VOL - XLVIII Aizawl, Thursday 23.5.2019 Jyaist ha 2, S.E. 1941, Issue No. 338 THE APPROPRIATION (No. 6) ACT, 2018 AN ACTto a uthorise payment and appropriation of certain further sums from and out of the Consolidated Fund of India for the services of the fina ncial year 2018-l9 . BE it enacted by Parliament in the Sixty-ninth Year of the Republic of India as follows:— 1. This Act may be called the Appropriation (No. 6) Act, 2018. 2. F rom and out of the Consolida ted Fund of India there may be paid and applied sums not exceeding those specified in column 3 of the Schedule amounting in the aggregate to the sum of eighty-five thousand nine hundred forty-eight crore and eighty-s ix lakh rupees towards defra ying the several charges which will come in course of payment during the financial year 2018-19 in respect of the services specified in column 2 of the Schedule. 3. VOL - XLVIII Aizawl, Thursday 23.5.2019 Jyaist ha 2, S.E. 1941, Issue No. 339 THE APPROPRIATION (VOTE ON ACCOUNT) ACT, 2019 AN ACTto provide for the withdrawal of certain s ums from and out of the Consolidated Fund of India for the services of apar t of the financial year 2019-20. BE it enacted by Parliament in the Seventieth Year of the Republic of India a s follows:— 1. This Act may be called the Appropria tion (Vote on Account) Act, 2019. 2. From and out of the Consolidated Fund of India, there may be withdr awn sums not exceeding those specified in colu mn 3 of the Schedule, amounting in t he aggr egate to the sum of thir ty-four lakh s eventeen thousand two hundred ninty-five cr ore and thirty-eight lakh rupees towards defraying t he several cha rges which will come in course of pa yment during the financial year 2019-20. 3. The sums authorised to be withdrawn from a nd out of the Consolidated F und by this Act shall be appropriated for the services and purposes express ed in t he Schedule in relation to the said year. 4. (2) This Regulation sha ll extend to the whole States of Manipur and Mizoram and shall apply in relation to all matters fa lling within the jurisdiction of the Commission. (3) This Regulations sha ll come into force from the date of their notifications in the Official Gazette of t he concerned Sta tes. 2 . Amendment in Regulation 4 of the Pr incipal Regulations: Clause 4.1 of the Joint Electricity Regulatory Commission for Manipur and Mizoram (Electricity Supply Code) Regulations, 2013 shall be substituted as below: 4.1 The licensee shall, on an applicationfor power supply by the owner or occupier(with due knowledge of the owner) of any premises located in his area of supplyfor new connection and additional connection arising from modification in existing connection, give supply of electric ity to such pr emisesfrom the nearest distribution main through service line from one source of LT for LT supply or one source of HT for HT supply within the time specified in this code, provided (1) the supply of power is technically feasible; (2) the applicant has observed the procedure specified in this Code; and (3) the applica nt agrees to bear the cost of supply and services as specified in the Code. Application These rules shall apply to the posts specified in Column I of Annexure-I her et o a nnex ed. 3. Number of posts, The number of the said post(s), their classification and the Level in classification and Pay Matrix a ttached thereto shall be as specified in Column 2 to 4 of Level in Pay Matrix the said Annexure-I 4. Method of r ecruitment, The method of recruitment, age limit, qualifications and other matters age limit and other relating to the said post shall be as specified in Column 5 to 14 of qualifications Annexure-I. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes or the Scheduled Tribes and other special categories of persons in a ccordance with the or ders issued by the Central Government or Government of Mizora m from time to t ime. 5. Power to transfer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these rules to any other post or position which is equivalent in rank or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be r ecorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and Nothing in these rules shall affect any reservations, relaxation of age other concessions age limit and other concessions required to be provided for the Scheduled C astes or the S cheduled Tribes and other ca tegories of persons in accorda nce wit h the or der issued by Central Government or Government of Mizoram from time to time in this regard. 10 Repeal & Savings All rules p ertaining to these posts fr amed by the Government of Mizoram notified vide 1) No. A.12018/16/2003-P&AR (GSW) dt 28.10.2009 and published in the Mizoram Gazette Extraordinary Issue No. 486 dated 29.10.2009 for the erstwhile post of Commissioner of Taxes and subsequently a mended vide notification No. A.12018/16/ 2013-P&AR(GSW) dt 23.06.2016 and published in the Mizoram Gazette Extraordinary Issue No.198 dated 28.06.2016; and 2) No. A.12018/2/93-P&AR (GSW) dt 12.06.2001 and published in the Mizoram Gazette Extraordinary Issue No. 118 dated 12.06.2001 for the erstwhile post of Joint Commissioner of Taxes and subsequently amended vide notification No. A.12018/2/93- P&AR(GSW) dt 26.06.2002 and published in the Mizoram Gazette Extraordinary Issue No.205 dated 02.07.2002; and 3) No. A.12018/16/2003-P&AR (GSW) dt 14.12.2004 and published in the Mizoram Gazette Extraordinary Issue No. 375 dated 21.12.2004 for the erstwhile post of Deputy Commissioner of Taxes; and 4) No. A.12018/16/2003-P&AR (GSW) dt 14.12.2004 and published in the Mizoram Gazette Extraordinary Issue No. 376 dated 21.12.2004 for the erstwhile post of Assistant Commissioner of Taxes; and 5) No. A.12018/16/2003-P&AR (GSW) dt 14.12.2004 and published in the Mizoram Gazette Extraordinary Issue No. 377 dated 21.12.2004 for the erstwhile post of Superintendent of Taxes stand hereby repea led with effect from the date of commencement of these r ules. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be r ecorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. For the purpose of availing the above mentioned age relaxations, unless the context otherwise requires: a)“a retr enched S tate Government employee” means a person who was employed under the Government of Mizoram for a continuous period of not less than six months pr ior to his retr enchment and was discharged as a r esult of right-sizing or due to normal r eduction in establishment. b)“a whole-time Cadet instructor in NCC” means a person who was recruit ed as a whole-time Cadet instructor in NCC on or after 01.01.1963. c)“Ex-GREF personnel” means a person who was employed in that F orce at least a continuous period for not less than six months and who was released from that F orce on completion of his tenur e of ser vice. d)“disabled ex-servicemen” means ex-serviceman who while serving in the Armed Forces in the Union was disabled in operations against the enemy or in disturbed ar eas. e)“ex-serviceman” means a person (i)who has served in a ny rank whether as a combatant or as non-combatant in a regular Army, Navy or Air Force of the India n Union, and a.who either has been retir ed or r elieved or discharged from such service whether at his own r equest or being relieved by the employer aft er earning his pension; or b.who ha s been relieved fr om s u ch s er vice on medica l gr ou nds a t t rib u t a ble t o milita r y service or circumstances beyond his control and awarded medical or other disability pension; or c.who has been released from such service as a result of r eduction in establishment; (ii) who has been released from such service after completing the specific period of engagement, otherwise tha n at his own r equest, or by way of dismissa l, or discharge on account of misconduct or inefficiency and has been given a gratuity; and includes personnel of the Terr itoria l Army, namely, pension holders for cont inuous embodied service or broken spells of qualifying service; or (iii) personnel of Army P ostal S ervice who are part of Regular Army a nd retired from the Ar my P os t a l S er vice wit hou t r ever s ion to t heir p a r ent s er vice wit h p ens ion, or ar e r elea s ed fr om the Army P osta l S ervice on medica l gr ounds attr ibutable to or a ggr avated by military service or circumstances beyond their control and awarded medical or other disability pension; or (iv) Gallantry Award winners of the Armed Forces including personnel of Territorial Army; or (v) Ex-r ecruits boarded out or relieved on medical ground and granted medica l disability pension f)“Meritorious sportsperson” means sportspersons considered meritor ious with reference to the following criteria on production of r elevant Certificate from the C ompetent Author ity: i)Spor tsmen who have represented a State or the country in the Nationa l or International competition in any games/sports; or ii)Spor tsmen who have represented their University in the Inter-University Tournaments conducted by the Inter-Universit y Sports Boards in any sports/games; or iii) Spor tsmen who have represented the State School Teams in the Na tional Sports/games for schools conducted by the All India School Games Federation in any games/sports; or iv) Spor tsmen who have been awarded National Awards in Physical Efficiency under the National Physical Efficiency Dr ive. 9.The contents of this Notification pertaining to Sl. No. 6 in paragra ph 6 are applicable only to State Government Civilia n employees holding Civil posts either on regular, work-charged, contr act, muster roll or adhoc/officiating basis including those working under Centrally Sponsored Schemes and are not applicable to personnel working in autonomous/statutory bodies, Public Sector Undertaking etc. which are governed by regulations/statute issued by the concerned administr ative Departments. 10. In t he absence of a specif ic crucia l da t e in the r eleva nt recr uitment rules/ service r ules, the cru cia l date for determining the age limit shall be the closing date for receipt of applications from candidates in India (other than those in Andaman & Nicobar Islands and Lakshadweep). In the case of recruitment made through the Employment Exchange, the crucial date for determining the age limit shall be the last date up to which the Employment Excha nge is asked to submit the list of ca ndidates (Refer ence Notification No.A-36012/1/2005-P&AR (GSW) dated 07.07.2006) 11. This Department’s OM No. A.12018/1/80-APT(B) dated 27.04.1992 on the subject of “Relaxation of a ge for a ppointment to Government Servant by direct r ecruitment” is hereby superseded.- 5 -Ex-375/2019 12. The contents of this Notification shall be without prejudice to the provisions of a ny other extant Act or r ules or directions, if any, of the Supreme Court/High Court pertaining to the subject matter. 12. The age relaxations as pr escribed in this Notification can be claimed only for one specific category as mentioned in the Table at par agraph 6 of this Notification and NOT for a combination of different cat egories . 13. This Notification shall come into force with effect from 1st July, 2019.
