No. NE-313(MZ) 2006-2008NOTIFICATIONNo. B. 13017/84/2016-UD&PA, the 19th July, 2017.Whereas theGovernment of Mizoram (Alloca tion of Bu siness) Rules, 2014 has allocated the subject of “ Uncla imed dead Bodies” to the Department of Urban Development & Poverty Alleviation vide Notification No. A. 46013/1/2013-GAD dt. 10th August, 2015; AND whereas, there is a need to have a proper system put in place for the disposal of uncla imed dead bodies; AND whereas, it is incumbent upon the Department to a ct as a nodal department for ma king arra ngement for the disposa l of the dead bodies by way of cremation or burial a nd to keep a r ecord of the dead bodies disposed of; Now therefore, in the interest of the general public, the Governor is pleased to notify the Mizoram Urba n Areas (Disposal of Unclaimed Dead Bodies) Guidelines, 2017 for general information. THE MIZORAM URBAN AREAS (DISPOSAL OF UNCLAIMED DEAD BODIES) GUIDELINES, 2017 1.These guidelines ma y be called the “Mizora m Urban Areas (Disposa l of Unclaimed Dead Bodies) Guidelines, 2017. 2.It shall extend to all urban areas in Mizoram except ar eas falling under Lai Autonomous District Council, Mara Autonomous District Council, and Chakma Autonomous District Council unless otherwise notified by the Government. 3.For the pur pose of these guidelines: (1) ‘Cemetery means a pla ce wher e the dea d bodies are la id / bur ied. (2) ‘Crematorium’ means a facility where dea d bodies are cremated or burned or incinera ted. (3) ‘Disposal’ means the action or process of getting rid of a dead body. (4) ‘Unclaimed dead body’ means a dead body which is not cla imed by anyone and whose relative cannot be tr aced or identified for the collection of the dead b ody. VOL - XLVI Aizawl, Thursday 27.7.2017 Sravana 5, S.E. 1939, Issue No. 368 - 2 - Ex-368/2017 (5) ‘Coffin’ means a box used for putting dead bodies for burial. (6) ‘Government’ means S tate Government of Mizoram. (7) ‘Honorarium’ means a payment given for professional service in connection with the disp osal of dead bodies. (8) ‘District Magistrate’ means Distr ict Magistrate of a district and includes Additional District Magistrate or any other Executive Magistrate empowered in this behalf by the District Magistrate. (9) ‘Sanitation Officer ’ means a Sanitation Officer designated or appointed by the Government. It includes Senior Sanitation Officer and Assistant Sanitation Officers or any other officer designated in this behalf. (10) ‘Undertaker ’ means an official in-charge to carr y out the disposal. 4.COMMON CEMETERY: The Government may designate a place for buria l of unclaimed dead bodies to be named ‘Common Cemetery’. Sanitation Officer may be responsible for maintenance and upkeep of common cemeteries. 5.CREMATORUIM: The Government may designate or establish a place for cremation of unclaimed dead bodies. Sanitation Officer or any other person or agency authorized by the Government may be responsible for maintenance and upkeep of t he facility. 6.DISPOSAL OF UNCLAIMED DEAD BODIES: Whenever or wherever there is an unclaimed dead body, the following procedures shall apply – (1) Police Personnel shall carry out investigation as per prescribed procedure. (2 ) P os t -mor t em ex a mina tion s ha ll be car r ied ou t by a M edica l Officer (M O), a u thorized t o a s cer t ain the cause of death. (3) Police Officer shall obtain written permission fr om Distr ict Magistrate for disposal of the unclaimed dead body. (4) After written order is issued by District Magistr ate, the Police shall hand over the dead body to the Sanitation Officer who shall dispose of the dead body as prescribed under these rules. 7.REGISTRATION: Whenever there is an unclaimed dead body, registration shall be maintained with the following particulars – 1)Name (if known)__________________________________ 2)Address (if known)__________________________________ 3)Date of expir y (if known)__________________________________ 4)Post Mortem Exam Status__________________________________ 5)Registration No.__________________________________ 6)Plot No.__________________________________ 7)Magistrate Order No. & Date__________________________________ 8)Date of disposal__________________________________ 9)Na me of Under taker__________________________________ (Notes: If date of death is not known approximate expiry date may be shown) 8.PLOT FOR BURIAL PLACE: The Sanitation Officer or his representa tive shall decide a specified plot for burial of the uncla imed dead body. 9.RE-USE OF PLOT: Plot used for buria l may be re-used after it is deemed fit for reuse by the Sanitation Officer. - 3 -Ex-368/2017 10.SAFETY MEASURE: Any person engaged in the burial of the dead body shall be provided with safety gears such as hand gloves, mask, etc. The dead body should be properly covered with polythene or other such materials used for containing a corpse during transportation. Safety precautions against any spreading of disease should be prepared. 11.HONORARIUM: The Sanitation Officer sha ll issue Detailment Order of persons who will be involved in the disposa l of dead bodies. Every person detailed may be entitled an honor arium the amount of which ma y be prescribed by the Govt. from time to time. 12.FUNERAL FUNCTION: If deemed a ppropriate by the Sanitation Officer, funeral function ma y be conducted by enga ging religious leaders of the same fait h of the deceased. In such ca ses, appropriate honor arium ma y be arra nged as prescribed by the Govt. from time to time. 13.CEMETERY SHED: A cemetery shed ma y be construct ed at the burial ground for storing all burial gears and equipment. 14.MATERIALS FOR DISPOSAL: For disposa l of unclaimed dead body, materials mentioned should be kept in t he cemetery shed or crematorium by Sanitation Officer. 1)Coffin 2)Digging tools 3)Coil of r ope 4)Electrical items 5)Emergency light 6)Silpoulin /Tarpaulin 7)Raincoat 8)Hand Gloves 9)Face masks 10) Cement work materials 11) Gas 12) Any other tools or machineries required 15.PLOT MARK: The Sanitation Officer shall specify a plot for each burial which shall be marked by its specific plot number for identifica tion. 16.FUND FOR BURIAL: The expenditure for disposal of unclaimed dead bodies shall be allocated in its a ppropriate Hea d of Account. 2217 -Urban Dev. 01-State Direction 800-Direction & Administr ation 06-Disposal of unclaimed dead body 50-other charges.Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. (2) It shall extend to the whole of the State of Mizoram except the areas under the three Autonomous District Council of Lai, Mara, Chakma and Municipal areas. (3) They shall come into force from the date of publication in the Mizor am Gazette. 2 . Definitions: In these r ules, u nless t he context ot her wise requir es:- (a)“Act” means The Lushai Hills District ( Village Councils) Act 1953 (Lushai Hills Act V of 1953) (b)“Assembly” means a meeting together of a group of people for a specific purpose; (c)“Dra in” includes a house drain, a drain of any other description, a culvert, a channel for carr ying off sulla ge, rain water and sub-soil water liquid wa ste; (d)“Exhibition”means a collection of things shown publicly or works of arts, goods for sale. (e)“Entertainment” includes a ny exhibition, perfor mance, a musement games or sport to which persons are usually admitted on payment of fee. (f)“Fair”means a collection of outdoor entertainments, sta lls on a large open ground. (g)“Government”means t he Government of Mizora m. (h)“Garbage and offensive matter”includes household and kitchen waste, solid or semi-solid cutting of shrubs, weeds, small branches of trees, drain spoils, animal dung, cutting and dressing of a ll organic and inorganic wastes, waste of market and other public pla ces; (i)“Officer” or “Officers” mea ns a Government Offic er of t he S tat e Gover nment; (j)“Pub lic Str eet”means any street, road, la ne, pathway, public bridge; (k)“Premises”means any land or building or pa rt of a building or land; (l)“Pr escrib ed”means prescribed under the provision of these rules; (m)“Village Council” mea ns Village Council constituted under the provision of The Lushai Hills District (Village C ouncils ) Act, 1953 as amended from time to time. (n)“Water point” means a pla ce where water is collected or distributed and includes natural sour ce of wa ter or water spr ing. Duties and responsibilities of Village Councils : (1) It shall be the general duty of each Village Council to enforce these rules within its jurisdiction in the most effective manner suitable to local conditions. (2) Wher e there is no Village Council, the Govt, or a ny officer or officers author ized in this behalf shall ensure due enforcement of these rules in such villa ges. 4 . Cleanliness of Street: ( 1 ) It sha ll be the genera l duty of ever y person to keep the street and dr ains in a clean and sanita ry condit i ons . (2) No person shall throw or deposit any offensive matter on the road, path, drain or any vacant land. (3) The Village Council if considered necessary shall provide dustbin or recepta cle in a ny suitable places. Disposal of waste or garba ges shall be done by the Villa ge Councils. (4) If collections of garbage are done in a village, the Village Council shall specify by public notice about the time of putting refuses or gar bage in a depot or pla ce for collect ion. (5) The Village Council shall organize a mass community work for cleaning of str eet, dr ains, water points and public places at least twice in a year during the month of February and October. A report of which shall be submitted to District Local Administration Officer concerned. 5 . Maintenance of cleanliness in Water Points : (1) The Village Council shall b e responsible to strictly maintain all water points in the village. The Village Council sha ll make local r ules relating to preser vation of water source, prevention against encroachment and pollution. The Village Council shall also specify the area for water points and they sha ll take all necessary action for protection of such a rea. (2) There shall be formed a Village Water Committee to assist the Village Council in the preservation of water source, distribution of piped wa ter and maintenance of cleanliness in the wa ter points. 6 . Goods, articles, meats intended for human consumption to be protected from flies etc. : No person s hall sell or expose in any market or by the side of any r oad, goods, meats, vegetables or article or any prepared or manufa ctured articles intended for human food or drink unless such article is p rotected from flies, dust and other source of contamination by means of sufficient covering or such other ways as may be prescribed from time to time. For br each of these rules, t he Sanitary Inspector or Officer or person authorized for the purpose sha ll be competent to seize and dispose of such article in the manner as he deems fit and proper. 7 . Assembly, Entertainment, E xhibition a nd Fair : (1) No person or persons shall hold within a Village area any assembly or meetings, outdoors or in a ma keshift pavilion for the sake of entertainment, exhibition and fair without the previous knowledge of the Village Council concerned. (2) Any person or persons who is desirous of holding such meeting shall a pply to the Village Council for permission to hold such meeting with such details of the arrangement made for collection and disposal of waste. Non-compliance of such arrangement may entail breach of these rules and shall be liable to punishment as per Rule 13 of these Rules. (3) A nominal fee shall be charged by the Village Council for such assembly or meeting, the rate of which sha ll be fixed not exceeding rupees five hundred by the Villa ge Council per day. 8 . Public Toilet and Urinals :The Village Council shall provide public toilet or urinals as per requirement of the Village. However, the Village Council shall have prior planning and arrangement for maintenance of cleanliness before such convenience are being constructed. And, no person shall erect toilet or urinals on a street or road side without the pr evious approval of the Villa ge Council. - 3 -Ex-371/2017 9 . Private Toilet: No owner or occupier of any building or land shall construct a toilet or urinal to be in such a state as to be offensive or annoyance to others. 10 . Trees and bamboos in the street or in private premises:No person s ha ll fell a ny t ree in a ny public street or park without the written permission of State Government. Trees or bamboos or plants planted or grown by way of natur al born shall not be allowed to cause inconvenience or a nnoyance to others such as allowing its leaves and branches to fa ll outside the owner of such land or premises. 11. Sanitation Committee:T he Villa ge C ouncil sha ll for m Sa nita tion Committee in each villa ge t o assist and to give advice to the Village Council in the enforcement of these rules. Such Sanita tion Committee s ha ll have offic e bearers and members as may be pres cribed by the State Gover nment by a notification from time to time. The Sanitation Committee shall continue till the term of Village Council expires. 1 2 . Power to make local guidelines:Subject to the pr ovision of these Rules and with the approva l of State Government, a Village Council may ma ke guidelines relating to the general cleanliness of the Village concerned. 13 . Punishment for Breach of these Rules :Whosoever commits a breach of these rules shall be punishable with a fine which may extend to five hundred rupees. Rodney L.
