THE RIGHT OF CHILDREN TO FREE AND COMPULSORY EDUCATION (AMENDMENT) ACT, 2012 AN ACTto a mend the Right of Children to Free and Compulsor y Educa tion Act, 2009. BE it enacted by Parliament in the Sixty-third Year of the Republic of India as follows:— 1.(1) This Act may b e called the Right of Childr en to Free and Compulsory Education (Amendment) Act, 2012. (2) It shall come into force on such date as the Centr al Government may, by notification in the Official Gazette, appoint. 2.In the Right of Children to Free and Compulsory Educa tion Act, 2009 (her einafter referr ed to as the pr incipal Act), in section 1, aft er sub-section (3), the following sub-s ections shall be inserted, namely:— “(4) Subject to the provisions of articles 29 and 30 of the Constitution, the provisions of this Act shall apply to conferment of rights on children to free and compulsory education.Short title and commence- men t. Amendment of section 1. 35 of 2009. (5) Nothing contained in this Act shall apply to Madr asas, Vedic Pathsalas and educational institutions primarily imparting religious instruction.”. 3.In the principal Act, in section 2,— (a) in clause(d), after the word “means”, the words “ a child with disability or” shall be inserted; (b) after clause (e), the following clause shall be inserted, namely:— ‘(ee) “child with disability” includes,— (A) a child with “disability” as defined in clause (i) of section 2 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995; (B) a child, being a person with disability as defined in clause (j) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Reta rdation and Multiple Disabilities Act, 1999; (c) a child with “severe disability” as defined in clause (o) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. 4.In section 3 of the principal Act,— (a) for sub-section (1), the following sub-section shall be substituted, namely:— (1) Every child of the age of six to fourteen years, including a child referred to in clause (d) or clause (e) of section 2 , shall have the right to free and compulsory education in a neighbourhood school till the completion of his or her elementary education. (b) in sub-section (2), the proviso shall be omitted; (c) after sub-section (2), the following sub-section shall be inserted, namely:— ‘(3) A child with disability referred to in s ub-clause (A) of clause (ee) of section 2 shall, without prejudice to the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, and a child referred to in sub-clauses (B) and (C) of clause (ee) of section 2, have the same right s to pursue free and compulsory elementary education which children with disabilities have under the provisions of Cha pter V of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995: Provided that a child with “multiple disabilities” referred to in clause (h) and a child with “severe disabilit y” referred to in clause (o) of section 2 of t he National Trust for Welfare of Persons with Autism, Cerebral Pa lsy, Mental Reta rdation and Multiple Disabilities Act, 1999 may also have the right to opt for home-based education.’. 5.In s ection 21 of the principal Act, in sub-section (2), the following proviso shall be inserted, namely:— “Provided that the School M anagement Committee constituted under sub-section (1) in respect of,— (a) a school established and administered by minority whether based on religion or language; and (b) all other aided schools as defined in sub-section (ii) of clause (n) of section 2, shall perfor m advisory function only.”.- 2 - Ex-349/2013 Amendment of section 2. Amendment of section 21.1 of 1996. 44 of 1999. 44 of 1999. 1 of 1996. 44 of 1999. 6.In s ection 22 of the principal Act, in sub-section(1) , for the words “School Management Committee, constituted”, the words “School Management Committee, except the S chool Ma nagement Commit tee in respect of a school est ablished and administered by minority, whether based on religion or la nguage and an a ided school as defined in sub-clause (ii) of clause (n) of section 2, constituted” shall be substituted. 7.In section 25 of the principal Act, in sub-section (1), for the words “Within six months”, the words ‘’Within t hree years” shall be substituted. 8.After section 38 of the principa l Act, the following section shall be inser ted, namely:— “39. (1) If a ny difficulty ar ises in giving effect to the provisions of this Act, the Centr al Government may, by order, published in the Official Gazette, ma ke such provisions not inconsistent with the provisions of this Act, as may appear to it to be necessary for removing the difficu lty: Provided that no order shall be made under this section after the expiry of t hree years from the commencement of the Right of Children to Free and Compulsory Education (Amendment) Act, 2012. (2) Every or der made under this section shall be laid, as soon as may be a fter it is made, befor e each House of P arliament.”.Amendment of section 22. In sertion of new section 39. THE CENTRAL EDUCATIONAL INSTITUTIONS (RESERVATION IN ADMISSION) AMENDMENT ACT, 2012 AN ACTto amend the Central Educational Institutions (Reservation in Admission) Act, 2006. BE it enacted by Parliament in the S ixty-third Year of the Republic of India as follows:— 1.This Act may be called the Central Educational Institutions (Reservation in Admission) Amendment Act, 2012. 2.In section 2 of t he Centr al Educational Ins tit utions (Reservation in Admission) Act, 2006 (hereinafter referred to as the principal Act), after clause (i), the following clauses shall be inserted, namely:— ‘(ia) “specified north-ea stern region” means the area comprising of the States of Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura and the tribal areas of Assam referred to in the Sixth Schedule to the Constitution; (ib) “Sta te seats”, in relation to a Central Educational Institution, means such seats, if any, out of the annual permitted strength in each branchShort title. Amendment of section 2. 5 of 2007. of study or faculty as are earmarked to be filled from a mongst the eligible students of the State in which such institution is situated;’. 3.In section 3 of the princip al Act, the following provisos shall be inserted, namely:— “Provided that the State seats, if any, in a Central Educational Institution situated in the tribal areas referred to in the Sixth Schedule to the Constitution shall be governed by such reservation policy for the Scheduled C astes, the Scheduled Tribes and the Other Backwa rd Classes, as ma y be specified, by notification in the Official Ga zette, by the Government of the State where such institution is situa ted: Provided further that if there are no State seats in a Central Educational Instit ution and the seats reser ved for the Scheduled Castes exceed the percenta ge specified u nder cla use (i) or the seats r eserved for the Scheduled Tribes exceed the percentage specified under cla u se(ii) or the seats reserved for the Scheduled Castes and the Scheduled Tribes taken toget her exceed the sum of percent ages sp ecified under cla uses (i) and (ii), but such seats are— (a) less tha n fifty per cent. of the annua l permit ted str ength on the da te immediately pr eceding the da te of commencement of this Act , the tota l percentage of the sea ts requ ir ed to be r eserved for the Ot her Backward Classes under clause (iii) shall be restricted to the extent such sum of percentages specif ied under cla u ses (i) and (ii) falls short of fift y per cent. of the annual permitted strength; (b) more tha n fifty per cent. of the annua l permit ted str ength on the date immediately preceding the date of commencement of this Act, in that case no sea t shall be reser ved for the Other Backwa rd Cla sses under clause (iii) but the extent of the reservation of seats for the Scheduled Castes and the Scheduled Tribes shall not be reduced in respect of Central Educational Institutions in the specified north-eastern region.”. 4.In section 4 of the principal Act, clause (a) shall be omit ted. 5.In section 5 of the principal Act,— (a) in sub-s ection (1), for the words “number of such seats ava ilable”, the words “number of su ch seats availa ble or a ctually filled, whichever be less,” s hall be substituted; (b) in sub-section (2), for the words “three years”, the words “six years” shall be substituted. 6.In s ection 6 of the principal Act, for the figures “2007”, the figures “2008” shall be substituted.- 2 - Ex-350/2013 Amendment of section 3. THE CHEMICAL WEAPONS CONVENTION (AMENDMENT)ACT, 2012 AN ACTto a mend the Chemica l Weapons Convention Act, 2000. BE it enacted by Parliament in the S ixty-third Year of the Republic of India as follows:— 1.(1) This Act may be called the Chemical Weapons Convention (Amendment) Act, 2012. (2) It shall come into force on such date as the Centr al Government may, by notification in the Official Gazette, appoint. 2.In t he Chemical Weapons Convention Act, 2000 (hereinafter referred to as the princip al Act), in section 9, in sub-section (1), — (a) after the words “National Authority”, the words “or of the Central Government” shall b e inserted; (b) the following proviso sha ll be inserted, namely:— “Provided that such officers shall fulfil the prescribed criteria.”.Short title and commence- men t. 34 of 2000.Amendment of section 9. 3.For section 16 of the principal Act, the following section shall be substituted, namely:— “ 16. No person sha ll transfer to, or receive fr om, a S tate which is not a party to the Convention or any person who is not a citizen of a State Party, any Toxic Chemical or Pr ecursor listed in Schedule 2 in the Annex on Chemicals to the Convention.”. 4.In section 18 of the principal Act,— (a) in sub-section(1), in the opening por tion, for the words “Every person who is”, the words “Subject to such exemptions and thresholds as may be prescribed, every person who is” shall be substituted; (b) in sub-section (2), in the opening portion, for the words “No person, who after the commencement of this Act”, the words “Subject to such exemptions and thr esholds as may be prescribed, no per son, who after the coming into force of this section” sha ll be substituted; (c) in sub-section (4), after the words “a certificate of registration”, the words “subject to such terms and conditions as may be prescribed” shall be inserted; (d) after sub-section (5), the following sub-section shall be inserted, namely:— “(6) Every person, to whom a certificate of r egistr ation is gr anted under sub-section (4), sha ll fu r nish t o the C ent ra l Gover nment periodica lly, or, as and when required, s uch information, decla ration or retur n as may be prescribed.”. 5.In s ection 42 of the principal Act , for the words “any person”, the words “a State which is not a State Party or any person” shall be substituted. 6.In section 56 of the principal Act, in sub-section (2),— (a) after clause (b), the following clause shall be inserted, namely:— “(ba) the criteria which the officers are required to fulfil under sub- section ( 1) of section 9”; (b) for clause (c), the following clause shall be su bstituted, namely:— “(c) the exemptions and thresholds under sub-sections (1) and (2) of section 18, the for m of application, the particulars to be cont ained in the application form, the form of certificate of registration, the manner of making application, the a mount of fee payable, the pr ocedure to be followed in granting or cancelling certificate of registration under sub-section (3) of section 18, the terms and conditions for granting a certifica te of r egistra tion under sub-section (4) of section 18, the period for which a renewed certificate of registration may be issued and the amount of fee payable therefor under sub-section (5) of section 18 and information, declaration or return to be furnished under sub-section (6) of that section;”.- 2 - Ex-355/2013Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl.
