The Mizoram Lotteries (Regulation) (Amendment) Rules, 2015.

No. NE-313(MZ) 2006-2008VOL - XLV Aizawl, Friday 29.4.2016 Vaisakha 9, S.E. 1938, Issue No. 103 1)These Rules may be ca lled the Mizoram Lotteries (Regulation) (Amendment) Rules, 2015. 2)They shall come into force with immediate effect. In Sub-rule 17 of rule 4 of the principal rules, the following shall be substi- tuted namely :- “17) i) Prize claims that are not submitted to Director, Institutional Fi- nance & State Lottery within the period of 90 (ninety) days from the date of draw shall not be disbursed and shall stand forfeited to the State Gov- ernment as unclaimed prize money: Provided that the Director may, in exceptional circumstances, dis- burse the prize amount to the prize winners on his application even after the expiry of the said period of ninety days but not exceeding one hundred and twenty days if he is satisfied that the reasons for not claiming the prize amount within the said period of 90 ninety days are cogent and genuine; ii)In order to determine the unclaimed or undistributed prize money, the Distributor shall, within a period of one month from the expiry of ninety days referred to above or as the Director may allow in excep- tional circumstances, submit the audited account thereof, to the Director, Institutional Finance & State Lottery.” In Rule 5 of the principal rules :-NOTIFICATIONNo. G.16010/39/2012-F.IF&SL, the 19h April. 2016.In exercise of the powers conferred by Section 12 of the Lottery (Regulation) Act, 1998 (Act No. 17 of 1998) the Governor of Mizoram is pleased to make the following Rules to amend the Mizoram Lotteries (Regulation) Rules, 2011 (hereinafter called the Prin- cipal Rules), namely :- 1.Short title and Co mmencement : 2.Amendment of Rule 4 3.Amendment of Rule 5 Ex-103/20162 (1)In sub-rule 1, the proviso shall be omitted; (2)Sub-rule 2 shall be substituted by the following namely :- “The State Government may appoint Distributor(s)/Selling Agents by way of inviting Expression of Interest. The Expression of Inter- est shall be in two parts namely :- (a)Technical bid and (b) Financial bid. These parts shall be furnished separately by the Partici- pating Entity. The technical bid of the Participating Entity shall be opened first followed by the financial bid provided the Participat- ing Entity is considered eligible in the technical bid. Financial bids of the unqua lified pa rties in the technical bid shall not be opened and both the bids shall be returned to them. (3)Sub-rule 3 shall be substituted by the following, namely :- “The terms and conditions to be fulfilled by the Participating En- tity in Technical bid and Financial bid shall be as under, namely :- (a)The Technical Bid : (i)the tender form/documents shall be issued only to Regis- tered Firms/Proprietorship concerns/Companies registered under the law for the time being in force; (ii)the Participating Entity should be bonafide Distributor(s)/ Selling Agents of sound financial standing having satis- factory experience in lottery business; (iii) the Participating Entity shall have carried out similar jobs of Paper/Online Lotteries and should have an experience of at least one year as Sole Distributor of at least one State Government as per the existing Central Government Rules and Regulations prevailling at the time of floating of the tenders; (iv) the legal status of the Participating Entity, whether it is Sole Proprietorship, Private Limited Company, Partnership Firm or otherwise should submit documentry proof alongwith the bid; (v)any party willing to be present in the opening of the bid documents may do so with proper authorization letter duly issued by the authorized signatory of the Company/Firm/ Body/Individual or other Legal entities. (vi) the Participating Entity must be capable of commencing the operations with effect from the date stipulated in Ex- pression of Interest; Published and Issued by the Controller, Printing & Stationery, Mizoram Printed at the Mizoram Govt. C-100(vii) any other terms and conditions as the State Government may deem fit and proper to specify; (viii) the Participating Entity shall only be allowed to partici- pate in the bidding process as per their experience either in paper or online lotteries for smooth and effective run- ning of lotteries; (ix) the State Government reserves the right to reject all or any of the tenders without assigning any reasons thereof; (b)The Financial Bid: (i)the Participating Entity should be an Income Tax Assessee and have a valid Permanent Account Number/Tax Deduc- tion Account Number issued by the Income Tax Depart- ment, Government of India; (ii)the Participating Entity shall furnish clearance certificate from the other Lottery Organizing Sta tes wherever they are having distributorship; (iii) the Participating Entity shall deposit earnest money as specified by the State Government. The earnest money so deposited shall be forfeited in case the successful Partici- pating Entity fails to execute the agreement within the stipu- la ted time; (iv) The Distributor(s) or Selling Agent(s) on appointment through an agreement in each case shall furnish a security deposit in the form of Demand Draft or a Bank Guarantee, as may be specified by the State Government of Mizoram at the time of invitation of the Expression of Interest. NOW, THEREFORE, in exercise of the said powers and other powers enabling it in that behalf, the Mara Autonomous District Council, with the previous approva l of the Governor, is pleased to make the following regulations in the Sixty–fifth Year of the Republic of India as follows:– Short title,1.(1)These Regulations may be called t he Mara Autonomous extent and District Council (Establishment and Management of commencement. Elementary Schools) Regula tions, 2014. (2)They shall extend to the whole of the Mar a Autonomous District. (3)They shall come into force from the date of their publication in the Mizoram Gazette. Definitions.2.In these Regulations unless the context otherwise requires:– (i)“Authorised Officer” means an officer duly author ised by the Executive Committee to deal with any of the provisions of these Regulations. (ii)“Board” means the Board of School Education constituted by the Mara Autonomous District Council. (iii)“Child” means a person of the age of six to four teen years. (iv) “Concerned Authority” means the Executive Committee or Executive Member in–char ge of Education of the Mara Autonomous District Council, as the case may be. (v)“Concerned Department” means the Education Depart- ment of the Mara Autonomous District Council. Ex-106/20162 (vi)“District Council” means the Mara Autonomous District Council. (vii)“Education Officer” means any Officers of the Educa tion Department of the Mara Autonomous District Council as designated from time to time by the Executive Committee to deal wit h any of the provisions of these Regulations. (viii) “Executive Committ ee” means the E xecutive Committee of the Mara Autonomous Distr ict Council. (ix)“Government” means the Government of Mizoram and Government of India. (x)“Local Authority” means Village Council of the concerned localit y constituted under the provisions of the Mar a Autonomous District (Villa ge C ouncils) Act , 1974 a s amended from time to time. (xi)“Mara Autonomous District” means an area deemed as such under Paragraphs 2, 20 and 20B of the Sixth Schedule to t he Constitution of India. (xii)“Prescribed” means prescribed by these Regulations or rules, if a ny, made under these R egulations. (xiii) “ Element ar y S chool” mea ns a school in which children receive primary or elementa ry education from the ages of about six to fourteen, coming before high school or secondary school and after pre-school. (xiv) “Teacher” means a person who teaches, especially one employed or appointed by the Executive Committee of the Mara Autonomous District Council in any elementary schools. Applica tion of3.(1)These Regulations shall a pply to all elementar y schools, whether Regulations recognised or unrecognised, established within the Mara Autonomous District. (2)Notwithstanding anything contained in sub–section (1) of this Section, the Executive Committee may, by Official Notification or by Special Order, exempt certain elementary schools from application of these Regulations: Provided that there existed sufficient and reasonable ground for such purpose.Ex-106/2016 3 Application for4.(1)Any person, group of persons, registered society, etc. intending establis hmentand willing to establish elementary school within the Mara of elementa ry school.Autonomous District may submit his application in a prescribed form in the Annexure-I to Senior Officer for inspection of the concerned department of Mar a Autonomous District Council. The inspection team shall conduct inspections on the following grounds : (a)the place or locality wher e the applicant(s) int end(s) t o establish school; (b)the experience and expert ise of the a p plicant (s); (c)the population of the place or localit y where t he applica nt(s ) intend(s) to establish school; (d)the location and site of the building, if any, to be used for the purpose of establishment of school, etc. (2)The elementa ry school, which has been established before the commen- cement of these Regulations sha ll apply as pr ovided in sub–section (1) of S ection 4, within a period of 3 (thr ee) months. (3) Aft er the concerned depar tment conducted inspection, the report shall be submitted to the Senior Education Officer for consideration of the Executive Committee. Grant of5.(1)On receipt of its inspection report for permission under Section 4, the permissionExecutive Committee may decide whether the applicant(s) is/are eligible andor not for grant of permission. recognition of school. The terms and condit ions to be fulfilled by the grantee a re laid down in the Annexure atta ched to the Appendix–II of these Regulations. (3)Any elementary school established with and under the permission of the Executive Committee shall be deemed to be duly recognised school. Explanation.– All terms and conditions incorporated to these Regulations shall be treated as parts of these Regulations and shall have the force of law. Revocation of6.(1)The Executive Committee may, on its own motion or on any permission.refer ence made to it by any person(s) in writing, revoke permission already granted under Section 5, where:– (a)permission has been obtained by misrepresentation of material and essential facts or; Ex-106/20164 (b)the holder of permission ha s without reasonable ca use, failed to comply with the terms and conditions subject to which the permission has b een granted; (c)the holder of permission has violated any of the provisions of t hese Regulations or a ny other law in force in the Mara Autonomous District. Control, regulation7.(1)No elementa ry school shall be establis hed within the Mara Auto- and restriction onnomous District except under the permission issued by the elementary school.Executive Committee or in that behalf as per the provisions of these Regula tions or Rules, if any, made thereu nder. (2)The Executive Committee may, by public notification or special order, impose certain regulations, control and restriction on element ar y schools esta blished wit hin the Ma ra Autonomous District for the purpose of carrying out any of the provision of these Regulations: Provided that the Executive Committee ma y also be competent under this Section, to prescribe and fix medium of instruction, by public notification or by special order, for all elementary schools within the Mara Autonomous District. (3)Subject to the provisions set–forth in other Sections of these Regulations and any other law in force in the Mar a Autonomous District, such regulations, control and r estrict ion may provide for all or any of the following matters:– (a)the fixation, limitation and prescription of building cons- truct ion, stor eys of building, etc. to be used for the purpose of elementary school on the basis of site and location of s uch building; (b)the requirement and prescription of space of campus to be spared by elementary school so as to ensure healthy environment and surroundings for the pupils in particulars and the school at la rge; (d)the prescription, specification and requirement of the nature and style of building mainly to ensure desirable system of drainage and disposal of wastes and sewages, etc; (e) the inspection and verification of the process, procedure and progress of a ny school.Ex-106/2016 5 Special powers8.(1)The Executive Committee shall be competent to exer cise of t he Executivespecial powers and control over teaching and non–teaching staff Committee andwith their appointment, promotion, degradation, transfer, termi- procedure thereof.nation, suspension, retirement, leave, allowances and dismissal, etc. (2)In particular and without prejudice to the general public, the power and control as provided under sub–section (1) of this Section shall be carefully and prudently exercised in the following manner:– (a)in case, any appointment of teachers in elementary schools maintained, funded and aided by the District Council, the same shou ld be made in a r egular and fair manner and ensu re that only qualified persons have to be a ppointed to the posts; (b)whenever a vacancy or vacancies requir ed to be filled to the post of teachers, the Executive Committee or any authorised officer in this behalf shall make open adver- tisement and filling up of the post must be in order of merit from a mong the eligible candidates for the post: Provided that among the candidates, trained tea chers shall be given p references to the posts. (c)the applicant for the post of vacant teacher in any elementary school shall b e a person who had passed Class 12th Sta ndard or its equivalent with at least 45% fr om a Board or University recognised by the State/ Central Government, for lower primar y school a nd Bachelor Degree holder with 45% from a University r ecognised by the State/Central Government, for upper primary school: Provided that the teacher s already in service, as regular teachers shall be presumed to have duly qualified under these Regulations; (f)in the event of selection between two persons of equal rank in all aspects, priority should be given to a person older in a ge. (3)The Executive Committee shall also be competent to promote a teacher to the higher gra de on the basis of merit–cum–senior ity. (4)The Executive Committee sha ll fu rther have the power s in r es pect of posting and tra nsfer, termination, degradation, suspension and dismissal, etc. of a teacher on pr oven misconduct, indiscipline and in accordance with the or der of competent Court to that effect: Ex-106/20166 Provided that no action against teacher shall be taken until and unless Departmental Proceeding has been properly initiated against such teacher and give him/her an opportunit y of being heard. (5)The Executive Committee shall be the sole competent a uthorit y to determine pay and allowances of teachers from time to time as per the provisions of any law for the purpose in force in the Mara Autonomous District. (6)The Executive Committee or any authorised officer in this behalf, may also be competent to fix and prescribe Pupil–Teacher Ratio from time to time for a school or s chools, on the basis of the st atus and strength of such a school or schools, as t he case may be, by an Office Order, particularly for the welfare and benefit of the pupils concerned. (7)The Executive Committee or any a uthorised officer in this behalf shall determine and fix admission fee and monthly fee to be collected by unaided and unfunded school by the District Council from students admitted therein. Composition and9.(1)An elementary school established, irrespective of aided or funct ions of schoolunaided, funded or unfunded, etc. by the District Council within managementthe Mar a Autonomous District shall constitute a S chool committee.Mana gement Committee (her einafter referr ed to as the “S MC”) within six months from the commencement of these Regulations: Provided that the SMC constit uted, if any, under any other law in force within the Mara Autonomous District, shall be deemed to be duly constituted under these Regulations. (2)The composition and funct ions of the SMC cons tituted under sub– section (1) of this Section sha ll be as follows:– (a)tota l number of members of the SMC sha ll be seven (7) and after the commencement of these Regulations which may be incr eased from time to time, on the basis of t otal strength of the concerned school, by the Executive Committee; (b)two of the members shall be from parents or guardians of t he students, one each from local Non–Governmental Orga nisation and Local Authority respectively, two other members from the school concerned and one shall be a person from the locality prefer ably with deep experience and knowledge in the fields of education, social aspects and child management, etc;Ex-106/2016 7 (c)it shall function as an agency to communicate in simple and creative ways to the population in the loca lity of the school, the rights of the child as enunciated in these Regulations and any other law in force in the Mara Autonomous District, and also the duties of the Govern- ment, Local Authority, school, par ents and guardians; (d)to ensure the implementation of the provisions of these Regulations and any other law in force in the Mara Autonomous District; (e)to ensure and achieve high level of enrolment rate and cont inued attendance of all the children from the loca lity of school; (f)to bring to the notice of the concerned authority any deviation fr om the rights of the child, in particular mental and physica l harassment of children, denial of admission and timely provision of free entitlements to children as per the provisions of any law in force; (g)to identify the needs and pr epare plan for the progress and development of the concerned school; (h)to monitor the identification and enrolment of, and facilities for learning by disabled children, and ensure their parti- cipa tion in, and completion of elementary education; (i)to monitor that teachers a re not burdened with non– academic dut ies; (j)to monitor the implementation of mid-day meal in the school; (k)to prepare an annual accounts of receipt and expenditure of the school. (3)The day to day management of elementary school concerned shall be vested with the SMC cons tituted under these Regulations. To mana ge its affairs and also to ensure efficiency and tr ansparency, the S MC sha ll elect a cha ir per son and vice cha ir person from amongst the parent members. The Head Teacher of t he school or where the school does not have a Head Teacher, the senior most teacher of the school sha ll be the ex–officio member of the SMC. (4)The SMC sha ll meet at least once in thr ee months and the minutes and decisions of t he meetings sha ll be properly recorded and made available to the public. Ex-106/20168 (5)Any grant r eceived by the SMC for the discharge of it s funct ions under these Regula tions a nd any other la w in force, shall be kept in a separa te account to be made availa ble for inspection by any member of t he SMC at any time during office hour. (6)The accounts refer red to in this Section should be signed by the chairperson, vice chairperson and ex–officio member of the SMC and made available to the concerned authority for inspection at least once in every three months. Respons ibilities10.(1)A school established under the provisions of these Regulations and duties ofor any other law in force, shall ensure that children belonging to School.weaker section and disabled group are not segregated from other children in the class rooms and that their classes are not held at pla ces a nd timings different fr om the cla sses held for the other children. (2)The school referred to in sub–section (1) above shall ensure that children belonging to weaker section and disabled groups are not discriminated from the rest of the children in any manner pertaining to a ll kinds of entitlements and facilities, if any, such a s textbook, uniform, etc. (3)Every school, aided and funded by the District Council, shall provide free and compulsor y elementary education to all childr en admitted therein. (4)No school shall, while admitting a child, collect any ca pitation fee and subject the child or his or her parents or guardian to any screening test or procedure. (5)Every school shall p rovide such information as may be required by the Government, concerned authority or local author ity, as the case may be (6)No child sha ll be denied admission in a school for lack of age proof. (7)For the pur poses of admission to elementary education, the age of a child shall be determined on the basis of the Birth Certificate issued in a ccordance with the provisions of the Births, Deaths and Marriages Registration Act, 1886 or on the basis of such other docu ments a s may deem appropria te and reasona ble. (8)No child sha ll be denied admission in a school if such a dmission is sought at the commencement of academic year or within such period as may deem reasonable by the school concerned, local authority or concerned authority, as the case may be.Ex-106/2016 9 (9)No child admitted in a school shall be held back in any class or expelled fr om school till the completion of elementary education. (10) No child shall be subjected to any kind of physical or mental harassment. (11)No child shall be required to pass any Board examination till completion of elementary education. (12) A child completing element ar y education sha ll b e awar ded a certificate, in such a form, as may be prescribed by the Board. Respons ibilities11.(1)It shall be the dut y and r esponsibility of every parent or guar dian and duties ofto admit or cause to be admitted his/ her child or ward, as the par ents/guardianscase may be, to an elementary education in the nearest or in and teachers.any other elementary school. (2)No teacher shall, while admitting a child, collect and receive any capitation fee and subject the child or his/her parents or guar dian to a ny screening test or procedure. (3)Every teacher shall ensure that no child is denied admission in his/ her school without reasona ble and sufficient reason. (4)A teacher must also ensure that no child is held back in his/her class or expelled from school till the completion of elementary school. (5)Every teacher must also ensure that a child in his /her school is not subjected to any kind of physical or mental harassment. (6)It shall be the duty and responsibility of teacher to ensure that the child belonging to weaker section and the child belonging to disabled group are not discriminated against and prevented fr om pursuing and completing elementary education on any grounds. (7)No teacher shall engage himself/herself in private tuition or private teaching activity. (8)The teacher shall not only impart elementary education to his/her students, but also instill good moral character and manner in them and must try his/her level best to be a r ole model to his/her pupils in all his/her way of life and conduct. Penalty of t hese12. (1)Whos oever contravenes any of the pr ovisions of sub–section (1) pr ovisionsof Section 7 of these Regulations shall be liable to be punished with a fine of not less than Rs. 10,000/– (Rupees Ten thousand) only which may be increased to such an amount by the Executive Committee from time to time. Ex-106/201610 (2)A teacher who commits default in performance of duties and responsibilit ies specified in sub–sections (2) t o (8) of Section 11 of these Regulations on proof may be liable to disciplinar y action under the service r ules applicable to him/her. Power to make Rules . 13.(1)The Executive Committee may make rules to carry out the purposes of t hese Regulations. (2)The rules, if any, made by the Executive Committee under sub– section (1) of this Section shall come into force on their publication in the Mizoram Gazette. Protection of action 14.No suit, pr osecution or other legal pr oceeding shall lie against the E x e- taken in good fa ith.cutive Committee or any officer duly authorised by the Executive Committee before any Court of Law for anything done or intended to be done under these R egulations. Each class room shall be well lighted and well ventila ted. 3.The School shall have toilet facilities separ ately for boys and girls. 4.It shall not employ any teaching staff or other allied staff possessing qualification less than what has been prescribed and approved. The number of teachers in Middle Section shall be at least 5 (five) and equal number of teacher in Primary Section. 5.The School shall appoint two IVth Grades. 6.It shall pa y salary to teaching a nd non–teaching staff as approved by the Executive Committee of Mara Autonomous District Council. 7.It shall be an institution which is cons idered by the Mara Autonomous District Council as one ser ving the real needs of t he people of the area to which the permission is gra nted. The Government of M izor am has learnt with profound s orrow, the sad and untimely demise of Pu C .Vanlalsawma, Junior Grade of M SS, Superintendent, Directora te of Transport (OP) on 3rd May 2016. Pu C.Vanlalsawma entered into Government Service as Tracer under Local Administra tion Depar tment (Town Planning) on 19th July, 1979. He was posted as Tracer in the Office of Chief Engineer, PWD (Town Planning Cell) w.e.f 1st August, 1983 and again posted back to Local Administration Department w.e.f 1st September, 1985. Upon his appointment to Assistant Grade through direct recr uitment, he was posted in the Office of Institutiona l Finance and S tate Lottery w.e.f. 24th May, 1988. After that, he was posted in Agriculture Depa rtment a nd Dte. of Disa ster Mana gement and Reha bilitation. He was promoted to Junior Grade of MSS on 25th March, 2013 and posted as Superintendent in the Directorate of Transport (OP) where he served till his sad demise. He served the Govt. of Mizoram for 36 (thirty six) years, 9 months and 14 days in var ious capa cities with utmost sincerity and devotion, and endeared himself to all his colleagues. He always proved himself to be a conscientious Officer. The Government pla ces on record its deep appreciation of the sincere services rendered by Pu C.Vanlalsawma and conveys its heartfelt sympathy and condolence to the bereaved family. FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisor y Board will be the Screening Board in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board sha ll have to judiciously examine the applica nt’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board shall have its sittingat least twice in a year or as may be required and TA shall be given to the members of the Boar d if the place of sit ting is more than 8 (eight) kilometer from the headquarter of the member. The S ecretar y SAAB shall issue Meeting Notice in consultation with the Chairma n by giving at least 10 (ten) days in advance to the member of S AAB. 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (Land Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any ca tegory or purpose must be submitted to the Settlement Officer or Assista nt Settlement Officer if Chairman of SAAB is the Deputy C ommissioner of the Dis t rict . In cas e, C hair ma n of SAAB is S DO (C) or BDO or Pr esident , Villa ge Cou ncil t he a pp lica t ion for land allotment of any category must be submitted to the concerned Chair man. - 2 - Ex-112/2016 5.The Board shall make initial screening of the a pplication with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land by Surveyor, Revenue Depa rtment in the presence of the applica nt, the concerned VC and neighbouring land holder, if any. Measurement of land should be a ccurate and NOC sha ll be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. The recommendation of the meeting of Board shall be submitted to the concerned District Revenue Officer for fur ther submission to the Government through the Dir ector, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one applicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to fu ture infrastructure development wor k of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended fr om time to time. 9.The term of the Boa rd shall be three year s. The Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public. In exercise of the powers conferred by proviso to a rticle 162 of t he Constitution of India, the Governor of Mizoram hereby makes the following rules to amend the Mizoram Ministers, Leader of Opposition and Parliamentary Secretar ies (Discretionary Gr ant) Rules, 2009 (hereinafter r eferred to as the Principal Rules) as follows, namely :- 1.Amendment of short 1. “These Rules may be called The Mizoram Ministers, Leader of Title and Opposition, Parliamentary Secretaries and Deputy Government Chief Commencement Whip (Discr etionary Grant) (Amendment) Rules, 2016.” 2. They shall come into force with effect fr om the date of publica tion in the official Ga zette of Mizoram. 2. Amendment of Rule 2 Rule 2 of the Principal R ules shall be substituted as follows :- Save as provided in these rules, “These rules shall apply to all Ministers, Leader of Opposition, Parliamentary Secr etaries and Deputy Govt. Chief Whip of Mizor am.” 3. Amendment of Rule 3 After sub-rule (7) of rule 3 of the Principal Rules, a new sub rule (8) shall be added as follows :- “(8) Deputy Govt. Chief Whip means an MLA appoint ed as such”. 4. Amendment of Rule 4 After clause (e) of sub-rule (1) of rule 4 of the Principal Rules, a new clause (f) shall be inserted as follows :- “(f) Deputy Govt. Chief Whip - Rs. 3.00 lakhs p.a.”. 5. Amendment of Rule 5 After sub-rule (4) of rule 5 of the Principal Rules, a new sub-rule (5) shall be added as follows :- “(5) A proposal for sanction and disbursement of the Discretionary Grant for the Deputy Govt. Chief Whip shall be dealt with and drawn by the Parliamentary Affairs Department.” 6. Amendment of Rule 6 In s u b -r u le (2 ) of r u le 6 of t he P r inc ip a l R u les , t h e wor ds “ or Dep u t y Govt. Chief Whip” shall be inserted after the word “Pa rliamentary Secretary”. In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Mizoram is pleased to make the following rules to amend the Mizoram Standing Counsel for the Government (Appointment and conditions of Service) Rules, 2009, namely :-Shor t title and 1.(1) These rules may be called the Mizoram Standing Counsel for the Government commencement (Appointment and Conditions of S ervice) (Amendment) R ules, 2016. (2) They shall come into for ce at once.
