Region Higher Secondary School, Lawngtlai on 16.02.2017 at 01:20 PM. Born on 26.11.1979,Pu Lalhrezuala Hnialum was appointed on Contract basis as Post Graduate Teacher, Govt. Higher Secondary School on 01.06.2002 and appointed temporarily as Post graduate Teacher on 22.09.2002. On 25.4.2012 he was confirmed as Lecturer and served in Govt. Region Higher Secondary School, Lawngtlai till his last breath. He served the Gover nment of Mizora m with utmost sincerit y and devotion to duty and endeared himself to all his colleagues. He always proved himself to be a conscientious officer. The Government of Mizoram places on record its deep appreciation of the sincere services rendered by Pu. FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisor y Board will be the Screening Board in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board shall have to judiciously examine the applicant’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. - 2 - Ex-54/2017 3.The Board shall have its sittingat least twice in a year or as may be required and TA shall be given to the members of the Boar d if the place of sit ting is more than 8 (eight) kilometer from the headquarter of the member. The S ecretar y SAAB s hall issue Meeting Notice in consultation with the Chairma n by giving at least 10 (ten) days in advance to the member of S AAB. 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (Land Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any ca tegory or purpose must be submitted to the Settlement Officer or Assista nt Settlement Officer if Chairman of SAAB is the Deputy C ommissioner of the Dis t r ict . In ca se, C hair man of S AAB is S DO (C ) or BDO or P r es ident, Village Cou nc il t he a pp lica t ion for land allotment of any category must be submitted to the concerned Chair man. 5.The Board shall make initial screening of the a pplication with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land by Surveyor, Revenue Depa rtment in the presence of the applica nt, the concerned VC and neighbouring land holder, if any. Measurement of land should be a ccurate and NOC sha ll be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. The recommendation of the meeting of Board shall be submitted to the concerned District Revenue Officer for fur ther submission to the Government through the Dir ector, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to fu ture infrastructure development wor k of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended fr om time to time. 9.The term of the Boa rd shall be three year s. The Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public. VOL - XLVI Aizawl, Monday 27.2.2017 Phalguna 8, S.E. 1938, Issue No. 55 GUIDELINES FOR SETTING UP OF DISTRICT PLANNING COMMITTEES IN MIZORAM 1 . Intr oduction : The need for integrated local area development plans, b ased on specific endowments and needs of ea ch a rea ha s been emer ges from the widesp read need for instit utiona l cha nges to enable and sustain greater access to basic local services, as well as from the considerable investments tha t have been allocated in local service delivery functions-t hrough State and Central resources. Moreover, participative decentralized planning is gathering momentum with the innovations in Information and Communica tion Technology that have ma de it possible for the vision of pa rticipa tive planning so that plans relevant to the local ar ea are prepared, with local communit ies and their local governments gaining a strong sense of ownership for better outcomes a nd resu lts. 2 . Constitutional Pr ovision : The 74th Constitution Amendment Act mandated the establishment of the District Planning Committee (DPC) under Article 243ZD of the Constitution for consolida ting plans prepared by panchayats and municipalities in the District into District Plan. As mandated, by the Constit ution District Planning Committee may be set up in every District of Mizoram. 3 . Functions of the DP C : In the light of the Provision of Article 243ZD of the constitution of India, District Planning Committee shall be constituted in every district—to plan, monitor, evaluate, review and coordinates “ development initiatives in the distr ict and to exercise such other powers as may be assigned by the Government from time to time. The Commit tee sha ll, in preparing development plan, have regard to : (a) Matters of mutual common importance in the society; (b) Spatial particularity; - 2 - Ex-55/2017 (c) Sharing financial, physical and natural resources; (d) Integrated development of infrastructure and environmental conserva tion. The District Planning Committee shall perform the following functions : i.Identification of local needs and objectives wit hin the perspective of national and state goal; ii.Collection, compila tion and updating of statistics of the natur al and human resources of the distr ict; iii. Mapping of the infrastructure fa cilities, identification of growth drivers, manpower planning and skills gap assessment at village, block and distr ict levels; iv. Preparing blueprints of development plans for the district by identifying cr itical development gaps in the district - and identifying national and Sta te programme to address the stated gaps; v.Persuasion, evalua tion and review of plans of t he central domain, centre sp onsored plan, plan of the State domain and the local area development schemes on the legislators, account, in the district; vi. Submission of progress repor ts of the development works within the distr ict to the State Gover nment; vii. Ensur ing, cooperation of non government organizations in the pr ocess of all round development of t he distr ict; viii. Advising the State Government regarding the important initiatives of the State domain in the process of the overall development of the distr ict; ix. Other funct ions assigned by the State Government, if any. 4 . Official Data and Statistics at District Level : The District Planning Committee shall maintain up-to-date, accurate and reliable official data and statistics for the District. The available data may be put together for different sectors a t each level of the tier viz. village, block and district. The state government agencies, the departments and the district statistical or ganizations should assist them in this. Some of the essential items of data are listed in the suggested form atAppendix I and Appendix-II. 5 . Composition of District Planning Committee : The District Planning Committee of different districts shall consist of such number of members as may be specified by the State Government by notifica tion. a.The Deputy Commissioner of the District shall be Chairman of the District Planning Committee; b.The District resear ch Offic er sha ll be Member Secretary of the District Pla nning Commit tee; c.Member of Legislative Assembly (MLA) whose constituencies fall in that district shall be member of the District Planning Committee. As soon as an MLA ceases to be a member of the Legisla t ive Assembly, he/she shall cea se to be a member of the C ommit tee; d.Dis t rict L evel Hea d of Dep a rt ment s or S enior Most Officers in the D ist r ict of a ll line D ep a rt ments shall be members of the District Planning Commit tee; e.Chairman of the Joint Village Council (for each block) shall be members of the District Planning Committee; f.Municipal Commissioner of AMC in the ca se of Aizawl District shall be member of t he District Planning Committee; g.Not more tha n 3 in total from resp ective of NGOs, Civil Society and Academia nominated by the State Gover nment sha ll be member invit ees. 6. Secretariat :Secretariat service shall be provided by District Research Office (Economics & Statistics). Distr ict Pla nning Unit (DPU) may be created in the DRO’s Office by pooling staff from line Departments. District Planning Cell may also be created at the Headquar ters at Planning & Programme Implementation Department. 7 . Preparation of Vision Document : Based on the real time data and empirical evidence, a vision docu ment for 15 yea rs may b e prepa red based on a participatory a ssessment. The DPC may hold formal interactions with local governments and other key stakeholders on this and then finalize it. The docu ment should clearly indentify the key reasons for backwardness/development shortcomings and addr ess issues impeding development. It will cover : - 3 -Ex-55/2017 a)Agriculture and allied sectors (a s relevant) b)Availability and development of water sources c)Industries - especially traditional, sma ll industries including food processing d)Infr astruct ure including power e)Tourism potential . f)Drinking wa ter and sanita tion g)Literacy, school education h)Health and medical facilities i)Poverty reduction and basic needs j)Gender and children k)Social Justice - SC/ST, Persons with disability etc 1)Financial inclusion 8.To assist the DPC in prepa ring, the vision document, a Technica l Suppor t Group may be constit uted as a ppropriate in each district. It may consist of departmental officers (where a vailable) mandated and nominated for the purpose in a ddition to their duties or retired persons locally a vailable or a local academic institution or established NGO with a proven track record. These vision Documents prepared and submitted by District Planning Committee sha ll be integrated into the State level document. District Planning Committee shall be entrusted to update distr ict level vision as a nd when required by the State Government. - 4 - Ex-55/2017Appendix-I Baseline P r ofiles for Distr ict Visioning Exercise I.Geopolitical Information The geopolit ical information should be pr epared a nd presented in the form of t he following ma ps : i)District, Block, sub-division, cluster, and local governemnt boundar ies; ii)Elevation map/toposheet showing natural georaphic features such as hilly areas, flat areas, low-lying/flood plains, r ivers, lakes, etc. iii) Rainfall distribution; iv) Soil and vegetation types; v)Major and minor dams, watershed development structures, open wells, bore wells, tanks, etc; vi) Watersheds with annual sur face and ground water avalability; vii) Present land use including the land under irriga ted and non-ir rigated agricu lture; forest land, pastures, wasteland; land under mining, industries and huaman habitation etc; and viii) Road and ra il network. No. NE-313(MZ) 2006-2008NOTIFICATIONNo.A.12018/24/2003-P&AR(GSW)/Pt, the 24th February, 2017.In exercise of the powers conferred by the pr oviso to Article 309 of the Constitution of India r ead with sub-sections (1), (2) and (3 ) of section 60 of the Persons with Disabilit ies (Equal Opportunities, Protection of Rights and Full Par ticipation) Act, 1995 (Act No. 1. of 1996), the Gover nor of Mizoram is pleased to make the following rules regula ting the method of recruitment and conditions of service for the post of Commissioner for Persons with Disabilities under Socia l Welfa re Depa rtment, Government of Mizora m namely :- 1 . Short title and commencement: 1)Thes e Rules may b e called t he Mizor am Commiss ioner for Per sons with Dis ab ilities (Recruitment and conditions of Service) Rules, 2016. 2)These Rules shall come into force from the date of their publication in the Official Gazette. 2 . Definitions: 1)In t hese Rules, unless the context other wise requires: a)“Act ” means the Persons with Disabilities (Equal O pportunities, P rotection of Rights and Full Participations)Act, 1995 (Act No. 1 of 1996) b)“Governor” means the Governor of Mizoram c)“Secretary” means a Secretary to the Government of Mizoram 2)All other words and expressions used in these Rules and not defined herein sha ll have the same meaning respectively assigned to them in the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (Act No. 1 of 1996). 3 . Qualifications for appointment of the Commissioner:In order to be eligible for appoint ment as the Commissioner, a person must satisfy the following conditions, namely:- 1)he must have special knowledge or practical experience in respect of matters relating to rehabilitation of Persons with Disabilities; 2)if he is in service under the Central Government or a State Government or any other Organisation, he shall seek retir ement from such service befor e his appointment to the post; and 3)he must possess the following educationa l qualification and experience, namely:- ( A ) Educational qualifications: i)Essential:a)Bachelor ’s degree from a recognised univer sity b)Working knowledge of Mizo languange at least Middle School standard. ( B ) Exp erience: Should have at least ten (10) years experience in one or more of the following types of Or ganizations at specified levels:- i)In a Group ‘A’ level post in Central/State Government/Public Sector Undertaking/Semi Government/ Autonomous Bodies/Educational Institution/Registered National/International level Orga nisations dealing with disability related matters; or ii)A senior level functionary in a Registered National or International level Voluntary Organisation working in the field of disabilit y/ social development for at least 10 years; or iii) Senior Executive position in a leading private sector organisation, involved in social work and in char ge of handling social development activities of the organiza tion for at least 10 years; iv) Out of the total 10 yea rs experience mentioned a bove, a t lea st thr ee years of experience in the immediate pa st should have been in the field of empowerment of Persons with Disabilit ies. 4 . Disqualification for appointment as Commissioner :No person - (a ) Who has entered into or contract ed a ma rriage with a person having a spouse living; or (b) Who, having a spouse living, has entered into or contra cted a marriage with any person shall be eligible for appointment t o the sa id post(s); Provided that the Governor may, if satisfied tha t such marriage is permissible under the personal la w applicable to such person and to the other party to the marriage and tha t there are other valid grounds for doing so, exempt a ny such person from the operation of these rules. 5 . Age limit:In order to be eligible for appointment as the Commissioner, a person should not have atta ined the age of sixty two (62) years as on t he last date for receipt of applications. 6 . Mode of appointment of the Commissioner: 1)An advertisement shall be published, preferably six months before the post is due to fall vacant, inviting applications for the post of Commissioner from eligible candidates fulfilling the required criteria. 2)A Search-cu m-Selection Committee shall be constitutes by the State Government with the following composition: Chairman:Chief Secretary Member Secretary :Secr etary, Socia l Welfare Depart ment Member:Secretary, DP&AR. 3)The Search-cum-Selection C ommittee shall recommend a panel of three suitable candidates for the post of the Commissioner. 4)The panel recommended by the Committee may consist of persons from amongst those who have applied in response to the a dvertisement mentioned in su b-rule (1) above as well as other eligible persons whom the Committee may consider suita ble. 5)The State Government shall appoint one of the candidates recommended by the Search-cum- Selection Committee as the C ommissioner. 7 . Tenure of the Commissioner: 1)The Commissioner shall be appointed on full-time basis for a period of three years from the date on which he assumes office, or till he attains the age of sixty-five years, whichever is ear lier. 2)A person ma y serve as Commissioner for a maximum of two terms, subject to the upper age limit of sixty-five years.
