WHEREAS, in exercise of the power conferred by Section 3 (7) of the Lushai Hills Distr ict (Village Councils) Amendment Act 2014 and Rule 3 (1) of the Mizoram (Election to Village Councils) Rules 2014, the State Election Commission called upon all the Village Council Constituencies, including MZ-VC 02/17 Chawngte ‘L’ Village Council Constituency, to elect members of Village Council on 30th April 2015 vide Notification No.B.12011/57/2014- SEC/VC dt 6th April 2015. WHEREAS, counting of votes was held immediately after the poll is over, and in exer cise of the power conferred by Rule 77 of The Mizoram (Election to Village Councils) Rules 2014, the Retur ning Officer of MZ-VC 02/17 Chawngte ‘L’ Village Council Constituency published an Election Result forthwith as under. Firstly, the Returning Officer allegedly disallowed the counting agents to be seated near the counting tables during counting of votes. Secondly, after conclusion of counting, the Returning Officer turned down the request of the candidates to r e-examine all the ballot s and to recount the votes. THEREFORE, in exer cise of the power conferred by Rule 86 of The Mizoram (E lection to Village Councils) Rules 2014, the State Election Commission vide No. B.14015/3/2015-SEC dt. 20.5.2015 constituted an Election Tribunal for Lunglei District to consider the aforesaid election petition. AND WHEREAS, the Election Tribuna l having heard of all responsible officials in connection with the election to MZ-VC 02/17 Chawngte ‘L’ Village Council Constituency election including the Petitioner and thoroughly examined all election documents by way of re-count of t he ba llot papers, the Elect ion Tribunal, in exercising their power conferred by Rule 89 (2) of T he Mizoram (Election to Villa ge Councils) Rules, 2014, Dismissed the Election Petition. Leisenzo M/S on the 23rd September, 2015 at 8:40 PM. Born on 15.7.1971, Pu C. Lalmuankima entered service as a teacher at Deficit M/S, Lungphunlian on 12.6.1996. He was promoted to the post of Headmaster, Govt. M/S on 1.11.2002 and posted a t Lungphunlian Deficit M/S. He was confirmed to the post of Headma ster, Govt. Lungphunlian M/S on 26.3.2007. During his tenure as Headma ster, Govt. M/S , he was posted at Govt. Lungphunlian M/S, Govt. Tualcheng M/S and Govt. Leisenzo M/S. He served the Government with utmost sincerity and devotion to duty till he breathed his last. The Govt. of Mizoram places on record its deep appreciation of the sincere services rendered by Pu C. Lalmuankima and conveys its heartfelt sympathy and condolence to the bereaved family. K. (2) They shall come int o force from the date of their publica tion in the Official Gazette. 2. Application These Rules shall apply to the posts specified in Column I of Annexure-I her et o a nnex ed. 3. Number of posts, The number of the said post(s), classification, Pay/Pay Band & Grade Pay classification and scale attached thereto shall be as specified in Column 2 to 4 of the said of pa y/Pay Ba nd & Annexure-I Grade Pay 4. Method of r ecruitment, The method of recruitment, age limit, qualifications and other matters age limit and other relating to the said post shall be as specified in Column 5 to 14 of qualifications Annexure-I. Provided that the upper a ge limit pr escribed for dir ect r ecruit ment may be relaxed in the case of candidates belonging to the Scheduled Ca stes /the Scheduled Tr ibes and other special categories of persons in accordance with the or ders issued by the Central Government or Government of Mizora m from time to t ime. 5. Disqualification No per son – (a ) Who has entered into or contracted a mar riage with a person having a spouse living; or - 2 - Ex-498/2015 (b) Who, having a spouse living, has entered into or contract ed a marr iage with any person shall be eligible for appointment to the said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the ot her par ty to the mar ria ge and tha t ther e are other valid grounds for doing so, exempt a ny such person from the operation of these Rules. 6.Training and Every Gover nment servant r ecruited under these Rules shall undergo Departmental such training or pass such Depa rtmental Examination as may be Ex amination pres cribed from time to t ime. 7. Power to transfer Notwithstanding anything contained in these Rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these Rules to any other post or position which is equivalent in ra nk or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be recorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of t he provisions of these Rules with respect to any class or category of persons. 9. Reservation and Nothing in t hese Rules sha ll affect any r eservations, relaxation of other concessions age limit and other concessions required to be provided for the Scheduled Castes/the Scheduled Tribes and other categories of persons in accordance with the order issued by Centr al Government or Government of Mizoram from time to time in this regard.
