No. NE-313(MZ) 2006-2008VOL - XLVI Aizawl, Friday 10.3.2017 Phalguna 17, S.E. 1938, Issue No. 104 NOTIFICATIONNo.H.20013/04/16-JERC, the 7th March, 2017.In exercise power conferred under Section 50 read with Clause (x) of Sub-section (2) of Section 181 of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in this behalf, the Joint Electricity Regulatory Commission for Manipur & Mizoram hereby makes the following Regulations to amend the Joint Electricity Regulatory Commission for Manipur & Mizoram (Electricity Supply Code) Regulations, 2013 (hereinafter referred to as “the Principal Regula- tion”), namely; 1.Short title and commencement (1)This Regulations may be called the Joint Electricity Regulatory Commission for Manipur and Mizoram (Electricity Supply Code) (Eighth Amendment) Regulations, 2017. (2)The Regulations shall extend to the whole States of Manipur and Mizoram and shall apply in relation to all matters falling within the jurisdiction of the Commission. (3)This Regulations shall come into force from the date of their notifications in the Official Gazette of the concerned States. 2.Amendment in Regulation 6 of the Principal Regulations : Clause 6.11 and 6.12 of the Joint Electricity Regulatory Commission for Manipur and Mizoram (Electricity Supply Code) Regulations, 2013 shall be substituted as below : Billing in case of defective/stuck/stopped/burnt meter 6.11 In case of postpaid defective/stuck/stopped/burnt meter, the consumer shall be billed on the basis of average consumption of the past three billing cycles immediately preceding the date of the meter being found/reported defective. TheseBilling in case of defective/stuck/stopped/burnt meter. 6.11 In case of postpaiddefective/stuck/stopped/burnt meter, the consumer shall be billed on the bases of average consumption of the past three billing cycles immediately preceding the date of the meter being found/r eported defective. These charges sha ll be leviable for a maximum period of three months only during which time the licences is expected to have replace the defective meter : Proved that any evidence provided by consumer about conditions of working and/or occupancy of the concerned premises during the said period(s), which might have had a bearing on energy con- sumption, may be considered by the licensee. Provided that in case of average consumption of the past three billing cycles immediately preceding the date of the meter being found/reported defective is not available, the defective meter shall be immediately replaced and the period for which the meter is not recording shall be adjusted based on the average consumption of nest three months billing cycles after meter is replaced. If frequency of recharging of prepaid metering is doubtful, the licensee shall check the consumer’s premises for any mal-practices and action be taken accordingly. 6.12 In case, the Mixmum Demand Indicator (MDI) of the meter at the consumer ’s installation is found to be faulty or not recording at all (unless tampered), the demand charges shall be calculated based on maximum demand during corresponding months/billing cycle of previous year, when the meter was functional and recording correctly. In case, the recorded MDI of corresponding month/billing cycle of past year is also not available, the average maximum demand as available for lesser period shall be considered.If neither the record of MDI of past year not average miximum demand of lesser period is not available, average record of MDI in the next three months after meter is replaced may be considered.
