The composition of the SAAB shall be given as under. 1.Chairman : Deputy Commissioner, Champhai. 2.Secretary : Assistant Settlement Officer. MEMBERS : 1)Execu tive Engineer, P.W.D. 2)Superintendent Engineer, P. H.E. 3)Superintendent Engineer, P&E. 4)Divisional Forest Officer, Champhai. 5)Concerned VCP within Champha i Town area. 6)President, Sub Hqrs,. Y.M.A. 7)President, Sub Hqrs., M.U.P. 8)Concerned Block President, MPCC, MNF, MPC, ZNP & BJP within Champhai Town area. 9)Assistant Survey Officer. FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisor y Board will be the S creening Board in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board sha ll have to judiciously examine the applica nt’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board shall ha ve its sitting at least twice in a year or as may be required and TA sha ll be given to the members of the Board if the place of sitting is more than 8 (eight) kilometer from the headquarter of the member. The S ecretar y SAAB shall issue Meeting Notice in consultation with the Chairma n by giving at least 10 (ten) days in advance to the member of S AAB. 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (Land Revenue) Rules, 2013 read with VOL - XLV Aizawl, Tuesday 28.6.2016 Asadha 7, S.E. 1938, Issue No. 192 - 2 - Ex-192/2016 Section 39 and 40 of the Act for any ca tegory or purpose must be submitted to the Settlement Officer or Assista nt Settlement Officer if Chairman of SAAB is the Deputy C ommissioner of the Dis t r ict . In ca se, C hair man of S AAB is S DO (C ) or BDO or P r es ident, Village Cou nc il t he a pp lica t ion for land allotment of any category must be submitted to the concerned Chair man. 5.The Board shall make initial screening of the a pplication with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land by Surveyor, Revenue Depa rtment in the presence of the applica nt, the concerned VC and neighbouring land holder, if any. Measurement of land should be a ccurate and NOC sha ll be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. The recommendation of the meeting of Board shall be submitted to the concerned District Revenue Officer for fur ther submission to the Government through the Dir ector, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to fu ture infrastructure development wor k of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended fr om time to time. 9.The term of the Boa rd shall be three year s. The Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public. Born on 24. 4.1966, Pu K.Lalthazu ala entered Government service as a Teacher at Ramhlun M/S on 15th Apr il, 1988 and served in that capacity till he was pr omoted to the post of Headmaster, Government M/S on 24th October, 2001. On his promotion to the post of Headmaster, he was posted at Government Ma mit M/S. On 19th June, 2002, he wa s tr ansferr ed from Government Mamit M/S and posted at Government Thanbuka M/S. On 6th March, 2006, he was transferred and posted at Government Venghlui M/S where he served till he breathed his last. He served the Government of Mizora m with utmost. sincerity and devotion to duty and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. On 25th Ma y, 1998 he was tr ansferred and posted at Govt. KM HSS a nd joined on 7th September, 1998 and served there till he breathed his last. He served the Gover nment of Mizora m with utmost sincerit y and devotion to duty and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. CORRIGENDUM No. G. 25022/1/2001-PHE/pt, the 24th June, 2016.In partial modification of this Department’s Notification of even No. G.25022/1/2001-PHE/pt dt. 11.11.2014 pertaining to Amendment of Rule 7 of the Mizoram Water Supply (Control) Rules 2016 and published in the Mizoram Gazette Issue No 531 Dated 21.11.2014, the Sub-Rule under Rule 7 of the Principal Rule shall be re-numbered as follows :- 2.A minimum of Rs. 200/- (Rupees two hundred)only shall be collected as service charge for supply of water upto 5,000 (Five thousa nd) lit res per month water connection. Rs. 45/- (Rupees forty five) per kilo litres of water per connection shall be collected as service char ge for supply of water in excess of 5,000 (five thousand) litres per month but not exceeding 10,000 (ten thousand) litres per month per water connection. 3.A minimum of Rs. 75/- (Rupees Seventy five) per kilo lit re of water per water connection shall be collected a s service char ge for supply of water in excess of 10,000 (ten thousand) litres per month but not exceeding 20,000 (twenty thousand) litres per month per water connection. A minimum of Rs. 90/- (Rupees Ninety) per kilo litre of water per water connection shall be collected a s service charge for supply of water in excess of 20,000 (t wenty thousand) litres per month per water connection but not exceeding 30,000 (thirty thousand) litres per month per water connection. 4.A minimum of Rs. 105/- (R upees one hundred five) per kilo lit re of water per water connection shall be collected as service charge for supply of water in excess of 30,000 (thirty thousand) litres per month per water connection. 5.Rs. 150/- (Rupees one hundred fifty)only per kilo lit re of water shall be charged as service charge if water is purchased from the Department depending upon the ava ilability of wa ter. 6.Rs. 30 (Rupees thirty) only per month shall be charged as service charge to each family or household of consumer from P ublic P oint or Tube Wells within Mizoram where operation and maintenance of water supply is taken up by the Department. In exercise of the powers conferred by section 18 of the Mizoram Water Supplies (Control) Act, 2004 (Act No.11 of 2004) the Governor of Mizoram is pleased to make the following rules fur ther to amend “The Mizoram Water Supply (C ontrol) Rules 2011 (her ein aft er referred to as the Principal Rules) as follows, namely:- 1 . Short title, Extent and commencement : 1.These rules shall be called “ The Mizoram Water Supply (Control) (Amendment) Rules, 2016. 2.It shall have the like extent as the Principal Rules. 3.It shall come into force from the date of its publication in the Mizor am Gazette. 2 . Amendment of Rule 2: Rule 2 of the Principal Rules shall be substituted as follows, namely- Definitions: 1.In t his Rules, unless the context otherwise requir es,- a)‘Act’ means The Mizoram Water Supplies (Control) Act, 2004(No.l 1 of 2004): b)‘Catchment area’ means the area of land draining into the sour ce of water as notified by the Executive Engineer of the concerned Division as reser ved catchment a rea. c)‘Consumer ’ means any person or owner or occupier of any premises provided with water through either piped water connection, Public Water Point or Hand Pump Tube Well of the Department; d)‘Commercial Consumer ’ means any consumer who, directly or indirectly ear n profit out of the water supplied by the Depar tment. Identification of such commercial consumer shall be at the discretion of the Department. e)‘Disconnection’ means stoppage of water supply due to certain reasons, if r econnected, requires pa yment of re-connection fee and other expenses, if any. f)‘D omestic Consumer” means any consumer whose water connections are for household ut il it y. g)‘Government Consumer ’ means any water connections for building or esta blishment(s) belonging to State Government, State Government Underta kings, Government of India and Government of India Undertakings. h)‘Hab itation’ means any pla ce(s) where people are living permanently. i)“Premises” means any land or building; j)‘Reconnection’ means reconnecting the dis connected water connection on payment of reconnection fee a nd any other charges a s may be required. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLV Aizawl, Friday 1.7.2016 Asadha 10, S.E. 1938, Issue No. 201 - 2 - Ex-201/2016 k)“Suspension” means tempor ary stoppage of water supply for a certain period as notified in the suspension order where payment of reconnection fee is not impos ed, but may require payment of other expenses, if any. 1)“Supply Tank” means water tank(s ) from where pipe(s) of water connection(s) or Public Water Point (s) or Hydrant(s) are connected. m) ‘T-Cluster’ means point(s) on the water distribution pipe line(s) or end of water distribution pipe line(s) from where pipe(s) of house water connection(s) or Public Water Point(s) or hydrant(s) are connected. n)“Water Source” means the source of water notified by the Executive Engineer of the concer ned area a s reserved water s ource. o)‘Water Supply Scheme’ means all types of Water Supply Scheme(s) such as piped water Supply, all types of Spring Water Harvesting Schemes, Tube Well(s), Dug Well(s), Rain Water Harvesting Scheme(s), etc., installed for supply of drinking water to public. p)‘Water Supply System’ means all type of infrastructure(s) or asset(s) created for supply of drinking water to public. 2.All other words and expressions used herein and not defined shall have the meanings respectively assigned to them in the Act. 3 . Amendment of Rule 3: Clauses (ii) to (v) of Rule 3 of the Pr incipal Rules shall be subs titu ted as follows, namely- “(ii) 1 (one) water connection is meant for 1 (one) household or l(one) f amily. Sharing of 1 (one) water connection by 2(two) or more families or households is not allowed. Generally, GI pipe of s ize not larger than 20mm diameter shall be used for water connection and the qua lity infer ior t o M ediu m C la s s confor ming t o IS 1 2 3 9 p a r t -I s ha ll not b e u s ed. F or u s e of Gi p ip e s ize larger than 20mm diameter or any other pipe materials, specific approval of the concerned Superintending Engineer shall be obtained provided that all the technical feasibilities are est ablished. (iii) The prescribed application form for any type of water connections may be obtained from the Office of the concerned Ex ecutive Engineer or Sub-Divisional Officer during office wor king hour s on production of Land Settlement Certificate (LSC) or Land Lease Certificate (LLC) or land pass or any other land ownership document in original duly issued by the competent authority where water connection is requir ed. T he duly filled in application for m must be submitted to the concerned Sectional Officer enclosing attested photo copy of the documents produced at the time of collection of the application form. T hereaft er, the Sectional Officer shall condu ct spot verification for technical feasibility. After the Department determines the feasibility and decides the T-Cluster or Supply tank from where the water connection is to be given, shall accord the sa nction and intimate the same to the a pplicant along with the estimated installation costs and Connection Fees tha t the applicant has to deposit to the Department. If the applicant wants to change the T-C luster/Supply tank after the sanction is accorded, the applicant shall submit a fresh application with all the connected documents and the Department shall make fresh verification and if found feasible a fresh sanction shall be accor ded. (iv) Wher e the Superintending Engineer and Executive Engineer are in the same station the former shall sanction the water connection. However, where the Superintending Engineer and Executive Engineer ar e not in the sa me station, the latter shall accord the sanction. Where the Executive Engineer and Sub-Divisiona l Officer are in the same station, the Executive Engineer shall sa nction direct sa le of water. However, where the Executive Engineer and Sub-Divisional Officer are not in the same station, Sub-Divisional Officer sha ll sanction direct sale of water. - 3 -Ex-201/2016 (v) For the purpose of quality control and maintaining uniformity, it shall be the sole pu rview of the Depa rtment to procu re pipes and fittings and to lay the Pipes for water connection. If the cons umer desires so, he may procur e the pipes and fittings from outside provided that the quality conforms to the specifica tion as laid out in R ule 3 (2). The Department sha ll have the right to reject the pipes or fittings procured by the consumer if it does not conform to the specification. Normally, laying and fitting of water connection pipes shall be done only after all the installation costs and connection fees are deposited to the Department. The applicant shall be responsible for arranging right of wa y, clearances and No Objection Certificates through which the pipes have to be laid. Compensa tions, if any, for da mages caused to the public or priva te property due to laying of water connection pipes shall also be the responsibilit y of the applicant. In case of direct pur chase of water from the Depar tment, the applicant is expected to arr ange all necessary r equired pipes a nd fittings. If the a pplicant desir es so, the Depa rtment may provide the same provided that the cost of materia ls is deposited by the applica nt as per the r ates approved by the Department from time to time.” 4 . Amendment of Rule 4:In R ule 4 of the P rincipa l Rules , Sub-Rule 1 and cla use (i) and (x ) in Sub-Rule (2) along with sub-rule (2) itself in Rule 4 of the Principal Rules shall be substituted as follows, namely; 1)Sub-rule (1) shall be substituted by the following, namely:- “The concerned Executive Engineer or Sub Divis ional Officer may Disconnect or Suspend water supply as per provisions of Section 13 and 14(1) of the Act which shall be communicated by issue of written order. Whether to disconnect or to suspend the water supply shall be at the discretion of the concerned Executive Engineer. Reconnection of water connection and resu mption of suspended water supply shall be as per the provision of Section 14(4), (5) and (6) of the Act.” 2)The words and figures in Sub-rule (2) and clause (i) and (ii) shall be substituted by the following namely:- “In addition to the reasons for disconnection or Suspension of the water supply as provided in Section 13 and 14(1) of the Act, the concerned Executive Engineer and concerned Sub-Divisional Officer may disconnect water connection or suspend water supply for the following reasons:- (i) If a consumer or a nything under his influence ca uses any inconvenience t o the Depa rtmental Staff on duty by way of intimidating or endangering to the extent that operation of water supply to the premises is severely disturbed. (x) If the consumer requests the Depar tment to disconnect or suspend the water supply at his own interest”. 3)After sub-r ule 2, a new sub-rule 3 shall be inserted as follows, namely:- “No fresh or new water connection shall be sanctioned to any land or buildings after disconnection of the previous water connection until a nd unless the previous dues, if any, is cleared even if the name of owner or tenant or lessee of the bu ilding is changed or altered or loca tion of the building is changed”. 5 . Amendment of Rule 5:Rule 5 of the Principal Rules shall be substituted as follows, namely; ‘Transfer of Water Connection may be considered by the Executive Engineer concerned as per provision laid out in Section 15 of the Act on receipt of application in the prescribed form as per Annexure - ‘V’. The applicant shall bear all the expenses as may be required for transfer of the water connection. However, the applicant shall not be required to pay the connection fee afresh’. - 4 - Ex-201/2016 6 . Amendment of Rule 6: Rule 6 of the Principal Rules shall be substituted as follows, namely; “The Department reserves the right to preserve, protect and cons erve any water source(s) including Ground Water and its Catchment Area(s) for water supply to any habit ation. No person(s) shall engage in a ny activities which may cause depletion, contamination and pollution of water in the catchments a reas of the reserve source(s). No person sha ll use or utilize water from the reserves sour ce(s) without prior permission of the Depar tment. Any violation of this right s hall be liable for punishment as per Section 16(5) of the Mizoram Water Supplies (Control) Act, 2004. The Executive Engineer of the concerned Division is empowered to issue the notification of the reservation of water sour ce(s) and the catchment area(s ) within his jurisdiction” 7 . Amendment of Rule 7: 1.In Rule 7 of the Principal Rules, Sub-rule( 1) to (13), (15) to (19), (22) to (25), (27) to (28) shall be substituted as follows, namely; “(1) A non-refundable connection fee of Rs. 1000/- (Rupees one thousand) only shall be char ged for each new pipe water connection. (2) (3)Note : (4) (5) (6) (7) The rates of water and other char ges mentioned u nder Rule 7 may be revised by the Depa rtment by issue of notification not more than once in a year. (8) Deleted (9) Deleted (10) The cost of repairs, alteration, modifica tion or shifting of existing water connection, if required, shall be borne by the applicant or consumer. The Department shall normally star t the work only after t he cons umer or the owner of water connection deposits the required amount to the Department. In the event of any private or public property t o be damaged in the pr ocess, the owner of water connection or applicant sha ll settle the ma tter before the Depar tment sta rts t he work and a ll the expenses r equir ed for r e- installation and repair of damages shall be borne by the applicant or the owner of water connection. (11) Deleted (12) Deleted (13) Rs 10 (Rupees Ten) per month per water meter shall be charged as rent for water meter of all sizes if the water meter is provided by t he Depa rtment. Otherwise no rent shall be char ged. (15) Change of ownership of water connection ma y be considered by the Executive Engineer concerned on receipt of application in the prescribed form as per Annexure-VI. The application must be accompa nied by product ion of Land Settlement Certificate or any other relevant document issued by the appropria te authority showing sufficient proof of transfer of ownership of property to the applica nt at the satisfaction of the Department and on production of document showing tha t all the dues are cleared. (16) Deleted (17) All the required amount, a s estimated for installation of water connection shall be paid by t he applicant to the concerned Executive Engineer within the validity of t he sanction as per Section 4 of the Act . If pa yment is not made within the sp ecified period, the Executive Engineer may consider revalidation, only subject to receipt of written application and the revalidation sanct ion sha ll supersede the previous sanction. The applicant shall also bear any additional costs, if any, over the original estima tes arising out of the cost } Rates of Water Charges in Sub Rule 2-6 of Rule 7 s hall be as notified from time to time in exercise of the power conferr ed by Section-18 of the Mizoram Water Supplies (Control) Act, 2004 (Act No.l 1 of 2004). - 5 -Ex-201/2016 escalations. Payment shall be made through Treasury Challan as specified by the Department. (18) The consumer or owner of wa ter connection shall pa y monthly water bills by cash only to the payment counter specified by the Department. If a consumer requires making payment by cheque or demand draft or treasury challan, it will be the responsibilit y of the consumer to clear the cheque or demand draft or treasury cha llan with the bank. (19) Such monthly water bills a nd other charges shall be paid as per bill or card served to the cons umers by the Department and shall b e paid every month within the stipulated period mentioned in the bill. If bills are not paid within the stipulated period, the sa me shall be carr ied over to the monthly bill of the succeeding month and the consumer or owner of water connection shall have to pay the bill along with t he simple interest at the rate of 1% per month of the bill amount. (22) Deleted (23) The Department may supply water to the consumer at lea st once a week. If the water supplied in a month is less than 2,500 (Two thousand Five hundred) liters due to breakdown of the Water Supply System(s) or willful negligence of the Department personnel, the Department may consider a rebate of 50% of minimum water bill subject to verification by the Depa rtment on the genuineness of the qua ntity of water supplied. In order to get the r eba te, the consumer or owner of water connection(s ) sha ll ma ke claim to the concerned Executive Engineer or Sub-Divisional Officer within the la st date of payment as indicated in the Bill. Any claim made thereaft er shall not be enterta ined If the cons umer ha s been served a monthly water bill for water not being su pplied, the concerned Executive Engineer may wa ive the whole bill. 24) If the water meter is lost, damaged or out of order, the consumer or owner of water connection shall r eplace such water meter by a functional water meter duly certified by the Department within a grace period of 2 (two) months otherwise the water connection is liable to be disconnected. A flat rate of Rs 300/- (Rupees T hree-hu ndred) for Domestic and Government consumer and, Rs 800(Rupees Eight hundred) for Commercial consumer per month per water connection or average of monthly wa ter bill of the last three months whichever is higher, shall be charged until and unless the water meter is replaced by the cons umer or owner of the water connection, as the case may be. In case the average of monthly water bill of last three months, in the opinion of the Depar tment, does not commensurate with the qua ntity of water supplied, any other mode of assess ment, which the Department considered most appr opriate, shall be applied.. (25) Deleted (27) A minimum of Rs. 600 (Rupees Six hundred) only shall be charged to all commercial consumer up to a maximum supply of 10,000 (ten thousand) litres of water per month per water connection and in excess of supply of 10,000 (ten thousand) litres of water a minimum of R s. 105/- (Rupees One hundred and Five) only per kilolitre of water shall be charged. (28) If community water supply by Truck is resorted, a minimum charge of Rs. 3.0 (Rupees three) only per 15 litres (one tin) will be cha rged as service charge to the consumer.” 2.After sub-rule 30 a new sub-rule 31 shall be inserted as follows, namely; “31) At any time if the outstanding liabilities of the consumer, on account of the monthly water bills accumulates for more than 3(three) months, the Department shall have the right to club the bill with other water bills aga inst any other premises owned by the consumer to ena b le r ea lization of dues” 8 . Amendment of Rule 8: Sub-rule (1) of Rule 8 of the Principal Rules shall be substituted as follows, namely; “Criminal proceedings can be filed by an officer of t he Department not below the ra nk of Sub- Divisional Officer to the competent Judicial Magistr ate” 9 . Amendment of Rule 9: Sub-rule (1) and (2)of Rule 9 of the Principal Rules shall be substituted as follows, namely; 1)“If any disputes or misunderstandings arise due to the action of the Departmental sta ff on duty, the consumer may file a complaint in wr iting t o the concerned Executive Engineer. On receipt of t he complaint, the Executive Engineer or his r epresent ative on his behalf, shall conduct inquiry and hear the complainant and others involved in the dispute and pass necessary orders. 2)The consumer may file an appeal against the order made under sub-rule 1 of Rule 9 to the next higher authorities of the Department within 15 days from the date of communication to him or her of such or der”. Insertion of new rules 10 to 15: After Rule 9 of the Principal Rules, new rules- 10 to 15 shall be inserted as follows, namely; “10. Trespass on water supply premises No person shall trespass within the premises of the Department that a re directly connected with Water Works except with due permission of the Department. 11. P rohibit ion of constr uct ions over water mains. 1)No s tructures, tempor ary or permanent, shall be erected over any water mains or pipelines without prior permission of the Department, 2)If a ny permanent or tempor ary str uctures be so constructed, the Depar tment may cause the same to be removed or otherwise dealt with as it deems fit a nd the expenses thereby incu rred shall be paid by the persons contr avening the provisions of Rule 11(1) a bove 12 . Power to lay mains and right of Control 1)The Department may lay Pipelines in such a rea; i.street or land belonging t o the Government and any local authority or corpor ation owned or controlled by the Government; ii.over, on or under a ny private land with prior consent of the owner. 2)The Department reserves the right of access to the pipelines including the point of connections such as bunching or T-cluster and pipe appurtenances installed by the Department on any land, which shall be inspected, altered, removed, repaired and kept in proper order at any time. 13 . Pipe not to be laid t hrough insanitary places. No water connection or other water supply pipelines shall be laid so as to pass into or through any sewer, drain, latrine, manhole, or ash pit or manure pit. Such pipe shall not be allowed to remain in cont act with any foul smelling or injurious materials. In unavoidable cases, adequate protection to the pipe shall invaria bly be provided by ca rrying it through an exterior cast iron tube or in any other suit able ma nner approved by the Department. 14. Plantation over Water Supply Pipelines or structures No person s hall make plantation upon or nearby any water supply struct ures or pipelines which is liable to cause da mage or difficulty to the routine operation and ma intenance of water supply works.- 6 - Ex-201/2016 15. Water Meters 1)The water meter shall, as far as possible, be installed inside the premises of the consumer, who shall be responsible for the safe custody against loss, damage or ta mpering with the meter. He shall be liable to pay the cost of making good such dama ges or new water meter as the case may be. 2)The meters shall generally be read between sunr ise and sunset, and the readings sha ll be reflected in the monthly water bill which shall be fina l and binding. The consumer ma y, if he so desires, verify the meter readings. 3)Complaints in meter reading, if any, shall be lodged by the consumer within the last date of payment of bill as indicated in the monthly water bill. Any complaints received after this period shall not be entertained. The complaint shall be examined by the concerned Executive Engineer and make the decision which shall be final and binding. The final bill on the outcome of the complaint shall be carried over to the monthly water bill of the succeeding month and, waive of interest on late payment, if any, due to such complaints shall be at the discretion of the Executive Engineer”. ORDINANCE NO.1 of 2016 Promulgated by the Governor of Mizoram on the Sixty Seventh year of the Republic of India. An Ordina nce to a mend the Mizora m Motor Vehicle ( Taxa tion) Act, 1996 (5 of 1996) WHEREAS the Mizoram Motor Vehicles (Taxation) Act, 1996 (5 0f 1996) was enacted by the Legislative Assembly of Mizoram, under the provisions of Entry 57 of List II of the Constitution of India; AND WHEREAS, the sa id Act was amended in the year 2011 a nd 2014 namely “The Mizoram Motor Vehicles Taxa tion (Amendment) Act, 2011”, “The Mizoram Motor Vehicles Taxation (Amendment) Act, 2014”, and aga in in 2 015 in pursuance of the decision of Transpor t Development Council, Government of India in its 35th meetings held on 23.10.2013 ; AND WHEREAS, circumstances exist which r enders it expedient to further amend the Mizoram Motor Vehicles (Taxation) Act, 1996 ( 5 0f 1996); AND WHEREAS, the Legislative Assembly of Mizora m is not in session and the Governor of Mizoram is satisfied, on the advice of the Councils of Ministers, Mizoram that circumstances exist which deem it necessary and expedient for him to take immediate act ion; NOW THEREFORE, in exercise of the powers conferred by clause 1 of article 213 of the Constitution of India, the Governor of M izoram is pleased to p romulga te the following Ordinance in the Sixty Seventh year of the Republic of India, namely :-VOL - XLV Aizawl, Thursday 21.7.2016 Asadha 31, S.E. 1938, Issue No. 232 - 2 - Ex-232/2016 1.Shor t title, and :-1) This Ordina nce may be called the Mizora m Motor Vehicles Taxa tion Commencement (Amendment) Ordinance, 2016. 2) It shall come into force on such date as the St ate Government may, by notification in the Official Gazette, appoint. 2. Amendment of :-Sub-section (3) of section 3 of the Mizora m Motor Vehicles (Taxation) Section 3 Act, 1996 (hereinafter referred to as the Principal Act) shall be substituted by the following, namely:- “(3) One Time Tax s ha ll be levied in resp ect of all 2-wheelers, 3-wheeler s of motor vehicles and LMV/Motor Cars coming under non-transport category, and vehicles under Rent a Cab Scheme. Life Time Tax shall be levied on all Motor cabs/Taxis including 2-wheelers Taxis, 3-wheelers Taxis and Max-cabs, opera ted and kept for operating within the State of Mizoram as well as those operating inter-stated, which shall be paid as per the choice of the applicant as One Time/ Two Time/ Three Time Tax as described in Schedule – II of this Ordinance at the ra te specified in the sa id Schedule; Provided tha t no ta x shall be levied in r espect of motor vehicles as specified in this section where the motor vehicle is more than 2 years old from its or iginal registra tion, entering from other State into the rolls of this State, by way of tra nsfer of its registration as provided under S ection 4 7(1) of the Motor Vehicles Act, 1988 if such a tax as contempla ted this by Ordinance has been paid in the State from which the vehicle migrated, otherwise tax as applicable will be levied; Provided further that for the issuance of No Objection Certificate (NOC) for vehicles that ar e to be sold or are to migrate to other states of the country, tax will be levied for a total period of 15 years calculated from the date of regist ration, which shall be inclu sive of tax already paid in each previous years; Provided also that such NOC will not be issued unless the said tax for the tota l period of 15 years a s stated above has not been paid in full; Provided also that in respect of a chassis of motor vehicles passing through this State from a manufacturer to a dealer under temporary certificate of registration for a period not exceeding 7 days, the rate of tax shall be one twentieth of the tax payable for a quarter specified in column (2) of Schedule – I”. 3. Amendment of :-In S ub-section (7) of section 4 of the Principal Act, the words “Life – time Section 4 tax” shall be substituted by the words “ One Time/Two Time/Three Time Tax”. 4. Amendment of :-In section 4A of the Principal Act, the words “life-time tax” shall be substituted section 4A by the words “one time/two time/ three time tax” 5.Amendment of :-In S chedule I of the Principal Act, schedule I (1) In Group II, in the description of Motor Vehicles, after the words “Motor Vehicles” and before the word “operating”, the words “registered within the Sta te and” shall be inserted. (2) In Group III, (a ) In t he descr iption of Motor Vehicles, aft er the words “Motor Vehicles” and before the word “operating”, the words “registered within the Sta te and” shall be inserted. (b) Serial Nos. (a), (b) and (c) shall be omitted. 6. No. NE-313(MZ) 2006-2008VOL - XLV Aizawl, Friday 8.7.2016 Asadha 17, S.E. 1938, Issue No. 204 OFFICE MEMORANDUMNo.A.33025/1/2013-F.Est/74, the 6st June, 2016.It has been observed with regret that Income Tax has never been deducted from the salary of a considerable number of employees of different Departments under the Government of Mizoram, who are liable to pay the tax as per relevant provision of the Income Tax Act - 1961, due to non-reflection of relevant information such as deductible amount, PAN Card details etc of the employees by the concerned Drawing & Disbursing Officers (DDOs) in the pay bills submitted to the Treasury Offices. This default in payment of Income Tax places the employees and the Departments con- cerned liable to be fined penalty consequently resulting in pecuniary loss and embarrassment for the Gov- ernment. Therefore, in order to avoid such situation, all Drawing & Disbursing Officers (DDOs) of different Departments/Offices under the Government of Mizoram are informed to strictly follow the instructions laid down below :- 1.All Drawing & Disbursing Officers (DDOs) shall identify employees liable to pay the Income Tax/ TDS under their jurisdiction. 2.All types of tax deduction shall be done through Treasury Offices and Income Tax/TDS shall be reflected in all pay bills submitted to the Treasury Offices, as required by Rule 222 of the Central Treasury Rules Volume-I, by the Drawing & Disbursing Officers (DDOs). 3.Henceforward, if Income Tax/TDS is not reflected in pay bills, they shall not be passed by the Trea- sury Offices without making any exception. The contents of this Office Memorandum may be brought to the notice of all concerned by every Administrative Department and Head of Department in their respective Departments.
