FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The site Allotment Advisory Boar d will be the Screening Board in the ma tter of applica tion for allotment of land for agricultural and non-agricultural purposes. 2.The Board shall ha ve to judiciously examine the applicant’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board shall have its sittingatleast twice in a year or as may be required and TA shall be given to the members of the Board if the place of sitting is more than 8 (eight ) kilometer from the headquarter of the member. T he Secreta ry SAAB shall issue Meeting Notice in consultation with the Chairman by giving at least 10 (ten) days in adva nce to the member of S AAB. 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (L and Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any category or purpose must be submitted to the Settlement Officer or Assistant Settlement Officer if Chairman of SAAB is the Deputy Commissioner of the District. In case, Chair man of S AAB is SDO (C) or BDO or President, Village Council the application for land allotment of any category must b e submitted to the concerned Chair man. 5.The Board shall make initial screening of the application with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land b y Surveyor, Revenue Depar tment in the pr esence of the applica nt, the concerned VC a nd neighbouring land holder, if any. Measurement of land should be accurate and NOC shall be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. T he recommendation of the meeting of Board sha ll be submitted to the concerned District Revenue Officer for further submission to the Government through the Director, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the a rea or potentia l obstr uction to future infra structure development work of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroa chment) Act, 2001 as a mended from time to time. 9.The term of the Boa rd shall be three year s. (1) These Regulations may be called the Mizoram Public Service Commission (Limitation of Functions) (Sixth Amendment) Regulations, 2013. (2) They shall come into force from the date of their publica tion in the Official Gazette. Amendment of Regulation 4-2.Clause (b) Regulation 4 of the Principal Regulations shall be substituted as follows, namely:- “(b) Promotion from a lower to a higher grade or post in respect of all posts of Group ‘B’ (Non-Gazetted) and below”. In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and all other powers enabling him in this behalf, the Governor of Mizora m is pleased to make the following Regulations to amend the Mizoram Civil Services (Combined Competitive Examination) Regulations, 2011 (hereinafter referred to as the Principal Regulations) which was notified under No.A.45011/1/2010-P&AR(GSW) dated the 3rd February, 2012 and published in the Mizoram Gazette Extraordinary Issue No.59 dated the 9th February, 2012, namely: 1.Shor t Title and (1 ) These Regula tions ma y be called the Miz or a m Civil Services (Combined commencement Competitive Examina tion) (S econd Amendment) Regulations, 2014 (2) These Regula tions shall come into force from the date of publica tion in the Official Gazette 2. Amendment of (1) In the Principal Regulations, clause (ix) of Regulation 3 shall be Regulation 3 substituted, namely, “The Commission shall prepare a combined final ranking list of successful candidates and publish the same through media a nd intimate to the successfu l candida tes . If two or mor e ca ndida tes obtained equ al mar ks, the Commission shall arrange them in order of priority as shown below: (a ) The total ma rks obta ined by the candidates in General Studies. (b) The age of the candidates with candidate having higher age coming before the candida te with lower age ” (2) In the Principal Regulations, clause (x) of Regulation 3 shall be substituted, n a me l y, “The Commission shall send a list of selected candidates service- wise for appointment to the concer ned cadre contr olling authorities” 3. Amendment of (1) In the Principal Regulations, clause (iii) of Regulation 4 shall be substituted, Regulation 4 n a me l y, “He must have attained the age of 21 years but must not have exceeded the age of 32 years on 1st Apr il of the year in which the - 2 - Ex-255/2014 examination is held. (This prescribed upper age limit will supersede the age limit pr escribed in the concerned Service Rules of the respective Services, i.e Mizoram Civil Service, Mizoram Police Service, Mizoram Finance & Accounts Service and Mizoram Information Service). Provided tha t the upper age limit of 32 years shall be effective from the 1st Apr il, 2018 befor e which candida tes who have not exceeded the a ge of 35 years on 1st Apr il of t he year in which the examina tion is held shall be a llowed to write the examina tion Provided that the upper age limit prescribed in Notification No. A.36012/1/2005-P&AR(GSW) dt. 07.07.2006 shall not be applicable for this R egulation. Provided that the upper age limit may be relaxable upto a maximum of 5 years in respect of ca ndidate belonging to t he Scheduled Ca ste/ Scheduled Tribe. Provided further that Persons With Disabilities belonging to Scheduled Castes and Scheduled Tribes will be eligible for age relaxa tion of ten year s over and above the age relaxation of 5 years admissible to them as Scheduled Caste/ Schedu led Tr ibe” 4.Amenement of (1) In the Principal Regulations, sub-clause (i) of clause (2) of regulation Regulation 9 9 shall be substituted, namely, “The Main Examination sha ll comprise of written examination and personal interview. T he written examination will consist of six compulsory papers carrying 100 marks each and one optional subjects of two papers each as listed under regulation 10, and each Paper will carry 100 marks” 5. Amendment of (1) In the Principal Regulations, the following shall be inserted under Regulation 10 Regulation 10(A) Compulsor y Subjects, namely, “(v) General Studies III (vi) Gener al Studies IV” 6. Amendment of (1) In the Principal Regulations, the entire provision of Regulation 12 Regulation 12 BAR TO COMBINATION OF SUBJECTS shall be deleted 7. Amendment of (1) In the Principal R egulations, the syllabus of General Studies at Serial Schedule-I N o. 3 G en er a l S t u di es ( I & II ) u nd er t he s u b -h ea di ng C OM P UL S ORY SUBJECTS of heading B. MAIN EXAMINATION under Schedule- I shall be substit uted with the syllabus as shown in Annexure-I (2) In the Principal Regulations, the syllabus for Home Science under the sub-heading OPTIONAL S UBJECTS of heading B. MAIN EXAMINATIO N under Schedule-I shall be substituted with the syllabus as shown in Annexur e-II (3) In the Regulations, entries under Sl. No. 1 of the Expla nation u nder the heading A. T he questions will be such as to test a candida te’s general awar eness of a variety of subject s, which will have relevance for a car eer in Civil S ervices. The questions ar e likely to test the candidate’s basic understanding of all relevant issues, and ability to analyze, and take a view on conflicting socio-economic goals, objectives and demands. The ca ndidates must give relevant, meaningful and succinct answers . FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisory Board will be the Screening Board in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board s hall have to ju diciously examine the applicant’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board s hall ha ve its s itting at least twice in a year or as may be required and TA sha ll be given to the members of the Boa rd if the pla ce of sitting is mor e tha n 8 (eight) kilometer from the headquarter of the member. T he Secretar y SAAB shall issue Meeting Notice in consultation with the Chairma n by giving at least 10 (ten) days in advance to the member of S AAB. - 2 - Ex-256/2014 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (Land Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any ca tegory or purpose must be su bmitted to the Settlement Officer or Assista nt Settlement Officer if Chairman of SAAB is the Deputy C ommissioner of the District. In case, Chairman of SAAB is SDO (C) or BDO or President, Village Council the application for land allotment of any Category must be submitted to the C oncerned Chair man. 5.The Board shall make initial screening of the a pplication with regard to location of the applied site. After a summary scr eening, the Board shall place the matter for demarcation of land b y Surveyor, Revenue Depa rtment in the presence of the applica nt, the concerned VC and neighbouring land holder, if any. Measurement of land should be accurate and NOC shall be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. T he recommendation of the meeting of Board shall be submitted to the concerned District Revenue Officer for further submission to the Government through the Director, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon pu blic safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to future infrastructure development wor k of the Government. It shall also take into account that the allot ment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended fr om time to time. 9.The term of the Boa rd shall be three year s. T he Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public. R.L. In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules regulating the method of recr uit ment to the post of Assistant Engineer under Trade & Commerce Department, Government of Mizor am, namely: 1.Shor t title and (1) These Ru les may be called the Mizor am Tr ade & Commerce commencement - Department (Group ‘A’ post) Recruitment Rules, 2014. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application - These rules sha ll apply t o the posts specified in column 1 of Schedule annexed to these rules. 3. Number of posts, The number of the said post(s), their classification, Pay Band and classification, pay band Grade pay/Pay scale attached thereto shall be as specified in columns and grade pay/pay sca le - 2 to 4 of the aforesa id Schedule. 4. Method of The method of recruitment to the sa id posts, age limit, qualifica tion recr uitment, age and other matters r elating thereto shall be as specified in columns 5 limit, qualifications, etc - to 14 of the said schedule. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram, as the case may be from time to time. 5. Disqualification - No person, - (a) who has entered into or contra cted a marriage wit h a person having a spouse living; or - 2 - Ex-260/2014 (b) who, having a spouse living, has entered into or contracted a marr iage with any other person, shall be eligible for appointment to the said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other gr ounds for doing so, exempt any such person from the operation of this r ule. 6.Training and Every Government servant recruit ed under these rules shall u ndergo such Departmental training or pass such Departmental Examination (s) as may be prescribed Examination - fr om time to time. 7. Powers to transfer - Notwithstanding anything contained in these rules, the Governor of Mizoram, in p u b lic int er es t , s ha ll ha ve t he p ower t o t r ans fer a ny Officer (s ), s o r ecr u it ed under these rules to any other post or position which is equivalent in rank or grade. 8. Power to relax - Wher e the Governor is of the opinion that it is necessary or exp edient s o to do, he ma y, by order and for reasons to be recorded in writing and in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax a ny of the provisions of these rules with respect to any cla ss or category of persons. 9. Reservation and Nothing in these rules shall affect reservation relaxation of age limit and other concessions - other concessions required to be provided for the Scheduled Tribes/the Scheduled C astes a nd other categories of persons in a ccordance with the orders issued by the Centra l Gover nment or the Government of Mizoram from time to time in this regard.
