In the interest of Public Service and as envisaged under Chapter V, section 43 (3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Government of Mizoram is pleased to notify that every police officer may, keeping in view the nature and gravity of offence, use handcuff while making the arrest of a person or producing such person before the court, who is a habitual or repeat offender, or who escaped from custody, or who has committed offence of organized crime, terrorist act, drug related crime, or illegal possession of arms and ammunition, murder, rape, acid attack, counterfeiting of coins and currency notes, human trafficking, sexual offence against children or offence against the State.

In the interest of Public Service and as envisaged under Chapter XIII, section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Government of Mizoram is pleased to notify that every information relating to the commission of a cognizable offence, irrespective of the area where the offence is committed, may be given by electronic communication to an officer-in-charge of a Police Station, and if given, it shall be taken on record by him on being signed within three days by the person giving it.

However, no male person under the age of fifteen years or a woman or a mentally or physically disabled person or a person with acute illness shall be required to attend at any place other than the place in which such person decides. Further, if such person is willing to attend at the Police Station, such person may be permitted to do so.

Further, each Officer-in-Charge of a Police Station shall depute such empowered officials only after scrupulous assessment and being satisfied of the suitability and capabilities of the official concerned.

While the provision of section 531 (2) (b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 protects all existing notification published, proclamations issued, powers conferred, forms provided by rules, local jurisdiction defined, sentences passed and orders, rules and appointments, not being appointments on special magistrate made under the old code i.e., Code of Criminal Procedure, 1973 and which are in force immediately before the commencement of the Bharatiya Nagarik Suraksha Sanhita, 2023 shall be deemed, respectively to have been published, issued, conferred, specified, defined, passed or made under the corresponding provisions of the Sanhita.
However, in view of the changes made in the three new criminal laws, all administrative departments under the Govt. of Mizoram are requested to make all such amendments/changes in their Act/ rules/ regulations/ orders/ instructions wherein specific sections of the Code of Criminal Procedure, 1973, Indian Penal Code, 1860 and The Indian Evidence Act, 1872 are mentioned. Until such time the appropriate amendments are made, the provisions of the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023 will apply mutatis mutandis.

Direction to DISCOM Department for strict compliance
The minutes of meeting to discuss the status of action points of 3rd National Conference of Chief Secretaries held from 27th to 29th December, 2023 on ‘Ease of Living’ held on 2nd April, 2024 at 10:15 AM at 2nd Floor Conference Hall, Shram Shakti Bhawan under the Chairmanship of the Secretary, Ministry of Power, Government of India reviewed the implementation by the states of the directions issued in the Chief Secretaries Conference. Some action points emerged from the discussions for consideration and implementation by all SERCs. In compliance of these directions, the Commission hereby issued direction to DISCOM/ Department for strict compliance that no technical feasibility study for roof top Solar (RTS) Systems is required for upto 10kW in partial relaxation of clause 7.6 of the JERC for Manipur and Mizoram (Metering for Grid Connected Renewable Energy) Regulations, 2016. This direction shall be effective from the date of publication in the Gazette of Mizoram Extraordinary and until further order.

Pu H.C. Lalmalsawma as Chairman of the Sinlung Hills Council
Consequent upon the removal of Pu Lalmalsawma Darngawn, Chairman of Sinlung Hills Council as per Rule 4 and Rule 82 of the Sinlung Hills Council (Procedure and Conduct of Business) Rules 2021 and in pursuance of the provision contained in Rule 23(6) of the Sinlung Hills Council (Procedure and Conduct of Business1 Rules 2021. the Governor of Mizoram is pleased to appoint Pu H.C. Lalmalsawma as Chairman of the Sinlung Hills Council with immediate effect and until further orders.

Whereas, the State Government of Mizoram, in pursuance of section 6 of the Delhi Special Police Establishment Act, 1946 hereby gives its Consent to the extension of powers and jurisdiction of the members of the Delhi Special Police Establishment in the whole State of Mizoram for investigation of the offences or classes of offences notified under section 3 of the Act, as amended from time to time, alleged to have been committed by employees of the Central Government, Central Public Undertakings and Private persons ( whether acting separately or in conjunction with the employees of Central Government/Central Government Undertakings). Subject, however, to the condition that no such investigation shall be taken up in cases relating to the public servants controlled by the State Government of Mizoram except with the prior written permission of the State Government. All previous general consent for any other offence by the State Government shall also remain in force.
