In exercise of the power conferr ed by section 22 of the Mizoram Animal (Control and Taxation) Act , 2014 the Governor of Mizora m is pleased to make t he following rules 5 namely 1 . Short title extent and commencement.- (1) These rules may be called The Mizoram Animal (Control and Taxa tion) Rules, 2016. (2) It shall ha ve the like extent a s the Act. (3) They shall come into force on the date of publication in the Official Gazette. 2 . Definitions.- In these r ules, u nless t he context ot her wise requir es.- (1 ) “Act” means the Mizoram Control and Taxation Act, 2014 (Act No. 12 of 2014), ( 2 ) “For m” mea ns a For m as pr escribed under these ru les. ( 3 ) “Section” mea ns a section of the Act. (4) Words and expressions used herein and defined in the Act, but not defined in these r ules, shall have the sa me meaning respectively assigned to them in the Act. 3 . Disposal of animal dung, excreta etc.- T he owner of a n animal shall not allow anima l dung, excr eta, ur ine, feeding left over wet and damp soils ca used by animal on the ground, to remain in such a ma nner as to cause public nuisance in whatever form. 4 . Animal (s) s eized to be tied or kept in a nimal pound - Animal (s) seized under sub-section (1) of section 7 of the Act should be kept at such place or enclosure as may be set apart by Village Council. Such place shall not cause any discomfiture to the animals (s) in wha tever means. 5. Register for the purpose of seized animals.- The Register to be kept by the Village Council for animal (s) seized a nd brought under sub-section (4) of section 7 of the Act shall be in Form‘ A’. 6 . Fines for seized animal (s).- (1) The fines for the seized animals shall be as follows : Fines Per day per adultPer day per young one (a ) PigsRs 100.00Rs 50.00 (b) GoatsRs 100.00Rs 50.00 (c) CattleRs 100.00Rs 50.00 (d) MithunsRs 100.00Rs 50.00 (e) HorsesRs 100.00Rs 50.00 (f) BuffaloesRs 100.00Rs 50.00 (g) Other animalRs 100.00Rs 50.00 (2) Receipt of payment of feeding charges a nd fines shall be given by t he Village Council to the owner of the animal or his agent in Form ‘B’ (3) Amount of fines shall be credited to Village Council fund. 8.Procedure for sale of animal by public auction.- (1) If a n animal (s) seized is to be sold by public auction under sub - section (1) or sub-section (2) of s ection 10 of the Act, the public auct ion shall be conducted as follows: (a ) The Village Council,shall cause to be announced through a village crier their intention of the sale, fixing t he date, time and place for the auct ion of the animal. (b) The Village Council shall also ca use to be notified of such a uction under clause (a ) of sub- rule (1) of r ule 8, in such manner as to serve wide notice to the public. (c ) The success ful bidder will have to pay the full amount of his bid on the spot. (2) If a n impounded animal is not likely to fetch a fair price if sold by public auct ion under sub-rule (1), it shall be disposed of by the Village Council by killing the a nimal and selling its meat in the market. 9.Animal Grazing Ground.- (1) The Village Council, if considered necessary, may declare and specify suitable land for animal grazing ground. Before such declar ation, the Village Council sha ll submit proposal to State Government for approval, mentioning loca tion of land, approximate area of land with boundary line, number of animal to graze about, a sketch map of the la nd and conditions to be observed by the owner of animal and the general public. (2) The State Government shall examine the proposal with respect to the suitability, necessity and environmental impa ct on t he Village. (3) Appr oval or otherwise, if any, shall be conveyed to Village Council concerned. (4) Normally, approval shall be given for 3 (three) years which may be extendable as per requirement. 10.Village Council to register anima ls.- (1) For the pur poses of sub-section (1) of section 12 of the Act every owner of animal shall report within l(one) month, the number of animals (adult and young) owned by him, to the Village Council concerned who shall enter the pa rticular s in the register maintained for the purpose in Form ‘C’ (2) On payment of the r egistra tion fee under sub - section (1) of section 12 of the Act the Village Council shall issue a receipt for it in Form ‘D’. (3) Registration fee collected by the Village Council shall be cr edited to Villa ge CouncilFund. 11. Collection of a nima ls t ax by Village Council.- (1) Every owner of animal (s) shall pay animal taxes to the Village Council concerned in respect of his animals at the rates as prescribed by the Gover nment. Animal Tax sha ll be collected at the time of registration or befor e they have been taken apart from their mother. (2) The Village Council shall keep account of anima l taxes in Form ‘E’. (3) On payment of the animal taxes under sub- rule (1) of rule 11 the Village Council shall issue a receipt for it in Form ‘D’. 1 2 . Procedure for cr editing animal taxes collected.- For the purposes of Rule 11, fifty percent of animal taxes collected by the Village Council s hall be credited to t he Consolidated Fund of the State of Mizoram and the balance of fifty percent sha ll be credited to the respective Village Council Fund. 1 3 . Revision of Ra tes. - All ra tes of charges to be collect ed under the provision of these rules Viz. Feeding charge, Fines for seized Animals, Registr ation fees and Taxes may be revised by the State Government from time to time. 14 . Appeal.- Any person who is aggrieved by any order of the Village Council or officer under section 14 of the Act may appeal to such authority as may be prescribed within 30 (thirty) days from the receipt of the or der. 1 5 . Repeal and saving.- (1) The Mizoram Animal (Control & Taxation) Rules, 1982 stands hereby repealed. (2) Notwithstanding such repea l, anything done or any action taken under the Rules so repealed shall, in s o far as it is not inconsistent with the provisions of these Rules, be deemed to have been done or taken, as the case ma y be, under the corresponding provisions of these Rules. (2) These Rules shall come into force from the date of their publication in the Official Gazette. 2. Application These Rules shall apply to the posts specified in Column I of Annexure-I her et o a nnex ed. 3. Number of posts, The number of the said post(s), classification and the scale of pay/ classification and Pay Band & Grade Pay attached thereto shall be as specified in scale of pay/Pay Column 2 to 4 of the said Annexure-I Band & Grade Pay 4. Method of r ecruitment, The method of recruitment, age limit, qualifications and other ma tters age limit and other relating to the said post shall be as specified in Column 5 to 14 of qualifications Annexure-I. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/Scheduled Tr ibes and other specia l categories of persons in accordance with the orders issued by the Central Government or Government of Mizora m from time to t ime. 5. Power to transfer Notwithstanding anything contained in these Rules, the Governor of Mizora m, in public interest , shall have the right and power to transfer any officers, so recruited under these Rules to any other post or position which is equivalent in ra nk or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or exp edient to do so, he may, by order and for reasons to be recorded in writing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Refor ms, relax any of the provisions of these Rules with r espect to any class or category of persons. 9. Reservation and Nothing in these Rules shall affect any reservations, relaxation of age limit other concessions and other concessions required to be provided for the Scheduled Castes/ the Scheduled Tribes and other categories of persons in accordance with the order issued by Central Government or Government of Mizoram from time to time in this regard. 10. Repea l and Sa vings All Rules perta ining the post framed by the Government of Mizoram notified vide No. A. 12018/2/89-P&AR(GSW) dated 26.05.1999 and published in the Mizoram Gazette Extraordinary Issue No. 105 dated 28.05.1999 and No. A. 12018/43/2004-P&AR(GSW) dated 29.03.2006 and published in the Mizoram Gazette Extraordinary Issue No. 74 dated 05.04.2006 shall stand repea led wit h effect from the commencement of t hese Ru les. Provided that any order made or a nything done or any action taken under the Rules so repealed or under any general order ancillary thereto, shall be deemed to have been made, done or taken under the corresponding provisions of these R ules. Power to relax Wher e the Governor is of the opinion that it is necessary or exp edient to do so, he may, by order and for reasons to be recorded in writing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Refor ms, relax any of the provisions of these Rules with r espect to any class or category of persons. 9. Reservation and Nothing in these Rules shall affect any reservations, relaxation of age limit other concessions and other concessions required to be provided for the Scheduled Castes/ the Scheduled Tribes and other categories of persons in accordance with the order issued by Central Government or Government of Mizoram from time to time in this regard. 10. Short title and commencement (1) These Regulations may be called the Mizoram Civil Services (Cadre Training) Regulations, 2016 (2) They shall come into force from the date of publication in the Official Gazette 2 . Definitions In these Regulations, unless the context otherwise requires; (1) “Civil Service” shall mean the Mizoram Civil Service (2) “Exa mination” shall mean examinations conducted under the Mizoram Civil Services (C adre Training) Regulations, 2015 (3) “Gazette” shall mean the Officia l Gazette of the Government of Mizoram (4) “Government” shall mean the Government of Mizoram (5) “Governor” shall mean the Governor of Mizoram 3 . Objectives of Cadre Training Programme: 1)To develop professional knowledge and skills for impar tial and efficient Civil Service; 2)To motivate and develop ethical conduct and commitment to work amongst Civil Service Officers; 3)To motivate and ena ble Civil Service Officers to contribute positively to the transformation of the society, economy and polity; 4)To increase job sa tisfact ion and facilitate smooth career progress ion; 5)To expose the Officers to best pra ctices in gover nance and service delivery; 6)To provide opportunity to acquire suitable soft skills like leadership, change management, inter personal communication, etc; 7)To expose to the techniques of effective decision making for enhancing efficiency in public administration. 4 . Course Design for F ounda tion Tr aining Pr ogr amme: 1)The Administrative Tr aining Institute (ATI), Aizawl shall be responsible for impa rting the Foundation Training Programme to the Proba tionary Officers of Mizoram Civil Service 2)The Administrative Training Institute shall designate one responsible Officer who will act as Course Director-cum-Coordinator till the Probationary Officers complete the 12 months Foundation Training Progr amme 3)There shall be an examination at the end of the 3 months Founda tion Tr aining P rogramme at Administrative Training Institute, Aizawl. The number of Papers and the syllabus for each Paper shall be decided by the Dir ector, Administrative Training Institute. 4)The Probationary Officers shall be attached to t he Offices of the Depu ty Commissioner s in the Districts during the 1 month Distr ict attachment progra mme. 5)The Deputy Commissioner shall be r esponsible for providing an institutionalized system for providing in-depth practical experience of the working of various facets of District Administration to the Probationa ry Officers 6)The Probationary Officers shall prepare a compr ehensive repor t on the working of the District Administration after completion of the District attachment programme and submit to the Course Director-cum-Coordinator a ppointed under sub-regulation (2). 7)There shall be a Foundation Training Programme at any of the reputed training instit utes listed in Annexure-I which shall be for a period of 3 (three) months including Bharat Darshan exposure visits. 8)On completion of the Foundation Tr aining Programme conducted under sub-regulation (7), the Probationary Officers shall be on regular posting to undergo an “On the Job Training” programme for another 5 months. 9)During the “ On the Job Tra ining” programme, the ATI, in close co-ordina tion with the DP&AR (Tra ining Wing), shall arr ange attachment of the officers in Secretariat, Dir ectorates and other subordinate Offices, especially in those areas involving funct ions of a civil or administra tive nature and including atta chments with ar my and police units, wherever feasible. 10) The Probationary Officers shall submit a monthly report on selected areas during the “On the Job Training” programme to the Course Director-cum-C oordina tor. 11) A Probationary Officer shall be deemed to have successfully completed the 12 months Foundation Training if and only if he attended all the tra ining programmes listed at Regulation 5(1) and obta in a minimum forty per centage of marks in each Papers of the examination conducted at the end of the Foundation Training at Administr ative Training Institute, Aizawl. Provided that Administrative Tra ining Institute, Aizawl shall offer 2 more attempts for those Probationary Officers who failed to obtain minimum forty percent marks in any of the Pa pers for the examination. 7 . Mid Career Tr aining Pr ogr amme of Mizora m Civil Service: 1)Every Officer in the Senior Grade and Junior Administrative Grade of Mizoram Civil Service shall attend a Mid Career Training Progra mme during the whole of his service in the Senior Grade and Junior Administr ative Gr ade. 2)The Officers in the Senior Grade and Junior Administrative Grade who do not undergo the Mid Career Training Programme during the whole of his service in t he Senior Grade and Junior Administrative Gra de shall be ineligible to be considered for promotion to the Selection Grade unless there is a lapse on the pa rt of t he Government in arranging the said training progra mme; Provided that Officers in the zone of consideration for promotion to the Selection Grade for the next two va cancy years with effect from the commencement of t hese Regula tions shall stand exempted. 3)Mid Career Training Progr amme shall be in the nature of a refresher course to be arranged at any of the r eputed training instit utes listed at Annexur e-I. 4)The duration of the training programme shall a t least be for a period of 1 week which may be extended or shortened by the State Government in consult ation with the concerned training institute. 5)Officers who had successfully undergone a training programme of the requisite dura tion in any of t he areas listed in Regulation 9 five years before the commencement of these Regulations, while serving in the Senior Grade or Junior Administrative Grade, shall be deemed to have completed the Mid Career Training Progr amme 6)The Government in Department of Personnel & Administrative Reforms (Training Wing) shall make arrangements for condu ct of the Mid C areer Training Programme annua lly.- 4 - Ex-391/2016 9 . Short title and commencement (1) These Regulations may be called the Mizoram Civil Services (Cadre Training) Regulations, 2016 (2) They shall come into force from the date of publication in the Official Gazette 2 . Definitions In these Regulations, unless the context otherwise requires; (1) “Civil Service” shall mean the Mizoram Civil Service (2) “Exa mination” shall mean examinations conducted under the Mizoram Civil Services (C adre Training) Regulations, 2015 (3) “Gazette” shall mean the Officia l Gazette of the Government of Mizoram (4) “Government” shall mean the Government of Mizoram (5) “Governor” shall mean the Governor of Mizoram 3 . Objectives of Cadre Training Programme: 1)To develop professional knowledge and skills for impar tial and efficient Civil Service; 2)To motivate and develop ethical conduct and commitment to work amongst Civil Service Officers; 3)To motivate and ena ble Civil Service Officers to contribute positively to the transformation of the society, economy and polity; 4)To increase job sa tisfact ion and facilitate smooth career progress ion; 5)To expose the Officers to best pra ctices in gover nance and service delivery; 6)To provide opportunity to acquire suitable soft skills like leadership, change management, inter personal communication, etc; 7)To expose to the techniques of effective decision making for enhancing efficiency in public administration. 4 . Founda tion Tr aining Programme for Junior Grade of Mizora m Civil Service: 1)Every Officer recruited into the Junior Grade of Mizoram Civil Service after the commencement of these Regulations, either by means of direct recruitment or by means of selection method, shall undergo a Foundation Training Progra mme which shall consist of: Sl. Course Design for F ounda tion Tr aining Pr ogr amme: 1)The Administrative Tr aining Institute (ATI), Aizawl shall be responsible for impa rting the Foundation Training Programme to the Proba tionary Officers of Mizoram Civil Service 2)The Administrative Training Institute shall designate one responsible Officer who will act as Course Director-cum-Coordinator till the Probationary Officers complete the 12 months Foundation Training Progr amme 3)There shall be an examination at the end of the 3 months Founda tion Tr aining P rogramme at Administrative Training Institute, Aizawl. The number of Papers and the syllabus for each Paper shall be decided by the Dir ector, Administrative Training Institute. 4)The Probationary Officers shall be attached to t he Offices of the Depu ty Commissioner s in the Districts during the 1 month Distr ict attachment progra mme. 5)The Deputy Commissioner shall be r esponsible for providing an institutionalized system for providing in-depth practical experience of the working of various facets of District Administration to the Probationa ry Officers 6)The Probationary Officers shall prepare a compr ehensive repor t on the working of the District Administration after completion of the District attachment programme and submit to the Course Director-cum-Coordinator a ppointed under sub-regulation (2). 7)There shall be a Foundation Training Programme at any of the reputed training instit utes listed in Annexure-I which shall be for a period of 3 (three) months including Bharat Darshan exposure visits. 8)On completion of the Foundation Tr aining Programme conducted under sub-regulation (7), the Probationary Officers shall be on regular posting to undergo an “On the Job Training” programme for another 5 months. 9)During the “ On the Job Tra ining” programme, the ATI, in close co-ordina tion with the DP&AR (Tra ining Wing), shall arr ange attachment of the officers in Secretariat, Dir ectorates and other subordinate Offices, especially in those areas involving funct ions of a civil or administra tive nature and including atta chments with ar my and police units, wherever feasible. 10) The Probationary Officers shall submit a monthly report on selected areas during the “On the Job Training” programme to the Course Director-cum-C oordina tor. 11) A Probationary Officer shall be deemed to have successfully completed the 12 months Foundation Training if and only if he attended all the tra ining programmes listed at Regulation 5(1) and obta in a minimum forty per centage of marks in each Papers of the examination conducted at the end of the Foundation Training at Administr ative Training Institute, Aizawl. Provided that Administrative Tra ining Institute, Aizawl shall offer 2 more attempts for those Probationary Officers who failed to obtain minimum forty percent marks in any of the Pa pers for the examination. 7 . Mid Career Tr aining Pr ogr amme of Mizora m Civil Service: 1)Every Officer in the Senior Grade and Junior Administrative Grade of Mizoram Civil Service shall attend a Mid Career Training Progra mme during the whole of his service in the Senior Grade and Junior Administr ative Gr ade. 2)The Officers in the Senior Grade and Junior Administrative Grade who do not undergo the Mid Career Training Programme during the whole of his service in t he Senior Grade and Junior Administrative Gra de shall be ineligible to be considered for promotion to the Selection Grade unless there is a lapse on the pa rt of t he Government in arranging the said training progra mme; Provided that Officers in the zone of consideration for promotion to the Selection Grade for the next two va cancy years with effect from the commencement of t hese Regula tions shall stand exempted. 3)Mid Career Training Progr amme shall be in the nature of a refresher course to be arranged at any of the r eputed training instit utes listed at Annexur e-I. 4)The duration of the training programme shall a t least be for a period of 1 week which may be extended or shortened by the State Government in consult ation with the concerned training institute. 5)Officers who had successfully undergone a training programme of the requisite dura tion in any of t he areas listed in Regulation 9 five years before the commencement of these Regulations, while serving in the Senior Grade or Junior Administrative Grade, shall be deemed to have completed the Mid Career Training Progr amme 6)The Government in Department of Personnel & Administrative Reforms (Training Wing) shall make arrangements for condu ct of the Mid C areer Training Programme annua lly.- 4 - Ex-391/2016 9 . Power to rela x:Where the Governor is satisfied that the operation of any of these Regulations causes undue hardship in any particular case or that in the exigencies of public service as well as for effective implementation of this Regulation, it is considered necessary or expedient to do so, he may dispense with or r elax or amend and repeal such particular Regulations to such extent or subject to such conditions as he may consider necessary from time to t ime.
