Appointment of Advocate General for the State of Mizoram, 2024

In exercise of the powers conferred by article 165 of the Constitution and in supersession of this Department’s Notification No. A.45012/3/2019-LJE dt. 30.03.2021, the Governor of Mizoram is pleased to lay down the terms and conditions of appointment of Advocate-General for the State of Mizoram, 2024.
1. Appointment.-
The Advocate-General shall be appointed in accordance with the provisions of article 165 of the Constitution and he shall hold office during the pleasure of the Governor of Mizoram.
2. Renumeration.-
The renumeration payable to the Advocate -General, Mizoram shall be as given in Annexure-I.
3. Statutory Duties.-
To attend meetings of the Legislative Assembly and Committee thereof.
The Advocate-General shall attend the meeting of the Mizoram Legislative Assembly and the Committee of the Legislature, when so required by the Government.
4. Adviser to Government.-
a) The Advocate-General shall advise the Government on such legal matters, including proposition of legislations, on which he may be consulted and perform such other duties of a legal character as may, from time to time, be specified in the rules or as may, from time to time, be referred to or assigned to him by the Secretary, Law & Judicial Department.
b) He shall also advise the Government in respect of proceedings whether civil or criminal, which he may be required to conduct on behalf of the state or its officers.
c) Advise on any matters on which he is consulted by the Governor, Law & Judicial Department or directly by the Chief Secretary to the Government of Mizoram.
d) He shall ordinarily entertain reference from a Government Department through the Secretary, Law & Judicial Department.
e) He shall supply to the Secretary, Law & Judicial Department, copies of the opinions or advice given by him directly to any other, Government Department along with the notes containing the points of reference made to him (except in such confidential matters where its disclosure would not be appropriate).

Engagement of Appointing Authority

In the interest of public service and in supersession of this department Notification No. A.45017/2/09-LJE, dated 25th August, 2009 published in the Official Gazette vide Issue No. 421 dated 26.08.2009 except things done or omitted to be done before such supersession, the State Government of Mizoram is pleased to make the following terms & conditions for engagement of Standing Counsel for the State of Mizoram in the Supreme Court, 2024.
1. Definition:-
a) “Appointing Authority” means the Governor of Mizoram.
b) “Government” means the State Government of Mizoram.
c) “Standing Counsel” means an advocate appointed by the Governor of Mizoram for the State of Mizoram to represent and defend the State in the Supreme Court, High Court, Tribunals and all other Quasi Judicial Fora and shall include an Additional Standing Counsel.
2. Qualifications and term for appointment:
(i) No person shall be eligible for appointment as Standing Counsel unless he is designated as an Advocate-on-Record in the Supreme Court of India and having continuously practised in the Supreme Court as an advocate for not less than ten years.
(ii) All engagement of Standing Counsel are to be co-terminus with the term of the Ministry or its pleasure thereof subject to approval for re-engagement.
3. Headquarters:
The headquarter of the Standing Counsel shall be New Delhi.
4. Duties of the Standing Counsel:
(i) to give advice to the Government upon such legal matters, and to perform such duties of legal character, as may from time to time, be referred or assigned to him by the Government;
(ii) to appear , on behalf of the Government whenever required, in the Supreme Court or in any High Court in cases (including suits, writ petitions, appeals and other proceedings), and in Tribunals and all other Quasi Judicial Fora in which the Government is arrayed as a Party or is otherwise interested.
(iii) to discharge such other legal functions as may be specifically entrusted to the Standing Counsel by the Government from time to time.

conferred by the proviso to article 309 of the Constitution and in supersession of the Mizoram Home
(Police) Department (Group ‘A’ posts) Recruitment Rules, 2016 notified in the Mizoram Gazette
extraordinary issue number 127 dated 24.3.2017 and the Mizoram Home (Police) Department (Group
‘A’ posts) Recruitment Rules, 2013 notified in the Mizoram Gazette extraordinary issue number 197
dated 9.5.2014, except as respects things done or omitted to be done before such supersession, the
Governor of Mizoram hereby makes the following rules regulating the method of recruitment to the
posts of Superintendent of Police (Ministerial), Additional Superintendent of Police (Ministerial)
and Deputy Superintendent of Police (Ministerial) under Home (Police) Department, Government of
Mizoram namely :-

Terms and Conditions for engagement of Government Advocates, Government of Mizoram, 2024

In the interest of public service and in supersession of this department Notification No. A.45017/2/09-LJE dated 29th April, 2016 published in the Official Gazette vide issue No. 384 dated 30.09.2016 except things done or omitted to be done before such supersession, the State Government of Mizoram is pleased to make the following Uniform Terms and Conditions for engagement of Government Advocates, Government of Mizoram, 2024.
1. Definition:
(a) “Advocate” means an Advocate as defined in the Advocates Act, 1961 (Central Act No. 25 of 1961).
(b) “Appointing Authority” means any Secretary to the Government of Mizoram, of the Departments listed under the Mizoram (Allocation of Business) Rules, 2019.
(c) “Government” means the Government of Mizoram.
(d) “Government Advocate” means an Advocate engaged or empaneled as such by the Government to enter appearance in any Court of Law including Tribunal, Quasi Judicial Fora on its behalf and it shall include:-
(i)
Additional Advocate General/Public Prosecutor in the Gauhati High Court.
(ii)
Government Advocate/Additional Public Prosecutor in the Gauhati High Court.
(iii)
Government Advocate/Public Prosecutor in the District Courts in Mizoram.
(i
v) Additional Government Advocate/Additional Public Prosecutor in the District Courts in Mizoram.
(v)
Assistant Government Advocate/Assistant Public Prosecutor in the District Courts in Mizoram.
(v
i) Standing Counsel and Assistant Standing Counsel engaged by concerned departments.
2. Qualification for engagement:
(1) No person shall be eligible for engagement as a Government Advocate unless he holds a degree in law from a recognized university and who is a registered Advocate under the Bar Council and has been in continuous practice for a period of not less than -
(a)
10 years for Additional Advocate General/Public Prosecutor of the High Court and Government Advocate/Public Prosecutor of the District Courts.
(b)
7 years for Government Advocate/Additional Public Prosecutor of the High Court.
(c)
7 years for Additional Government Advocate/Additional Public Prosecutor of the District Court.

R. Sangthanpuii
