Kaphlira, Deputy Director, Economics & Statistics on 31.5.2017 at 4:30 PM. Pu P. Kaphlira entered into Government service as Sub-Inspector of Statistics on 30.10.1980 and posted in the Directorate of Economics & Statistics. During his service of deca des he got promotion as follows:- 1.Assistant Research Officer on 28.1.1992 and posted in the Sta te Planning Board. 2.Research Officer on 28.11.2003 a nd pos ted in the Sta te Planning Board. 3.Senior Research Officer on 16.1.2014 and posted as Deputy Director at the Directorate of Economics & Statistics, Aizawl where he served till his last breath. He had served the Government of Mizoram with utmost sincerity and devotion, and endeared himself to all his collea gues. He always proved himself to be a conscientious Officer. The Government of Mizoram places on record its deep appreciation of sincere services rendered by Pu P. Kaphiir a and conveys its heartfelt sympathy to the bereaved family. Dr. C. MIZORAM (ANIMAL SLAUGHTER HOUSES) RULES, 2016 In exercise of the powers conferred under sub-section 4 of section 3 with section 18 of the Mizoram Animal Slaughter Act 2013, the Governor of Mizoram is pleased to make the following rules, namely :- CHAPTER I PRELIMINARY 1 . Short title, extent and commencement. 1.These rules may be called the Mizoram (Animal Slaughter Houses) Rules, 2016. 2.They shall extend to any such city or towns where sla ughter houses are est ablished or as the Government may, by notification in the Official Gazette, specify. 3.They shall come into force from the date of its publication in the Official Gazette. 2 . Definitions. (1) In t hese r ules, unless the context other wise requires, (a) ‘Act’ means the Mizoram Animal Slaughter Act, 2013 (Act No. 6 of 2013). (b) “Authority” means the Government of Mizor am or a ny officer authorized by it on its behalf; (c ) “Butcher” means the butchers holding va lid license issued by the Licensing Author ity; (d) “Cattle pound” means any place or room or shed or enclosure where animals are herded or kept with the permission of Authority before proceeding to their slaughtering; VOL - XLVI Aizawl, Wednesday 7.6.2017 Jyaistha 17, S.E. 1939, Issue No. 247 - 2 - Ex-247/2017 ( e) “Fee” means any amount fixed for payment as fees; (f) “Fine” means any a mount of fine imposed by the author ity; (g) “For ms” means any form prescribed for the enforcement of these rules; (h) “Gazette” means the Official Gazette issued by the Gover nment of Mizor am from time to t ime; (i)“Ins pector” means the Veterinary Officer under the Anima l Husba ndry and Veterinary Depa rtment, or any staff author ized to function as such; (j)“License” means the license issued by the Author ity; (k) “Licensing Authority” means the officer authorized to issue license under these rules; (1) “Light” means any type of light, electricity, candle, etc; (m) ‘Magistrate’ means any officer who have been invested with such powers, either executive or judicial or both by the Government; (n) “Mea t” means the meat of s uch animals as specif ied in t hese ru les; (o) “Occupier” means the person authorized to occupy the slaughter house constructed by the Government; (p) “Private” means a person other than a Government official; (q) “Sla ughter House” means any building or place where the animals are to be killed as permitted or licensed by the Author ity; (r ) “Veterinary Officer” means any veterina ry practitioner registered with the Veterinary Council of India established under the Indian Veterinary Council Act, 1984 (52 of 1984) serving under the Government of Mizoram. (s) “War den” means the person or persons appointed t o look after the slaughter house. (2) Words and expression used but not defined under these rules but defined in the Act shall have the meaning as respectively assigned t o them in the Act. CHAPTER II ESTABLISHMENT AND MANAGEMENT OF SLAUGHTER HOUSE 3 . Establishment of slaughter house. Under the provision of section 3(4) of the Act , interested persons or parties other than the Government may set up sla ughter house on the following condition: (1) Application for license to establish slaughter house in Form 1 of these rules may be submitted to the Authority by interested per son(s). No person shall establish slaughter house without obta ining pr ior written per mission from the Author ity. (2) The Authorit y may issue license for the establishment of the sla ughter house in Form II of these rules with specific terms and condition to the interested party if in his opinion setting up of the slaughter house is necessary in the interest of public services. (3) Interested parties shall obtain t he prescribed applica tion forms from the authority on payment of a pplication fees and submit it to the Director. (4) The Authority may reject a ny or a ll the applica tion for the establis hment of a slaughter house if in its opinion setting up of such esta blishment is contrary to public interest. (5) The Authorit y may grant combined or separa te license for slaughter house or cattle pound as the case may be. (6) License will ordinary be valid for a period of one year and shall b e renewed annually before the due date on pa yment of renewal fees fixed from time to time. Fa ilure to renew within the stipulated time will attra ct a fine of rupees One thousand as late fee which shall be cleared at the time of renewal of license. If license is not renewed after a lapse of one month, it shall be subject to cancellation. - 3 -Ex-247/2017 (7) The authorit y may, by notification, order cancellation of any license issued under these rules if in its opinion the establishment creates public nuisa nce by any means or by viola tion of any order issued by the Author ity. 4 . Recep tion ar ea or r esting gr ounds (1) The slaughter house shall have a r eception area of adequate size sufficient for livestock subject to veterinary inspection. (2) The Veterina ry Officer shall examine thoroughly not more than 12 animals in an hour and not more than 96 animals in a day. (3) The Veterinary Officer after exa mining the animal sha ll issue a soundness certificate in the form specified by the Government for this purpose. (Form - III) (4) The reception area of sla ughter house shall have proper ramps for direct unloading of animals from vehicles and a dequate facility sufficient for feeding and watering of animals. (5) Sepa rate isolation pens shall be provided with watering and feeding arrangements for animals suspected to be su ffering from contagious and infectious dis eases, and fra ctious animals, in order to segregate them fr om the remaining animals. (6) The resting grounds in slaughter house shall ha ve overhead pr otective shelters. (7) Ante-mortem and pen area shall be paved with impervious material suitable to stand wear and tear by hooves. 5 . Lair ages (1) Every animal after it has been subjected to veterinary inspection shall be passed on to a lairage for resting for 24 hours before slaughter. (2) Lair age shall be adequate in size sufficient for the number of a nimals to be aired. (3) The space pr ovided in the pens of such la irage shall be not less than 2.8 sq.mt. per large animal and 1.6 sq.mt. per small animal. (4) The animals shall be kept in such laira ge sepa rately depending upon their type and class and such lairage shall be so constructed as to protect the animals from heat, cold and r ain. 6 . Slaughter house building. The different construction of a slaughter house shall be built and maintained by its owner in the manner specified below, namely: (1) Plant Building - (a ) Materials used shall be impervious, easily cleanable, and resistant to wear and corrosion, (b) Materia ls such as wood, plaster board, and porous acoustic-type boa rds, which are absorbent and difficult to keep clean shall not be used. (2) Floors - The floor s shall be non-absorbent and non-slippery with rough finish and shall have suitable gra dient for drainage. (3 ) Int erior walls - (a ) Int erior walls s ha ll b e s mooth a nd fla t a nd const r uct ed of imp er viou s mat eria ls . (b) The interior walls sha ll have washable surface up to the height of 2 meters from the floor so t hat the splashes may be washed and disinfected. (4) Abattoir shall be provided with distributed artificial light of an overall intensit y of not less than 200 lux at the distances a s may be specified by the authority throughout the slaughter hall and workrooms and at places where meat inspection is carried out, the overa ll intensity of artificial light shall be not less than 500 lux. (5) Abattoir shall be provided with suitable and sufficient means of ventilation to the outside air and the construction of the slaughter ha ll shall be so arranged that the dressed ca rcasses are not exposed to direct sunlight. - 4 - Ex-247/2017 (6) Sufficient, safe, potable and cons tant supply of fresh wa ter sha ll be available at adequate pressure through the premises. (7) Floor washing point shall be provided preferably for minimum 37 meter square on slaughter floor and working compartments. (8) A constant supply of clean hot water shall be ava ilable in the s laughter hall a nd workr ooms during working hour s and the hot water r equired for frequent sterilizing of equipment shall not be less than 82 degree Celsius. (9) The following materials shall not be used in an abattoir, namely - (a ) Copper and its alloys in equipment used for edible products. (b) Cadmium in any for m in equipment handling edible products. (c ) Equipment with paint ed surface in product zone. (d) Enamel conta iners or equipment is not desir able (e) Lead (10) All permanently mounted equipment shall either be installed sufficiently away from walls and floor (minimum 300 mm) to provide a ccess for cleaning and inspection. (11) Screens and Insect control - All windows, doorways and other openings t hat may admit flies shall be equipped with effective insect and rodent screens and Fly chaser fa ns and ducts or air curtains shall be provided over doorways in outside wall of food ha nding a reas that are used for dispatch or receiving. (12) Drainage - (a) All parts of floors where wet operations are conduct ed shall be well drained. (b) A slope of about 20 mm per metre to drainage inlets shall be provided for usual conditions and it shall be ensured that the floor slopes uniformly to drains with no low spots, which collect liquid. 7. Slaughter (1) No a nimal shall be slaughtered in a sla ughter house in sight of other animals. (2) No animal shall be administered any chemical, drug or hormone before slaughter except drug for its treatment for any specific disease or ailment. (3) Every slaughter house shall provide a separate space for stunning of a nimals prior to slaughter, bleeding and dressing of the carcass. (4) Dressing of carcasses shall not be done on floor and adequate means and tools for dehiding or belting of the animals sha ll be provided with means for immediate disposal of hides and skin. 8 . Inspection of Slaughter House. (1) The Inspection tea m as appointed by Government may, at any time, inspect any slaughter house or ca ttle pound and its pr emises and give necessary instruction to t he owner or warden of t he hous e regar ding the standard of hygiene and cleanliness. (2) The owner or warden shall comply with the advice, instructions, order etc. of the inspecting official without hesitation. If such instructions are not complied with, the a uthority may impose a fine of r upees Five Hundred or cancel his license. 9 . Right to management of Government. (1) No slaughter house shall be managed without the prior permission of the author ity; Provided tha t in respect of the la nd and buildings owned by the Department, Government may appoint suit able person or persons to manage or r un the slaughter house constr ucted by the Government on cont ract ba sis. (2) Selection of persons to manage the slaughter house sha ll ordinarily be made on public auction for a period of one year which will be ext endable for another six months. If in the opinion of the authority, extension of the norma l term is required in the interest of public services, he may obta in appr oval fr om the Author ity. (3) If the Director is pleased to extend the terms of the warden or manager on payment of the pres cribed fees, the same may be r ecor ded in writ ing in the lic ense iss ued. 10. Right to issue orders. Notwithstanding anything contained in these rules, the authority may issue orders, instruction, guidelines etc. for the effective execu tion of these ru les. CHAPTER III ESTABLISHMENT OF MEAT SHOPS 11. Establishment of meat shops. Meat shops shall be established where only meat duly certified a s fit for human consumption by the meat inspector and slaughtered in the recognized slaughter house in accordance with the provisions of these rules shall be sold. Such mea t shops should fulfill the following conditions: (1) Meat shops should be so constructed that flies and other insects cannot enter the shop. The floors and walls should b e made of impervious materia ls that can ea sily be cleaned. The shop along with the other articles such as knives, slabs etc. must be kept clean at all times. (2) Meat should be suspended by means of hook in such a way that the meat does not touch the roof, floor, wall or pillars of the shop. (3) The butcher should display the soundness certificate issued by the meat inspector in a prominent place where the meat is being sold. (4) The stamped portion of the meat should be made clearly visible and should be preserved till the meat is sold out. (5) Offa l, skin, horns and entrails etc. for which there is provision for sale in the sla ughter house should not be brought to t he meat shops or kept in for sale. (6) Trimming, refuses a nd rubbish should be kept in a covered receptacle and should be disp osed off in manner prescribed by the Author ity. (7) Meat shops sites/places shall be identified and permit issued by appropriate agency/department under Government of Mizoram. CHAPTER IV LICENSING BUTCHERS AMD THEIR DEPLOYMENT 12. Deployment of butchers. (1) No person shall deploy any butcher in the slaughter house or houses without the permission of the Authority. (2) No person who has not atta ined the age of 18 years sha ll be employed in any manner in a slaughter house. (3) No person who is suffering from any communicable or infectious disease sha ll be permitted to slaughter a nimals to be sold for human consumption. (4) The owner or the wa rden of the sla ughter house may deploy any number of butcher or flayer at their own arrangement. The owner or the warden shall submit application in FORM IV to the Authority giving full particulars of person or persons intended to be deployed as butcher or flayer. (5) The Director will issue permit/license in Form V to the owner, occupier or war den for the deployment of such butcher or fla yer on payment of Rupees Twenty Five to the Director as annual fee. The permit once issued will have a validity of one year which may be extended annually on payment of the prescribed fees. (6) Permit/license so issued to a butcher is liable to cancellation by the Director at a ny point of time, if the permit holders misbehaves or violate the direction of the administra tion of the slaughter house where he is employed.- 5 -Ex-247/2017 CHAPT ER V SLAUGHTER HOUSE WASTES MANAGEMENT AND SANITATION 13. D i sposal of i nedi bl e meat and w ast es. The carcass or parts thereof, of animals unfit for human consumption so destroyed, and the liqu id and solid wastes a nd offa l shall be disposed of in the manner descr ibed here under :- (1) No a nimal or parts thereof, of animals declared unfit shall be allowed to be sold. (2) Animals which had been brought to the slaughter house dead or dying or decla red unfit shall be caused to be destroyed in a humane manner and the carcass destroyed by burning or incineration as deemed pr oper by the Mea t Inspector. (3) Offal and other waste products of slaughtered animal shall be processed in the rendering plants or s ha ll b e s old t o t he p u r cha s er s t o wh om p er mi t s ha ve b een i s s u ed t o p u r ch a s e s u ch ma t er i a ls . (4) Bleeding ar eas should be clearly identified and blood collect ion should be done immediately so that its full potential could be utilized. (5) Solids (skin trimmings, hair, pieces of bones, hooves, hide and skin etc.) should be removed immediately from the slaughtering a rea. (6) Adequate compartments for immediate separation and disposal of condemned ma terial must be provided. (7) Disposal of the effluents into municipal drains, lake or permanent river shall not be allowed to avoid contamina tion. (8) Stinking odour due to degeneration of any tissue materials remaining as a waste in the premises of the slaughter house sha ll be a voided with the provision of proper ventilation, washing of the floors with non-poisonous disinfectants or aerobic deodora nts. CHAP TER-VI SLAUGHTER HOUSE AND MEAT INSPECTION 14. Ante mortem and post mortem examination. Animals intended for slaughter shall be thoroughly examined by the Meat Inspector. The Meat Inspector shall issue certificates to the effect that the animal to be slaughtered is fit for human cons umption; otherwise, he may reject unhealthy animals for slaughtering. No person shall kill any animal before ante mortem inspection is conduct ed by t he Meat Inspector. 15. Segregation of healthy and unhealthy animals. (1) The Meat Ins pector may reject the animal on a nte mortem examination if found unfit for huma n consumption, he sha ll record in writing t he condition of the animal with clear comments as to whether such animal should be given treatment or be destr oyed/culled. (2) Such unfit a nimal shall be marked and segregated from the rest of the healthy animals. The meat inspector may issue order for killing of the incurable animal at the appointed time and place. (3) The animal unfit for slaughter but curable by medical treatment shall be taken back by the owner of the animal and su ch animal shall be slaughtered only a fter issue of a certificate to the effect that the animal is fit for human consumption after proper medical treatment subsequent to medication withdrawal time. 16. Stamping of animals. No a nimal shall be admitted into a slaughter hous e for slaughter unless it is examined, certified, stamped and registered in Form VI of these rules by the inspector tha t the anima l is free fr om cont agious diseases and other diseases. A certificate may be issued by the inspector after examina tion which shall contain the time and date of the examination of the animal and it sha ll be valid for 48 hours only.- 6 - Ex-247/2017 17 . Disposal of u nhealthy a nima l. The animal unfit for slaughter but cura ble by medical treatment sha ll be taken ba ck by the owner of the animal a nd such animal shall be slaughtered only aft er issue of a certificate to the effect that the animal is fit for human consumption after proper medical treatment subsequent to medication withdrawal times. Animal carcasses found to have diseases/defected as listed in schedule 1 and 2 of these r ules shall be disposed of in a ccordance with rule 13 of t hese rules. 18. Slaughter of healthy animals. (1) The animal intended for slaughter shall be kept in the lairage or cattle pound for at least F orty eight hours before they ar e killed. Feeding of animal except watering within Twenty four hours immediately preceding its sla u ghter is not p ermissible. (2) No person s hall sla ughter any animal within a municipal area except in a slaughter house recognized or licensed by the concerned author ity empowered under the law for the time being in force to do so. (3) The animal shall not be slaughtered which- a.is pregnant, or b.has an offspring less than three months old, or c.is under the age of three months or d.has not been certified by a Veter inary Officer t hat it is in a fit condition to be slaughtered. 19. Marking of healthy meat. The Meat Inspector shall put appr oved/inedible marks while conducting post mortem exa mination in some parts of the carcass passed for huma n consumption. The butcher shall display such marks and the certificate at the time and place of selling such inspected meat. The decision of the meat inspector shall be final and binding and no appeal shall lie to anyone. 20. Disposal of unfit meat. Rejected meat unfit for human consumption shall be disposed of in the manner descr ibed in rule 13(2) of t hese r u les. 21. Disposal of offal. Offa l and inedible parts of the meat shall be disposed of in the ma nner described in rules 13(3 ) of these rules. CHAPTER-VII SERVICES FEES 22 . Service fees in sla ughter houses. Subject to r evision from time to time, fees payable to the owner or war den of the sla ughter house shall be as follows :- Sl. (d) Explain the mode of construction/ to be constr ucted of internal sur face of the wa ll and what materials ar e to be used for such construct ion. ( e) Deta ils of waste (solid and liquid) and tr eatment facilities. (f) Means of lighting and ventilation. (g) Means of access to bring animals from the nearest animal market or area. (h) Number, position and dimension of stables and pounds provided near the premises for relaxing and keeping of animals. (i) Number of animals for which accommodation will be provided in such places indica tes item wise. Higher Secondary School, Lunglei on 01.06.2017 at 5:21 AM. Born on 16.01.1968, Pu Lalmuanzuala was appointed as Teacher, Deficit Rahsi Veng High School on 09.04.1991. He served in that capacity till the school was provincialised on 01.01.1994. He was absor bed as Teacher in the Govt. Rahsi veng High School and cont inued to served there till he was transferred to Govt. Higher Seconda ry School, Lunglei on 25.6.1996 and s erved there as Post Graduate Teacher and later as Lecturer (Gazetted) from 24.8.2011 till his last breath. He served the Government of Mizoram with utmost sincerity and devotion to duty and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. The Government of Mizoram places on record its deep appreciation of the sincere services rendered by Pu Lalmuanzua la and conveys its heartfelt sympathy to the bereaved family. (3)The Board shall meet at such time and pla ce and observe such rules or procedur e in regards to the transaction of business at its meeting as may be prescribed and submit report to the State Secretary (Labour). C/50 (4)The Chairperson, if, for any reasons, is unable to attend a meeting of the Board, any member nominated by the C hairperson in this behalf and in the absence of such nomination, any member elected by the members pr esent from amongst themselves at the meeting, shall preside over the meeting. (5)Any question which comes up before any meeting of the Board shall be decided by a majorit y of votes of the members present and voting, a nd in the event of equality of votes, the Chairperson or in his/her absence, the person presiding, shall have a second or ca sting vote. (6)The Board will comply with the instructions/orders/circu lars issued by the Govt. of Mizorani from time to time with r egard t o personnel, financial and other matters. 2.FUNCTIONS OF THE BOARD (1).The Board may - a ) provide immediate assistance to a beneficiary in case of accident; b) make payment of pension to the beneficia ries who have completed the a ge of sixty years; c ) sanction loa ns and advances to a beneficiary for construction of house, not exceeding such amounts and on such term and conditions as may be prescribed; d) pay such amount in connection with Premia for Gr oup Insurance S cheme of the beneficia ries as it may deem fit; e ) give such financial assistance for the education of children of the beneficia ries as ma y be pr escribed; f) meet such medical expenses for tr eatment of major ailments of a beneficiary or such dependant, as ma y be p rescribed; g) make payment of maternity benefit to the female beneficiar ies; h) make provision and improvement of such other welfare measures and facilities as may be prescribed; i) take all necessary action to comply wit h the directions and a dvice of Centr al Government with regard to implementation of Building & Other Construction Workers (RECS) Act. 1996 and Rules framed thereunder and also of the Building & Other Construction Workers Cess Act, 1996 and Rules framed thereunder. (2)The Board ma y grant loan or subsidy to a local authority or an employer as may be approved by the State Government towards welfare of building workers. (3)The Board ma y also pay gra nt-in-aid to a local authority or to an employer for the benefit of the Building wor kers and their family members, subject to conditions and limit as may be prescribed by the State Government. (4)The Board ma y pay sitting a llowance to the members present in it s meeting and the amount of which may be as prescribed from time to time.
