No. NE-313(MZ) 2006-2008REMOVAL OF DIFFICULTY ORDERNo. 5/2019-State Tax No. J.21011/2/2019 (iv) - TAX, the 9th May, 2019.WHEREAS, sub-section (2) of section 29 of the Mizoram Goods and S ervices Tax Act , 2017 (hereinafter referred to as the ‘MGST Act’) provides for cancellation of registration by proper officer in situations described in clause (a) to clause (e) as under :- (a)a registered person has contravened such provisions of the Act or the rules made thereunder as may be prescribed; or (b)a person pa ying ta x under section 10 ha s not furnished retur ns for three consecutive tax periods; or (c)any registered person, other tha n a person specified in clause (b), has not furnished returns for a cont inuous period of six months; or (d)any person who has taken voluntary registration under sub-section (3) of section 25 has not commenced business within six months from the date of registration; or (e)registration has been obta ined by means of fraud, willful misstatement or suppression of fa cts: Pr ovided that the pr oper officer shall not cancel the registration without giving the person an opportunit y of being heard. AND WHEREAS, sub-section (1) of section 169 of the MGST Act provides for service of notice (opportunity of being heard); clause (c) a nd (d) of said sub-section are as-under: - (c)by sending a communication to his e-mail address provided at the time of r egistra tion or as amended from time to time; or (d)by making it available on the common portal; or AND WHEREAS, sub-section (1) of Section 30 provides for revocation of cancella tion of the registration within thirty days fr om the date of service of the cancellation or der. AND WHEREAS, sub-section (1) of section 107 of the MGST Act provides for filing appeal by any person a ggrieved by any decision or or der passed by a n adjudicating authority within three months from the date on which t he said decision or order is communica ted to such person and sub-section (4 ) of section 107 of the MGST Act empowers the Appellate Authority t hat it may, if he is satisfied that the appellant was prevented by sufficient cause fr om presenting the appeal within the aforesa id period of t hree months, a llow it to be pr esented within a fur ther period of one month.VOL - XLVIII Aizawl, Thursday 16.5.2019 Vaisakha 26, S.E. 1941, Issue No. 317 - 2 - Ex-317/2019Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. C/50 AND WHEREAS, a large number of registrations have been cancelled under sub-section (2) of section 29 of the MGST Act by the proper officer by serving notices as per clause (c) and clause (d) of sub- section (1) of section 169 of the MGST Act a nd the period of thirty da ys provided for revocation of cancellation order in sub-section (1) of section 30 of the MGS T Act, the period for filing a ppeal u nder section (1) of section 107 of the MGST Act and also the period of condoning the delay provided in sub- section (4) of Section 107 of the MGST Act has elapsed; the registered persons whose registration have been cancelled under sub-section (2) of section 29 of the MGST Act are unable to get their cancellation of registration revoked despite having fulfilled all the requirements for revocation of cancellation of registration. GST being a new Act , these taxpayers were not fa miliar with the manner of service of notice by e-mail or making available at portal in comparison to earlier regime where manual service of notice was provided, as a result whereof certain difficu lties have arisen in giving effects to the provisions of sub-section (1) of section 30 of the MGST Act; NOW, THEREF ORE, in exercise of the powers conferred by section 172 of the Mizoram Goods and Services Tax Act, 2017, the Governor of Mizoram, on recommendations of the Council, hereby makes the following Order, to r emove the difficulties, namely: — Shor t title.—This Order may be called the Mizor am Goods and S ervices Tax (F ifth Removal of Difficulties) Order, 2019.- In s ub-section (1) of section 30 of the said Act, the following proviso sha ll be inserted, namely: - “Pr ovided tha t the registered person who was served notice under sub-section (2) of section 29 in the manner as provided in clause (c) or clause (d) of sub-section (1) of section 169 and who could not reply to the said notice, thereby resulting in ca ncellation of his registration certificate a nd is hence una ble to file application for revocation of cancellation of registration under sub-section (1) of section 30 of the Act, against such order pa ssed up to 31. 03.2019, shall be allowed to file applica tion for revocation of cancellation of the registration not later than 22.07.2019.”. WHEREAS, the practice of p lacing bottled or packaged dr inking water in various official meetings has often r esulted in wastage of water a nd resou rces due to non-consumption of water so pla ced. WHEREAS, the use of bottled or packaged drinking water in official meetings or conferences or gatherings has discouraged the use of water dispenser and other similar means of serving water in official meetings. WHEREAS, the plastics used for pa ckaging water not only deplete the natural resources but also contribute to the destruction of the environment and climate due to its improper disposal as they are non-degra dable. AND WHEREAS, discontinuation of t he prevailing practice of distributing packaged water bottles made of pla stic in officia l meetings, conferences and gatherings under the State Government needs to be actively realised to cut down unnecessary expenses, reduction of wastage of resources and for the cons ervation of the environment. NOW THEREFORE, the State Government of Mizoram hereby bans, with immediate effect, distribution or pla cing of packaged drinking water made of pla stics in all official meetings or conferences or gatherings, and tha t water dispenser and glasses be put in pla ce for the pur pose of drinking water in meeting halls and venues of gathering a s the case may be. BE it enacted by Parliament in the Sixty-ninth Year of the Republic of India as follows:— 1. (1) This Act may be called the Right of Children to Free and Compulsory Education (Amendment) Act, 2019. (2) It shall come into for ce on such date as the Central Government may, by notification in the Officia l Gazette, appoint. 2. In the Right of Children to F ree a nd Compulsor y Education Act, 2009 (her einafter referred to as the princip al Act), for section 16, the following section shall be substituted, namely:— “16. (1) There shall be a regular examina tion in the fifth class and in the eighth class at the end of every academic year.Short title and comme nce me nt. Substitution of new section for section 16. Examination and holding back in certain cases. 35 of 2009. - 2 - Ex-335/2019 (2) If a child fails in the examination r eferred to in sub-section (1), he shall be given additional instruction and granted opportunity for re-examination within a period of two months from the date of declaration of the result. (3) The appr opriate Government may allow schools to hold back a child in t he fifth class or in t he eighth class or in both classes, in such manner and subject to such conditions as may be prescribed, if he fails in the re-examination referred to in sub-section (2): Provided tha t the a ppropria te Government may decide not to hold back a child in a ny class till the completion of elementary education.(4) No child shall be expelled from a school till the completion of elementary education.”. 3. BE it enacted by Parliament in the Sixty-ninth Year of the Republic of India as follows:— 1. (1) This Act ma y be ca lled the National Council for Teacher Educa tion (Amendment) Act, 2019. (2) It shall be deemed to have come into force on the 17th day of August, 1995. 2. In the Nationa l Council for Teacher Education Act, 1993 (hereinafter referred to as the principal Act ), in section 14, in sub-section (1 ), after the proviso, the following pr oviso shall be inserted, namely:— “Provided further that such institutions, as maybe s pecified by t he Central Government by notification in the Official Gazette, which—Short title and comme nce me nt. Amendment of section 14. 73 of 1993. - 2 - Ex-336/2019Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. C/60 Amendment of section 15.(i) arefunded by t he Central Government or the State Government or the Union territory Administration; (ii) have offered a course or tr aining in teacher education on or a fter the appointed day till the a cademic year 2017-2018; and(iii) fulfil the conditions specified under clause (a) of sub-section (3), shall be deemed to have been recognised by the Regional Committee.”. 3. In section 15 of the pr incipal Act, in sub-s ection (1), the following proviso shall be inserted, namely:— “Provided that the course or training in teacher education offered on or after the appointed day till the academic year 2017-2018 by such institutions, as may be specified by the Central Government by notification in the Official Gazette, which— (i) are funded by the Central Government or the State Government or the Union territory Administration; and (ii) fulfil the conditions specified under clause (a) of s ub-section (3), shall be deemed to have been granted permission by the Regional Committee.”.

VOL - XLVIII Aizawl, Thursday 23.5.2019 Jyaist ha 2, S.E. 1941, Issue No. 336 THE NATIONAL COUNCIL FOR TEACHER EDUCATION (AMENDMENT) ACT, 2019 AN ACTfurther to amend the National Council for Teacher Educa tion Act, 1993. BE it enacted by Parliament in the Sixty-ninth Year of the Republic of India as follows:— 1. (1) This Act ma y be ca lled the National Council for Teacher Educa tion (Amendment) Act, 2019. (2) It shall be deemed to have come into force on the 17th day of August, 1995. 2. In the Nationa l Council for Teacher Education Act, 1993 (hereinafter referred to as the principal Act ), in section 14, in sub-section (1 ), after the proviso, the following pr oviso shall be inserted, namely:— “Provided further that such institutions, as maybe s pecified by t he Central Government by notification in the Official Gazette, which—Short title and comme nce me nt. C/60 Amendment of section 15.(i) arefunded by t he Central Government or the State Government or the Union territory Administration; (ii) have offered a course or tr aining in teacher education on or a fter the appointed day till the a cademic year 2017-2018; and(iii) fulfil the conditions specified under clause (a) of sub-section (3), shall be deemed to have been recognised by the Regional Committee.”. 3. In section 15 of the pr incipal Act, in sub-s ection (1), the following proviso shall be inserted, namely:— “Provided that the course or training in teacher education offered on or after the appointed day till the academic year 2017-2018 by such institutions, as may be specified by the Central Government by notification in the Official Gazette, which— (i) are funded by the Central Government or the State Government or the Union territory Administration; and (ii) fulfil the conditions specified under clause (a) of s ub-section (3), shall be deemed to have been granted permission by the Regional Committee.”.The Appropriation Act, 2019 (Act No. 4 of 2019)

From and out of the Consolidated Fund of India there may be paid and applied sums not exceeding those specified in column 3 of the Schedule amounting in the aggregate to the sum of one lakh ninety-eight thousa nd eight hundred thirty-one cror e and thirty-six lakh rupees towards defraying the several charges which will come in cou rse of payment during the financial year 2018-19 in respect of t he services specified in column 2 of the Schedule. 3.
