G.S.R. 1209(E).— In exercise of the powers conferred by the proviso to article 309 read with clause (5) of a rticle 148 of the Constitution and a fter consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules fur ther to amend the Central Civil Services (Leave) Rules, 1972, namely:- 1.(1) These rules may be called the Central Civil Services (Leave) (Fourth Amendment) Rules, 2018. (2) They shall come into force on the date of their publication in the Official Gazette. 2.In the Central Civil Services (Leave) Rules, 1972, ( A) in r ule 28, in sub -rule (1 ) for clauses (a), (b ) and (c), the following clau ses sha ll be s ubstitu ted, namely:- “(a) The leave account of every Government servant (other than a milit ary officer) who is serving in a Vacation Department shall be credited with earned leave, in advance’ intwo installments of five days each on the first day of Ja nuary and July of every calendar year. VOL - XLVIII Aizawl, Friday 15.2.2019 Magha 26, S.E. 1940, Issue No. 112 - 2 - Ex-112/2019 (b) In r espect of any year in which a Government Servant a vails a portion of the vacation, he shall be entitled to additional earned leave in such proportion of twenty days, as the number of days of vacation not taken bears to t he full vacation, provided thetot al ea r ned leave credited sha ll not exceed thirty days in a calendar year. (c ) If, in any year, the Government servant does not avail a ny vaca tion, earned leave will be as per Rule 26 instead of clauses (a ) and (b).”; (B) in r ule 29, for sub-rule (1), the following sub-r ule sha ll be substituted, namely:— “(1) The half pa y leave account of every Government servant (other than a milit ary officer and a Government servant serving in a Vaca tion Department) shall be credited with half pay leave in advance, in two installments of ten days each on the first day of January and J uly of every calendar year”; (C) in rule 43-C. (a) for sub-rule (1), the following sub-rule shall be substituted, namely”; “(1) Subject to the provisions of this rule, a female Government servant and single male Government servant may be granted child care leave by an authority competent to grant leave for a maximum period of seven hundred and thirty days during entire service for taking care of two eldest surviving children, whether for rearing or for looking after any of t heir needs, such as education, sickness and the like.”; (b) for sub-rules (3) and (4), the following sub-rules shall be substituted, namely:- “(3) Grant of child care leave to a female Government servant and a single male Government servant under sub-r ule (1) shall be subject to t he following conditions, namely:- (i)it shall not be granted for more than three spells in a calendar year; (ii) in case of a single female Government servant, the grant of lea ve in three spells in a calendar year shall be extended to six spells in a ca lendar year. (iii) it shall not ordinar ily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is satisfied about the need of child care leave to the probationer, pr ovided that the period for which such leave is sanctioned is minimal. (iv) child care leave may not be granted for a period less than five days at a time. (4) During the period of child care leave, a female Government servant a nd a single male Government servant shall be paid one hundr ed percent of the salary for the first three hundred and sixty five days, a nd at eighty percent of the sa lary for the next three hundred a nd sixty five days. Explanation.—Single Male Government Servant’ means - an unmarried or widower or divorcee Government serva nt. ”; (D ) for rule 44, the following rule sha ll be substituted, namely:- “44. Work Related Illness and Injury Leave:- The authority competent to grant leave ma y gr ant Work Related Illness a nd Injur y Leave (her ein aft er referred to as WRIIL) to a Government servant (whether permanent or tempora ry), who suffers illness or injury that is a ttributable to or aggr avated in the performance of her or his official duties or in cons equence of her or his official position subject to the provisions contained in sub-rule (1) of rule 19 of these rules, on the following conditions, namely : (1) Full pay and allowances shall be gr anted t o all employees dur ing the entire period of hospit a lisation on a ccount of WR IIL. (2) Beyond hospitalization, WR IIL sha ll be governed as follows: - 3 -Ex-112/2019 (a ) A Government servant (other than a milit ary officer) full pay and allowances for the six months immediately following hospitalisation and Half Pa y for twelve months beyond the said period of six months. The Half Pa y period may be commuted to full pay with cor resp onding number of da ys of Half Pay Leave debited from the employees leave a ccount. (b) For officers of Central Ar med Police Forces full pay and allowa nces for six months immediately following the hospitalisation and full pay only for the next twenty four months. (c ) For personnel below the ra nk of officer of the Central Armed Police Forces full pay and allowances, with no limit regarding period. (3) In t he case of persons to whom the Workmen’s Compensation Act , 1923 a pplies, the amount of leave sa lary pa yable under WRIIL shall be reduced by the amount of compensation paid under the Act. After this he was appointedas Inspector, FCS& CA Depa rtment on 27.1.1989and posted at different places viz. Office of the DCSO Aizawl, Ratu, W.Phaileng, Champhai and Office of the DCSO Aizawl ‘E’. He was promoted toAssistant Directoron 6.5.2004and posted a t Directorate of FCS & CA and later at Champhai. He was pr omoted again to the post ofDeputy Directoron17.10.2013and posted at Directorate of FCS & CA. He was transfer red and posted as DCSO Kolasib on10.10.2014and he rema ined at this post till his untimely demise at12:40AMon11th February, 2019. Application These rules shall apply to the posts specified in Column I of Annexure-I her et o a nnex ed. 3. Number of posts, The number of the said post(s), their classification and the Level in classification and the Pay Matr ix atta ched thereto shall be as specified in Column 2 to Level in Pay Matrix 4 of the said Annexure-I 4. Method of r ecruitment, The method of recr uitment of the said posts, age limit, qua lifications age limit and other and other matters r elating to the said post shall be as specified in qualifications Column 5 to 14 of Annexure-I; Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or Government of Mizora m from time to t ime. 5. Power to transfer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be r ecorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and Nothing in these rules shall affect any reservations, relaxation of age other concessions limit and other concessions requir ed to be provided for the Scheduled Castes/the Scheduled Tribes and other categories of persons in accorda nce with the order issued by Centr al Government or Government of Mizoram from time to time in this regard. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be r ecorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. VOL - XLVIII Aizawl, Friday 15.2.2019 Magha 26, S.E. 1940, Issue No. 117 - 2 - Ex-117/2019 THE PARKING HOUSE SUPPORT SCHEME, 2019 Prea mble to the Scheme Introduction Aiza wl, t he c a p it a l o f M izor a m is t he fa s t es t gr owing cit y in t he S t a t e. It i s t he p o lit ica l, commer c ia l, educational a nd cultur al hu b of the State. As the administrative centre of the St ate, Aiza wl houses all important Government offices, including the Sta te Assembly and Secretariat. The Aizawl cit y cover s an area measur ing 129.91 sq km. The city has attr acted considera ble economic investment in the previous deca de. Growing levels of in-migra tion ha s resulted in rapid ur banization and haphaza rd development. The transport network of the city is complex due to constraints of the terr ain. The urban road network in the core area is densely inhabited and is typically characterised by limited and non-expa ndable road spa ces. Aiza wl has a bout 429 km of road in the municipal area. Of the total roa d network, only 40% of the roads have Right of Way more than 10m. The spine has a concentra tion of the trip gener ating (high density residential functions) and trip a ttracting (important offices) land uses along them necessitating every intra- city travel to pass through it creating continuous congestion. Aizawl has seen a steep increase in vehicle ownership, due to higher incomes , la ck of public tra nsit a nd investments in non-mot or ised tra nspor t infr astructure. T his has overburdened the existing road network causing extreme congestion on city roads. Development of infr astructures has occurred all along the major roads with negligible scope for widening. Most of the regional road links pass through the congested urban street network of the town. This causes interference to both regional and local traffic movements. A few road st retches that function as both local and regional linkages have experienced significant growth of vehicular traffic. The topogr aphical conditions do not offer a ny possibility of creating alterna tive alignments, relocation of existing activities at strategic locations is crucial so as to ensure that the parked vehicles do not become a barr ier to vehicle movement. Parking Problems in Aizawl City: The core city of Aizawl is reasonably compact with most of the development along a spinal ridge. All importa nt destinations are located in the core area of the city and within 500 meters of the spinal r oad. Aiza wl city is char acterised by na rrow roads with high to steep gradients and a number of acu te bends and curves responsible for low capacity and speeds on the road networks. Most of the available pa rking spaces primarily consists of haphazard on-street parking. However, on-street parking is another important challenge faced by the vehicular tra ffic and pedestrians on the constrained road spaces in the city. The city officials have tr ied to earmark all available road-side space for the increasing par king dema nd in the city, trying to orga nise meagre space into parking lots, trying to balance between par king for cars a nd two wheeler s, taxis, buses and fr eight vehicles. The existing number of parking areas in Aiza wl city for car s, two-wheelers, LMVs, Maxi ca bs and HMVs has maximum capacity of a pproxima tely 4,500 vehicles but actual demand is more than 18, 000. The city r oads ar e extremely congested in the peak- hour s. This could be addressed by a compr ehensive and systematic provision of parking in the city, which would required private par ticipation. In order to solve the tra ffic pr oblem due to inadequa te parking facility, the Government of Mizoram formulated a scheme for pr oviding substantial amount of assistance for constr uction of parking space at various locations within Aizawl City by providing incentive to priva te, recognised NGO, Local Council having suitable land and building. - 3 -Ex-117/2019 1 . Na me of Scheme: This Scheme shall b e called “The Parking House Support S cheme, 2019” 2. Date of Commencement: It shall come into force from the date of publication in the official gazette. 3 . Extent of the Scheme: The Scheme shall initially extend to Aizawl City. Extension of the Scheme to other urban areas may be notified separately by the Government. 4 . Scope of the Scheme: 1)Private, recognised NGO or Local Council land owners who are willing to constr uct par king space for a minimum of 5 light motor vehicles (LMV) will be eligible to receive the assistance as a grant-in-aid. There will be no maximum number of cars that can be accommodated for availing assistance under the scheme. 2)Assistance will be given in the form ofgrant-in-aidfor construction of car parking at the rate of R s 1.00 lakh per every light motor vehicle or ever y six t wo-wheeler. 3)Parking fee should be collected by the owner as per rate fixed by the Aizawl Municipal Corporation from time to time. 4)The Car parking so constructed should be opened for commercial parking only during daytime (7:00 am to 7:00 pm) and night time (7:00 pm to 7:00 am) as rent out parking or garage. 5)The Car par king so constructed should be utilised as a vehicle parking for a period of at least 30 years. 6)Priority Area shall be notified separately time to time by implementing Department. 7)Timeline for implementation of the scheme/project sha ll be determined by Executive Committee based on area and size of individua l of project 5 . Eligibility: The eligibility cr iteria for availing the assistance will be as follows: 1)The minimum dimension for parking to be provided will be 2.5x4.5 meter per car or as per pr ovisions of prevailing building regulations of Aizawl Municipal Corpor ation. 2)Adequate circulation spa ce for vehicles shall be provided in the vehicle parking. 3)The vehicle parking should be cons tructed with permanent struct ure with metre 2.4 ceiling height. It should have proper roofing and wall of at least 1.5 meters high. 4)The building will be designed for parking any kind of two wheeler and light motor vehicles. 5)If the plan consists of different levels, there must be easy access for vehicles to reach road level. 6)Necessary secur ity measur e should be ensur ed in t he par king place by the owner. CCTV surveillance system must be installed. 6 . Mode Of Selection And Approval : 1)Applicant should have suitable land/spa ce for construction of Vehicle Parking. 2)The applicant should have valid building permission fr om Aizawl Municipal Corpora tion before release of first instalment for Parking house assista nce. 3)An applicant desirous of availing this assistance shall submit application in a prescribed format to the Director, Urban Development & Poverty Allevia tion Department.(Appendix – 1) 4)The following documents should be enclosed in the application:a) No objection certificate from Pr esident, Local Councils concern. b) Certificate of land/house ownership from Land Revenue & Settlement Department. c) Adhaar Card/Voter ID /any other unique identification document. 5)The plan should be verified by technical team of UD&PA Department/AMC and should variably be approved by an officer not below the rank of Executive Engineer. 6)After being satisfied in all resp ects, the Director, UD&PA Department will recommend the application to the Executive Committee for sanction. Composition of the Executive Committee is indicated inAppendix - 2 7)The Executive Committee will then appr ove and sanction the assista nce. 8)An applicant selected for availing the assistance under the scheme shall sign an agreement with the Government in a prescribed format(Appendix - 3). 7 . Mode Of Release Of Financial Support : 1)Sepa rate head of account will be made available with the implementing department for disbursal of assistance. 2)Assistance under the scheme will be released as Grant-in-aid to the owner in 3 installments of 40:30:30 ratio. 3)The implementing department will release the first instalment of 40% after signing of an agr eement. 4)Second instalment of 30% would be relea sed on financia l completion of 80% of first instalment or 30% of t he physical completion of construction. Utilisation Certificate should be submitted accordingly. Before releasing 2nd instalment the implementing department/agency should check the quality of the houses b eing constructed and pr ogress of the work. 5)The final instalment of 30% will be released upon completion of construction of vehicle parking. 6)Subsequent instalment release shou ld be made in a prescr ibed form(Appendix - 4). 8 . Monit oring & Evaluation 1)Monitor ing and evalua tion shall be done as per conditions of release of assistance(Appendix - 5). 2)Time of completion for cons truction of the building will be fixed from time to time as per size of the building and number of parkings to b e provided. 3)In ca se of non-completion of the building wit hin the stipula ted time of completion, non- implementation, reduction in number of capacity etc, t he beneficiary shall immediately refund such amount of the assista nce to t he implementing department and any balance a mount s hall be forfeited. 4)Suit able monitoring mechanism will be developed by the implementing department/agency for monitoring a nd evaluating t he phys ical pr ogress of the construct ion. 5)Quarterly progress report in a prescribed format indicating the physical and financial achievement should be s ubmitted to the State Government by implementing Department/agency. 9 . Amendment of the Scheme: The Government may amend a ny of the provisions of this Scheme and notify the amendments. 10. Except as both the pa rties may otherwise agree in writing, it shall be valid for 30 (thirty) years.- 6 - Ex-117/2019 2.The assistance will be disbursed by the implementing Department/Agency subject to the beneficiary complying with the provisions in the Sanction letter, Agreement, General Conditions and such other conditions as may be decided by the implementing Department/Agency. 3.The assistance made by the Govt. of Mizoram shall be utilized by the beneficiary solely and exclusively to cover the expenditure on the construction of Car Parking in the land approved for such construction. 4.The assistance shall be paid in 3 (three) instalments: 1)40% as first insta lment will be released upon signing of the Agreement. 2)Second insta lment of 30% would be released financial completion of 80% of first instalment or 30% of the physical completion of construction. Before releasing 2nd instalment the implementing department/agency should check the quality of the houses being constructed and progress of the work. 3)The final instalment of 30% will be released upon completion of construction of vehicle parking. 4)disbursement of the assista nce if the beneficiary is in default or the progress of construction is below expectation or for any other reason. 5.The owner should complete construction of the building within (to be fixed base on size and number of parking to be provided) from the release of assista nce. In case of non- completion of the building within the stipulated time of completion, non- implementation, reduction in number of capacity, etc., the beneficiary shall immediately refund such amount of the assistance to the implementing department and any ba lance amount s hall be forfeited. 6.At the request of the beneficiary, the implementing department, in deserving case, may cons ider a deferment / re-scheduling of t ime of completion. 7.The beneficiary shall provide fr ee access for inspection during and after completion of the works to the site engineers, its other employees and other agents engaged by him on the site. 8.The beneficiary shall give one month advance intimation to implementing department before completion of the cons truction to ena ble the site engineer s and other employees to carr y out final inspection of the scheme. 9.The beneficiary a grees that the conditions contained in the sanction letter amended from time to time shall extend and be applicable to the agr eement and be deemed to have been incorporated in the Agreement. 10. It i s t he p o lit ica l, commer c ia l, educational a nd cultur al hu b of the State. As the administrative centre of the St ate, Aiza wl houses all important Government offices, including the Sta te Assembly and Secretariat. The Aizawl cit y cover s an area measur ing 129.91 sq km. The city has attr acted considera ble economic investment in the previous deca de. Growing levels of in-migra tion ha s resulted in rapid ur banization and haphaza rd development. The transport network of the city is complex due to constraints of the terr ain. The urban road network in the core area is densely inhabited and is typically characterised by limited and non-expa ndable road spa ces. Aiza wl has a bout 429 km of road in the municipal area. Of the total roa d network, only 40% of the roads have Right of Way more than 10m. The spine has a concentra tion of the trip gener ating (high density residential functions) and trip a ttracting (important offices) land uses along them necessitating every intra- city travel to pass through it creating continuous congestion. Aizawl has seen a steep increase in vehicle ownership, due to higher incomes , la ck of public tra nsit a nd investments in non-mot or ised tra nspor t infr astructure. T his has overburdened the existing road network causing extreme congestion on city roads. Development of infr astructures has occurred all along the major roads with negligible scope for widening. Most of the regional road links pass through the congested urban street network of the town. This causes interference to both regional and local traffic movements. A few road st retches that function as both local and regional linkages have experienced significant growth of vehicular traffic. The topogr aphical conditions do not offer a ny possibility of creating alterna tive alignments, relocation of existing activities at strategic locations is crucial so as to ensure that the parked vehicles do not become a barr ier to vehicle movement. Parking Problems in Aizawl City: The core city of Aizawl is reasonably compact with most of the development along a spinal ridge. All importa nt destinations are located in the core area of the city and within 500 meters of the spinal r oad. Aiza wl city is char acterised by na rrow roads with high to steep gradients and a number of acu te bends and curves responsible for low capacity and speeds on the road networks. Most of the available pa rking spaces primarily consists of haphazard on-street parking. However, on-street parking is another important challenge faced by the vehicular tra ffic and pedestrians on the constrained road spaces in the city. The city officials have tr ied to earmark all available road-side space for the increasing par king dema nd in the city, trying to orga nise meagre space into parking lots, trying to balance between par king for cars a nd two wheeler s, taxis, buses and fr eight vehicles. The existing number of parking areas in Aiza wl city for car s, two-wheelers, LMVs, Maxi ca bs and HMVs has maximum capacity of a pproxima tely 4,500 vehicles but actual demand is more than 18, 000. The city r oads ar e extremely congested in the peak- hour s. This could be addressed by a compr ehensive and systematic provision of parking in the city, which would required private par ticipation. In order to solve the tra ffic pr oblem due to inadequa te parking facility, the Government of Mizoram formulated a scheme for pr oviding substantial amount of assistance for constr uction of parking space at various locations within Aizawl City by providing incentive to priva te, recognised NGO, Local Council having suitable land and building. - 3 -Ex-117/2019 1 . Na me of Scheme: This Scheme shall b e called “The Parking House Support S cheme, 2019” 2. Date of Commencement: It shall come into force from the date of publication in the official gazette. 3 . Extent of the Scheme: The Scheme shall initially extend to Aizawl City. Extension of the Scheme to other urban areas may be notified separately by the Government. 4 . Scope of the Scheme: 1)Private, recognised NGO or Local Council land owners who are willing to constr uct par king space for a minimum of 5 light motor vehicles (LMV) will be eligible to receive the assistance as a grant-in-aid. There will be no maximum number of cars that can be accommodated for availing assistance under the scheme. 2)Assistance will be given in the form ofgrant-in-aidfor construction of car parking at the rate of R s 1.00 lakh per every light motor vehicle or ever y six t wo-wheeler. 3)Parking fee should be collected by the owner as per rate fixed by the Aizawl Municipal Corporation from time to time. 4)The Car parking so constructed should be opened for commercial parking only during daytime (7:00 am to 7:00 pm) and night time (7:00 pm to 7:00 am) as rent out parking or garage. 5)The Car par king so constructed should be utilised as a vehicle parking for a period of at least 30 years. 6)Priority Area shall be notified separately time to time by implementing Department. 7)Timeline for implementation of the scheme/project sha ll be determined by Executive Committee based on area and size of individua l of project 5 . Eligibility: The eligibility cr iteria for availing the assistance will be as follows: 1)The minimum dimension for parking to be provided will be 2.5x4.5 meter per car or as per pr ovisions of prevailing building regulations of Aizawl Municipal Corpor ation. 2)Adequate circulation spa ce for vehicles shall be provided in the vehicle parking. 3)The vehicle parking should be cons tructed with permanent struct ure with metre 2.4 ceiling height. It should have proper roofing and wall of at least 1.5 meters high. 4)The building will be designed for parking any kind of two wheeler and light motor vehicles. 5)If the plan consists of different levels, there must be easy access for vehicles to reach road level. 6)Necessary secur ity measur e should be ensur ed in t he par king place by the owner. Mode Of Selection And Approval : 1)Applicant should have suitable land/spa ce for construction of Vehicle Parking. 2)The applicant should have valid building permission fr om Aizawl Municipal Corpora tion before release of first instalment for Parking house assista nce. 3)An applicant desirous of availing this assistance shall submit application in a prescribed format to the Director, Urban Development & Poverty Allevia tion Department.(Appendix – 1) 4)The following documents should be enclosed in the application:a) No objection certificate from Pr esident, Local Councils concern. b) Certificate of land/house ownership from Land Revenue & Settlement Department. c) Adhaar Card/Voter ID /any other unique identification document. 5)The plan should be verified by technical team of UD&PA Department/AMC and should variably be approved by an officer not below the rank of Executive Engineer. 6)After being satisfied in all resp ects, the Director, UD&PA Department will recommend the application to the Executive Committee for sanction. Composition of the Executive Committee is indicated inAppendix - 2 7)The Executive Committee will then appr ove and sanction the assista nce. 8)An applicant selected for availing the assistance under the scheme shall sign an agreement with the Government in a prescribed format(Appendix - 3). 7 . Mode Of Release Of Financial Support : 1)Sepa rate head of account will be made available with the implementing department for disbursal of assistance. 2)Assistance under the scheme will be released as Grant-in-aid to the owner in 3 installments of 40:30:30 ratio. 3)The implementing department will release the first instalment of 40% after signing of an agr eement. 4)Second instalment of 30% would be relea sed on financia l completion of 80% of first instalment or 30% of t he physical completion of construction. Utilisation Certificate should be submitted accordingly. Before releasing 2nd instalment the implementing department/agency should check the quality of the houses b eing constructed and pr ogress of the work. 5)The final instalment of 30% will be released upon completion of construction of vehicle parking. 6)Subsequent instalment release shou ld be made in a prescr ibed form(Appendix - 4). 8 . Monit oring & Evaluation 1)Monitor ing and evalua tion shall be done as per conditions of release of assistance(Appendix - 5). 2)Time of completion for cons truction of the building will be fixed from time to time as per size of the building and number of parkings to b e provided. 3)In ca se of non-completion of the building wit hin the stipula ted time of completion, non- implementation, reduction in number of capacity etc, t he beneficiary shall immediately refund such amount of the assista nce to t he implementing department and any balance a mount s hall be forfeited. 4)Suit able monitoring mechanism will be developed by the implementing department/agency for monitoring a nd evaluating t he phys ical pr ogress of the construct ion. 5)Quarterly progress report in a prescribed format indicating the physical and financial achievement should be s ubmitted to the State Government by implementing Department/agency. 9 . Amendment of the Scheme: The Government may amend a ny of the provisions of this Scheme and notify the amendments. 10. Except as both the pa rties may otherwise agree in writing, it shall be valid for 30 (thirty) years.- 6 - Ex-117/2019 2.The assistance will be disbursed by the implementing Department/Agency subject to the beneficiary complying with the provisions in the Sanction letter, Agreement, General Conditions and such other conditions as may be decided by the implementing Department/Agency. 3.The assistance made by the Govt. of Mizoram shall be utilized by the beneficiary solely and exclusively to cover the expenditure on the construction of Car Parking in the land approved for such construction. 4.The assistance shall be paid in 3 (three) instalments: 1)40% as first insta lment will be released upon signing of the Agreement. 2)Second insta lment of 30% would be released financial completion of 80% of first instalment or 30% of the physical completion of construction. Before releasing 2nd instalment the implementing department/agency should check the quality of the houses being constructed and progress of the work. 3)The final instalment of 30% will be released upon completion of construction of vehicle parking. 4)disbursement of the assista nce if the beneficiary is in default or the progress of construction is below expectation or for any other reason. 5.The owner should complete construction of the building within (to be fixed base on size and number of parking to be provided) from the release of assista nce. In case of non- completion of the building within the stipulated time of completion, non- implementation, reduction in number of capacity, etc., the beneficiary shall immediately refund such amount of the assistance to the implementing department and any ba lance amount s hall be forfeited. 6.At the request of the beneficiary, the implementing department, in deserving case, may cons ider a deferment / re-scheduling of t ime of completion. 7.The beneficiary shall provide fr ee access for inspection during and after completion of the works to the site engineers, its other employees and other agents engaged by him on the site. 8.The beneficiary shall give one month advance intimation to implementing department before completion of the cons truction to ena ble the site engineer s and other employees to carr y out final inspection of the scheme. 9.The beneficiary a grees that the conditions contained in the sanction letter amended from time to time shall extend and be applicable to the agr eement and be deemed to have been incorporated in the Agreement. 10. Reservation and Nothing in these rules shall affect any reservations, relaxation of age other concessions limit and other concessions required to be provided for the Scheduled Castes/the Scheduled Tribes and other categories of persons in accorda nce with the order issued by Centr al Government or Government of Mizoram from time to time in this regard. 10 Repeal & savings All rules pertaining to the posts of Electrician Grade-II and Electrician Grade-III framed by the Government of Mizoram vide Notifica tion No.A.12018/58/80-APT(B)/Pt dt 24.07.2001 and published in the Mizoram Gazette Extraordinary Issue No. 173 dated 27.07.2001 stand hereby repealed with effect fr om the date of commencement of these rules.
