Va nlalsawma was born on 29th November, 1966 and entered into Government service on 11.4.1990 as Ins pector of Taxes. He was first posted in the office of Superintendent of Taxes, Aizawl Circle - II and then posted at various places in that capacity. Thereafter, he was promoted to the post of Superintendent of Taxes on 20.7.2012 a nd posted at Lunglei Z one till he breathed his last. Pu C. Vanlalsawma served the Gover nment of Mizoram with utmost devotion and endeared himself as conscientious officer. The Government of Mizoram places on records its deep appreciation of the sincere services rendered by Pu C. Vanlalsawma a nd conveys its heartfelt sympathy to the bereaved family. No. NE-313(MZ) 2006-2008NOTIFICATIONNo.B.12011/1/2016-PLG, the 20th April, 2016.The Governor of Mizoram is pleased to notify the policy on Public Private Partnership (PPP) in infrastructure development in the state of Mizoram as approved by the Council of Ministers in its meeting held on 7th Apr il, 2016 and hereby published for information and necessary a ction. POLICY ON PUBLIC PRIVATE PARTNERSHIP 1.INTRODUCTION1.1.The Government of Mizoram is committed to improving the level and the quality of economic and social infrastructure and various services across the State. In pursuance of this goal, the Government of Mizoram envisages a substantive role for Public Private Partnership (PPP) as a means for harnessing private sector invest ment and opera tional efficiencies in the provision of public assets and services. 1.2. In order to facilitate and promote increasing role of Public Private Partnership in the creation of new infrastr uct ure a ssets as well as for the mana gement of existing ones, the Government of Mizoram proposes to lay down an explicit and a comprehensive policy. The policy deta iled herein will put in position a br oad fra mework for implementation of PPP in the Sta te in physical and social infr astruct ure and provision of various services while being sensitive to public needs. 2.POLICY OBJECTIVES AND SCOPE2.1The key objective of this policy is to - 1)Leverage the resources of State Government and Central Government to invite private sector investment in infr astruct ure and provision of services at best possible terms for the peop le of the St ate. 2)Protection of the interest of users and securing value for public money. 3)Setting up of an efficient adminis trative mechanism to ensure selection of private sector developer through tr ansparent bidding criteria. 4)To bring in uniformity in approach cutting across various sectors and Departments of the Government. 5)To prepare a shelf of projects to be offered for PPP under va rious Departments and take them forward for implementation. 6)Putting in place an effective and efficient institutional mechanism for obta ining various clea rances for the project s speedily. VOL - XLV Aizawl, Friday 22.4.2016 Vaisakha 2, S.E. 1938, Issue No. 91 - 2 - Ex-91/2016 7)Provide a fr amework that clearly set forth the risks, rewards and obligations of different participants. 8)Create a robust dispute redressal mechanism / regulatory framework for P PP projects. 9)Provide the required Viability Gap Funding (VGF) where the essential projects are intrinsically unvia ble. 10) To create “ Mizoram Infrastructure Development Fund (MIDF)” to facilitate implementa tion of the objectives of the policy. 11) Ownership a nd transfer of land t o priva te/orga nization are to be avoided, but leasing of the land for specific tenures in conformity with land law of the Sta te, extendable for specific periods and specific conditions may be allowed. 3.INFRASTRUCTURE SECTORS3.1The Government of Mizoram recognizes that constraint-free infrastructure pr ovisioning fosters economic and industrial activities conducive to sustainable development and inclusive growth, as envisioned by it for the State. The Gover nment of Mizora m also identifies that the pr ivate sector can play a significant role in infrastr ucture development, a nd that given the investor-friendly and transparent policies and frameworks, pr ivate investment can b e facilitated. The Government of Mizoram shall stress upon Public Private Partnership mode because PPP approach is best suited for the infrastructure sector as it sup plement s scarce public resou rces, creates a more competitive environment and br ings in the efficiencies of private sector management. 3.2The indicative list of the infr astruct ure sectors covered by the policy is a s follows :- 1)Roads, bridges and bypasses. 2)Inla nd water transport. 3)Agriculture Product ion, Hor ticulture, Agr o Processing, floricult ure. 4)Wasteland management. 5)Indu strial parks, Theme P arks like IT /BT Parks, Knowledge Par ks, and Townships. 6)Water Supply, Treatment and Distribution and collection of tariff. 7)Power Gener ation, Transmission and Distr ibution and collection of tar iff. 8)Solid Waste Management. 9)Sewer age & Dr aina ge. 10) Tourism. 11) Healthcare facilities. 12) Education. 13) Real Estate Development. 14) Urba n Infra structur e inclu ding Entertainment and Recreational facilities. 15) Urban transportation systems / Improvement of Public Transport Facilities including construction of bus terminals, truck terminals, Maxi Cab Terminals, Multi-level car parking, City Bus stands. 16) Mining and mineral based industries and Infrastructure Development in Mining Areas. 17) La nd Resour ces Management. 18) Disa st er Ma na gement. 19) Any other sector / facility as may be included by the Government from time to time. New projects and sectors can be included in the list with the approval of the PPP Apex Authority on PPP. 4.SERVICE DELIVERY THROUGH PUBLIC PRIVATE PARTNERSHIP4.1.Government of Mizor am recognizes t hat “provider-charges’ and the “user-p ays” pr inciples are crucial to the success of PPP in physica l infrastructur e. The Government would, where necessary and appropriate, consider levying user charges (fees, tariffs, cess etc.) to cover costs of infrastructure provisioning and cr eate a stable and dedicated financia l source for construct ion/ redevelopment/ rehabilitation/ replacement of project assets and their ongoing operations and maintenance to involve and encourage the end users. The focus would be to provide efficient, s ustainable and high qua lity services at affor dable pr ices to the us ers. 4.2.The levy of user charges would be based on the following main considerations 1)Recovery of the investments 2)Recovery of Opera tions & Maintenance Cost 3)Savings to the users arising out of impr oved /created facilities. 4)Willingness to pay 5)Uniformity in various projects. 5.INSTITUTIONAL FRAMEWORK5.1.The Government of Mizora m recognizes the requirement of effective and efficient ins titutional mechanism to ensure timely cleara nce of projects and therefore lays down the following structure to meet the policy goals. 5.2. PPP Apex Authority There shall be cons tituted a PPP Apex Authority a t the State Level with the following composit ion: 1)Chief Minister, Mizoram–Chairman 2)Minister of Planning & Progr amme Implementa tion Department–Vice Chairman 3)Minister of Finance Department–Member 4)Minister of Law & Judicial Department –Member 5)Minis ter of Industries Department–Member 6)Minister of Public Works Department–Member 7)Minister of the line Depart ment (to which the projects belong)–Member 8)Chief Secretary–Member Secretary 5. 3. Power & F unctions The PPP Apex Author ity will grant in-principle approval for all project s proposed to be developed in PPP mode. Further, in a ll PPP projects having investment or where value of underlying assets exceeds Rs. 100 crore, the Apex Authority shall accord investment approval and selection of develop er. 5.4. Empowered Committee for PPP There shall be cons tituted a PPP Empowered Commit tee: 1)Chief Secretary–Chairman 2)Secr etary, P lanning & Progr amme Implementa tion Department–Member Secretary 3)Fina nce Commissioner/Senior most officer of the Finance Depar tment by whatever designation called–Member 4)Secr etary, Public Wor ks Depart ment–Member 5)Secr etary, Industries Depart ment–Member 6)Secr etary, Law & J udicia l Depart ment–Member 7)Secr etary of the line Depart ment (to which the project belongs)–Member - 3 -Ex-91/2016 Empowered Committee on PPP will be free to co-opt members from other Department as and when considered necessa ry. 5. 5. Responsibilities, Powers & Functions of Empowered Committee for PPP The Empowered Committee on PPP shall be the nodal agency to achieve the policy goals and co- ordinate with various authorities of the State and Central Governments to facilit ate private sector investment in developing infrastr ucture and provision of various services through PP P mode. The Powers and F unctions of the Empowered Committee on PPP would include: 1)Sa nct ion PP P P rojects, approval of developer selected thr ough competitive bidding and appr oval of concess ion agr eements for PPP projects involving investment or where value of underlying assets is up to Rs. 100 crores. 2)Deliberate and recommend to Apex Author ity the final b ids for approval of the projects involving investment above Rs. 100 crores. 3)Sanction and author ize exp enditure by Departments for PP P projects. 4)Adopt and develop Model Concession Agreements for various sectors. 5)Recommend pr ojects for Viability Gap Funding to Government of India. 6)Prepare and seek the approval for the shelf of p rojects to be developed through PPP mode. 7)Deliberate and recommend to Apex Authority any special grants and concessions for ensuring fina ncial viability of the projects. 8)Review and monit or PP P Pr oject s dur ing implementa tion, execution, operation a nd management. 9)Sett le disp utes between t he part ies. 10) Sanction fund out of Project Development Fund for undertaking project development activities. 11) Mana ge the “Mizoram Infrastructure Development Fund (MID F)” proposed to be created to facilitate infrastructure development, and to recommend projects along with amount required to meet the objectives of this Policy. 5.6. PPP Cell The Empowered Committee on PPP shall be assisted by the PPP Cell. The cell shall be established by a government notification in the Planning & P rogramme Implementation Department of the Government of Mizoram. The PPP Cell is to be assisted by the financial, technical and legal consultants appointed by the government . 5. 7. Functions of the PPP Cell The functions of the PPP Cell and its Technical Secreta riat would include: 1)To identify, conceptualize and create a shelf of projects in consultation with the line departments and seek approval of such projects for PPP from time to time from the Empowered Committee on P PP/Apex Author ity. 2)To a ssist different government departments in preparing pre-feasibility reports by itself or through consulta nts. 3)Evaluate PPP projects from financial, legal angles. 4)Provide technical support in terms of finance, law to the Apex Authority and Empowered Committee on PPP. 5)To assist the respective departments in preparing Detailed Project Reports. 6)To help resp ective departments to conduct the bidding pr ocess for selection of developers. 7)To interact with the Department of Economic Affairs, Ministry of Finance, GOI for obtaining appr oval under the scheme of Via bility Gap Funding (VGF). 8)To a ct as the nodal agency for capacity building for PPP in the st ate. 9)Prepa re PPP r ules for the sta tes.- 4 - Ex-91/2016 6.PROCEDURE FOR SELECTION AND APPROVAL OF PPP PROJECTS6. 1. Project Identification/ Conceptualization The State Government Departments/Agencies in consultation with PP P Cell shall identify/ conceptualize infra structure projects to be developed in the State through PPP mode a nd prepa re a shelf of pr ojects. Preparation of Preliminary Feasibility Report State Government departments with assistance of the PPP Cell will prepare the preliminary feasibility report for the identified projects. The preliminary feasibility report should establish the need for the projects to be undertaken in PPP mode, contour s of the project, rough project cos t estimation, cost benefit ana lysis and indicative commercial viability of proposed project. 6. 3. DPR should specifically indicate cost benefits of the project considering social and environmental factors. If there is need to engage a consulta nt for prepara tion of DPR, preparation of various contractua l, concession a nd bid documents and a ssisting the Department in selection of investor, the same should be done through the t ransact ion advisers short listed by the Ministry of Finance, Government of India. It should however be ensured tha t the transact ion adviser selected for the project will not act a s consultant/fa cilitator to a ny of the prospective bidder s to avoid conflict of interest. The bid process shall be fully transpar ent and conforming to best pract ices in the Sector. 7. 2. Setting up of Special Purpose Vehicle There would be projects requiring substantial amount of land and other statutory clearances which is not only time consuming but requires constant follow up by competent professiona ls. Fur ther these lands and clearances need to be transfer red to the selected developer at a later da te. It will be p referab le to t ake up project development a ctivities in r espect of such projects by s etting up a SPV, prefera bly in joint venture with the consultant selected for prepa ration of DPR a nd assisting the Department in selection of Developer. In such cases the expenditure incurred in obta ining land, other clea r ances a nd fees of cons ultants will b e recovered fr om the s elected Developer. 7. 3. The Government of Mizoram would develop cont ractual frameworks to allow for equitable a llocation of risks between the contracting parties, taking into account the legitimate concerned of private investors. The attempt would be to allocate risks to the party best suited to bear the risks. 8.2.Appr oval of Contract Principles: In case a model contract for a Sector has not been a dopted or in case there are deviations proposed vis-à-vis the approved model contra ct for a Sector, then, the Empowered Committee for PPP Constitution will formulate or approve the cont ract pr inciples as the case may be. 8.3.The contract ual arr angement for existing infrastructure project s would typically include: 1)Mana gement of the assets by private opera tors thr ough (a ) Operation and Maintenance (O&M) contracts for defined periods. (b) Lease of assets. (c) Rehabilitate, Operate, Maintain and Transfer (ROMT) contracts. 2)Partial divestiture of the Undertaking. 8.4.Contractual arrangement depending on na ture of project , for new infr astruct ure projects would typically include, besides others, the options available under various common modes of PPP such as:- 1)Service Contracts; 2)Ma nagement Contr act s; 3)Lease Contracts; 4)Concessions; 5)Build – Operate – Transfer (BOT) and similar arrangements; and 6)Joint Ventures. 9.STATE SUPPORT AGREEMENT9.1.Concerned Department of the Government will sign a St ate Support Agreement with the investor to facilitate early financial closure and implementation. State support may, inter alia include: 1)Political Support Commitment on behalf of the Government that the project and its assets will not be nationa lized during the Concession period. 2)Fina ncial Support Commitment in a ddition to the viability gap funding from Government of India and other incentives availa ble in the State Gover nment may also contribute for the rema ining portion of Viability Gap as emerged from the bid or other concessions if the State Government is of the opinion that providing such contribution is necessary as per greater public interest.- 6 - Ex-91/2016 3)Other Support (a ) Facilitate acquiring of land necessary for the project. (b) Assistance in rehabilitation & resettlement of affected families. (c ) Facilitate obtaining all State & Centra l Government clearances as may be required for the project. (d) Facilitate the process of availing benefits under State Government Industrial Policy incentives wherever applicable ( e) Facilitate provision of supply of power a nd water at projects site. 10.SETTLEMENT OF DISPUTES10.1.In t he event of a dispute, both parties (Government Department and selected Investor ) will make sincere attempt to resolve the dispute amicably. If both the parties fail to reach the settlement the matt er will be referred to Empowered Committee in PPP who will resolve the dispute in terms of various agreements/concess ion failing which the matter will be dealt with under the provisions of Reconciliation & Arbitration Act. 11.MIZORAM INFRASTRUCTURE DEVELOPMENT FUND11.1.The Government shall establish a fund to b e called “Mizor am Infr astructure Development Fund (MIDF)”. The fund shall be augmented by placing of funds by the Government from the consolidated Fund of the State, and may levy cess / ta x separ ately to augment this fund. P lanning & Progr amme Implementation Department will provide initial fund R s. 20.00 crores to this fund. The fund will be utilized for building up the required infr astruct ure and the works to be undertaken would include- 1)Taking up of technical and financial pr e-feasibility and feasibilit y studies, preparation of repor ts and bid documents and any other act ivities that need to be undertaken pr ior to offering proposed infrastructure projects for private sect or participation including facilitation to select projects to assess Viability Gap funding and other such schemes from Government of India. 2)To provide direct financial support to the projects for enhancing project viability as considered by the Government. 3)For capacit y building and training. 4)For any other purposes in pursua nce of this act and building of infrastructure in the State. 11. 2. OPERATION OF FUND: Detailed guidelines for operation of the fund shall be issued separately. 12.DURATION AND REVIEW OF POLICY12.1. T his policy would come into force with effect from the date of notification by the Government Order and would be effective till it is superseded by Government. 12.2.There may b e a mid-term r eview of this Policy based on a crit ical assessment of feedback from stakeholders, and changes that would be deemed necessa ry and desirable, would be incorpor ated at that stage. 12.3.The government recognizes that expanding and institutionalizing the scope of PPP in provision of infr astruct ure may also necessitate appropriate changes in the existing legislative framework. It is however felt that the present framework offers sufficient scope for PPP in provision of infrastructure and various services to the citizens. POLICY ON PUBLIC PRIVATE PARTNERSHIP 1.INTRODUCTION1.1.The Government of Mizoram is committed to improving the level and the quality of economic and social infrastructure and various services across the State. In pursuance of this goal, the Government of Mizoram envisages a substantive role for Public Private Partnership (PPP) as a means for harnessing private sector invest ment and opera tional efficiencies in the provision of public assets and services. 1.2. In order to facilitate and promote increasing role of Public Private Partnership in the creation of new infrastr uct ure a ssets as well as for the mana gement of existing ones, the Government of Mizoram proposes to lay down an explicit and a comprehensive policy. The policy deta iled herein will put in position a br oad fra mework for implementation of PPP in the Sta te in physical and social infr astruct ure and provision of various services while being sensitive to public needs. 2.POLICY OBJECTIVES AND SCOPE2.1The key objective of this policy is to - 1)Leverage the resources of State Government and Central Government to invite private sector investment in infr astruct ure and provision of services at best possible terms for the peop le of the St ate. 2)Protection of the interest of users and securing value for public money. 3)Setting up of an efficient adminis trative mechanism to ensure selection of private sector developer through tr ansparent bidding criteria. 4)To bring in uniformity in approach cutting across various sectors and Departments of the Government. 5)To prepare a shelf of projects to be offered for PPP under va rious Departments and take them forward for implementation. 6)Putting in place an effective and efficient institutional mechanism for obta ining various clea rances for the project s speedily. The Gover nment of Mizora m also identifies that the pr ivate sector can play a significant role in infrastr ucture development, a nd that given the investor-friendly and transparent policies and frameworks, pr ivate investment can b e facilitated. The Government of Mizoram shall stress upon Public Private Partnership mode because PPP approach is best suited for the infrastructure sector as it sup plement s scarce public resou rces, creates a more competitive environment and br ings in the efficiencies of private sector management. 3.2The indicative list of the infr astruct ure sectors covered by the policy is a s follows :- 1)Roads, bridges and bypasses. 2)Inla nd water transport. 3)Agriculture Product ion, Hor ticulture, Agr o Processing, floricult ure. 4)Wasteland management. 5)Indu strial parks, Theme P arks like IT /BT Parks, Knowledge Par ks, and Townships. 6)Water Supply, Treatment and Distribution and collection of tariff. 7)Power Gener ation, Transmission and Distr ibution and collection of tar iff. 8)Solid Waste Management. 9)Sewer age & Dr aina ge. 10) Tourism. 11) Healthcare facilities. 12) Education. 13) Real Estate Development. 14) Urba n Infra structur e inclu ding Entertainment and Recreational facilities. 15) Urban transportation systems / Improvement of Public Transport Facilities including construction of bus terminals, truck terminals, Maxi Cab Terminals, Multi-level car parking, City Bus stands. 16) Mining and mineral based industries and Infrastructure Development in Mining Areas. 17) La nd Resour ces Management. 18) Disa st er Ma na gement. 19) Any other sector / facility as may be included by the Government from time to time. New projects and sectors can be included in the list with the approval of the PPP Apex Authority on PPP. 4.SERVICE DELIVERY THROUGH PUBLIC PRIVATE PARTNERSHIP4.1.Government of Mizor am recognizes t hat “provider-charges’ and the “user-p ays” pr inciples are crucial to the success of PPP in physica l infrastructur e. The Government would, where necessary and appropriate, consider levying user charges (fees, tariffs, cess etc.) to cover costs of infrastructure provisioning and cr eate a stable and dedicated financia l source for construct ion/ redevelopment/ rehabilitation/ replacement of project assets and their ongoing operations and maintenance to involve and encourage the end users. The focus would be to provide efficient, s ustainable and high qua lity services at affor dable pr ices to the us ers. 4.2.The levy of user charges would be based on the following main considerations 1)Recovery of the investments 2)Recovery of Opera tions & Maintenance Cost 3)Savings to the users arising out of impr oved /created facilities. 4)Willingness to pay 5)Uniformity in various projects. 5.INSTITUTIONAL FRAMEWORK5.1.The Government of Mizora m recognizes the requirement of effective and efficient ins titutional mechanism to ensure timely cleara nce of projects and therefore lays down the following structure to meet the policy goals. 5.2. PPP Apex Authority There shall be cons tituted a PPP Apex Authority a t the State Level with the following composit ion: 1)Chief Minister, Mizoram–Chairman 2)Minister of Planning & Progr amme Implementa tion Department–Vice Chairman 3)Minister of Finance Department–Member 4)Minister of Law & Judicial Department –Member 5)Minis ter of Industries Department–Member 6)Minister of Public Works Department–Member 7)Minister of the line Depart ment (to which the projects belong)–Member 8)Chief Secretary–Member Secretary 5. 3. Power & F unctions The PPP Apex Author ity will grant in-principle approval for all project s proposed to be developed in PPP mode. Further, in a ll PPP projects having investment or where value of underlying assets exceeds Rs. 100 crore, the Apex Authority shall accord investment approval and selection of develop er. 5.4. The Powers and F unctions of the Empowered Committee on PPP would include: 1)Sa nct ion PP P P rojects, approval of developer selected thr ough competitive bidding and appr oval of concess ion agr eements for PPP projects involving investment or where value of underlying assets is up to Rs. 100 crores. 2)Deliberate and recommend to Apex Author ity the final b ids for approval of the projects involving investment above Rs. 100 crores. 3)Sanction and author ize exp enditure by Departments for PP P projects. 4)Adopt and develop Model Concession Agreements for various sectors. 5)Recommend pr ojects for Viability Gap Funding to Government of India. 6)Prepare and seek the approval for the shelf of p rojects to be developed through PPP mode. 7)Deliberate and recommend to Apex Authority any special grants and concessions for ensuring fina ncial viability of the projects. 8)Review and monit or PP P Pr oject s dur ing implementa tion, execution, operation a nd management. 9)Sett le disp utes between t he part ies. 10) Sanction fund out of Project Development Fund for undertaking project development activities. 11) Mana ge the “Mizoram Infrastructure Development Fund (MID F)” proposed to be created to facilitate infrastructure development, and to recommend projects along with amount required to meet the objectives of this Policy. 5.6. PPP Cell The Empowered Committee on PPP shall be assisted by the PPP Cell. The cell shall be established by a government notification in the Planning & P rogramme Implementation Department of the Government of Mizoram. The PPP Cell is to be assisted by the financial, technical and legal consultants appointed by the government . 5. 7. Functions of the PPP Cell The functions of the PPP Cell and its Technical Secreta riat would include: 1)To identify, conceptualize and create a shelf of projects in consultation with the line departments and seek approval of such projects for PPP from time to time from the Empowered Committee on P PP/Apex Author ity. 2)To a ssist different government departments in preparing pre-feasibility reports by itself or through consulta nts. 3)Evaluate PPP projects from financial, legal angles. 4)Provide technical support in terms of finance, law to the Apex Authority and Empowered Committee on PPP. 5)To assist the respective departments in preparing Detailed Project Reports. 6)To help resp ective departments to conduct the bidding pr ocess for selection of developers. 7)To interact with the Department of Economic Affairs, Ministry of Finance, GOI for obtaining appr oval under the scheme of Via bility Gap Funding (VGF). 8)To a ct as the nodal agency for capacity building for PPP in the st ate. 9)Prepa re PPP r ules for the sta tes.- 4 - Ex-91/2016 6.PROCEDURE FOR SELECTION AND APPROVAL OF PPP PROJECTS6. 1. The fund will be utilized for building up the required infr astruct ure and the works to be undertaken would include- 1)Taking up of technical and financial pr e-feasibility and feasibilit y studies, preparation of repor ts and bid documents and any other act ivities that need to be undertaken pr ior to offering proposed infrastructure projects for private sect or participation including facilitation to select projects to assess Viability Gap funding and other such schemes from Government of India. 2)To provide direct financial support to the projects for enhancing project viability as considered by the Government. 3)For capacit y building and training. 4)For any other purposes in pursua nce of this act and building of infrastructure in the State. 11. 2. OPERATION OF FUND: Detailed guidelines for operation of the fund shall be issued separately. 12.DURATION AND REVIEW OF POLICY12.1. T his policy would come into force with effect from the date of notification by the Government Order and would be effective till it is superseded by Government. 12.2.There may b e a mid-term r eview of this Policy based on a crit ical assessment of feedback from stakeholders, and changes that would be deemed necessa ry and desirable, would be incorpor ated at that stage. 12.3.The government recognizes that expanding and institutionalizing the scope of PPP in provision of infr astruct ure may also necessitate appropriate changes in the existing legislative framework. It is however felt that the present framework offers sufficient scope for PPP in provision of infrastructure and various services to the citizens. Pr ovided that such applicant who have not got their result sheets at the time of submission of t heir applications, should submit their final results with mark sheet within fifteen days from the date of publication of their results by the concerned Examina tion Board. d)have obtained not less than fifty percent of the maximum marks in aggr egate in the a forementioned subject s. The minimum percentage of marks for Scheduled Caste, Scheduled Tribe and Other Backward Class shall be forty percent of the maximum marks in a ggrega te, pr ovided that this requirement may be ra ised if any p articu la r institution insist a higher percentage. Method of Selection 5.(1) All applica nts sha ll be classified into three categories for the pur pose of allotment of seats, viz :- a ) Children of permanent residents of the Sta te of Mizoram as Ca tegory-I. b) Children of other permanent residents of the State of Mizoram as Category-II. c ) Children of Central/Other State Government employees not permanent ly serving in Mizoram, as Ca tegory-III. Expla nation :For the purpose of this sub-rule : a ) the term “permanent residents” means those who a re Zo-et hnic people of the State of Mizoram and have been residing perma nently in the State. b) the term “other permanent residents” means those who are (i) Children of non- Zo-ethnic people of the State of Mizoram and have been r esiding permanently in the State. (ii) Children of parents who ar e serving under the Government of M izoram or Government corpora tion or Autonomous Bodies under the State Government who are regula r employees of such organization and in whose case, it can safely be inferred that they would r eside permanently in Mizoram including children of deceased employees of the State Government whose families are living in Mizoram. c ) to be eligible to be considered u nder Ca tegory-III, either of the parents of the candidate(s) should have been r esiding and posted in Mizoram for at least t hree years. (2) Percentage of seats for Category I, II and III. 95% of the total s eats shall be reserved for Category-I, 4% of the total seats shall be reserved for Category-II and 1% of the total seats shall be reserved for Category-III. Determination of percentage for each Category has been made on the basis of average result of STEE (State Technical Entr ance Ex amination) for the last 5(five) years. The disciplines in which s eats ar e to be alloted to Category-I, II and III will be decided by the Selection Board by preparing seat matrix. Vacant seats, if any, due to unavailability of suitable candidates from amongst the Category-II and III shall be reverted back to Category-I. Application for 6.(1) All applications, in prescribed form obtainable from the Office of the Joint Director(Technical), Technical Wing of Higher & Technical Education or any other office as appoint ed by the Government from time to time, on payment of such fees as may be prescribed, and duly filled in, should be submitted to the Joint Director(Technical), Technical Wing of Higher & Technical Educa tion or any other person as a ppointed by the Government from time to time, for which a specified date shall to b e fixed. Application received after the s pecified da te for receipt of the application shall not be accepted. (2) Subject to t he provision to clause (c) of rule 4 herein before, and sub-rule (3 ) of this rule, every applica tion form duly filled in shall be accompanied with attested copies of the following documents :-- 3 -Ex-92/2016 a ) Certificate and Mark sheet in the High School Leaving Certificate or equivalent examina tion. b) Certificate and Mark sheet in the Higher Secondary School Leaving Certificate or equivalent examination. c ) Certificate showing the candidate’s caste, tribe or class in case he is member of Scheduled Caste, Scheduled Tribe or other Backward Class issued by the Deputy Commissioner of the Administrative Dis trict or any other competent authority in the Administrative Distict in which the applicant resides; d) Proof of date birth e) Residential Certificate f) Voters I.D. of either parents or legal guar dian g) Family Ration Card in the absence of (f) above. h) Proof of being a Government serva nt for (ii) of sub-clause (b) of clause 5. i) Proof of being a Government servant and length of r esiding in Mizoram for sub-clause (c) of clause 5. j) Three copies of recent passport-size photographs, printed from the same photonegative, a ttested on the front side by a Gazette Officer one copy of which is to be firmly affixed to the application form while the other two loose copies shall be meant for Admit Card and for Office Record. (3) A ca ndidate not in possession of the afore-mentioned Certificates and Mark sheets at the time of submission of his application form may submit authenticated Provisional documents issued by the concerned Secondary or equivalent Board or by the Principal of the Educational Institute from where the candidate has studied or appeared at the Higher Secondar y School Leaving or equiva lent Examination, showing the subjects taken and the date of birth recorded therein. The decision of the Selection Board on the authenticity of the documents shall be final and no representation on that matter shall be entertained. In complete application shall be liable to be rejected without assigning any reason. (4) Admit Cards will be issued to the candidates two weeks before commencement of the Selection Examination and no candidate should mutilate the Admit Card or change any entry made therein after it has been issued to him. (5) Every candidate shall have to pay fees for application form with information brochu re, exa mination and counseling in the manner as may be prescribed, at the time of obtaining the application form. The amount of fees to be pa id shall be fixed by the Selection Board from time to time. (6) Confirmation of seat shall be done by every candidate by depositing security deposit which will be refunded on production of joining report by the candidate. Examination in Mathematics and Biology subjects shall be conducted separately to facilitate the candidates who want to appear in both the Groups. The ma rks secured by the candidates in written examination shall be taken into considera tion for allotment of seats. DATE OF EXAMINATION : T he Selection Examination will be conducted every year on such date as may be notified by the Director of Higher & Technical Education or any other body as may be appointed by the Gover nment from time to t ime. 2 . SCHEME OF EXAMINATION: In the Selection Examination the candidates must appear in the following papers:- (a) PCB Group: (i)Physics, Chemistry and Biology (Z oology a nd Bota ny) (for Medical, Agriculture etc disciplines etc.) AND (b) PCM Group : Physics, Chemistry & Mathematics (for Engineering discip lines etc.) (ii) Duration:3 hours each (iii) Each paper shall carry 400 marks ; (iv) All questions shall be of objective type. 3 . EXAMINATION CENTRE : The Selection Examination will be held every year at the place/ places as notified by the Director of Higher & Technical Education or any other body as ma y be appointed by the Government from time to time. 4. CONDUCT OF EXAMINATION:(a ) The Examination Hall will be opened 30 minutes before the commencement of t he Examination. Candidates are expected to take their seats 15 minutes before commencement of the Examination. (b) A candidate who does not possess the Admission Card shall not be admitted into the Examination Hall. (c ) A seat with a number will be allotted to each candida te. Candidates must find out and occupy their allotted seat. (d) A ca ndidate who comes aft er 30 minutes of the commencement of Examination s hall not be permitted to sit in the Examination without a Special permission of the Controller of Examination. In no way a student who comes after one hour shall b e admit ted. ( e) A ca ndidate shall not be allowed to carry any textual ma terial, printed or writ ten, bits of pa pers or a ny other objectionable materials inside the Examination Hall. (f) No candidate without specia l permission of the Controller of Exa mination or the Invigilator concerned is to leave his seat or the Examination Hall until he has finished his Exam. Candidates should not leave the Hall without handing over their answer sheets to the Invigilator on duty. (g) Use of Elect ronic/Manual Calculator/Mobile phone or any other electronic gadgets shall not be allowed. (h) Candidates shall maintain complete silence and attend to their papers only. Any conversa tion or gesticulation or disturbance in the Examination Hall shall be deemed as misbehavior and if a ca ndidate is found using unfair means or impersonating, his candida ture will be ca ncelled and he will be liable to be debarred for ta king Exa mination either perma nently or for a specified period according to the nature of offence. (i) During the Examina tion time, the invigilator will check the Admit Card of each ca ndidate and put his signature in the place provided in the a nswer sheet.- 6 - Ex-92/2016 (j) The candida tes sha ll bring their own pens, pencils, sharpener s and erasers etc. with them for use during Examination. These shall not be supplied in the Examination Hall. (k) After completing the examination a nd before handing over the Answer Sheets, the candidate should check again that a ll the particulars required in the Answer S heets have been correctly written. (l) Signal will be given at the beginning of t he Examination, and ten minutes befor e the end of Examination as warning and at the end of the time when the candidate must stop answering the questions. (m) For those who are unable to appear on the scheduled date of Examination for any reason, special examination shall not be held under any circumstances. 5 . RE-CHECKING OF ANSWER PAPERS : No re-rechecking/re-evaluation of Answer Sheets shall be a llowed if OMR is used for checking of the answer sheets. However, re-rechecking/r e- evaluation of Answer Sheets may be allowed if OMR is not used for checking of the answer sheets within two weeks of the declaration of results and on pa yment of the required fee of Rs 500/- per paper. 6 . SYSTEM OF MARKING (a ) Each objective question shall carr y four answers. Questions without any response shall be awar ded ZERO. More than one answer indicated against a question will be deemed a s an incor rect r esp ons e. (b) A negative mark shall be a warded against wrong answer. For ea ch incor rect response, one fourth (¼th ) of the total mar ks allotted to the question will be deducted.The candidates are advised not to attempt an item in the answer sheet if they are not sure of the correct response. 7. ISSUE OF PHOTOCOPY OF ANSWER SHEET : In order to ensure transparency and accountability in the SMAT EE, provisions for obtaining a photocopy of evaluated answer sheet has been made as follows : (a ) A photocopy of the answer sheet shall be given on request accompanied by a fee of Rs. 100/- (Rupees one hundred) only. (b) Photocopy of answer sheet can be applied for and claimed by only the candida te himself/ herself upon production of his/her original admit car d issued by the Examining Board for the examination under consideration. The Boa rd will not entertain any application/claims made on behalf of the ca ndidate(s). (c ) A period of 10 (ten) days after the declaration of results shall be given to the ca ndidates to apply for a photocopy of a nswer s heet. Upon the expiry of this period, no application shall be entertained. (d) A candidate who desires to get a photocopy of the answer sheet shall have to sign an undertaking with a pledge to maintain utmost confidentialit y. Any violation of the undertaking will render the result of the candidate null a nd void and the Examination of the ca ndidate shall be liable to be cancelled. ( e) While giving the photocopy of the answer sheet, names of the Exa miner and Scrutinizer which appear on the sheet shall be concealed. 8 . ISSUE OF MARK STATEMENT :Mark statement will be issued to all the candidates on production of their original SMATEE admit ca rds. 9. MERIT LIST : (a ) The Examina tion Board shall prepa re a list of the candidates in order of mer it on the basis of the marks obtained in the Written Examination.- 7 -Ex-92/2016 (b) In case of two or more candidates obtaining equal marks in the merit list, the inter-se- merit of such candida tes sha ll be determined in order of pr eferences as under: (i)Candidates obtaining higher marks in Biology (Botany and Zoology) for Medical, Agriculture etc. disciplines and in Mathematics for Engineering disciplines in the Selection Examination. (ii) Candidates obtaining higher marks in Chemistry for Medical, Agriculture etc. disciplines and in Physics for Engineering disciplines in the Selection Examination. (c ) Candidate older in age sha ll be preferred in ca se of marks obtained being equal. (d) No weightage will b e given for higher qua lifications. 10 . ALLOTMENT OF SEAT:All the selected ca ndidates or authorized representative will be required to a ppear in person before the Dir ector, Higher & Technical Education for counseling and checking of a ll the documents listed under rule in original on the date, time a nd venue to be intimated to t hem. The candida tes who fail t o pr oduce the Original documents at the time of personal appearance, allocation of seats shall be liable to be rejected.If any candidate is found to have furnished false information or certificate (s) or to have withheld or concealed any material/ information to gain personal advantage, he shall be disqualified. If selection or even admission ha s already been done or effected, it shall be cancelled at any stage of his study and such other action as deemed necessary may be taken against him, under any la w for the time being in force in the state of Mizoram. Note: The decis ion of the Selection Board on the authenticity of the documents shall be final and no repr esentation on that score sha ll be entertained. 11 . Method of Selection :On t he basis of mar ks obtained in the Selection Examination, selection s hall be made in order of merit from amongst eligible candida tes from Category – I, Category - II and Category - III to fill up their respective quota portion. 12 . CONFIRMATION OF SEATS :All the candidates should confirm their allotted seats within the stipulated time by depositing the required secur ity deposits as mentioned in clause (6) of r ule 6 herein failing which the seat will be disposed off in the next r ound of Counseling. 13 . JOINING REPORT :All the allotted students should submit their joining report to the Director, Higher & Technical Education through the Principal of the respective Colleges/institutions within one month from the date of joining. Their applications should be supported by attested copies of admission receipts, etc. 14 . MEDICAL FITNESS CERTIFICATE :Selected Candidates are requested to produce Medical Fitness Certificate at the time of Counseling, failing which they will not be allotted the seat. 15 . (ii) Children of parents who ar e serving under the Government of M izoram or Government corpora tion or Autonomous Bodies under the State Government who are regula r employees of such organization and in whose case, it can safely be inferred that they would r eside permanently in Mizoram including children of deceased employees of the State Government whose families are living in Mizoram. c ) to be eligible to be considered u nder Ca tegory-III, either of the parents of the candidate(s) should have been r esiding and posted in Mizoram for at least t hree years. (2) Percentage of seats for Category I, II and III. 95% of the total s eats shall be reserved for Category-I, 4% of the total seats shall be reserved for Category-II and 1% of the total seats shall be reserved for Category-III. Determination of percentage for each Category has been made on the basis of average result of STEE (State Technical Entr ance Ex amination) for the last 5(five) years. The disciplines in which s eats ar e to be alloted to Category-I, II and III will be decided by the Selection Board by preparing seat matrix. Vacant seats, if any, due to unavailability of suitable candidates from amongst the Category-II and III shall be reverted back to Category-I. Application for 6.(1) All applications, in prescribed form obtainable from the Office of the Joint Director(Technical), Technical Wing of Higher & Technical Education or any other office as appoint ed by the Government from time to time, on payment of such fees as may be prescribed, and duly filled in, should be submitted to the Joint Director(Technical), Technical Wing of Higher & Technical Educa tion or any other person as a ppointed by the Government from time to time, for which a specified date shall to b e fixed. Application received after the s pecified da te for receipt of the application shall not be accepted. (2) Subject to t he provision to clause (c) of rule 4 herein before, and sub-rule (3 ) of this rule, every applica tion form duly filled in shall be accompanied with attested copies of the following documents :-- 3 -Ex-92/2016 a ) Certificate and Mark sheet in the High School Leaving Certificate or equivalent examina tion. b) Certificate and Mark sheet in the Higher Secondary School Leaving Certificate or equivalent examination. c ) Certificate showing the candidate’s caste, tribe or class in case he is member of Scheduled Caste, Scheduled Tribe or other Backward Class issued by the Deputy Commissioner of the Administrative Dis trict or any other competent authority in the Administrative Distict in which the applicant resides; d) Proof of date birth e) Residential Certificate f) Voters I.D. of either parents or legal guar dian g) Family Ration Card in the absence of (f) above. h) Proof of being a Government serva nt for (ii) of sub-clause (b) of clause 5. i) Proof of being a Government servant and length of r esiding in Mizoram for sub-clause (c) of clause 5. j) Three copies of recent passport-size photographs, printed from the same photonegative, a ttested on the front side by a Gazette Officer one copy of which is to be firmly affixed to the application form while the other two loose copies shall be meant for Admit Card and for Office Record. (3) A ca ndidate not in possession of the afore-mentioned Certificates and Mark sheets at the time of submission of his application form may submit authenticated Provisional documents issued by the concerned Secondary or equivalent Board or by the Principal of the Educational Institute from where the candidate has studied or appeared at the Higher Secondar y School Leaving or equiva lent Examination, showing the subjects taken and the date of birth recorded therein. The decision of the Selection Board on the authenticity of the documents shall be final and no representation on that matter shall be entertained. In complete application shall be liable to be rejected without assigning any reason. (4) Admit Cards will be issued to the candidates two weeks before commencement of the Selection Examination and no candidate should mutilate the Admit Card or change any entry made therein after it has been issued to him. (5) Every candidate shall have to pay fees for application form with information brochu re, exa mination and counseling in the manner as may be prescribed, at the time of obtaining the application form. The amount of fees to be pa id shall be fixed by the Selection Board from time to time. (6) Confirmation of seat shall be done by every candidate by depositing security deposit which will be refunded on production of joining report by the candidate. DATE OF EXAMINATION : T he Selection Examination will be conducted every year on such date as may be notified by the Director of Higher & Technical Education or any other body as may be appointed by the Gover nment from time to t ime. 2 . EXAMINATION CENTRE : The Selection Examination will be held every year at the place/ places as notified by the Director of Higher & Technical Education or any other body as ma y be appointed by the Government from time to time. 4. CONDUCT OF EXAMINATION:(a ) The Examination Hall will be opened 30 minutes before the commencement of t he Examination. Candidates are expected to take their seats 15 minutes before commencement of the Examination. (b) A candidate who does not possess the Admission Card shall not be admitted into the Examination Hall. (c ) A seat with a number will be allotted to each candida te. Candidates must find out and occupy their allotted seat. (d) A ca ndidate who comes aft er 30 minutes of the commencement of Examination s hall not be permitted to sit in the Examination without a Special permission of the Controller of Examination. In no way a student who comes after one hour shall b e admit ted. ( e) A ca ndidate shall not be allowed to carry any textual ma terial, printed or writ ten, bits of pa pers or a ny other objectionable materials inside the Examination Hall. (f) No candidate without specia l permission of the Controller of Exa mination or the Invigilator concerned is to leave his seat or the Examination Hall until he has finished his Exam. Candidates should not leave the Hall without handing over their answer sheets to the Invigilator on duty. (g) Use of Elect ronic/Manual Calculator/Mobile phone or any other electronic gadgets shall not be allowed. (h) Candidates shall maintain complete silence and attend to their papers only. Any conversa tion or gesticulation or disturbance in the Examination Hall shall be deemed as misbehavior and if a ca ndidate is found using unfair means or impersonating, his candida ture will be ca ncelled and he will be liable to be debarred for ta king Exa mination either perma nently or for a specified period according to the nature of offence. (i) During the Examina tion time, the invigilator will check the Admit Card of each ca ndidate and put his signature in the place provided in the a nswer sheet.- 6 - Ex-92/2016 (j) The candida tes sha ll bring their own pens, pencils, sharpener s and erasers etc. with them for use during Examination. These shall not be supplied in the Examination Hall. (k) After completing the examination a nd before handing over the Answer Sheets, the candidate should check again that a ll the particulars required in the Answer S heets have been correctly written. (l) Signal will be given at the beginning of t he Examination, and ten minutes befor e the end of Examination as warning and at the end of the time when the candidate must stop answering the questions. (m) For those who are unable to appear on the scheduled date of Examination for any reason, special examination shall not be held under any circumstances. 5 . RE-CHECKING OF ANSWER PAPERS : No re-rechecking/re-evaluation of Answer Sheets shall be a llowed if OMR is used for checking of the answer sheets. However, re-rechecking/r e- evaluation of Answer Sheets may be allowed if OMR is not used for checking of the answer sheets within two weeks of the declaration of results and on pa yment of the required fee of Rs 500/- per paper. 6 . SYSTEM OF MARKING (a ) Each objective question shall carr y four answers. Questions without any response shall be awar ded ZERO. More than one answer indicated against a question will be deemed a s an incor rect r esp ons e. (b) A negative mark shall be a warded against wrong answer. For ea ch incor rect response, one fourth (¼th ) of the total mar ks allotted to the question will be deducted.The candidates are advised not to attempt an item in the answer sheet if they are not sure of the correct response. 7. ISSUE OF PHOTOCOPY OF ANSWER SHEET : In order to ensure transparency and accountability in the SMAT EE, provisions for obtaining a photocopy of evaluated answer sheet has been made as follows : (a ) A photocopy of the answer sheet shall be given on request accompanied by a fee of Rs. 100/- (Rupees one hundred) only. (b) Photocopy of answer sheet can be applied for and claimed by only the candida te himself/ herself upon production of his/her original admit car d issued by the Examining Board for the examination under consideration. The Boa rd will not entertain any application/claims made on behalf of the ca ndidate(s). (c ) A period of 10 (ten) days after the declaration of results shall be given to the ca ndidates to apply for a photocopy of a nswer s heet. Upon the expiry of this period, no application shall be entertained. (d) A candidate who desires to get a photocopy of the answer sheet shall have to sign an undertaking with a pledge to maintain utmost confidentialit y. Any violation of the undertaking will render the result of the candidate null a nd void and the Examination of the ca ndidate shall be liable to be cancelled. ( e) While giving the photocopy of the answer sheet, names of the Exa miner and Scrutinizer which appear on the sheet shall be concealed. 8 . ISSUE OF MARK STATEMENT :Mark statement will be issued to all the candidates on production of their original SMATEE admit ca rds. 9. MERIT LIST : (a ) The Examina tion Board shall prepa re a list of the candidates in order of mer it on the basis of the marks obtained in the Written Examination.- 7 -Ex-92/2016 (b) In case of two or more candidates obtaining equal marks in the merit list, the inter-se- merit of such candida tes sha ll be determined in order of pr eferences as under: (i)Candidates obtaining higher marks in Biology (Botany and Zoology) for Medical, Agriculture etc. disciplines and in Mathematics for Engineering disciplines in the Selection Examination. (ii) Candidates obtaining higher marks in Chemistry for Medical, Agriculture etc. disciplines and in Physics for Engineering disciplines in the Selection Examination. (c ) Candidate older in age sha ll be preferred in ca se of marks obtained being equal. (d) No weightage will b e given for higher qua lifications. 10 . ALLOTMENT OF SEAT:All the selected ca ndidates or authorized representative will be required to a ppear in person before the Dir ector, Higher & Technical Education for counseling and checking of a ll the documents listed under rule in original on the date, time a nd venue to be intimated to t hem. The candida tes who fail t o pr oduce the Original documents at the time of personal appearance, allocation of seats shall be liable to be rejected.If any candidate is found to have furnished false information or certificate (s) or to have withheld or concealed any material/ information to gain personal advantage, he shall be disqualified. If selection or even admission ha s already been done or effected, it shall be cancelled at any stage of his study and such other action as deemed necessary may be taken against him, under any la w for the time being in force in the state of Mizoram. Note: The decis ion of the Selection Board on the authenticity of the documents shall be final and no repr esentation on that score sha ll be entertained. 11 . Method of Selection :On t he basis of mar ks obtained in the Selection Examination, selection s hall be made in order of merit from amongst eligible candida tes from Category – I, Category - II and Category - III to fill up their respective quota portion. 12 . CONFIRMATION OF SEATS :All the candidates should confirm their allotted seats within the stipulated time by depositing the required secur ity deposits as mentioned in clause (6) of r ule 6 herein failing which the seat will be disposed off in the next r ound of Counseling. 13 . JOINING REPORT :All the allotted students should submit their joining report to the Director, Higher & Technical Education through the Principal of the respective Colleges/institutions within one month from the date of joining. Their applications should be supported by attested copies of admission receipts, etc. 14 . MEDICAL FITNESS CERTIFICATE :Selected Candidates are requested to produce Medical Fitness Certificate at the time of Counseling, failing which they will not be allotted the seat. 15 .
