MINISTRY OF LAW AND JUSTICE (Legis la tive Depar tment) New Delhi, the 4th May, 2017/Vaisakha 14, 1939 (Saka) THE BANKING REGULATION (AMENDMENT) ORDINANCE, 2017 No. 1 OF 2017 Promulgated by the President in the Sixty-eight Year of the Republic of India. An Ordinance further to amend the Banking Regulation Act, 1949 WHEREAS the stressed assets in the banking system have reached unacceptably high levels and urgent measures are required for their resolution; AND WHEREAS the Insolvency and Bankruptcy Code, 2016 has been enacted to consolidate and amend the laws relating to reorganisation and insolvency resolution of corporate persons, part- nership firms and individuals in a time bound manner for maximisation of value of assets to promote entrepreneurship, avail- ability of credit and balance the interest of all the stakeholders; Ex-222/2017 2 Published and Issued by the Controller, Printing & Stationery, Mizoram Printed at the Mizoram Government Press, Aizawl C-50AND WHEREAS the provisions of Insolvency and Bank- ruptcy Code, 2016 can be effectively used for the resolution of stressed assets by empowering the banking regulator to issue direc- tions in specific cases: AND WHEREAS Parliament is not in session and the Presi- dent is satisfied that circumstances exist which render it necessary for him to take immediate action; NOW, THEREFORE, in exercise of the power s conferred b y c lau s e (1 ) of a r ticle 1 23 of t he Const it ut ion, the P r esident is plea sed to promulgate the following Ordinance:- 1.(1 ) This Ordinance may be called the Banking Regula- tion (Amendment) Ordinance, 2017. (2) It shall come into force at once. 2.In the Banking Regulation Act, 1949, after section 35A, the following sections shall be inserted, namely:- ‘35AA. The Central Government may by order authorise the Reserve Bank to issue directions to any banking company or bank- ing companies to initiate insolvency resolution process in respect of a default, under the provisions of the Insolvency and Bankruptcy Code, 2016. Explanation.-For the purposes of this section, “default” has the same meaning assigned to it in clause (12) of section 3 of the Insol- vency and Bankruptcy Code, 2016. 35AB. (1) Without prejudice to the provisions of section 35A, the Reserve Bank may, from time to time, issue directions to the banking companies for resolution of stressed assets. (2 ) The Reserve Bank may specify one or more authorities or committees with such members as the Reserve Bank may appoint or approve for appointment to advise banking companies on resolu- tion of stressed assets.’. VOL - XLVI Aizawl, Monday 29.5.2017 Jyaistha 8, S.E. 1939, Issue No. 233 - 2 - Ex-233/2017 Explanation4.1)“Scheduled Tribe” means the people of the State of Mizoram and have been residing permanently in the St ate holding Schedule Tribe Certificate and Residential Certificate issued by Mizoram Government. 2)“Scheduled Tribe Physically Handicap people” means the people of the State of Mizoram and have been residing permanently in the State holding Scheduled Tribe Certificate and Residential Certificate issued by Mizoram Government. 3)To be elgible to be considered under sub-clause (ii) of clause (c) of rule 3, the current posting of the Government servant in Mizoram should be atleast for two (2) consecutive years. Allotment of Seat5.1)All the selected candidates will be required to appear in person before the Counselling Authority Central Counselling Advisory Board (CSAB) for counselling and checking of all the documents (Residential Certifica te, Tribal Certificate, Educational Certificate) in original on the date, time and venue to be intimated to Director, Higher & Technical Education. The candida tes who fail to produce such origina l documents at the time of personal appearance, allocation of seats shall be liable to be rejected. The vacant seats if any shall be filled up by the next deserving candidate from amongst the category. 2)If a ny candidate is found to ha ve fur nished fa lse infor ma tion of certificate(s) or to have withheld or concealed any material/information to gain personal advantage, he shall be disqualified. If selection or even admission ha s already been done or effected, it shall be cancelled at any stage of his study and such other action as deemed necessary may be taken against him, under a ny law for the time being inforce in the State of Mizoram. S.P. & Addl. S .P.” 4.A copy of post creation or der of Legal Adviser dated 23-03-2011 shall be attached in Appendix Z (iv) in ACB Manual 2012.
