VOL - XLVIII Aizawl, Friday 22.2.2019 Phalguna 3, S.E. 1940, Issue No. 127 - 2 - Ex-127/2019 3.FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisor y Board will b e the Screening Board in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board shall ha ve to judiciously examine the applicant’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board shall have its sittingat least twicein a year or as may be required and TA shall be given to the members of the Boar d if the place of sitting is more t h a n 8 ( e i g h t ) k i l o me t e r f r o m t h e headquarter of the member. The Secretary SAAB sha ll issue Meeting Notice in consultation with the Chairman by giving at least 10 (ten) days in adva nce to the member of S AAB. 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (L and Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any category or purpose must be submitted to the Settlement Officer or Assistant Settlement Officer if Chairman of SAAB is the Deputy Commissioner of the District. In case, Chair man of S AAB is SDO (C) or BDO or President, Village Council the application for land allotment of any category must b e submitted to the concerned Chair man. 5.The Board shall make initial screening of the application with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land b y Surveyor, Revenue Depar tment in the pr esence of the applica nt, the concerned VC a nd neighbouring land holder, if any. Measurement of land should be accurate and NOC shall be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. T he recommendation of the meeting of Board sha ll be submitted to the concerned District Revenue Officer for further submission to the Government through the Director, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the a rea or potentia l obstr uction to future infra structure development work of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroa chment) Act, 2001 as a mended from time to time. 9.The term of the Boa rd shall be three year s. The Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public. R. Power to transfer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be recorded in writing through the Department of Personnel & Administrative Reforms, relax any of the provisions of t hese rules wit h respect to any class or category of persons. 9. The Government of Mizoram has learnt with deep sorr ow the sad and untimely demise of Dr.C.Laldailova , V.O, Khawzawl on 18.02.2019. Dr. C. Lalda ilova was born on 18.11.1980 a nd entered into the Government service on 08.04.2008 as Veterinary Assistant Surgeon. He was posted as Veterinary Assistant Surgeon at Sa nga u, VAS S angau (Atta ched to Lawngtla i) Hna hlan, Ruantla ng and K hawzawl where he served till his end. He served the Government of Mizoram for 10 years, 10 months and 10 days with utmost sincerity and devotion, and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. The Government place on record its deep appreciation of the service rendered by Dr.C.Laldailova and convey its heartfelt sympathy and condolence to the bereaved family. On 10.6.1996 he was deputed to RD Department and posted at Aibawk as AEO . On 16.01.2012 he was transferred to Horticulture Department and posted at Directorate. On 24.05.2012 he was transferred to Mamit Sub-Division. On 23.12.2015 he was promoted to Mizoram Horticultur e Service Grade-IV (HDO) and posted at Directorate of Horticultur e and held the post till he passed away. He served the Government with sincerity and devotion to duty, a nd endeared himself to all his colleagues. He proved himself to be a tota lly conscientious officer. VOL - XLVIII Aizawl, Tuesday 12.3.2019 Phalguna 21, S.E. 1940, Issue No. 149 No.B.13011/1/90-DCA, the 8th March, 2019.In exercise of the powers conferred by paragraph 7(2) read with paragraph 20 BB of the Sixth Schedule to the Constitution of India, read with rule 20 of the Delegation of Financial Powers Rules, 1978 and with the approval of Comptroller and Auditor General of India conveyed by Accountant General of Assam, Meghalaya and Mizoram at Shillong Vide letter No.MTM/ 28-IV/88/831 Dt.15.2.91, the Governor of Mizoram is pleased to make the following rules, governing grants- in-aids to the Autonomous District Council in Mizoram, namely :-Short title and 1.(i) These rules may be called the Mizoram Autonomous District Councils commencement (Grants-in-aid) Rules, 2018 (ii) They shall come into force on the date of their publication in the Official Gazette. Definitions 2.In these rules, unless the context other wise requir es, (a ) “Accountant General” means the Accountant General, Mizoram at Aizawl ; (b) “Chairman” means the Chairman of a District Council duly elected as such under the provisions of the rules made either under paragraph 2 (6) or 2(7) of the Sixth Schedule to the Constitution of India, as the case maybe ; - 2 - Ex-149/2019 (c ) “Chief Executive Member” means the Chief Executive Member duly elected / appointed under the provisions of the rules made under the paragraph 2(6) or under paragraph 2(7) of the Sixth Schedule to the Constitution of India, as the case may be; (d) “Controlling Officer” means Executive Secretary of the District Council; (e) “District Council” means the District Council of each of the Autonomous Districts of Lai, Mara and Chakma constituted under the provisions of paragraph 20-B of the Sixth Schedule to the Constitution of India; (f) “Executive Committee” means the Executive Committee of a duly constituted District Council and includes all the Executive Members thereof ; (g) “Executive Secretary” means Secretary to the Executive Committee of the District Council concerned; (h) “Governor” means the Governor of the State of Mizoram.Sanction of 3.The Governor may, from time to time, sanction grants-in-aid to the District grants-in-aid Council for running of administration as well as developmental activities in the various fields within the territorial jurisdiction of the District Councils. Grants-in-aid to be 4.The tota l gra nts-in-a ids for a fina ncia l year shall be within the limit of the within limit of budget budget provisions made in this behalf, passed by the Legislative Assembly provision of the State of Mizoram. Satisfaction of Governor 7.The Governor must be satisfied that the District Councils have the necessary before sanction ways and means to spend the amount of grants and utilise the same in the best interest of the people and that there is no likelihood of any corrupt practice in the utilisation of such grants for the purpose for which they are sanctioned. Grants-in-aid in 8.Grants-in-aid in the Capital Sector of outlay would be subject to specific Capital Sector and well worked-out schemes to be scrutinised and approved by the respective Technical Departments under the District Council and the Governor shall have the right to cause inspection and supervision over the execution of such schemes by any officer or authority as may be authorised by the Governor in this behalf at such intervals as may be determined by the Governor. On receipt of the report of inspection, the Governor may issue such directions as may be considered necessary to the District Council to rectify any defects brought out in the inspection report and the District Council Authorities shall be bound to carry out such directions. Only so much of grant shall be - 3 -Ex-149/2019 paid during any financial year as is likely to be expended during the year. The sanctioning authority shall use its direction in authorising payments according to the needs of the scheme.Power to withhold 9.The Governor shall have the power to withhold, keep in abeyance, or suspend, grants-in-aid at any time, any amount sanctioned as grants-in-aid in respect of any item or items for which such grants may be issued even after the amount has been credited to the District Fund of the District Council concerned. Responsibility of the 10. The Executive Committee and the Chief Executive Member shall be jointly executive Commit tee and severally responsible for expenditure incurred in respect of grants-in and Chief Executive aid to the District Council. Member Action for Non- 11. The Governor shall have the right to take suitable action including legal compliance with action against the Chief Executive Member and or any or all of the Members rules of the Executive Committee or against the Executive Secretary in case of any material departure in regard to the compliance with these rules. Controlling Officer 12. (1) The Executive Secretary concerned shall be the controlling officer with r egar d to the grants-in-a id sa nct ioned by the Government to a Distr ict Council. T he gra nts sha ll be dr awn b y the Head of Depar tment of Fina nce & Accounts Depar tment of t he District Council after being countersigned by the Contr olling Officer who will maintain records of the grants so drawn in a register in Form No.GFR 19. Only one out of the triplicate copies of the bills should be countersigned by the Controlling Officer for presentation to the Treasury or Sub-Treasury, as the case may be. Of the other two copies, one shall be kept in the District Council Office and the other in the Executive Secretary’s Office with the writ ing on top of the bill in red ink “Duplicate-not for payment” and “Triplicate-not for payment” respectively. (2) Assets acquired wholly or substantially out of Government grants should not, without the prior sanction of the Government, be disposed of, encumbered or utilised for any purpose other than those for which the grants were sanctioned. Maintenance of 13. District Council Authorities shall maintain separate accounts of the grants a ccounts in-aid given to them by the Government and shall also maintain a register for the same in the Form in Annexure-A of these rules, showing therein the accounts in respect of each scheme separately. T he account maintained by the District Council in regard to grants-in-aid shall be open to inspection by the Controlling Officer or such other officer as may be authorised in this behalf by the Governor. The District Council authorities shall abide by such instructions with regard to expenditure incurred and maintenance of accounts as may be given to them by the Controlling Officer. Utilisation Certificate 14. In respect of every instalment of grants, the District Council authorities for instalment shall submit Utilisation Certifica te to the Government on half year ly basis of grants i.e September and March of every financial year subject to the provision of rule 18. A copy of such certificate should be sent to the Accountant General by the District Council. - 4 - Ex-149/2019Re-appropriation 15. The District Councils shall not re-appropriate any fund allocated under the of fund sub-heads of ‘Salary’ and ‘wages’ for any other object or purpose except with prior approval of the Governor. Funds not to be 16. The District Councils sha ll not divert a ny funds sa nctioned for a specific diver t ed purpose for any other purpose. Quarterly Progress 17. Besides Utilisation Certificates, it will be obligatory on the part of the District Reports Council administration concerned to keep the Government informed about the progress of utilisation of the grants-in-aid from time to time by submitting Quarterly Progress Reports of expenditure and physical targets achieved. Full Progress Reports 18. In addition to Quarterly Progress Reports referred in Rule 17, the District Councils shall submit before the 30th June of ever y Calendar year, full progress repor t of expenditur e and physica l ta rgets achieved, dur ing the p receding financia l yea r separately in r espect of each scheme. Right to Call for 19. Both the Executive Secretary and the Government shall have the right to records call for and examine at any time the records of expenditure incurred by the District Councils of the grants-in-aid released in their favour. Release of grants 20No grants-in-aid may be sanctioned or released except on the basis of actual as per immediate and immediate requirement of funds by the District Councils to be ascertained requ ir ements from the balances lying in their Personal Ledger Accounts. Grants nto to be 21. No grants-in-aid should be paid in cash from the treasuries but transferred paid in cash to the Personal Ledger Accounts of the District Council which shall further be credited to the District Council Current Account for the drawal according to the immediate requir ement. Relaxation of the 22. The Governor shall have the power to relax any of the provisions of these provisions of these rules in justifiable circumstances or cases to his satisfaction. rules Repeal and Saving 23. The Mizoram Autonomous District Council (Grant-in-aid) Rules, 2003 is hereby rep ealed. Provided that notwithstanding such repeal, anything done or any action taken under the repealed rule shall be deemed to have been done or taken under the corresponding provision or provisions of these rules. The Governor shall have the right to take suitable action including legal compliance with action against the Chief Executive Member and or any or all of the Members rules of the Executive Committee or against the Executive Secretary in case of any material departure in regard to the compliance with these rules. Controlling Officer 12. (1) The Executive Secretary concerned shall be the controlling officer with r egar d to the grants-in-a id sa nct ioned by the Government to a Distr ict Council. T he gra nts sha ll be dr awn b y the Head of Depar tment of Fina nce & Accounts Depar tment of t he District Council after being countersigned by the Contr olling Officer who will maintain records of the grants so drawn in a register in Form No.GFR 19. Only one out of the triplicate copies of the bills should be countersigned by the Controlling Officer for presentation to the Treasury or Sub-Treasury, as the case may be. Of the other two copies, one shall be kept in the District Council Office and the other in the Executive Secretary’s Office with the writ ing on top of the bill in red ink “Duplicate-not for payment” and “Triplicate-not for payment” respectively. (2) Assets acquired wholly or substantially out of Government grants should not, without the prior sanction of the Government, be disposed of, encumbered or utilised for any purpose other than those for which the grants were sanctioned. Maintenance of 13. District Council Authorities shall maintain separate accounts of the grants a ccounts in-aid given to them by the Government and shall also maintain a register for the same in the Form in Annexure-A of these rules, showing therein the accounts in respect of each scheme separately. T he account maintained by the District Council in regard to grants-in-aid shall be open to inspection by the Controlling Officer or such other officer as may be authorised in this behalf by the Governor. The District Council authorities shall abide by such instructions with regard to expenditure incurred and maintenance of accounts as may be given to them by the Controlling Officer. Utilisation Certificate 14. In respect of every instalment of grants, the District Council authorities for instalment shall submit Utilisation Certifica te to the Government on half year ly basis of grants i.e September and March of every financial year subject to the provision of rule 18. A copy of such certificate should be sent to the Accountant General by the District Council. - 4 - Ex-149/2019Re-appropriation 15. The District Councils shall not re-appropriate any fund allocated under the of fund sub-heads of ‘Salary’ and ‘wages’ for any other object or purpose except with prior approval of the Governor. Funds not to be 16. The District Councils sha ll not divert a ny funds sa nctioned for a specific diver t ed purpose for any other purpose. Quarterly Progress 17. Besides Utilisation Certificates, it will be obligatory on the part of the District Reports Council administration concerned to keep the Government informed about the progress of utilisation of the grants-in-aid from time to time by submitting Quarterly Progress Reports of expenditure and physical targets achieved. Full Progress Reports 18. In addition to Quarterly Progress Reports referred in Rule 17, the District Councils shall submit before the 30th June of ever y Calendar year, full progress repor t of expenditur e and physica l ta rgets achieved, dur ing the p receding financia l yea r separately in r espect of each scheme. Right to Call for 19. Both the Executive Secretary and the Government shall have the right to records call for and examine at any time the records of expenditure incurred by the District Councils of the grants-in-aid released in their favour. Release of grants 20No grants-in-aid may be sanctioned or released except on the basis of actual as per immediate and immediate requirement of funds by the District Councils to be ascertained requ ir ements from the balances lying in their Personal Ledger Accounts. Grants nto to be 21. No grants-in-aid should be paid in cash from the treasuries but transferred paid in cash to the Personal Ledger Accounts of the District Council which shall further be credited to the District Council Current Account for the drawal according to the immediate requir ement. Relaxation of the 22. The Governor shall have the power to relax any of the provisions of these provisions of these rules in justifiable circumstances or cases to his satisfaction. rules Repeal and Saving 23. The Mizoram Autonomous District Council (Grant-in-aid) Rules, 2003 is hereby rep ealed.
