In exercise of the powers conferred under the proviso to Article 309 of the Constitution of India, read with the provisions of Rule 12 of the Mizoram Police Service Rules, 2008 as amended from time to time, the Governor of Mizoram is pleased to make the following regulations namely:- 1.SHORT TITLE AND COMMENCEMENT: (1) These Regulations may be called the Mizoram Police Service (Departmental Examination) Regulations, 2015. (2) They shall come into force with effect from the date of publication in the Mizoram Gazette. 2.DEFINITIONS: (1) In these Regulations, unless the context requires – (a) “Commission” means the Mizoram Public Service Commission; (b) “Constitution” means the Constitution of India; (c) “Departmental Examination” means the departmental examination conducted by the Commission for Officers in the Junior Grade of Mizoram Police Service; (d) “Government” means the Government of Mizoram; ( e ) “Governor” means the Governor of Mizoram. (2) All the other words and expressions used in these Regulations and not defined shall have the meanings respectively assigned to them in the Mizoram Police Service Rules, 2008 as amended from time to time. 3.DEPARTMENTAL EXAMINATIO N: (1) Every Mizoram Police Service officer shall, during the period he is in the Junior Grade of Mizoram Police Service, appear at and pass such Departmental Examination and shall be required to pass the minimum standard under Regulation 5 before he can be considered for promotion to the next higher grade. - 2 - Ex-51/2016 (2) A Junior Grade of Mizoram Police Service officer who has passed a particular subject once need not re-appear in the same subject. (3) The examination shall be conducted by the Commission in the manner as laid down in these Regulations. POWER TO RELAX: Where the Governor is satisfied that the operation of any of these Regulations causes undue hardship in any particular case or that in the exigencies of public service, it is considered necessary, he may, by special or general orders, in consultation with the Commission, dispense with or relax or amend or repeal such particular Regulation(s) to such an extent or subject to such conditions as he may consider necessary from time to time. 7. MISCELLANEOUS PROVISION: If any doubt arises about the interpretation of any of the provisions of these Regulations, it shall be referred to the Governor whose decision shall be final. 8. REPEAL AND SAVINGS: The Mizoram Police Service (Departmental Examination) Regulations, 2003 notified vide No.A.12018/18/2003-P&AR(GSW) dated 11.12.2003 and published in the Mizoram Gazette Extra-Ordinary issue No. 388 dated 18.12.2003 stands hereby repealed with effect from the commencement of these Regulations. Notwithstanding such repeal, anything done or any action taken or purported to be taken under the said Regulations so repealed shall be deemed to be taken or done or purported to be done under the relevant provisions of these Regulations. After graduating in Civil Engineering, he joined the Government of Mizoram, P ublic Works Department as SDO(TC), Airport Division on the l8th December, 1995 and now he is serving as SDO, Pr oject Sub-Divis ion- II from 13th June, 2014 till he breathed his last. The Government of Mizoram would like to place on record its deep appreciation for the services rendered by Er. Vanlalhluna and conveyed its heartfelt sympathy to the bereaved family. R. In exercise of the powers conferred by section 11 of the Mizoram Entry Ta x Act, 2015 (M izoram Act No. 8 of 2015), the Governor of Mizoram is pleased to make the following rules, namely : - 1.Shor t title and 1) These rules may be called The Mizoram Entry Tax Rules, 2015. commencement : 2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions : 1) In t hese ru les, unless the context otherwise r equir es : - a) ‘Act’ means The Mizoram Entry Tax Act, 2015 (Act No. 8 of 2015) b) ‘For m’ means a for m a ppended to t hese ru les; c ) ‘Rules’ means The Mizoram Entry Tax Rules, 2015; d) ‘Month’ means a calendar month; e ) ‘Qua rter ’ means the respective qua rter of the year ending on the 30th June, 30th Sep tember, 31st December, 31st Mar ch; f) ‘Registered Dealer ’ means a Dealer regist ered under the Act. 2) Words or exp ressions used and not defined in these rules but defined in the Act or the Mizoram Value Added Tax Act, 2005 or the rules framed there- under, sha ll ha ve the same meanings r espectively a ssigned to them in the Act or in the Mizoram Value Added Tax Act, 2005 or the Rules framed ther eunder, as the case may be. 3. Registration : 1) Every importer who imports any specified goods, for sale or for use in works contract or for use in manufacture in any local area shall make an application for registra tion in respect of his business before the Assessing Authorit y of the area in which his principal place of business is located within fifteen days from the date on which the importer becomes liable to pa y tax u nder the Act: 2) (a) Such application shall be in Form No. MET-1 and shall be signed and verified in the manner prescribed in the Form - i. by the proprietorship firm, ii. by the authorised partner in ca se of a partnership firm, iii. by the Principal Officer or the Chief Executive Officer in case of a Company or a Corpor ation or a loca l Authority VOL - XLV Aizawl, Thursday 10.3.2016 Phalguna 20, S.E. 1937, Issue No. 54 - 2 - Ex-54/2016 iv. by t he secr etary or any other authorised executive in case of a society or a Club or an association of persons. v. by the Head of Depa rtment/Office in case of Government Department. ( b) The application shall be accompanied by two copies of passport size photogr a ph of the per son signing the application, except in case of Government Department. 3) On r eceipt of an application for registration, the Assessing Authority of the area shall, after verifying or causing to be verified the par ticular s furnished by the impor ter, gr ant him a certificate of registration in Form No. MET-2within a period ordinarily not exceeding fifteen days from the date of receipt of t he said application: Provided that, in order to ensur e proper payment of tax, the Assessing Authority of the area, before granting the certificate of registration, may require an importer to fur nish such secur ity as he may consider necessary. But such security shall not be more than the amount of tax, which ma y be estimated as payable by the importer in a year. 4) A register of certificate of registration issued shall be maintained by the Assessing Authority in Form No. MET-3; provided that if an importer who imports a ny specified goods for use or consumption in the course of his business on regular basis is already registered under the Mizoram Value Added Tax Act, 2005, he shall be deemed to have been registered under this Act. He shall submit an application for registration under the Mizoram Entry Tax Act, 2015 and all the provisions relating to submission of monthly or quarterly statement and annual return and payment of tax, as applicable to importers registered under the Mizoram Value Added Tax Act, 2005, shall also apply t o such importers under this Act. 5) The security required to be furnished under sub-rule (3) shall be furnished in a ny of the following manners, namely:- i. by deposit ing the challa n in F or m No. MET-6 into a Designated Bank or ii. in t he form of National Savings Certificate or Kisan Vika sh Patra , or iii. by a guarantee from a Nationalised Bank agreeing to pay the State Government on demand, the security fixed by the Assessing Author ity. 6) The securit y furnished may, in the event of default of payment of any tax penalty or other dues, be adjusted towards such tax, penalty or other dues. The Assessing Authority may, in any case where adjustment has been made, demand fresh security or additional security to make up the amount adjusted towards tax, penalty or other dues. 7) The relevant rules of the Mizora m Value Added Tax Rules, 2005, in force at t he appropriate time, shall apply mutatis mutandis in all matters relating to a mendment of the certificate of registration necessitated by any change in t he ownership or constitution of business, change in the name and style of business or pla ce of business or any ot her materia l cha nge ha ving releva nce to the liability to pay t ax under this Act and in issuing duplicate certificate of registration in case of loss or defacement of the original certificate of registration and also in cancella tion of the certificate of registration. 4.Documents for 1) As a dealer registered under the Mizor am Value Added Tax Act, 2005 has import of to use Form - 33 (Way Bill) prescr ibed under the Mizoram Value Added specified goods : Tax Rules, 2005 for importing any goods liable to be ta xed under that Act, he shall not be required to use a separa te form for importing such goods which are also taxable under the Mizoram Entry Tax Act, 2015. 2) An importer importing specified goods except as mentioned in sub-rule (1) above may import the specified goods by using a declaration in For m MET-10. 5. Submission of 1) Every registered dealer liable t o pay tax under the Act whose aggregate retur n and import value of specified goods imported in any assess ment year exceeds payment of tax : Rs.10 Lakhs, sha ll, before the expiry of the next succeeding month, submit to the Assessing Authority his monthly statement of such import value in Form No. MET-4. 2) Every registered dealer liable to pay tax, other than a registered dealer referred to in sub-rule (1) shall submit to the Assessing Authority, a quarterly statement in Form No. MET-4, for the quarter ending 30th June, 30th September, 31st December and 31st Mar ch, within a month fr om the last day of the quarter concerned. 3) Every impor ter other than a registered dealer referred to in sub-rules (1) and (2) sha ll submit a sta tement in Form No. MET-4 wit hin ten days from the date of entry of the goods into the local a rea. 4) The statements to be submitted under sub-rules (1), (2) and (3) above shall be a ccompanied by a challa n or a crossed cheque or a crossed Demand draft for the full amount of tax payable on the import value of the goods disclosed in the statement. 5) Every registered dealer referred to in the sub-r ules (1 ) and (2) shall, in addition to monthly/quarterly statements, furnish an annual return in FormNo. MET-5accompanied by a challan or acrossed cheque or a crossed Dema nd draft in token of payment of any balance tax due, to the Assessing Authority within 31st May of the following fina ncial year. 6. Assessment of 1) Upon the expiry of the assessment year, the Assessing Authority shall, after Ta x : such enquir y, as he may deem necessary, deter mine the aggrega te impor t value of goods of the dealer in respect of the assessment year and shall assess the tax paya ble thereon. 2) In case of an importer as referred to in sub-rule (3) of rule 5, the Assessing Authority s ha ll verify the cor rectness of the sta tement soon after it s submission for ensuring proper payment of tax. 3) If the tax assessed differs from the total amount of tax deposited by the registered dealer or any ot her importer for the r elevant year, the differ ence shall be realised or refunded by the Assessing Authority in t he manner prescribed under the Mizoram Value Added Tax Act, 2005 and the Rules framed thereunder. 7. Payment of Tax: The Challan for payment of entry tax payable under sub-rule (4) of rule 5 or for payment of any other dues under the Act or the Rules shall be in FormNo. MET-6 and the amount sha ll be deposited into an Accredited Bank. Note: Accredited Bank means any bank accredited by the Government of Mizoram to collect Government revenue manually or through online mode.- 3 -Ex-54/2016 8.Issue of Certificate 1) An importer who imports a motor vehicle for his own use into any local area, on import of motor shall file an application in Form No. MET-7 before the Assessing Authority vehic les : of the area, under whose jurisdiction he resides for issuance of certificate for product ion before the Registering Authority under the Mot or Vehicles Act, 1988 of the District for registration of his motor vehicle under the said Act. 2) The Assessing Authority, after satisfying himself about the particulars furnished in the application and of the payment of tax, shall issue a certificate in F orm No. M E T-8 to the importer, a copy of Assessment of tax Application for Motor Vehicle P ayment of tax which sha ll also be forwarded to the concerned Registering Authority under the Motor Vehicles Act. 1988 a long with a copy of the challan showing payment of entry tax. Accounts of such certificates issued shall be maintained by the Assess ing Officer in his office in a bound r egister in Form No. MET-9. 9. Proof of An importer who claims deductions under section 3 of the Act shall pr oduce claiming the following:- deduction: (i) evidence of dispatch of specified goods, in the form of Railway Receipt or lorry receipt (C onsignment Note) or Bill of Lading; (ii) copy of bill issued by him; (iii) a declaration showing the details of payment received; (iv) the originals of the written contract and accounts rendered by the agent t o t h e p r inci p a l fr om t ime t o t ime, i n ca s e o f s p ecif ied good s dis p a t ched outside the State by way of stock transfer; (v) copy of the bill of expor t and letter of credit, in ca se specified goods are exported out of the territor y of India: Provided tha t all payments relating to dispatch of goods to any other State under any of the circumstances mentioned in sub-section (3) of section 3 shall be by way of Bank Draft purchased from any Ba nk situated in the State of the consignee. 11. Administration of 1) The tax sha ll be deposited in a separate, distinct and exclusiveHead of Mizoram Account “0042-106-Tax on Entry of Goods into local area”.The Infrastructure amount so deposited shall constitute The Mizoram Infrastructure Development Fund. In exercise of the powers conferred by section 11 of the Mizoram Entry Ta x Act, 2015 (M izoram Act No. 8 of 2015), the Governor of Mizoram is pleased to make the following rules, namely : - 1.Shor t title and 1) These rules may be called The Mizoram Entry Tax Rules, 2015. commencement : 2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions : 1) In t hese ru les, unless the context otherwise r equir es : - a) ‘Act’ means The Mizoram Entry Tax Act, 2015 (Act No. 8 of 2015) b) ‘For m’ means a for m a ppended to t hese ru les; c ) ‘Rules’ means The Mizoram Entry Tax Rules, 2015; d) ‘Month’ means a calendar month; e ) ‘Qua rter ’ means the respective qua rter of the year ending on the 30th June, 30th Sep tember, 31st December, 31st Mar ch; f) ‘Registered Dealer ’ means a Dealer regist ered under the Act. 2) Words or exp ressions used and not defined in these rules but defined in the Act or the Mizoram Value Added Tax Act, 2005 or the rules framed there- under, sha ll ha ve the same meanings r espectively a ssigned to them in the Act or in the Mizoram Value Added Tax Act, 2005 or the Rules framed ther eunder, as the case may be. 3. Registration : 1) Every importer who imports any specified goods, for sale or for use in works contract or for use in manufacture in any local area shall make an application for registra tion in respect of his business before the Assessing Authorit y of the area in which his principal place of business is located within fifteen days from the date on which the importer becomes liable to pa y tax u nder the Act: 2) (a) Such application shall be in Form No. MET-1 and shall be signed and verified in the manner prescribed in the Form - i. by the proprietorship firm, ii. by the authorised partner in ca se of a partnership firm, iii. by the Principal Officer or the Chief Executive Officer in case of a Company or a Corpor ation or a loca l Authority VOL - XLV Aizawl, Thursday 10.3.2016 Phalguna 20, S.E. 1937, Issue No. 54 - 2 - Ex-54/2016 iv. by t he secr etary or any other authorised executive in case of a society or a Club or an association of persons. v. by the Head of Depa rtment/Office in case of Government Department. ( b) The application shall be accompanied by two copies of passport size photogr a ph of the per son signing the application, except in case of Government Department. 3) On r eceipt of an application for registration, the Assessing Authority of the area shall, after verifying or causing to be verified the par ticular s furnished by the impor ter, gr ant him a certificate of registration in Form No. MET-2within a period ordinarily not exceeding fifteen days from the date of receipt of t he said application: Provided that, in order to ensur e proper payment of tax, the Assessing Authority of the area, before granting the certificate of registration, may require an importer to fur nish such secur ity as he may consider necessary. But such security shall not be more than the amount of tax, which ma y be estimated as payable by the importer in a year. 4) A register of certificate of registration issued shall be maintained by the Assessing Authority in Form No. MET-3; provided that if an importer who imports a ny specified goods for use or consumption in the course of his business on regular basis is already registered under the Mizoram Value Added Tax Act, 2005, he shall be deemed to have been registered under this Act. He shall submit an application for registration under the Mizoram Entry Tax Act, 2015 and all the provisions relating to submission of monthly or quarterly statement and annual return and payment of tax, as applicable to importers registered under the Mizoram Value Added Tax Act, 2005, shall also apply t o such importers under this Act. 5) The security required to be furnished under sub-rule (3) shall be furnished in a ny of the following manners, namely:- i. by deposit ing the challa n in F or m No. MET-6 into a Designated Bank or ii. in t he form of National Savings Certificate or Kisan Vika sh Patra , or iii. by a guarantee from a Nationalised Bank agreeing to pay the State Government on demand, the security fixed by the Assessing Author ity. 6) The securit y furnished may, in the event of default of payment of any tax penalty or other dues, be adjusted towards such tax, penalty or other dues. The Assessing Authority may, in any case where adjustment has been made, demand fresh security or additional security to make up the amount adjusted towards tax, penalty or other dues. 7) The relevant rules of the Mizora m Value Added Tax Rules, 2005, in force at t he appropriate time, shall apply mutatis mutandis in all matters relating to a mendment of the certificate of registration necessitated by any change in t he ownership or constitution of business, change in the name and style of business or pla ce of business or any ot her materia l cha nge ha ving releva nce to the liability to pay t ax under this Act and in issuing duplicate certificate of registration in case of loss or defacement of the original certificate of registration and also in cancella tion of the certificate of registration. 4.Documents for 1) As a dealer registered under the Mizor am Value Added Tax Act, 2005 has import of to use Form - 33 (Way Bill) prescr ibed under the Mizoram Value Added specified goods : Tax Rules, 2005 for importing any goods liable to be ta xed under that Act, he shall not be required to use a separa te form for importing such goods which are also taxable under the Mizoram Entry Tax Act, 2015. 2) An importer importing specified goods except as mentioned in sub-rule (1) above may import the specified goods by using a declaration in For m MET-10. 5. Submission of 1) Every registered dealer liable t o pay tax under the Act whose aggregate retur n and import value of specified goods imported in any assess ment year exceeds payment of tax : Rs.10 Lakhs, sha ll, before the expiry of the next succeeding month, submit to the Assessing Authority his monthly statement of such import value in Form No. MET-4. 2) Every registered dealer liable to pay tax, other than a registered dealer referred to in sub-rule (1) shall submit to the Assessing Authority, a quarterly statement in Form No. MET-4, for the quarter ending 30th June, 30th September, 31st December and 31st Mar ch, within a month fr om the last day of the quarter concerned. 3) Every impor ter other than a registered dealer referred to in sub-rules (1) and (2) sha ll submit a sta tement in Form No. MET-4 wit hin ten days from the date of entry of the goods into the local a rea. 4) The statements to be submitted under sub-rules (1), (2) and (3) above shall be a ccompanied by a challa n or a crossed cheque or a crossed Demand draft for the full amount of tax payable on the import value of the goods disclosed in the statement. 5) Every registered dealer referred to in the sub-r ules (1 ) and (2) shall, in addition to monthly/quarterly statements, furnish an annual return in FormNo. MET-5accompanied by a challan or acrossed cheque or a crossed Dema nd draft in token of payment of any balance tax due, to the Assessing Authority within 31st May of the following fina ncial year. 6. Assessment of 1) Upon the expiry of the assessment year, the Assessing Authority shall, after Ta x : such enquir y, as he may deem necessary, deter mine the aggrega te impor t value of goods of the dealer in respect of the assessment year and shall assess the tax paya ble thereon. 2) In case of an importer as referred to in sub-rule (3) of rule 5, the Assessing Authority s ha ll verify the cor rectness of the sta tement soon after it s submission for ensuring proper payment of tax. 3) If the tax assessed differs from the total amount of tax deposited by the registered dealer or any ot her importer for the r elevant year, the differ ence shall be realised or refunded by the Assessing Authority in t he manner prescribed under the Mizoram Value Added Tax Act, 2005 and the Rules framed thereunder. 7. Payment of Tax: The Challan for payment of entry tax payable under sub-rule (4) of rule 5 or for payment of any other dues under the Act or the Rules shall be in FormNo. MET-6 and the amount sha ll be deposited into an Accredited Bank. Note: Accredited Bank means any bank accredited by the Government of Mizoram to collect Government revenue manually or through online mode.- 3 -Ex-54/2016 8.Issue of Certificate 1) An importer who imports a motor vehicle for his own use into any local area, on import of motor shall file an application in Form No. MET-7 before the Assessing Authority vehic les : of the area, under whose jurisdiction he resides for issuance of certificate for product ion before the Registering Authority under the Mot or Vehicles Act, 1988 of the District for registration of his motor vehicle under the said Act. 2) The Assessing Authority, after satisfying himself about the particulars furnished in the application and of the payment of tax, shall issue a certificate in F orm No. M E T-8 to the importer, a copy of Assessment of tax Application for Motor Vehicle P ayment of tax which sha ll also be forwarded to the concerned Registering Authority under the Motor Vehicles Act. 1988 a long with a copy of the challan showing payment of entry tax. Accounts of such certificates issued shall be maintained by the Assess ing Officer in his office in a bound r egister in Form No. MET-9. 9. Proof of An importer who claims deductions under section 3 of the Act shall pr oduce claiming the following:- deduction: (i) evidence of dispatch of specified goods, in the form of Railway Receipt or lorry receipt (C onsignment Note) or Bill of Lading; (ii) copy of bill issued by him; (iii) a declaration showing the details of payment received; (iv) the originals of the written contract and accounts rendered by the agent t o t h e p r inci p a l fr om t ime t o t ime, i n ca s e o f s p ecif ied good s dis p a t ched outside the State by way of stock transfer; (v) copy of the bill of expor t and letter of credit, in ca se specified goods are exported out of the territor y of India: Provided tha t all payments relating to dispatch of goods to any other State under any of the circumstances mentioned in sub-section (3) of section 3 shall be by way of Bank Draft purchased from any Ba nk situated in the State of the consignee. 11. Administration of 1) The tax sha ll be deposited in a separate, distinct and exclusiveHead of Mizoram Account “0042-106-Tax on Entry of Goods into local area”.The Infrastructure amount so deposited shall constitute The Mizoram Infrastructure Development Fund. Development Fund: 2) Budget provisions shall be made and shown separately under the expenditure Heads of Account of the Departments concerned with the activities mentioned- 4 - Ex-54/2016 in sub-section (1) of section 10 of the Act. The total allocation of such budget provisions in a fina ncial year shall not be less than the amount collected as Entry Tax minus cost of collection during the year. 3) The Departments entrusted with the utilization of funds shall approve schemes and sanction funds exclusively for the development of selected infrastructure as stipulated under Section 10 of the Mizoram Entry Tax Act, 2015. 12.Applica tion of The relevant provisions of the Mizoram Value Added Tax Rules, 2005 shall certa in provisions mutatis mutandis apply in respect of all such procedural and other matters incidental of t he Mizoram to carrying out the purposes of this Act for which no provision ha s been made Value Added Tax in t hese r u les. Lalhmangaiha, MCS (R td.), Local Body Ombudsman, Mizoram on 4.3.2016 at 12:15 pm. Pu R. Lalhmangaiha was born on 1.3.1952 and entered into Government service on 19.11.1980 to the post of Administrative Officer (NG). He was later inducted to Mizoram Civil Service on 27.4.1987. He retired from service on superannuation pension on 31.3.2012. He was appointed to the post of L ocal Body Ombudsman for the S tate of Mizora m on 25.10.2013 for a period of 3 years. In his capa city as Ombudsman, he receives and disposes of complaints a nd grievances against local bodies under Government of Mizoram. He served the Gover nment of Mizora m with utmost sincerit y and devotion to duty and endeared himself to the officers and sta ff and always proved himself as cons cientious and hard working officer. The Government of Mizoram placed on record its appreciation of the sincere services rendered by Pu R. Lalhmangaiha and conveys its heartfelt sympathy to the bereaved family. DR. C. Lalhmangaiha was born on 1.3.1952 and entered into Government service on 19.11.1980 to the post of Administrative Officer (NG). He was later inducted to Mizoram Civil Service on 27.4.1987. He retired from service on superannuation pension on 31.3.2012. He was appointed to the post of L ocal Body Ombudsman for the S tate of Mizora m on 25.10.2013 for a period of 3 years. In his capa city as Ombudsman, he receives and disposes of complaints a nd grievances against local bodies under Government of Mizoram. He served the Gover nment of Mizora m with utmost sincerit y and devotion to duty and endeared himself to the officers and sta ff and always proved himself as cons cientious and hard working officer.
