str uct ures a nd demolish unsafe structur es which may be hazardous to public; - 3 -Ex-235/2019 (j)ensu re that non-governmental orga nizations carr y out their activities in an equitable and non- discriminatory manner; (k) disseminate information to public to deal with any thr eatening disaster situation or disaster; (1) take such steps as the Central Government or the State Government may direct in this regard or take such other steps as are required or war ranted by the form of any threatening disa ster situation or disaster; 4.The Chairperson of the Sta te Executive Committee shall exercise such powers and such functions as may be prescribed by the State Government and such other powers and functions as may be delegated to him by the State Authority. 5.The procedures to be followed by the State Executive Committee in exercise of its powers and its functions shall be as prescribed by the State Government. 6.The State Executive Committee may, as and when consider necessary, constitute one more sub- committee for efficient discharge of its functions. No. 5 of 2019) (Received the assent of the Governor of Mizoram on 26.3.2019) AN ACTto amend the Registration Act, 1908 in its application to the State of Mizoram WHEREAS it is expedient to amend the Registration Act, 1908 (Central Act 16 of 1908), in its application to the State of Mizora m for the purposes hereinafter appear ing; BE it enact ed by t he Legislative Assembly of M izoram in the Seventieth year of the Republic of India as follows:- 1. Short title, extent and commencement.- (1) This Act may be called the Registration (Mizoram Amendment) Act, 2019. (2) It extend to the whole of the State of Mizoram except the Autonomous District Council a reas of Lai, Mara and Cha kma. (3) It shall come into force on such date as the Sta te Gover nment may, by notifica tion in the official Ga zette, a ppoint and different dates may be appointed for different sections and ar eas. 2 . Amendment of Section 69: In section 69 of the Registration Act, 1908 (Central Act 16 of 1908) (hereinafter referred to as the Principa l Act), in sub-s ection (1),- (a ) clause (i) shall be omitted; (b) after clause (j), the following clauses shall be inserted, namely:- VOL - XLVIII Aizawl, Monday 8.4.2019 Chaitra 18, S.E. 1941, Issue No. 238 - 2 - Ex-238/2019 “(k) regulating the procedure for presentation of va rious types of documents, appearance of executants for admission of execution, endorsements, a nd the manner of fixing signa ture and seal of registering officer, mode of payment of registration fees and otherfees and such other processes when the document is presented forregistr ation by electr onic means; (1) regulating the process of registr ation r eferred to in sub-section (1) of section 70 C by using electronic or other devices and printers including storage, retrieval and preservation and also the manner in which documents are indexed and certified copies, encumbr ance cert ificat es iss ued; (m) providing the manner in which and the safeguards subject to which the books may be kept in computer or in any other electronic for m under sub-section (1 ) of section 16 A; (n) regulating the procedure for taking of photograph of identifying witnesses to a docu ment pres ented befor e a r egister ing officer; (o) providing for online registration of documents a nd enquiry before the registering officer when the document is presented befor e the register ing officer by electronic means at any office of the r egistering officer; (p) providing for scanning the documents for their safety in electronic form; (q) providing for sending of memoranda of documents registered in elect ronic form; (r ) regulating the manner of r ecopying of books, indexes or portions thereof; (s) the time within which and t he manner of hearing and disposing of appeals under sub- section (3) of section 80-A; (t ) the manner of cancellation and the procedure to be adopted under sub-section (2) of section 82; and (u) any other matter which is required to be, or ma y be, p rescribed.” 3. Insertion of new Part XI-A: After section 70 of the Pr incipal Act, the following new Part and sections shall be inserted, namely: “PART XI-A REGISTRATION OF DOCUMENTS BY MEANS OF ELECTRONIC OR OTHER DEVICES. 7 0 - A. Application of this part.-This part shall apply only to the areas in respect of which a notifica tion is issued by the State Government under section 70-C. 7 0 - B . Definition.-In t his part, “Process of R egistra tion of documents by means of electronic or other devices” shall mean and include maintaining various Books in electr onic forms, scanning and preservation of documents with the help of computers, scanners and any other device used for the purpose of storage a nd retr ieval when required. 70-C . Process of registration of documents by means of electronic or other device in the areas notified by the State Government- (1) The State Government may, by notification, direct any District or Sub-District specified in this behalf that process of registration by means of electronic or other device shall be applicable and the documents admitted for Registration under this Act may be scanned or micro- filmed and their images stored a nd preserved with the help of electr onic or any other device. (2) On the issue of such notification, it sha ll be pa sted in a conspicuous place a t each registra tion office affected by the notification. 7 0 - D . App lica tion of Act to areas notified under section 70-C -In any District or Sub-District in resp ect of which notification has been issued under section 70-C, the following provisions of the Principal Act shall, for the purpose of this pa rt be subject to the following modifications, namely:- - 3 -Ex-238/2019 (a ) in clause (2) of section 2, the words “a nd the information, storage devices or any other media” shall be inserted at the end; (b) in section 16, for sub-section (1), the following shall be substituted, namely:- (1) “The State Government shall provide for the office of Registering Officer the books and the information, or image processing and storage devices or computer and scanners along with the softwar e prescribed by the Ins pector General from time to time necessary for the purpose of this Act.” (c ) in s ection 51, in sub-section (1), for the words “ The following books” the words, figures and brackets “The following books and the information or storage devices as specified in sub-s ection (1) of section 16” sha ll be substituted. (d) in clause (c) of sub-section (1) of section 52 after the words “book appropriate therefor” the word “or stored in the electr onic or other storage device” shall be inserted. ( e) in section 54, aft er the word “copied” the words “or stored in the electronic or other stor age device” shall be inserted. (f) in s ub-section (1) of section 60, after t he word “copied” the words “or where the document is stored in an electronic or other device the certificate shall contain the word “ Registered” with Document No, Year, Book No. and Date” shall be inserted. (g) in section 61,- (i) in t he heading aft er the word “copied” the word “or stored in the electronic or other storage device” shall be inserted. (ii) after sub-s ection (1), the following shall be inserted, namely:- “Provided that, where the process of registration is done by using electronic or other devices, such endorsements and certificate shall also be stor ed with it along with the copy of the map or plan: Provided further t hat, the Registering Officer shall a fter the storage for preserva tion of t he document shall also endorse thereon on the original, the refer ence to the serial No. of the file, pa ges and compact disk or any other stor age device, as the case may be, wher e su ch docu ment is preserved”. (h) in section 89, in sub-sections (1), (2), (3) and (4) the following shall be inserted at the end, namely:- “ or shall get the same scanned, stored and pr eserved on the electr onic or other device, as the ca se may be.” 70-E . Evidentiary value of copy of certain documents registered through t he pr ocess of registr ation by means of electronic or other devices or by other methods.- Notwithstanding anything contained in this Act or any other law for the time being in force, a copy of a ny document registered through the process of registration by means of electronic or other devices or by any other method a nd certified or attest ed by the Registering Officer in charge of the office shall also be received in evidence of any transaction as is described in the sa id document. 70- F. Saving.- Nothing in this part shall apply: (1) to a ny docu ment which in t he opinion of the Registering Officer is not in a condition fit t o be processed by means of electronic or other devices; (2) in the case of unforeseen eventuality like br eak-down of the elect ronic or other devices of registration: Provided tha t the Registering Officer shall recor d in wr iting the reasons therefor: - 4 - Ex-238/2019 Provided fu rther that the Registering Officer shall ensure that the data and images of the documents registered during t he period of non-application of this part du e to a break-down of electronic or other device a re duly incor pora ted into t he system, after the sa me is r e-stor ed in the ma nner specified in the r ules by the Inspector Genera l of Registration. 70-G. Powers of the State Government under this Pa rt.-Where for any reason, the State Government is satisfied that, the process of R egistra tion by means of electronic or other device is not possible in respect of all documents in any office to which this part applies, ma y direct by notification publish in the official Ga zette to copy such documents in the books kept in the office and in accordance with the rules made for this purpose”. 4.Insertion of new Section 78-A:After section 78 of the Principal Act, the following section shall be inserted, na mely: “78-A. Power to r edu ce or remit fees .-The State Government may by rule or or der publish in the Official Ga zette, reduce or remit, whether prospectively or retrospectively, in the whole or any part of the territories under its administr ation, the fees chargeable in respect of any instrument or class of instruments, or in r espect of any class of instr uments when executed by or in favour of the State Government or a ny person or class of persons”. 5.Insertion of new Section 80-A:After section 80 of the Principal Act, the following new sections shall be inserted, namely: “80-A. Recovery of deficit registration fee and refund of excess fee.- (1) Notwithstanding anything contained in section 80, after the registrationof adocu ment, if it is found that the fee paya ble under this Act, in relation to that docu ment ha s not been paid, or has been insufficiently pa id, such fee for the deficit, as the case may be, on a cer tificate of the Registering Officer, be recovered from the person who presented such document: Provided that no such certificate shall be issued unless an inquiry is made and such person is given an opportunity of b eing heard: Provided fur ther that no s uch inquiry sha ll be commenced after the exp iry of such period, after the date of the registration of the document, as may be specified by the State Government. (2) The certificate of the registering officer issued under sub-section (1) shall, subject to appeal under sub-section (3), be final. (3) Any person aggrieved, by certifica te of t he registering officer under sub-section (1), may p r efer a n a p p ea l t o t he R egis t r a r if it is a c er t ifica t e of t he S u b -R egis t r a r, or t o t he Ins p ect or- General of Registration if it is a certificate of the Registrar, and all such appeals shall be preferred within such time and be heard and disposed ofinsuch manner as ma y be prescribed. (4) Wher e the R egistra r finds that the amount of fee char ged and paid is in excess of that which is legally chargeable and payable under this Act, he may, upon a n application in writing or otherwise, refund the excess amount of fee so charged and paid. (5) An application for the refund of registra tion fee, referred to in sub-section (1), shall be made within a period of six months from the date of r egistration: Provided that after the expiry of the period of six months fr om the date of registration, the State Government ma y entertain the application up to a period of one year, and direct the Registrar to refund the excess amount of fee so charged and paid within the period of six months from such direction.” 6.Insertion of new Part after Part XIII: After Part XIII of the Principal Act, the following new Part shall be inserted,. namely: “PART XIII-A OF DEED WRITERS 8 0 - B . Deed Writers to hold licenses.-No person other tha n an a dvoca te or other registered lega l practitioner, write deeds unless he holds a license gra nted in accordance with rules made under section 69". 7.Amendment of section 82:In s ection 82 of the Principal Act, the existing sub-heading shall be re-numbered as sub-section (1) having the existing clauses (a),(b), (c) and (d) and a new sub- section (2) shall be inserted, namely :- “(2) In addition to the punishment specified under sub-section (1), documents referred to in clauses (b) and (c) of sub-section (1) shall be liable for canc ellation in su ch manner and p rocedur e as may be prescribed by the State Government.” 8.Insertion of new section 82-A:After section 82 of the P rincipa l Act, the following new section shall be inserted namely: “ 82-A. Pena lt y in respect of deed writers.- Whoever contravenes the provisions of section 80-B or any term or condition of a license granted under rules made under section 69, shall be punishable with imprisonment which may extend to one month or with fine which may extend to five hundr ed rupees or with both”. Process of registration of documents by means of electronic or other device in the areas notified by the State Government- (1) The State Government may, by notification, direct any District or Sub-District specified in this behalf that process of registration by means of electronic or other device shall be applicable and the documents admitted for Registration under this Act may be scanned or micro- filmed and their images stored a nd preserved with the help of electr onic or any other device. (2) On the issue of such notification, it sha ll be pa sted in a conspicuous place a t each registra tion office affected by the notification. 7 0 - D . App lica tion of Act to areas notified under section 70-C -In any District or Sub-District in resp ect of which notification has been issued under section 70-C, the following provisions of the Principal Act shall, for the purpose of this pa rt be subject to the following modifications, namely:- - 3 -Ex-238/2019 (a ) in clause (2) of section 2, the words “a nd the information, storage devices or any other media” shall be inserted at the end; (b) in section 16, for sub-section (1), the following shall be substituted, namely:- (1) “The State Government shall provide for the office of Registering Officer the books and the information, or image processing and storage devices or computer and scanners along with the softwar e prescribed by the Ins pector General from time to time necessary for the purpose of this Act.” (c ) in s ection 51, in sub-section (1), for the words “ The following books” the words, figures and brackets “The following books and the information or storage devices as specified in sub-s ection (1) of section 16” sha ll be substituted. (d) in clause (c) of sub-section (1) of section 52 after the words “book appropriate therefor” the word “or stored in the electr onic or other storage device” shall be inserted. ( e) in section 54, aft er the word “copied” the words “or stored in the electronic or other stor age device” shall be inserted. (f) in s ub-section (1) of section 60, after t he word “copied” the words “or where the document is stored in an electronic or other device the certificate shall contain the word “ Registered” with Document No, Year, Book No. and Date” shall be inserted. (g) in section 61,- (i) in t he heading aft er the word “copied” the word “or stored in the electronic or other storage device” shall be inserted. (ii) after sub-s ection (1), the following shall be inserted, namely:- “Provided that, where the process of registration is done by using electronic or other devices, such endorsements and certificate shall also be stor ed with it along with the copy of the map or plan: Provided further t hat, the Registering Officer shall a fter the storage for preserva tion of t he document shall also endorse thereon on the original, the refer ence to the serial No. of the file, pa ges and compact disk or any other stor age device, as the case may be, wher e su ch docu ment is preserved”. (h) in section 89, in sub-sections (1), (2), (3) and (4) the following shall be inserted at the end, namely:- “ or shall get the same scanned, stored and pr eserved on the electr onic or other device, as the ca se may be.” 70-E . Evidentiary value of copy of certain documents registered through t he pr ocess of registr ation by means of electronic or other devices or by other methods.- Notwithstanding anything contained in this Act or any other law for the time being in force, a copy of a ny document registered through the process of registration by means of electronic or other devices or by any other method a nd certified or attest ed by the Registering Officer in charge of the office shall also be received in evidence of any transaction as is described in the sa id document. 70- F. Saving.- Nothing in this part shall apply: (1) to a ny docu ment which in t he opinion of the Registering Officer is not in a condition fit t o be processed by means of electronic or other devices; (2) in the case of unforeseen eventuality like br eak-down of the elect ronic or other devices of registration: Provided tha t the Registering Officer shall recor d in wr iting the reasons therefor: - 4 - Ex-238/2019 Provided fu rther that the Registering Officer shall ensure that the data and images of the documents registered during t he period of non-application of this part du e to a break-down of electronic or other device a re duly incor pora ted into t he system, after the sa me is r e-stor ed in the ma nner specified in the r ules by the Inspector Genera l of Registration. 70-G. Powers of the State Government under this Pa rt.-Where for any reason, the State Government is satisfied that, the process of R egistra tion by means of electronic or other device is not possible in respect of all documents in any office to which this part applies, ma y direct by notification publish in the official Ga zette to copy such documents in the books kept in the office and in accordance with the rules made for this purpose”. 4.Insertion of new Section 78-A:After section 78 of the Principal Act, the following section shall be inserted, na mely: “78-A. Power to r edu ce or remit fees .-The State Government may by rule or or der publish in the Official Ga zette, reduce or remit, whether prospectively or retrospectively, in the whole or any part of the territories under its administr ation, the fees chargeable in respect of any instrument or class of instruments, or in r espect of any class of instr uments when executed by or in favour of the State Government or a ny person or class of persons”. 5.Insertion of new Section 80-A:After section 80 of the Principal Act, the following new sections shall be inserted, namely: “80-A. Recovery of deficit registration fee and refund of excess fee.- (1) Notwithstanding anything contained in section 80, after the registrationof adocu ment, if it is found that the fee paya ble under this Act, in relation to that docu ment ha s not been paid, or has been insufficiently pa id, such fee for the deficit, as the case may be, on a cer tificate of the Registering Officer, be recovered from the person who presented such document: Provided that no such certificate shall be issued unless an inquiry is made and such person is given an opportunity of b eing heard: Provided fur ther that no s uch inquiry sha ll be commenced after the exp iry of such period, after the date of the registration of the document, as may be specified by the State Government. (2) The certificate of the registering officer issued under sub-section (1) shall, subject to appeal under sub-section (3), be final. (3) Any person aggrieved, by certifica te of t he registering officer under sub-section (1), may p r efer a n a p p ea l t o t he R egis t r a r if it is a c er t ifica t e of t he S u b -R egis t r a r, or t o t he Ins p ect or- General of Registration if it is a certificate of the Registrar, and all such appeals shall be preferred within such time and be heard and disposed ofinsuch manner as ma y be prescribed. (4) Wher e the R egistra r finds that the amount of fee char ged and paid is in excess of that which is legally chargeable and payable under this Act, he may, upon a n application in writing or otherwise, refund the excess amount of fee so charged and paid. (5) An application for the refund of registra tion fee, referred to in sub-section (1), shall be made within a period of six months from the date of r egistration: Provided that after the expiry of the period of six months fr om the date of registration, the State Government ma y entertain the application up to a period of one year, and direct the Registrar to refund the excess amount of fee so charged and paid within the period of six months from such direction.” 6.Insertion of new Part after Part XIII: After Part XIII of the Principal Act, the following new Part shall be inserted,. namely: “PART XIII-A OF DEED WRITERS 8 0 - B . Deed Writers to hold licenses.-No person other tha n an a dvoca te or other registered lega l practitioner, write deeds unless he holds a license gra nted in accordance with rules made under section 69". 7.Amendment of section 82:In s ection 82 of the Principal Act, the existing sub-heading shall be re-numbered as sub-section (1) having the existing clauses (a),(b), (c) and (d) and a new sub- section (2) shall be inserted, namely :- “(2) In addition to the punishment specified under sub-section (1), documents referred to in clauses (b) and (c) of sub-section (1) shall be liable for canc ellation in su ch manner and p rocedur e as may be prescribed by the State Government.” 8.Insertion of new section 82-A:After section 82 of the P rincipa l Act, the following new section shall be inserted namely: “ 82-A. Pena lt y in respect of deed writers.- Whoever contravenes the provisions of section 80-B or any term or condition of a license granted under rules made under section 69, shall be punishable with imprisonment which may extend to one month or with fine which may extend to five hundr ed rupees or with both”.
