In exercise of the powers conferr ed by Section 15 of the Industrial Employment (Standing Orders) Act, 1946 (20 of 1946) the Governor of Mizoram is pleased to make the following rules, namely :- 1 . Short title, extent and commencement:- (1) These Rules may be called the Mizoram Industrial Employment (Standing Orders) Rules, 2013. (2) They shall extend to the whole State of Mizoram. (3) These Rules shall come into force from the date of their publication in the Official Gazette. 2 . In these Rules, unless there is anything repugnant in the subject or context:- (a) “Act” means the Industrial Employment (Standing Orders) Act, 1946(20 of 1946); (b) “For m” means a form set out in the Schedule appended to these Rules; (c ) “Wor ds and expressions” used in these Rules but not defined shall have the meaning assigned to them in the Act. 3.The model standing orders for the purpose of the Act for application to the industr ial establishments shall be those set out in Schedule I. 4.Application for certifica tion of Standing Orders sha ll be in Form ‘A’. 5.The draft standing orders submit ted to the Certifying Officer shall be accompanied by a statement in For m ‘B’ giving the following particula rs in respect of the wor kman employed in the industr ial establishment:- (1) Number of workmen (classified into men, women and children) employed under the following ca tegor ies:- ( a ) Skilled (b) Unskilled (c ) Clerica l (d) Others, if any (e) Total (2) Number of workmen cla ssified into (a) Permanent (b) Temporary (c) Casual (d) ‘Badli’ or substitute 6.(a ) Five copies of the Draft S tanding Order which an employer proposes t o adopt for his industrial esta blishment shall be forwarded by registered post t o the certifying officer. (b) A group of employers in similar industr ial esta blishment may submit a joint draft of standing orders, provided t hat five times as many copies of the draft s shall be made as the number of industrial establishments to which the joint draft is to apply. (c ) Such joint drafts shall be accompanied by statements prescribed by Rule 5 in resp ect of each of the industrial est ablishments. 7.On r eceipt of the standing orders submitted by an employer the certifying officer, shall, as soon as practicable- (i) Cause copies thereof together with notice in Form ‘C’ to be affixed on the notice board of the Industrial establishment concerned for the information of the workmen of the said establishment and (ii) Shall forward by r egistered post copies of the draft standing orders and of the notice in Form together with notice in Form ‘D’ to the trade union or unions named by the employer in the statement submitted by him in Form ‘C’ and to any other trade union or unions which in the opinion of the Certifying Officer are concerned with the establishment. 8. (1) Wher e there is no t rade union in a n industrial establishment, the Certifying Officer shall cause a meeting of the workmen to be held on a date fixed by him for the purpose, for the election of four repr esentatives of the workmen concerned from among themselves. (2) The Certifying Officer may require the employer or an officer of the indu strial establishment to display a notice of the date, time and place of the meeting in a prominent place a t or near the main gate of the establishment. (3) The meeting shall be convened, and presided over by the certifying officer or such person as the certifying officer may by special or general Order specify for the purpose. (4) The workmen declar ed elected at the meeting by the person pr esiding shall be the representatives of the workmen for the purpose of the Act and these rules to whom the certifying Officer shall for ward a copy of the draft standing orders and of the notice in For m ‘C’ together with notice in Form ‘D’. 9.The standing orders certified by t he certifying officer or the a ppellate author ity sha ll be a uthenticated by affixing thereto the signature and the seal of the cer tifying officer or the appella te authority as the case may be. The s tanding orders shall be forwarded by registered letter post. 10. The register of standing orders r equired to be maintained under Section 8 shall be in Form ‘E’ 11. A copy of t he certified Standing Orders under Section 8 of the Act may be obt ained by any person from the Certifying Officer by presenting an a pplication affixing a Court Fee sta mp of Rupees Fifty and furnishing copy stamped papers of R upees Ten for every hundred words or fraction thereof.- 2 - Ex-307/2013 12.(1) Any person desiring to prefer an appeal against an order of the Certifying Officer shall draw up a Memorandum of Appeal setting ou t the grounds of appeal and forward it to the Appellate Authority in quadruplicate, accompanied by a certified copy of t he standing orders. (2) The Appellate Authority shall, after giving the appellant an opportunity of being heard, unless it comes to the conclusion that the decision of Certifying Officer is contrar y to la w or ot herwise erroneous, confirm the standing orders as certified by him. (3) Wher e the Appellate Author ity does not confirm the standing or ders it shall fix a date for the hearing of the appeal and direct notice thereof to be given:- (a) Where the appeal is filed by the employer of workman, to trade unions of the industrial esta blishment and where there are no such trade unions to the representatives of wor kman elected in accordance with the provisions of Rule 8, or (b) Wher e the a ppeal is filed by a trade union, to the employer a nd all other trade unions of the esta blishment or (c ) Wher e the ap peal is filed b y the r epresent atives of wor kmen to t he employer. (d) The appella nt shall furnish each of the respondents with a copy of the memorandum of appeal. (4) The Appella te Authority may at a ny stage call for any evidence it considers necessary of the appeal. (5) On the date fixed u nder Rule 12 (3) for the hear ing of the appeal, the author ity shall take such evidence as it may have called for and considers to b e relevant. 13.(1) Files rela ting to t he appeals preferred u nder the Act shall be preserved for t hr ee years. (2) After the expiry of the sa id period of t hree years, the records may be destr oyed either by treating or by burning in the presence of the Labour Officer provided, however, that records of secret of confidential nature shall be destroyed only by burning. The records destroyed by tearing may be sold or otherwise disposed of in such manner as the Certifying Officer thinks fit. 14. Guidelines for Prevention of Sexual Harassment of Women in Work places : (l) Duty of the employer or other resp onsible persons in work places and other institutions: It shall be the dut y of the employer or other responsible persons in work places or other institutions to prevent or deter the commission of acts of sexu al harassment a nd to provide the procedure for the resolution, settlement or prosecution of acts of sexua l harassment by taking all steps required. (2 ) Definition: For this purpose, sexual harassment includes such unwelcomed sexually determined behavior (whether directly or by implication) as : (a ) physical contact and advances; (b) a demand or request for sexual favours; (c ) sexua lly-coloured remarks; (d) showing pornogra phy; ( e) any other unwelcome physica l, verbal or non-verba l conduct of sexual nature. Wher e any of these acts is commit ted in circumstances whereunder the victim of such conduct has a reasonable apprehension that in relation to the victim’s employment or work whether she is dra wing sala ry, or honorar ium or volunta ry, whether in government, public or private enterprise such conduct ca n be humiliating and may constitute a health and safety problem. It is discriminatory for instance when the women has reasonable grounds to believe that her objection would disadvantage her in connection with her employment or work including recruiting or promotion or when it creates a hostile work environment. Adverse consequence might be visited if the victim does not consent to the conduct in question or raise any objection thereto.- 3 -Ex-307/2013 (3)Preventive steps: All employers or persons in charge of work places whether in the public or private sector should take appr opriate steps to prevent sexual har assment. Without prejudice to the generalit y of this obligation they should take the following steps: (a ) Express prohibition of sexual harassment as defined above at the work places should be notified, published and circu lated in appropriate ways. (b) The Rules/Regulations of Government and Public Sector bodies relating to conduct and discipline should include rules/regulations p rohibiting sexual hara ssment a nd provide for appropr iate penalties in such rules against the offender. (c ) As r egard p rivate employer s steps should be taken to include the aforesaid prohibit ions in the standing orders under the Industrial Employment (Standing Orders) Act, 1946. (d) Appr opriate work conditions should be pr ovided in resp ect of work, leisure, health and hygiene to further ensure that there is no hostile environment towards women at work places and no woman employee should have reasonable grounds to believe that she is disadva ntaged in connection with her employment. (4 ) Criminal proceedings: Wher e such conduct amounts to a specific offence under the Indian Penal Code or under any other law, the employer shall initiate appropriate action in a ccordance with law by making a compla int with the appropriate authority. In p articular, it should ensure that victim, or witnesses are not victimized or discrimina ted aga inst while dealing with compla ints of sexual harassment. The victims of sexual harassment should have the option to seek transfer of the perpetrator or their own transfer. If the allege harassment is found guilty, the complainant - victim is not forced to work with / under such har assment and where appropriate and possible the alleged harasser should be tr ansferred. Hara ssment and intimidation of witness a nd the complainants shall be met with s evere disciplinary act ion. (5)Discipline action: Wher e such conduct amounts to misconduct in employment as defined by the relevant service rules, appr opriate discip linary action should be initiated by the employer in accordance with those rules. (6)Complaint mechanism: Whether or not such conduct constitutes a n offence under law or a breach of the service rules, an appr opriate complaint mecha nism should created in the employer ’s organization for redress of the complaint made by the victim. Such complaint mecha nism should ensure time-bound treatment of complaints. (7)Complaint Committee: The complaint mechanism, r eferred to in Rule 14(6) above, should be adequate to provide, where necessary, a Compla ints Committee, a special counselor or other support service, including the maintenance of confidentia lity. The Complaints Committee should be headed by a woman and not less than half of its members should be women. F urther, to prevent the possibility of any undue pr essure or influence from senior levels, such Complaints Committee should involve a third party, either NGO or other body who is familiar with the issue of sexual harassment. The Complaint Committee must make an annual report to the Government Depar tment concerned of the complaints and action ta ken by them. The employers and persons-in-cha rge will also report on the compliance with the aforesaid guidelines including on the reports of the Complaint s Committee to the Government Department.- 4 - Ex-307/2013 (8)Workers’ initiative: Employees should be allowed to ra ise issue of sexual ha rassment at workers meeting and in other appr opriate forum a nd it should be affirmatively discussed in employer -employee meetings. (9)Awareness: Awar eness of the rights of female employees in this regar ds should be cr eated in particula r by prominently notifying the guidelines (and appropriate legisla tion when enacted on the subject) in a suitable manner. (10) Third-party harassment: Wher e sexua l harassment occurs a s a result of an act or omission by any third party or outsider, the employer and person-in-charge will take all steps necessary a nd reasonable to assist the affected person in terms of support and preventive act ion. (11) These guidelines will not prejudice any rights available under the Protection of Human Rights Act, 1993. Liant hangpuia, Stat e Co o rdinat or, CCDU, Public Healt h E ngineering Department at 10:00 AM on 27.6.2013. Er. C. Lianthangpuia was born on 13.9.1963 and entered into Government Service as Assistant Engineer under Public Health Engineering Department on 19.11.1990. He was promoted to Executive Engineer on 24.7.2007. During his entire tenure of 23 years, he had been serving in various capacities as Assistant Engineer/SDO, Executive Engineer under Public Health Engineering Department. And he was posted as State Coordinator, CCDU, PHE Department on 25.2.2013 where he served till he drew his last breath. He served the Government of Mizoram with utmost sincerity and devotion and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. The Government of Mizoram places on reco rd its appreciation of the sincere services rendered by Er. C. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLII Aizawl, Tuesday 2.7.2013 Asadha 11, S.E. 1935, Issue No. 330 NOTIFICATION No. B. 16017/85/2010-IND, the 21st June, 2013.In exercise of the powers conferred by section 30 r ead wit h sub-section (3) of section 21 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), the Government of Mizoram hereby makes the following rules, namely :- Preliminary 1.Short title, extent and commencement :- (1) These rules may be called the Mizoram Micro and Small Enterprises Facilitation Council Rules, 2012. (2) They shall extend to the whole of Mizoram State. (3) They shall come int o force with effect fr om 1st day of April, 2013. 2.Definitions -In t hese r ules, unless the context other wis e r equir es - (a) “Act” means the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006); (b) “Arbitration and Conciliation Act” means the Arbitration and Conciliation Act, 1996 (26 of 1996); (c ) “Council” means the Micro and Small Enterprises Facilitation Council, established by the State of M izoram under section 20 of the Act; (d) “Cha irperson” means the Chairperson of the Council appointed under clause (i) of sub-section (1) of section 21 of the Act; ( e) “Government” means the Government of Mizoram (f) “Institute” means any institution or centre providing alternate dispute resolution services referred to in sub-section (2) and (3) of section 18 of the Act; (g) “Member” mea ns a member of the Council; (h) “Section” means a section of the Act; (i) The words a nd expr essions used a nd not defined, but in the Act shall have the meanings assigned to them in the Act. 3. Manner of Appointment: (a) The Government shall appoint the representatives, specified in clauses (ii),(iii) or (iv) of Sub Section (1) of Section 21 of the Act as member of the Council. (b) When a member of t he Council dies or resigns or is deemed to have resigned or is removed from office or becomes inca pable of acting as member, the Government may by Not ification in the officia l gazette appoint a person to fill that vaca ncy. (c) A member, other than the Chairperson, shall hold office for a period not exceeding two years from the date of his appointment. (d) A member appointed under clauses (ii),(iii) and (iv) of sub-section (1) of section 21 of the Act shall cease to be a member of the council if he ceases to represent the ca tegory or interest from which he was so appointed. (e) Any member of the Council may resign from the Council by tendering one month's notice in writ ing to the Government. The power to accept the resignation of a member shall vest in the Government. (f) The Government may remove any member fr om office:- (i) if he is of unsound mind and sta nds so declared by a competent court; or (ii) if he becomes bankr upt or insolvent or suspends payment t o his creditors; or (iii) if he is convicted of any offence which is punishable under the Indian Penal Code (Act XLV of 1860); or (iv) if he absents himself from three consecutive meetings of the Council without the leave of the Chairperson, and in any case fr om five consecutive meetings; or (v) acquires such fina ncial or other interest as is likely, in t he opinion of the Government, to affect prejudicially his functions as a member. 4.Pr ocedur e to be followed in the discha rge of fu nct ions of the Council : (i) The Council shall meet at least once a month. (ii) At least 7 (seven) days' notice shall ordinarily be given for any meeting. However, in the case of u rgency a meeting may be called at such shorter notice as the Chair person may cons ider sufficient. (iii) The Council may appoint/or engage the services of one or mor e experts in t erms of section 26 of the Arbitration and Conciliation Act, 1996. (iv) The Council, or a party to the dispute with the approval of t he Council may apply to the court under section 27 of the Arbitration and Conciliation Act, 1996, for assistance in taking evidence. (v) The reference/application of the aggrieved micro or sma ll enterprise supplier shall contain full particulars of the supplier and it s status, supplied goods or services, terms of payment, if any, agreed between the supplier and b uyer, a ctual pa yment r eceived with date, amount due and the interest duly calculated under section 16 of the Act, supported by an affidavit, with necessary cour t fee s tamp affixed thereon. The Chairperson of the Council may require any petitioner to provide fur ther par ticular s of the claim or any r elevant documents in support of the claim a s he may consider necessary for the pur pose of the proceedings. If the petit ioner fails or omits to do so within fifteen days of receipt of such communication or within such further time as the Chairperson may, for sufficient cause, allow, the Council may terminate the proceedings without prejudice to the right of t he petitioner to make fresh r eference if he is otherwise entitled so to do. The petitioner shall a lso simultaneously send a cop y of the reference to the buyer or buyers against whom the reference is directed. (vi) The reference/application shall be acknowledged forthwith if it is delivered at the office of the Council. Where the r eference/app lication is received b y r egis tered p ost, it s receipt sha ll be acknowledged on the same day. T he Chairperson sha ll cause the bu yer to furnish his deta iled resp onse to the reference within fifteen days of receipt of the reference by the buyer or within such further time not exceeding fifteen days, as he may, for sufficient ca use, allow. (vii) On r eceipt of a reference under section 18 of the Act, the Chair person of the Council s hall cause the reference and the buyers' response thereto to be examined and, on being satisfied with the reference making a prima facie case of dela yed payment, cause the reference t o be placed befor e the Council at its next immediate meeting for consideration. The Chairperson shall also ensure that each reference received within two weeks of the date of the last preceding meeting of the Council is examined and, if found in or der, is placed for considera tion of the Council at its next immediate meeting.- 2 - Ex-330/2013 (viii) The Council shall either itself conduct concilia tion in each r eference placed before it or seek the assistance of any institute or centre providing alternate dispute resolution services by making a reference to such an institution or centre ,for conducting conciliation. The pr ovisions of sections 65 to 81 of the Arbitration and Conciliation Act, 1996 shall apply to such a refer ence as if the conciliation was initiated under Part 111 of that Act. (ix) The Council or the institute to which it has been referred for conciliation shall require the supplier and the bu yer concerned to appear befor e it by issuing notices to both parties in this behalf. On the appearance of both parties, the Council or the institute shall fir st make efforts to bring about conciliation between the buyer and the supplier. The instit ute shall submit its report to the Council within fifteen da ys of r eference from the Council or within such period as the Council may specify. (x) When such concilia tion does not lead to settlement of the dispute, the Council shall either, itself act as an Arbitration for final settlement of the dispute or refer it to an institute for such Arbitration, in accordance with the provisions of the Arbitra tion and Conciliation Act, 1996. The supplier or the buyer may either in person or through his lawyer registered with any court, present his case before the Council or the institute during the arbitration proceedings. The institute shall submit its report to the Council within such time as the Council may stipulate. (xi) Any decision of the Council shall be made by a majorit y of it s members present at the meeting of the Council. (xii) The Council shall make an arbitr al awar d in accordance with section 31 of t he Arbitration and Conciliation Act 1996 and within the time specified in sub-section (5) of section 18 of the Act. The award s hall be stamped in accordance with the relevant law in force. Copies of the a ward shall be ma de available within seven da ys of filling of an application. (xiii) The Chairperson or any other officer authorized by the Chairperson shall forward the proceedings of every meeting of the Council including annua l progr ess report of the Council to the Member Secr etary of the Advisory Committee cons tituted under sub-section (3 ) of section 7 of the Act.
