Application These rules shall apply to the post specified in Column I of Annexure-I her et o a nnex ed. 3. Number of posts, The number of the said post, cla ssifica tion and Level in the Pay classification and Matrix attached thereto shall be as specified in Column 2 to 4 of the Level in the Pay Matrix aforesaid Annexure-I 4. Method of r ecruitment, The method of recruitment, age limit, qualifications and other matters age limit and other relating to the said post shall be as specified in Column 5 to 14 of qualifications Annexure-I: Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or Government of Mizora m from time to t ime. 5. Disqualification No per son – (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, ha s entered into or contracted a marr iage with any other person shall be eligible for appointment to the said post(s): VOL - XLVIII Aizawl, Thursday 25.4.2019 Vaisakha 5, S.E. 1941, Issue No. 264 - 2 - Ex-264/2019 Provided that the Governor may, if satisfied that such marr iage is permissible under the personal law applicable to such person and to the other pa rty to t he mar riage and t ha t there ar e other va lid grounds for doing so, exempt any such person fr om the operation of these rules. 6.Training and Every Gover nment servant r ecruited under these rules shall undergo Departmental such training or pa ss such Departmental Examination as ma y be Ex amination pres cribed from time to t ime. 7. Power to transfer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be r ecorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and Nothing in these rules shall affect any reservations, relaxation of age other concessions limit and other concessions required to be provided for the Scheduled Castes/Scheduled Tribes and other categories of persons in accordance with the orders issued by Centr al Government or Government of Mizoram from time to time in this regard. 10 Repeal & Savings All rules pertaining to the post of a) Accounts Officer notified by the Government of Mizoram vide No.A.12018/6/87-PAR(GS) dated 19.07.1988 and published in the Mizoram Gazette extraordinary issue No. 85 dated 19.07.1988 and b) Superintendent of Accounts notified by the Government of Mizoram vide No.A.12018/6/87-PAR(GS) dated 15.01.1992 and published in the Mizoram Gazette extraordinary issue No. 6 dated 15.01.1992 stand hereby repealed with effect from the da te of commencement of these r ules Provided that any order made or anything done or any action taken under the rules so repealed or under any general order ancillary thereto, shall be deemed to have been made, done or taken under the corresp onding provisions of these rules. THE AIZAWL MUNICIPAL CORPORATION PLASTIC WASTE MANAGEMENT BYE-LAWS, 2019 In order to regula te all matters connected wit h the storage, collection, transpor tation, processing and disposa l of municipal plastic wastes and in exercise of the power conferred under Rule 6(4) of the Plastic Waste Ma nagement Rules, 2016, the Aizawl Municipal Cor pora tion hereby makes theAiza wl Municipal Corporation Plastic Waste Management Bye-Laws, 2019. 1 . Definitions : In t hese Bye-la ws, unless the context ot her wise r equir es :- “Act” means the Environment (Pr otection) Act, 1986 (2 9 of 1986); “bra nd owner” means a person or compa ny who sells any commodity under a registered br and label. “bulk waste genera tor”means and includes buildings occupied by the Centra l government depa rtments or undertakings, State gover nment departments or undertakings, local bodies, public sector undertakings or pr ivate companies, hospitals, nursing homes, schools , colleges, universities, other educa tional institutions, hostels, hotels, commercial establishments, markets, places of worship, stadia and sports complexes having an a verage waste generation rate exceeding 100kg per day; “carry bags” mean bags made from plastic material or compostable plastic material, used for the purpose of carrying or dispensing commodities which have a self-car rying feature but do not include bags that constitute or form an integral part of the pa ckaging in which goods are sealed pr ior to use. “commodit y” mea ns tangible item that may be bought or sold and includes all marketa ble goods or wares; “importer” means a person who imports or int ents to import a nd holds as Importer-E xporter Code Number, unless other wise sp ecifically exempted. “institutional waste generator” means and includes occupier of the institutiona l buildings such as building occupied by Central Government Departments, State Government Depa rtments, public or private sector companies, hospitals, schools, colleges, universities or other places of education, orga nization, academy, hotels, restaurants, malls and shopping complexes; “manufacturer”means and include a person or unit or agency engaged in production of plastic raw material to be used as raw material by the producer. “multilayered packaging” means any materia l used or to be used for packa ging and having at least one layer of plastic as the main ingredients in combination with one or more layers of materials such as paper, paper board, polymeric materials, metalized layers or aluminum foil, either in the form of a laminate or co-extruded struct ure; “plastic” means material which contains as an essential ingredient a high polymer such as polyethylene terephthala te, high densit y polyethylene, Vinyl, low density polyethylene, polypropylene, polystyrene resins, mult i-ma terials like a cr ylonit rile butadiene styr ene, polyphenylene oxide, polyca rbonate, Polybutylene terephthalate; “plastic sheet” means Plastic sheet is the sheet made of plastic; “plastic waste” means any plastic discarded after use or after their intended use is over; “producer” means persons engaged in manufacture or import of carry bags or multilayered pa ckaging or plastic sheets or like, and includes industries or individua ls using plastic sheets or like or covers made of plastic sheets or multilayered pa ckaging for packaging or wrapping the commodity; - 3 -Ex-479/2019 “recycling’’ means the process of tra nsforming segr egated plastic waste into a new product or raw material for producing new products; “r egistra tion” means registration with the Aizawl Municipal Corporation or the State Pollution Control Boar d or Pollution Control Commit tee concerned, as the case may be; “str eet vendor” sha ll have the same meaning as assigned to it in clause (1) of sub-section (1 ) of Section 2 of the St reet Vendors (Protection of Livelihood and R egulation of Street Vending) Act. 2014 (7 of 2014); “virgin plastic” means plastic material which has not been subject ed to u se earlier and has also not been blended with scr ap or waste; “waste genera tor” means and includes every person or group of persons or instit ution, residential and commercial esta blishments which generate pla stic waste; “waste management” means the collection, storage, transportation reduction, re-use, recovery, recycling, composting or disposa l of plastic waste in an environmentally s afe manner; “waste pickers” mean individual or agencies groups of individuals voluntarily engaged or author ized for picking of recyclable plastic waste. “processing”means any scientific process by which plastic waste is treated for processing for the purpose of reuse, r ecycling or tr ansforma tion into new product s or making it suitable for la nd filling; “co-processing” means use of non-biodegradable and non-recycla ble solid waste having calor ific value exceeding 1500 kcal as raw material or a s a source of energy or both to replace or supplement the natural minera l resources and fossilfuels in industrial processes; “fine”means penalty imposed on waste generator s or operators of waste processing a nd disposal facilities under the bye-laws for non-compliance of the directions contained in these rules and/or bye- laws; “user fee” means a fee imposed by t he Loca l Body and any entity mentioned in rule 2 on the waste generator to cover full or part cost of providing solid waste collection, transportation, pr ocessing and disposal services. Words and expressions used herein but not defined in the Environment (Protection) Act, 1986, The Water (Prevention and Control of Pollution) Act, 1974, Water (Prevention and Control of Pollution) Cess Act, 1977, the Air (P revention and C ontrol of Pollu tion) Act, 1981, Plastic Waste Management Rules, 2016 shall have the same meaning as assigned to them in the respective Act/Rules. 3 . Application : These Bye-Laws shall be a pplicable within the jurisdiction of Aizawl Municipal Corporation to every generator of municipal solid waste and to every premise under the ownership or occupa tion of any person within the limits of the Aizawl Municipal Corporation. (a ) The Aizawl Municipa l Corpor ation shall encourage the minimization of pla stic use within its jurisdictional limits by generating awareness on the problems presented by excess ive pla stic use, the short term and long term effects of plastic waste on the environment, alt ernate non- plastic substitutes of plastics etc., on a continuous ba sis and shall provide budget for the same. (b) Use of plastic car ry bags or plastic products that do not conform to the specifications of the PWM Rules 2016 shall be prohibited. (c ) Pr oducer s and retailer s shall take definit ive s teps to substit ute plastic pa cka ging to other biodegr ada b le and recycla b le materia l to the ex tent possible as per t he PWM 2016 Ru les. (d) Waste generators shall take steps to minimize their consumption of pla stics a nd their genera tion of plastic wastes. 4 . Compliance with Plastic Waste Management Rules : No person shall manufacture, stock, distribute, sell or use plastic carry bags, plastic s heet, cover made of plastic sheet or multi-layered pa ckaging or any other plastic product in violation of the provisions of the Plastic Waste Management Rules, 2016. Carry bags made of virgin or recycled plastic sha ll not be less than fifty microns in thickness. 5 . Segregation, Collection and Storage of Plastic Waste : (a ) Every waste generator shall segregate the waste generated by t hem at the sour ce at which such wastes are generated a nd plastic wastes shall be stored separately from other kinds of wastes in a uthorized stora ge bins or bags. This responsibilit y shall fall upon the occupier or ma nager of the premises of the wa ste generator as the case may be. The a for ement ioned entities shall hand over such segregated plastic waste to the collection agency designated by the AMC. (b) Plastic packaging of food wastes shall be emptied of their food content, before being segregated. Further non-plastic biodegradable waste (including food waste) shall not be disposed of in plastic bags other than plastic garbage bags manufactur ed specifically for the disposal of non- plastic biodegradable waste. No plastic waste shall be disposed otherwise as has provided under these Bye-Laws. Further, no plastic waste shall be burnt in any public or private premise. (c ) No plastic, including pla stic containing any liquid which by reasons of its mass or other characteristics is likely to render any collection unreasonably difficult for the AMC’s employees or service provider to handle, sha ll be stored or placed along with other plastic wastes. (d) Bulk generators of plastic waste such as Hotels, Institutions, Shopping Centre, Hostels, Schools, Chur ches, etc. shall be encouraged to initiate and undertake special drives and programs to promote segregated plastic waste collect ion. 6 . Collection Cent ers a nd Tra nspor ta tion : (a ) The AMC sha ll provide for the collection of pla stic waste from specific designated points on a public road or private road up to which the genera tor must b ring the collected waste for delivery to vehicles accor ding to the route plans as notified b y the a uthority concer ned. (b) plastic wastes sha ll, upon segregation, be handed over to waste pickers designated to collect plastic wastes from the doorstep of the particula r waste generator. However, where door to door collection services is not a vailable and/or a waste generator does not avail of the waste collection services of waste pickers, such waste generator shall dispose of the segregated plastic waste at the Community Waste Collection Centers designated by the AMC. 7 . Processing of Plastic Waste : (a ) The Aizawl Municip al Corporation shall set up treatment and processing facilities as per the requirement of quality of plastic to be processed in line with the PWM Rules 2016 and SWM Rules 2016.- 4 - Ex-479/2019 (b) The Aizawl Municipal Corporation may, for the purpose of recycling, treating, processing and disposing of plastic wastes or converting such wastes into any other matter construct, acqu ire, operate, maintain a nd manage any establishment within or outside the AMC area a nd run it on a commercia l basis or may out source such activity. (c) The AMC shall encourage the adoption of suitable processing technologies such as road construction, co-incineration, co-processing etc. to reduce the disposal of plastic wastes into landfills. (d) The waste pr ocessing and disposal site sha ll be designed, constr ucted and maint ained as per the SPCB or CPCB guidelines. ( e) Plastic wastes, which cannot be processed further or r ecycled, and inert shall be disposed in landfills. (f) Thermo set plastic waste shall be processed and disposed off in accordance with the relevant provisions of the SPCB or CPCB guidelines. 8 . Plastic Waste Management System: The AMC sha ll esta blish, operate, administer and co-or dinate a Plastic Waste Management System (PWM S). The key goals of the Plastic Waste Mana gement System are: (a ) To ensure the safe collection, storage, segregation, tr ansportation, processing and disposa l of plastic waste within its jurisdictional limits as may be mandatory for the AMC in accordance with the Plastic Waste Management Rules, 2016; (b) To set up plastic waste collection centres/material recovery facilities for plastic waste; (c ) To ensure its channelizing to recyclers including through the existing formal/ informal waste recycling sector; (d) To create awareness among all the stakeholders about their responsibilit ies; ( e) To ensure the financial sustainability of plastic waste management; (f) To implement Envir onment P rotection Rules (RPR) and levy user charges, penalty etc. for effective implementation of plastic waste management. 9. 1 Was te gener ator s : (a ) Individual household and institutional waste generator shall take st eps to minimize genera tion of plastic waste and segregate plastic waste at source. (b) Wast e genera tor s will segr ega te the pla stic waste at sour ce and s tor e it separat ely. (c ) All institutional generators of plastic waste, s hall segregate and store the waste generated by them in accordance with t he Solid Waste Management, Rules 2016 and handover segregated wastes to a uthorized waste processing or disposa l facilities or deposition centers either on its own or through the authorized waste collection agency. (d) The waste generator s shall not litter or burn the plastic waste. No generator shall dispose the plastic waste to dr ains/ u nauthor ized place within municipal a rea. ( e) Every person responsible for orga nizing an event in open space, which involves service of food stuff in plastic or mult ilayered packa ging shall segregate and ma nage the waste generated during such events in accor dance with the Solid Wa ste Mana gement, Rules 2016. 9. 2 Organized retailers, un-organized retailers and street vendors : (a ) No person shall sell or pr ovide commodit ies to consumers in plastics carry bags, plastic sheet or multi-layered pa ckaging which is manufa ctured, labeled or mar ked in contravention of the PWM Rules, 2016. (b) No plastic carry bags shall be ma de available free of cost by organized reta ilers, unorganized reta ilers, vendors, wholesalers, hawkers etc. to any consumers.- 5 -Ex-479/2019 (c ) The organized reta ilers, un-orga nized r etailers and street vendors willing to provide pla stic carry bags for dispensing any commodity shall register with the AMC and pay a waste mana gement charges as decided fr om time to time. Only the registered organized retailers, un- orga nized r etailer s and street vendors can provide pla stic ca rry bags that conform to the PWM Rules 2016. They sha ll sign a decla ration a s given in FORM-I in ANNEXURE-A. (d) Unregistered organized , and un-organized reta ilers a nd street vendors fou nd guilty of using plastic carry bags shall be penalized as specified in these Bye-Laws and by PWM Rules 2016. ( e) Every organized and un-organized retailer or str eet vendors selling or providing commodities in plastic carr y bags or multi-layered packa ging or plastic sheets or like or covers made of pla stic sheets which are not manufa ctured or labeled or marked in accordance wit h these rules shall be lia ble to pay su ch cha rges as s pecified in these Bye-Laws. (f) Street vendors using plastic products to serve their goods shall ensure that the waste is collected, segregated and handed over to designated waste collect ion agency. 9. 3 Producers and Brand Owners: Producers and brand owner shall adhere to Plastic Waste Management Rules 2016, and other regulations in conformance with the State Pollu tion Control Board. (a ) The primary responsibility for setting up collection systems-for plastic waste lies with producers and brand owners; (b) The AMC shall work out the modalit ies of a mechanism based on Environment Protection Rules (EPR) involving producers and brand owner. (c ) Primary responsibility for collection of used multi-layered plastic sachet or pouches or packaging is of Producers, Importers and Bra nd Owners who introduce the pr oducts in the market. They need to esta blish a system for collecting back the plastic waste genera ted due to their products. This plan of collection to be submitted to the State Pollution Control Boards while a pplying for registration to Establish or Operate or Renewal. The Br and Owners whose registration has been renewed before the notification of these rules sha ll submit such plan within one year from the date of notification of these rules a nd implement within two years thereafter. 9. 4 Recyclers and Operators of Plastic Treatment Plants: Recyclers and Operators shall a dhere to Plastic Waste Mana gement Rules 2016, and other regula tions in conformance with the Sta te Pollu tion Control Board. (a ) Recycling of pla stic shall be carried out in accordance with the Indian Standar d: IS 14534:1998 titled as Gu idelines for recycling of Plastic, as amended from time to time; (b) Recyclers shall ensure tha t recycling fa cilities are in accordance with the Indian Standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastic and in complia nce with the rules under the Environment (Pr otection) Act, 1986 as amended from time to t ime; (c ) Recyclers shall work with the AMC to ensure tha t the r esidue generated from recycling process is disposed of in accordance with the relevant schedules under the SWM, 2016. 9.5 Self-Compliance: (a ) Every Institutiona l waste generator orga nized a nd un-organized retailer, recycler a nd operator of plastic treatment plants shall mainta in a self-compliance register, which shall be mandatory evidence for proof of compliance with these Bye-Laws. (b) Such self-compliance register shall be maintained in the forma t prescribed by the AMC in FORM-II in ANNEXURE-B and shall be filled with such periodicit y as to correspond to the frequency of the disposal of pla stic wastes, by the maintaining entity. (c ) Persons failing to maintain the self-compliance regist er, sha ll be subjected to the penalty as stipulated in the Schedule.- 6 - Ex-479/2019 10User Charges or Fees : Waste genera tors, r etailers and pr oducers shall be liable for all charges incur red towards pla stic waste management in the city as prescribed by the AMC from time to time. 11Pr ohibition of certain plastic items: (a ) No person shall car ry, use or store any plastic carry bags below the permissible minimum thickness (as prescribed from time to time ) and size or any plastic articles having single use such as disposable plastic bottles, cups, plates, spoons, forks etc. within premises owned, mana ged or controlled by the AMC or any Department of the State Government. (b) The prohibit ion under clause (a) a bove sha ll not affect the use of plastic carr y bags as specified under the Bio-Medical Waste Management Rules, 2016. (c ) Any person in breach of such prohibition shall be liable to charges prescribed in schedule of Fines under the Bye- laws and any other law in force at the time being. Notice will be provided as per FORM-III in ANNEXURE-C. (d) The Aizawl Municipal Corpora tion ma y, by notification - i)Extend such prohibition to any other place or premises, whether private or public, including premises owned, managed or controlled by Departments of the Centra l or S tate governments within the jur isdiction of t he AMC a s may b e specified in such notification; ii)Direct minimum standards of non-plastic carry bags, such as a minimum recycled content for paper bags provided by shopkeepers, vendors, wholesalers, retailers, hawkers etc. 12The AMC shall - (a ) Attempt to integra te the scrap s hops within the city, so far as they comply with regulations prescr ibed by the Municipa l Commissioner from time to time and register with the Corpor ation. These units shall b e granted registration for a period of one year, unless revoked, suspended or cancelled, prior to the expiry of one year as per FORM-IV of ANNEXURE-D. No registr ation fee will be applicab le to scrap shop recyclers. (b) Encourage the recycling of plastic wastes and adoption of suitable processing technologies such as roa d construction, incineration, coprocessing etc, to reduce the disposal of pla stic wastes into landfills. (c ) Prepare and submit a n Annual Report in FORM -V given in the PWM Rules 2016 t o the State Secr etary-in-charge of the Urban Development Department and intimate the Mizoram SPCB of the sa me. (e) Review and amend the PWM plan once in every 5 years for purposes of ensuring their sustainability, via bility, effectiveness a nd relevance in relation to r egulator y and technological developments. 13. Penalties for contravention of these Bye-Laws : (a ) Whos oever contravenes any of the provisions of t hese Bye-Laws or fails to comply with the requirements made under any of these Bye-Laws shall be punished with a fine a s mentioned in SCHEDULE OF F INES appended to these Bye-La ws failing which the default er shall be liable to do the community service or as directed by the AMC. (b) In the event of continuation of t he breach of the provisions of these Bye-La ws, the fine amount will be doub led. 14. Miscellaneous provisions : (a ) The Municip al Commissioner may appoint or designate any individuals or agencies t o assist in connection with enforcement and implementation of these Bye-L aws. Short tittle, extent and Commencement: - 1)These bye-laws sha ll be called The Aiza wl Municipal Corporation Solid Waste Management Bye-Laws, 2019. 2)They shall apply t o all the areas cover ed by The Aiza wl Municipal Corporation. 3)Theyshall come into force from the date of publication in Official Gazette. 2.Applicability:- These bye-laws shall be applicable to every public places, to every generator of Municipal Solid Waste and to ever y pr emises under the ownership or occupation of any person within the jurisdiction of Aizawl Municipal Corporation. 3In these Bye-laws and the Schedules attached thereto the following words shall have the meaning herein defined i.e.: 3.1“Aangan”/premises/place means the public place in front of, or adjacent on any side of any premises, extending to the road, kerb side including the footpath kerb, drain, nullah, plot or premises; 3.2“aerobic composting” means a controlled process involving microbial decomposition/breaking down of organic ma tter in the presence of oxygen; 3.3“Agency/Agent” mea ns any entity/person a ppointed or authorized by Aizawl Municipal Corpora tion to a ct on it s behalf, for discharge of duties or functions i.e. sweeping of str eets, collection of waste, collection of char ges / fines, a nd other such delegated resp onsibilities etc.; 3.4“anaerobic digestion” means a controlled process involving microbial decomposition/breaking down of organic matter in absence of oxygen; 3.5“authorization” means the permission given by the State Pollution Control Board or Pollution Control Committee, as the case ma y be, to the operator of a fa cility or Aiza wl Municipal Corporation, or any other agency responsible for processing a nd disposal of solid wa ste; 3.6“Bio-degrada ble was te” means any organic material that can be degraded by micr o- organisms into simpler stable compounds; for example the waste of plant and a nimal origin e.g. kit chen waste, food & flower waste, leaf litter, garden waste, animal dung, fish/meat waste and any other material that gets degraded/decomposed by the a ction of micro-organisms; 3.7“Bio-medical waste” means a ny wa ste, which is gener ated dur ing t he diagnosis, trea tment or immunization of human beings or animals or in research activities pertaining thereto or in the production or testing of biological, and including categories mentioned in Schedule IV of the Bye-laws; 3.8“bio-methanation” means a process which enta ils enzymatic decompos ition/ breaking down of the orga nic matter by microbia l action to pr oduce methane-r ich biogas; 3.9“bra nd owner” means a person or compa ny who sells any commodity under a registered br and label. 3.10“buffer zone” means zone of no-development to be maintained around solid wa ste processing and disposal fa cility, exceeding 5 TPD of installed capacit y. This will be mainta ined within the total area allotted for the solid waste processing and disposal facility. 3.11“Bulk Waste Generator” means the owner, occupier or any other person representing owners and occupiers of House(s)/Flat(s), Group of Houses/ Flats, housing society(s)/ complex(s),Restaurant(s); Hotel(s), Ma rket(s), Industrial Estate(s) and Shopping C omplex(s)/ Mall(s) and includes buildings occupied by the Central Government Ministries, Departments or Undertakings, State Government Departments or Undertakings, Local Bodies, Public SectorUndertakings or Private Companies, Hospital(s), Nursing Home(s), School(s), College(s),University(s ), Other Educational Institutions, Hostel(s), Hotel(s), Commercial Establishment(s), Places of Worship, Sta dium and Sports complexes, clubs, gymkhanas, marriage halls,recreation/entertainment complexes having an average waste gener ation ra te exceeding 100kg per da y; or other establishment sources/premises that are specifically identified and notified by the officials of Aiza wl Municipal Corporationof the concerned area to be so; - 3 -Ex-480/2019 3.12“Bulk garden and hor ticultural waste”means bulk waste from par ks, gardens, tr affic islands, road medians etc. including gra ss & wood clippings, weeds, woody ‘b rown’ carbon-r ichmaterial such as pruning, bra nches, twigs, wood chipping, straw or dead leaves a nd tree trimmings, which cannot be accommodated in the daily collection system for bio-degra dable waste. 3.13“census town” means an urban ar ea as defined by the Registra r Gener al and Census Commissioner of India; 3.14“Collection” means lifting and removal of municipal solid waste from designated collection points or a ny other location; 3.15“Collection at Source” means the collection of municipal solid waste by Aizawl Municipal Corporation directly from the premises of any building or common premises of a group of buildings. This is also referred to as “point to point collection”; 3.16“combustible waste” means non-biodegra dable, non-recyclable, non-reusable, non-hazardous solid waste having minimum calor ific va lue exceeding 1500 kca l/kg and exclu ding chlorinated materials like plastic, wood pulp, etc.; 3.17“Composting” mea ns a controlled process involving micr obial decomposition/ degradation/ breaking down of organic ma tter including vermi-composting –which is a process of using ear thworms for conversion of bio-degradable waste into compost; 3.18“Community Service” means to serve the community by sweeping of road, cleaning of walls, tree guard portion etc.; 3.19“contractor” means a person or firm tha t undertakes a contract to provide materials or labour to perform a service or do a job for service providing author ity; 3.20“ Construct ion a nd Demolit ion wa ste” means waste from building materials, debris and such rubble resu lting fr om construction, remodeling, repair and demolition operations; 3.21“co-processing” means use of non-biodegradable and non-recycla ble solid waste having calor ific value exceeding 1500 kcal as raw material or a s a source of energy or both to replace or supplement the natural minera l resou rces and fossil fuels in industrial processes; 3.22“decentralized pr ocessing” means est ablishment of dispersed facilities for localized processing of biodegradable waste and recovery of recyclables closest to the source of generation so as to minimize tra nsporta tion of waste for processing or disposal; 3.23“Delivery” mea ns handing over any ca tegory of solid waste to a Aizawl Municipal Corpora tion worker or any ot her person appointed, authorized or licensed persons by the Aizawl Municipal Corporation for taking delivery of such waste; 3.24“disposal” means the final and safe disposal of post-processed residual solid waste and inert street sweepings a nd silt from surface drains on land as specified in Schedule I to prevent conta mination of ground water, surfa ce water, ambient air a nd attr action of animals or birds; 3.25“domestic hazardous waste” mea ns disca rded pa int drums, pest icide cans, CFL bulbs, tubelights, medicines including expired medicines, broken mercury thermometers, batteries, used needles and syringes and conta minated gauge, etc., generated at the household level; 3.26“door to door collection” means collection of solid waste from the door step of households,shops, commercial establishments , offices , institutional or any other non-residential pr emises a nd includes collection of such waste fr om entr y gate or a designated location on the ground floor in a housing society , multi stor ied building or apartments , large residential,commercial or institutional complex or premises; 3.27“Door-to-Door collection system Municipal vehicle” means the bell-ringing or such vehicle(includes a car riage, cart, va n, dray, truck, hand-car t, bicycle, cycle-r ickshaw, auto- rickshaw,motor vehicle and every wheeled conveyance which is used or is capable of being used on a street) provided by Aizawl Municipal Corpora tion for point to point collection of Municipal Solid Was te. - 4 - Ex-480/2019 3.28“dry waste” mea ns waste other than bio-degradable waste and inert street sweepings and includes recyclable and non-recyclable waste, combustible waste and sa nitary napkin and dia pers, etc.; 3.29“Dry Waste” means the category of municipal solid waste refer red to at No.5. 1 (6) of these Bye- laws; 3.30“Dry Waste Sorting Center” means any designated land, shed, kiosk, or structure located on any municipal or Government land or in a public space which is authorized to receive and sort dry wa ste; 3.31“dump sites” means a la nd utilized by local body for disposal of s olid wa ste without following the principles of sanitary land filling; 3.32“extended producer responsibility” (EP R) means responsibilit y of a ny pr oducer of packa ging products such as plastic, tin, glass and corrugated boxes, etc., for environmentally sound management, till end-of-life of the packaging products; 3.33“facility” means any establishment wherein the solid waste management processes namely segregation, recovery, stor age, collection, recycling, processing, treatment or safe disposal are car ried out; 3.34“fine” means penalty imposed on waste generators or operators of waste processing a nd disposal facilities under the bye-laws for non-compliance of the directions contained in these bye- laws; 3.35“Generator of waste” means any person gener ating municipal solid waste within t he limits of Aizawl Municipal Corporation; 3.36“ ha ndling” includes all activities relating to sorting, segregation, material recovery, collection,secondary stor age, shredding, baling, crushing, loading, unloading, tra nsporta tion, processing and disposa l of solid wastes; 3.37“Hazardous waste” mea ns any waste, which by reason of any of its physical, chemical,react ive, toxic harm able, explosive or cor rosive charact eristics causes danger or is likely to cause danger to health or environment, whether alone or when in contact with other wastes or substances and shall include wastes specifically listed in Schedule III of these Bye-laws. 3.38“House-gully”/lane/Service Lane means a passage or strip of land, constructed, set apart or utilized for the pur pose of serving as a drain or of affording access to the latrine, urinal,cesspool or other receptacle for filthy or other polluted matter by persons employed in the removal of cleaning thereof or in the removal of such matters there from; 3.39“incineration” mea ns an engineer ed pr ocess involving bur ning or combustion of solid waste to thermally degrade wa ste materials a t high temperatures; 3.40“inerts” mea ns wast es which are not bio-degr ada b le, recycla ble or comb ustible street sweeping or dust and silt removed from the sur face dra ins; 3.41“Inert S olid Wast e” means a ny solid waste or r emna nt of processing whose physical, chemical and biological properties make it suitable for sanitary land filling; 3.42“informal waste collector” includes individuals, associations or waste tr aders who are involved in collection, sorting, sale and purchase of recyclable materials; 3.43“Landfill” mea ns a waste disposal sit e for the deposit of r esidual solid waste in a facility designed with pr otective measures against pollution of gr ound water, surface water a nd air fu gitive dust, windblown litter, bad odour,fire hazard, bird menace, pests or rodents,greenhouse gas emissions, slope instability and erosion; 3.44“leach ate” means the liquid that oozes and seeps through solid waste or other medium and has extr acts of dissolved or s uspended material from the media; 3.45“Litter” means all refuse and other such waste material which, tends to create nuisance, dirt,insanitary conditions, ugliness and endangers cleanliness, public orderliness & movement, environment, public health, safety, life and welfare if dropped, thr own, scattered, depositedor left un-cleaned or unpicked as a gainst the prohibition under these Bye-laws; - 5 -Ex-480/2019 3.46“Littering” means carelessly spreading litter so that falls, descends, blown, seeps, percolates or otherwise escapes or is likely to fall, descend, blown, seep, p ercolate or otherwise escape into or onto any public or private place; Or causing, permitting or allowing litter to fall,descend, blow, seep, percolate or otherwise escape into or onto a ny public or pr ivate place; 3.47“Local body” for the purpose of these bye laws means and includes the Aizawl Municipal Corporation; 3.48“Lysometer” means a device which is used to measure the movement of water in or through the medium of soil layer or which is used to collect the leached water for qua litative analyses. 3.49“Market” includes any place where persons assemble for the sale of, or for the purpose of exposing of sale, meat, fish, fruit s, vegetables, animals intended for human food or a ny other articles of human needs whatsoever, with or without the consent of the owner of such place notwithstanding that t here may be no common regulation for the concou rse of buyers and sellers and whether or not any control is exercised over the business of, or the person frequenting, the ma rket by the owner of the place or by any other person; 3.50“materials r ecover y fa cility” (MRF) means a facility where non-compostable solid waste can be temporar ily stor ed by t he loca l body or any other entity mentioned in rule 2 or any person or agency authorized by any of them to facilitate segregation, sorting and recovery of recyclables from various components of waste by authorized informal sector of waste pickers,informal r ecycler s or any other work for ce enga ged by the local body or entity mentioned in rule 2 for the pur pose before the waste is delivered or taken up for its processing or disposal; 3.51“Municipal Commissioner” means the Commissioner or any designated officer authorized or power delega ted by the Municipal Commissioner of the Aizawl Municipal Corporation. 3.52“Municipa l Corporation” means t heAizawl Municipal Corporation. 3.53“Municipal S olid Waste” includes commercial and residential wastes generated in a Municipa l or Notified Local Body in either Solid or Semi -Solid form excluding industrial hazardous waste but including properly and fully treated bio-medical waste(as per applicable rules); 3.54“non-biodegrada ble waste” means any waste that cannot be degraded by micro-orga nisms into simpler stable compounds; 3.55“Nuisa nce” includes any act, omission, pla ce, animal or thing which causes or is likely to cause inju ry, danger, annoyance or offense to t he sense of sight, smell, hearing, breath, modesty and dignity or disturba nce to movement, work, rest or sleep, or which is or may be dangerous to life or injur ious to health or property; 3.56“Nuisance Detectors” (NDs) means those employees of Aizawl Municipal Corporation, who are appointed by Aizawl Municipal Corporation to detect acts of Public nuisance etc. under the Bye laws; 3.57“Occupier” includes- (a) any person who for the time being is paying or is liable to pay to the owner the rent or any por tion of the rent of the land or building in respect of which such rent is paid or is paya ble; in occupa tion of, or otherwise using, any land or building or part thereof, for any pur pose whatsoever;(b) an owner in occupation of, or otherwise using his land or building;(c) a rent- free tenant of a ny land or building;(d) a licensee in occupa tion of any land or building; and(e) any person who is liable to pay to the owner damages for the use and occupation of any land or building; 3.58“operator of a facilit y / operator of concession” means a person or entity, who owns or operates the concession for handling, collection, sorting, storage, transportation, processing and disposal of municipa l solid waste and it a lso includes a ny other agency appointed by the local body /municipal authority for management and handling of municipa l solid waste in its a rea and any other entit y or agency appointed by the local b ody; 3.59“Pellet forming” means a process used to make pellets, which will be small cubes/cuboids or cylindrical pieces from solid waste and will also include fuel pellets which is obtained fr om garbage. 3.60“ Person” means any person or persons and shall include any shop or establishment or firm or compa ny or a ssociation or body of individu als whether incorporated or not and their agents;assignee etc.; - 6 - Ex-480/2019 3.61“Point to Point Collection” means the system of collection of municipal solid waste fr om specific pick-up points as designated by Aizawl Municipal Corporation, up to which the generator must bring the collected and stored waste for delivery in vehicles so pr ovided/appointed by the Aizawl Municipal Corporation; 3.62“Premises” means any land or building or part of a building and includes-(a) The gar den, gr ound and out- houses, if any, appertaining to a building or pa rt of a building;and(b ) Any fittings affixed to a building or part of a building for the more beneficial enjoyment thereof; 3.63“primary collection” mea ns collecting, lifting and removal of segregated solid waste from source of its generation including households, shops, offices and any other non-residentia l premises or from any collection points or any other location specified by the local body; 3.64“Processing” mea ns any s cientific process by which solid waste is treated for processing for the purpose of reuse, r ecycling or tr ansforma tion into new product s or making it suitable for la nd filling; 3.65“Public Nuisance” mea ns any a ct, omission, offence or wrong-doing which causes or is likely to cause nuisance ( as defined) in any public place; 3.66“Public place” means any place which is open to the use and enjoyment of the public,whether it is actually used or enjoyed by the public or not; 3.67“Rubbish”includes ashes, broken bricks, broken gla sses, dust, malba, mor tar and refuse of any kind which is not filth; 3.68“Receptacle” mea ns conta iner, including bins a nd bags, used for the storage of any category of municipal waste as prescribed by Aizawl Municip al Corporation form time to t ime; 3.69“Recycling’’ means the pr ocess of tr ansfor ming segr egated non-biodegradable s olid waste into raw materia ls for producing new product s, which may or may not be similar to the origina l products; 3.70“redevelopment” mea ns r ebuilding of old r esidentia l or commercial buildings at the sa me site, where the existing buildings and other infrastr uctures have become dilapida ted; 3.71“refuse derived fuel”(RDF) means fuel derived from combustible waste fraction of solid waste like plastic, wood, pulp or organic waste, other than chlorina ted materials, in the form of pellets or fluff produced by drying, shredding, dehydrating and compacting of s olid wa ste; 3.72“Refu se” means any waste matter generated out of different activities, processes, either degrada ble/ non-degrada ble garbage and rubbish /inert in nature in either solid or semi-solid form which cannot be cons umed, u sed or processed by the gener ator in its existing form; 3.73“residual solid waste” means and includes the wa ste and rejects from the solid waste processing facilities which a re not suitable for recycling or further processing; 3.74“sanitary la nd filling” means the final a nd safe disposal of r esidual solid waste a nd inert wastes on land in a facility designed with protective measures a gainst pollution of ground water, surface water and fugitive air dust, wind-blown litter, bad odour, fire haza rd, animal menace, bird menace, pest s or rodents, gr eenhouse gas emissions, persistent or ganic pollutants slope insta bility a nd erosion; 3.75“Sanitation” mea ns the promotion of hygiene and the prevention of disease and other Ca uses of ill health related to environmental fact ors. 3.76“sanitary waste” means wastes comprising of used diapers, sanitary towels or napkins,tampons, condoms, incontinence sheets and any other similar waste; 3.77“secondary stora ge” means the temporary containment of solid waste after collection at secondary waste stora ge depot s or MRFs or bins for onward transportation of the waste to the pr ocessing or disposal facility; 3.78“segregation” means sorting and separate storage of var ious components of solid waste namely biodegradable wastes including a gricultur e and da iry waste, non-biodegrada ble wastes including recycla ble waste, non-recyc la ble combustib le wast e, sanitary was te and non-recycla ble inert wa ste, domestic ha zardous wastes, and construct ion and demolit ion wastes; - 7 -Ex-480/2019 3.79“service provider” means an authority providing public utility services like water, sewerage,electricity, telephone, roads, dra inage, etc.; 3.80“solid waste” means and includes solid or semi-solid domestic waste, sanita ry waste,commercial waste, institutional waste, catering and market waste and other non-residential wastes, street sweepings, silt removed or collect ed from the surface drains, horticulture waste, agriculture and dair y waste, treated bio-medical waste excluding industr ial waste, bio-medical waste and e-waste, battery waste, radio-active waste genera ted in the area under the local authorities and other entities mentioned in rule 2; 3.81“sorting” means separ ating various components and categories of r ecyclables such as paper,plastic, cardboards, metal, glass, etc., from mixed waste as ma y be appropria te to fa cilitate recycling; means sepa rating organic, inorga nic, recyclable and hazardous wastes into ca tegories to fa cilitate recycling; 3.82“sta bilizing” means the biological decomposit ion of biodegra dable wastes to a sta ble sta te wher e it generates no leach ate or offensive odour s and is fit for application to farm land, soil erosion control and soil remediation; 3.83“Sta te boa rd or Committee” mea ns, as applica ble, the State Pollu tion Control Board of a state or committee a ppointed by the government for the sa id purpose. 3.84“s tr eet vendor ” means any person engaged in vending of a rticles, goods, wares, food items or merchandise of everyday use or offering services to the gener al public, in a street, lane, sidewalk, foot path, pavement, public park or any other p ublic place or private area, from a tempora ry built up structure or by moving from place to place and includes hawker, peddler,squatter and all other synonymous terms which may be local or region specific; and the words”street vending” with their grammatical variations and cogna te expressions, shall be cons trued accordingly; 3.85“Sour ce” means the premises from which waste is genera ted. 3.86“Stabilized biodegradable waste” means the biologically stabilized (free of pathogens) waste resu lting fr om the mechanical / biologica l treatment of biodegradable waste; only when stabilized such waste can be used wit h no fu rther restrictions; 3.87“Stor age” means the tempora ry containment of municipal solid waste in receptacles; prevent littering, attr action t o vector s, stra y animals and excessive foul odour; 3.88“Street” includes a ny way, road, lane, square, court, a lley, gully, passage, whether a thor oughfar e or not and whether built upon or not, over which the public have a right of wayand a lso the roadway or foot way over any bridge or causeway. 3.89“tipping fee”means a fee or support price determined by the local authorities or any state agency authorized by the State government to b e paid to the concess ionaire or operator of waste processing facility or for disposal of residual solid waste at the landfill; 3.90“transfer station” mea ns a fa cility created to receive solid waste from collect ion Local Body and transport in bulk in cover ed vehicles or containers to waste processing and, or, disposal facilit ies; 3.91“transportation” mea ns conveyance of solid waste, either treated, partly treated or untreated from a location to another loca tion in an environmentally sound manner through specially designed and covered t ranspor t system so a s to pr event the foul odour, littering and unsightly conditions a nd accessibility to vectors, animals and birds; 3.92“treatment” means the method, technique or pr ocess designed t o modify physica l, chemica l or biological characteristics or composition of any waste so as to reduce its volume and potentia l to cause harm; 3.93“user fee” means a fee impos ed by the loca l body and any entity mentioned in r ule 2 on the waste generator to cover full or part cost of providing solid waste collection, tra nsporta tion,processing and disposal services. 3.94“Vadose water” mea ns the water situated between top soil and gr ound wa ter table level, i.e.in the unsaturated soil strata. - 8 - Ex-480/2019 3.95“vermi composting” mea ns the process of conversion of bio-degradable waste into compost using earth worms; 3.96“waste genera tor” means and includes every person or group of persons, every residential premises and non-residential establishments including Indian Railways, Defense establishments, which generate solid waste; 3.97“waste hierar chy” mea ns the priority order in which the solid waste is to be managed by giving emphasis to prevention, reduction, reuse, recycling, r ecovery and disposal, with pr evention being the most prefer red option and the disposal at the landfill being the least; 3.98“Was te picker” means a person or groups of persons informally engaged in collection and recovery of r eusable and recyclable solid waste from the source of waste gener ation t he streets, bins, material recovery fa cilities, processing and waste disposal facilities for sale to recyclers directly or thr ough intermediaries to earn their livelihood. 3.99 Words and expressions used herein but not defined but defined in the Environment(Protection) Act, 1986, the Water (Pr evention and C ontrol of Pollu tion) Act, 1974, Water(Prevention and Control of Pollution) Cess Act, 1977 and the Air (prevention and Control of Pollution) Act, 1981 and all the Waste Mana gement Rules shall ha ve the same meaning asassigned to them in t he resp ective Acts/Rules. 4Prohibition of littering, a nd other nuisances and ensur ing “Clean Aangan/Premises/ Pla ce” 4.1Littering in/or on any public/private place: No person shall throw or deposit litter in any occupied/unoccupied/open/vacant public or private place except in authorized public or private litter recepta cles. 4.2Littering fr om vehicles: No person shall t hrow or deposit litter upon a ny street, road, sidewalk, playground, garden, traffic island or other public/priva te place from a ny vehicle either moving or parked. 4.3Lit ter fr om wa s te car ria ge vehicles: No person shall drive or move any truck or other vehicle filled with litter unless such vehicles a re so designed to cover the litter and loaded as to prevent any litter from being blown off or deposited upon a ny road, sidewalks, tr affic islands, playground, ga rden or other public place. 4.4Creating Public Nuisa nce: No person shall cook, ba the, spit, urinate, defecate, feed animals /birds or a llow their droppings/poop, wash utensils or any other object or keep a ny type of storage in any public place except in such public facilities or conveniences specifically provided for a ny of these purposes 5Segregation, storage, delivery and collection of Municipal Solid Waste: 5.1 Segregation of waste into separate specified groups: Every generator of Municipal SolidWaste shall sepa rate the waste at sour ce of generation into the following categories as applica ble and shall store sepa rately, without mixing it for segregated storage in authorized storage bins/ba gs, private/public receptacles for handing over or delivering to authorized waste pickers or waste collectors as directed by the local author ity/body from time to time; 1)Bio-degradable (wet) wa ste, 2)Specified domestic hazar dous waste, 3)Fully treat ed Bio- medical waste (as per applica ble rules), 4)Construction and demolit ion wa ste, 5)Bulk garden and horticult ure waste including tree and plant trimmings, 6)All other non- biodegradable (dry) waste including recyclable and non-recyclable waste. Sanitary waste like napkins, diapers, tampons etc. shall be securely wrapped in pouches provided by the manufacturers or b rand owners or in suitable wrappers as instructed by the officia l/authority and shall be stored with the dr y waste for ha nding over. - 9 -Ex-480/2019 7)All bulk generators shall manage the waste at their premises a s per instruct ions notified bythe Aiza wl Municipal Cor poration from time to t ime. 5.2 The Aizawl Municipa l Corporation may sepa rately notify different stages for implementation of the byelaw taking into account the level of awareness among generators of waste as well as a vailability of infrastr uctural support in their operational Local Body. 5.3 The Aizawl Municipa l Corporation shall s eparately notify from time to time the mandatory colour coding and other specifica tions of receptacles prescribed for storage and delivery of different types of s olid wa ste to enable safe and easy collection without any mixing or spillage of waste, which generators of different types of solid waste shall have t o adhere to. 5.4Delivery of segregated premises waste: It shall be the duty of every generator of municipal solid waste, either owner or occupier of every land and building to collect or cause to be collected from their r espective land, premises and b uilding, to segregate waste a nd to store and deliver the same to the municipal worker/vehicle/waste picker / waste collector deployed by the Aizawl Municipal Corporation for the purpose. 5.5Bio-degrada ble waste: Segregated Bio-degradable Municipal Solid Waste (as per the illustra tive list in Schedule II if not composted by t he generator, shall be stored by them within their premises and its delivery shall be ensured to the municipal worker/vehicle/waste picker / waste collector or to the bio-degradable waste collection vehicle provided for specified commercial generators of bulk bio- degradable waste at such times as may be notified from time to time. 5.6Composting by all generator s: Local composting of waste shall be promoted to minimize transportation of waste. 5.7Specified household hazardous waste: (as listed in Schedule III) shall be stored and delivered by every generator of waste to the collection vehicle, which shall be provided weekly/periodically by the Aizawl Municipa l Corporation or any other Agency authorized by the Mizora m Pollution Control Boar d for collection of such waste, or to a center designed for collection of such waste for disposal in a manner that is mandated by the Government of Mizora m or the Mizora m Pollu tion Control Boar d. 5.8Untreated bio-medical waste (as listed inSchedule IV) shall be collect ed & s tor ed in specified type of covered receptacles and deliver ed by every generator of such waste to the collect ion vehicle which shall be provided weekly/periodica lly by Aizawl Municipa l Corporation or any other Agency authorized by the Mizoram Pollution Control Boar d (MPCB), or to a center approved by the Aizawl Municipal Corporation designated for collection of such waste, for disposal in manner that is mandated by Mizora m Pollution Control Board (MPCB) in a ccordance with the Bio-Medical Wa ste (Management & Handling) Rules, 2016. 5.9Construction and Demolit ion waste sha ll be stored and delivered separately at such spot and at such time a s notified by Aizawl Municipa l Corporation or its a gent fr om time to time for collection of such waste. Small generator s(household level) sha ll be r esponsible to segregate the Construction & Demolition waste at source by contacting a local Council or the Agent who shall then send a vehicle to pick up such segregated construction & demolit ion waste on payment of necessary charges by the said genera tor and transport this waste to appr oved disposal site. 5.10 All other Non-biodegradable (“Dry”) waste – both recyclable and non-recyclable – shall be stored and deliver ed by every generator of waste to the dry wa ste collection vehicle, which shall be provided by the Aiza wl Municipal Corporation or its Agents at such spots and at such times as may be notified by t hem from time-to-time for collection of such waste. 5.11 Bulk garden and horticultural waste shall be kept un-mixed and composted at source. The Aizawl Municipal Corporation sha ll also notify Instructions/ guidelines with regar d to pr uning of trees and storage and delivery of tree trimmings including segregated garden and horticultural waste by charging suitable fees as notified by it from time to time, for collection and transport to its facility. - 10 - Ex-480/2019 5.12Burning of wa ste: Disposal by open burning of any type of solid wa ste at r oadsides, or at any private or public property is prohibited. 6Ob liga tory duties of Aiza wl Municipa l Corporation 6.1 Action against Transport Contractors/Municipal Corporation: Aizawl Municipal Corporation shall take action against theTransport Contra ctor and/or Agents/employees of Aizawl Municipal Cor poration, if any worker of the contract or or of any Aizawl Municipal Corpora tion mixes segregated waste at any point of collection, or fails to pick up waste as per the specified time schedule. 6.2Infrastructure facilities: Aizawl Municipal Corporation shall provide adequate infrastructure facilities to assist citizens’ complia nce with these Bye-laws. In addition to waste collection services, litter bins, dry waste sorting centers, and composting centers shall be set up, wherever p ossible and essential, in consultation with local citizens. Adequa te community toilets shall be provided in slum loca lities with the participation of Community Based Organizations to prevent nuisance such as defecating/urinating, washing and bathing in public places. 6.3Citizen Resource Base: The Aizawl Municipal Corporation shall facilitate information about composting as well as recycling of dry waste through composting centers and dry waste sor ting cent ers lis ting them on its webs ite. 6.4Bio-degradable puja ar ticles: The Aizawl Municipal C orporation shall authorize interested organizations to collect bio-degradable ‘puja’ articles (flowers, leaves, fruits etc.) at certain designated sit es near water-bodies such as beaches,lakes , ponds, etc. in notified receptacles. The collect ion from such receptacles shall preferably be composted at a suitable location. 6.5Point-to-Point waste collection services: The Aiza wl Municipa l Cor por ation shall provide for the collect ion of t he municipal solid waste from specific pick-up points on a public or private roa d up to which the genera tor must bring the collected, segregated and stored waste for delivery to municipal worker/vehicle/waste picker / waste collector pr ovided by Aizawl Municipal Corporation accor ding to the route plans at such times and at such spots as notified by the concer ned official/a uthorit y in adva nce for specified types of waste for different localit ies. 6.6Collection at source: Aizawl Municipal Corporation sha ll provide for the collection of municipal solid waste from premises of a building or group of buildings from waste storage receptacles kept on the premises to which Aiza wl Municipal C orporation vehicles/workers shall be provided access at such times a s may be notified by the concerned official/authority of Aizawl Municipal Corporation. 6.7Data about waste received at landfill: The Municipal Aizawl Municipal Corporation shall release publicly, the monthly data a bout the qua ntity of waste going to the different landfills and waste processing sites. Such information shall be available at the Office and on Municipal Corporation/ Council/ Board /Urban Loca l Body of Mizor am webs ite. 6.8Community Bins in public places: a)The Aizawl Municipal Corporation may provide and maintain suitable community bins on public roads or other public spaces, as determined by the Aizawl Municipal Corporation itself or through an Agent as an interim arr angement till Aizawl Municipal Corpora tion make provision for collection at source or point-to-point collection at the required frequencies and shall notify the same on Aizawl Municip al Corporation website from time to time. b)Segregated waste shall be delivered by the concer ned generators to such community bins,and thereafter collected by Aizawl Municipal Corpora tion. Aizawl Municipal Corpora tion or its Agen ts to ensure compliance of segregation and avoidance of public nuisance and health hazards from these community bins. Every community bin shall be separate for bio-degradable and non- bio-degradable waste. Details of all such pla ces including t he arra ngements and schedules of waste collection from such places shall be available a t the Office and at the Aizawl Municipal Corporation webs ite. - 11 -Ex-480/2019 c)Official/authority of Municipal C orporation/Council/ Board /Urban Local Body of Mizoram shall ensure that a t no point of time the community bins are not overflowing nor exposed to open environment and prevent their scattering by rag pickers,stray animals or birds etc. 6.9Dry waste sorting centers / Material Recovery Facilities: In order to regulate and facilitate the sorting of the recyclable and non-recyclable waste, the Aizawl Municipal Corporation shall provide for as many dry waste sorting centers as possible and required. These dry waste sor ting centers shall be on Aizawl Municipal Cor poration land or land belonging to the Government or other bodies, made available especially for this purpose, or in the form of sheds or kiosks pr ovided at suit able public places and shall be manned/opera ted by registered cooperative societies of waste pickers / licensed recyclers or any other Agents authorized / appointed by Aizawl Municipal Cor poration. The non- recyclable waste, which remains a fter sorting shall be further, transported from such sorting centers from time-t o- time to waste disposal sites for processing or land-filling. Such center shall be fenced/ screened in such a way that waste shall not be visible to passersby. 6.10Time schedule and route of collection: The daily and weekly time schedules and routes of Aizawl Municip al Corpor ation collection of different types of municipal solid waste shall be fixed and notified in advance by the concerned official/authority to the public. Details shall be available at all Offices and on the Aizawl Municipal Corporation webs ite. a.A time will be fixed compulsorily in each area to collect garbage from each hou se/premises/ Aangan. Usua lly, the time will be from 7. 00 to 11.00 or any convenient time fixed by Local Council concerned in the morning but can vary. But the Aizawl Municipal Corpor ation should ensure compliance with the timed fixed for any special cleaning purpose. A bell/horn/ announcement (whose sound must not be over the permissible sound limit) should be fitted on the vehicle of gar bage collection/blown by wor ker so that the residents ca n be made awar e of collection being underta ken. b.The time for garbage collection from commercial establishments/shops/markets shall be from9.00 to 12.00 in the morning in general but can vary. 6.11 Similarly, the arr angements for the collection of construction and demolit ion waste, and garden and horticultur al waste, by Aizawl Municipal Corporation or its licensees shall be made available to the public as well as to the bulk generators of waste by the official/authority as the case may be. 6.12Surprise checks: Any authorized Officer/Agent of Aizawl Municipal Cor poration shall have right to enter, a t all r easonable times, with such a ssistance as he considers necessary, any place for the purpose of (i)Performing a ny of t he funct ions entrusted to him by Aiza wl Municipal Corporation or (ii) Determine whether, and if so, in what ma nner, any such functions are to be performed, or whether any provisions of these Bye-laws has been complied with. 6.13Nuis ance Detectors: T he officia l/authority sha ll pr ovide and strengthen the system of Nuisa nce Detectors by providing suitable uniforms and vehicles to Nuisance Detectors 6.14Publicity: Citizen Information Services: The Aizawl Municipal Corporation shall publicize the provision of the Bye-la ws thr ough the media of signs, advertisement, leaflets, a nnouncement on radio and televisions, newsp apers a nd through any other appropriate means, so that all citizens are made a ware about the statutor y duties of citizens and the Aizawl Municipal Corporation for services, recycling, anti-litter and anti-nuisance penalties and fines. 6.15Designated officers and periodic reports: T he official/author ity concerned shall designa te officers under their contr ol who shall be responsible for implementing the obligatory responsibilities of Aizawl Municipal Corpor ation specified under these Bye-laws in accordance with the plans and time schedules for implementation. The specific p lans and time schedules and achievements aga inst the same, a long with reasons for short falls, if any, shall a lso be shared publicly by the official/ authority through the Aiza wl Municipal C orporation webs ite. 6.16Transparency and Public Accessibility: To ensure greater transparency and public accessibility, the Aizawl Municipal Corporation shall provide all necessary information that is required to be publicized through its website. 6.17Co-or dination with Government Bodies: Aizawl Municipal Cor por ation sha ll co-or dinate with other government agencies and authorities, to ensure compliance of these Bye-laws, within Local Body under t he jurisdiction or cont rol of such bodies. 6.18 The urban local body shall ensure arrangements for clea ning da ily or at set interva ls and a ll the year through at all the public roads, places, colonies, slums, Local Body, markets and tourism places, parks of t he urba n body, cremation grounds etc. and the urba n local body shall be commit ted to collect and carr y the garbage from these pla ces door to door or from the nearest garba ge bin/container/facility and transpor t it fr om ther e to the final disposal place in clos ed vehicles. 6.19 The urban local body shall utilize its own/outsourced/contract sanitation workers and vehicles in carr ying out sanitation and solid waste management functions for full or par tial daily cleaning work, so that the urban body is able to keep it s area neat and clean in public interest. 6.20 In order to manage the complete daily cleaning system of the city, the urban local body ma y establish a ward office (complaint center) in each ward, garbage bin/container at suitable places a s required, public toilets/urinals, transfer stations to transport the garbage to the landfill for final disposal, processing unit, etc. 6.21User cha nges: The local body shall levy user charges from the households / premises for the waste mana gement services rendered as per the table given below as determined fr om time to time. For this purpose, the Aizawl Municipal Corporation shall appoint its staff/designated person or persons in all wards/localities to collect garbage from every home/premises in compliance with Solid Waste Management Rules, 2016. 6.22 The Rates/User Cha rges/Fees for collect ing garbage from home and establishments within Aizawl Municipal ar eas are fixed as follows: - TABLE: Sl. The a bove ra tes sha ll be properly advertised by the ULB/institution/person and the rates shall also be announced to the public. 6.24 The waste shall not be handled manually. But, due to some unp recedented circumstances, if the waste material has to be manually handled and lifted us ing manual labour, in such circumsta nces manual labour would be used with all due care and precautions of personal safety gear. 6.25 If the waste material is not disposed by any person on the designated sites, waste bins, litterbins, cont ainers kept on the road and parks by the concerned municipal council/corporationand is disposed by a ny person/party elsewhere where waste disposal is prohibit ed, in such circumstances, Fine / compounding charges can be levied on the concerned person/party in addit ion to fine. 7Obligatory Responsibilities of Aizawl Municipal Corporationand /or generators of waste in case of some specific categories/situations:Keeping in mind the particular nature of some situations, the following responsibilities are specifically mandated: 7.1Poultry, Fish and Slaughter Waste (Fr om all Local Body other than designated slaughter housesand markets) 7.1.1 Every owner / occupier of any premises other than designated slaughter houses and markets, who generates poultry, fish a nd slaughter waste as a resu lt of a ny commercial activit y, shall store the same separa tely in closed, hygienic condition a nd deliver it a t aspecified time, on a daily basis to a collection vehicle provided for this pur pose. Deposit of such waste in any community bin is prohibited and shall attract fines as indicated in the schedule of Fines. 7.1.2 The officia l/authority of Aizawl Municipal Cor poration shall be resp onsible for repair/remodeling of civic facilities in the markets to provide maximum hygiene and sanitary conditions in the market premises. 7.2Vendor/Hawkers:All vendor s/hawkers shall keep their b iodegra dable a nd other waste unmixed in cont ainers / bins at the site of vending for segregated storage of waste genera ted by that vending activity.It shall be the r esponsibility of the generator/vendor to deliver t his waste duly segregated tothe Municipal Collection Vehicle of Aizawl Municipal Corpora tion or to the nearest designated community bins. Fa iling which fine shall be imposed as per the Schedule of F ines. Each Vendor/ hawker shall be responsible to maintain their ‘Clean Aangan’. 7.3House /gullies/Service Lanes: 7.3.1 It shall be the responsibility of the owner/occupier of premises within house-gullies to ensure tha t no waste is dumped or thrown in the house-gully, and to segregate and deliverany solid waste to the waste collection vehicle which s hall be provided by Municipa l Corporation at such spots and at such times as may be notified by official/authority.- 13 -Ex-480/2019 7.3.2 Wher e owners/occupiers of s uch premises wish to a vail of the ser vices of Municipal Cor poration for the cleaning of the house gully, they must apply to the concerned Office of Municipal Corpora tion and pay suitable prescribed char ges as notified by Municipal Corpora tion fr om time to time. It shall be the responsibility of the owners/occupiers to provide access to the house gully for cleaning purposes. 7.4 Litter by owned / p et animals It shall be the responsibility of the owner of any pet animal to promptly scoop/clean up any poop/litter/fecal matter created by any owned/pet animals on the street or any public place and take adequate steps for the proper disposal of such waste their own sewage or other such sanita ry system. 7.5Public Gatherings a nd Event s: 7.5.1 For Public Gatherings and Events, organized in public places for any reason (including for processions, exhibitions, circus, fairs, political rallies, commercia l, religious, socio-cultural events, protests and demonstrations, etc.) where Police and/or Municipal Cor poration permission is required,it shall be the resp onsibility of the Orga nizer of the event or gathering to ensure the cleanliness of that area as well as a ll appurtenant Local Body immediately after the event. 7.5.2A Refundable Cleanliness Deposit: The Organizer of the event shall pay required deposit with the concerned office for the dura tion of the event, which shall be refundable on the completion of the event on notifying that the said public place has been restor ed back to a clean state, and any waste gener ated a s a result of t he event has been collected and transported t o designa ted sites, to the satisfaction of official/authority concerned. This deposit shall be only for the cleanliness of the pu blic place and does not cover a ny dama ge to pr operty. This section s hall also, apply to va rious other events which are being or ganized outside the Municipa l Parks i.e. on roads/lanes etc. In case the Organizers of the event wis hes to avail of the services of Municipal Corporation for the cleaning, collection and transport of waste generated as a r esult of that event,they sha ll apply in adva nce to the concerned Office of Municipal Corporation and pa y the necessary charges in advance as may be fixed for this purpose by Municipal Corporation. 7.6Receptacles on private property:Every owner or occupant of private property shall maintain author ized refuse recepta cles on privat e premises provided t he receptacles are neither visible from public street/roads and side walks nor accessible to animals. 7.7 Other public placesThe Government/Semi-government, statutory bodies shall be responsible for implementation of these Bye-laws within the public premises owned/occupied by them. 8Penalties for contravention of these Bye-laws 8.1. Whosoever contravenes any of the provisions of these Byelaws or fails to comply with the requirements made under a ny of t hese Byelaws shall be punished with a fine a s mentioned in Schedule-I appended to these Bye-laws, failing which, the said defaulter shall be liable to do the community service for at least one hour like road sweeping or graffiti cleaning etc. a s directed/ordered by the Nuisance Detector or Implementing Authority or any person a uthorized to do so. 8.2. In t he event of continuation of the breach of the provisions of these Bye-laws, the equa l amount of fine for every day of default shall be levied or Rs.100/day, whichever is higher, in a ddition to original fine. 9Miscellaneous provisions: 9.1 Bio medical waste and industrial waste shall not be mixed with urban solid waste and the collection of such waste sha ll b e made as per the byela ws sp ecified separa tely for the p urpose. Common Bio Medical Waste Treatment Fa cility (CBWT F) services shall be availed for disposal of bio medical waste as per byelaws. Disposal of such ha zardous waste will have to be ensured at the Common Bio Medical Was te Tr eat ment Fa cility (CBWTF) pla nt at the p rescrib ed cha rges. 9.2 Stra y animals shall not be allowed to r oam freely around waste dumps or at other places in the city and arrangement will have to be made for restraining them at a uthorized area/place only.- 14 - Ex-480/2019 9.3 No one will collect or throw waste water, muddy water, night soil, dung, excreta etc. from his/her building, institution or commercial esta blishment to pollute the atmosphere and ground with its stench and harm pu blic hea lth or obstruct traffic, failing which, car rying charges shall be levied on the spot for spreading such waste, and ca se can be brought against them in court. 9.4 If a person is found spreading pollution or filth in public par ks etc. by throwing dead animal/cattle or its parts, it will be a punishable offense and carrying char ges sha ll also be levied. 10Responsibility of Urban local bodies – 10.1 Transport of the municipal solid waste: - The vehicles used for the transpor t of solid waste are to be duly closed so that the waste should not be visible to the public and the waste is not scattered elsewhere on the r oad dur ing tra nsporta tion, the following standards should be maintained during the transporta tion of the solid wa ste. 10.2 The solid waste would be collected and cleaned as per schedule from the esta blished waste collect ors. Along with the waste, the surrounding area of the disposal site should also be kept clean. 10.3 The design of the transport vehicles will be such that the wa ste will not be allowed to t ouch gr ound until it reaches it s final processing/disposal site, and thus the recurr ing handling of the wa ste will not be allowed. 11Recycling of the municipal solid waste - To process the solid waste collected in the Local Body of Municipal Corporation/ council as useful materials, various solid waste disposal units approved by the pollution control board/P CC and different techniques of such solid waste should be applied so that the dependency of wa ste disposal on the landfills can be minimized. Following standards should be applied for the expected results: - 11.1 For the pr ocessing of the bio-degrada ble waste, various techniques can be used such as vermin composting, composting, mechanized composting, bio methanation etc. Also, the waste can be degraded using the other natural methods/resources by obta ining the required authorizations. 11.2 For the was te mater ia l mix ed with the r ecycla ble/renewa ble resources a s a mix ture, the method of recycling should be used. In some cases, the waste resou rces ca n be used to generate energy. Such plants with the technology should be authorized by the pollution control board. 12Prosecution and P enalties: -As provided in these byelaws, for any breaching of the sa id byelaws, prosecutions and penalties can be rendered as levied down in these byelaws. Further, as per the Environment Protection Act of 1986, cases can be filed a gainst them. 13Repeal and saving of Orders: - 13.1. Before these bylaws are brought into force, any actions taken accor ding to the pr evious bylaws will not be cons idered as void, due to these bylaws coming into effect,provided that such act ions do not violate these bylaws. 13.2.
