In exercise of the powers conferred by the proviso to Article 309 of t he Constitution of India, the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment by deputation to the post(s) of Head Constable, Constable and Driver under Vigilance Department (ACB), Government of Mizor am, namely :- 1.Shor t Title and (1) These Rules may be called the Mizoram Vigilance (Anti Corruption Commencement Bureau) Department (Group ‘C’ post) Recruitment (by deputation) Rules, 2013. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application These rules shall apply to the posts specified in Column 1 of the Annexure-I annexed to these rules. 3. Number of posts, The number of the said post(s), their classification, Pay Band and Grade classification, pa y ba nd Pay/pay scale attached thereto sha ll be a s specified in columns 2 to and grade pa y/pay scale 4 of the Annexure-I a s aforesaid. 4. Method of r ecruitment, The method of recruitment to the sa id posts, age limit, qualifica tion age limit, and other matters relating thereto shall be as specified in columns 5 qualifications, etc. to 1 4 of the Annexure-I aforesaid. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram, as the case may be from time to time. 5. Disqualification No person- (a ) who, has entered into or contracted a marr iage with a person having a spouse living; or - 2 - Ex-64/2014 (b) who, having a spouse living, ha s entered into or contracted a marriage with any other person, shall be eligible for appointment to t he said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any such person from the operation of this r ule. 6.Training and Departmental Every Gover nment s ervant recruited under these rules s hall undergo Examination. such training or pass such Departmental Exa mination(s) as may b e pr escribed from t ime to t ime. 7. Powers to trans fer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have power to transfer any officer(s) so r ecruited under these rules to a ny other post or position which is equivalent in rank or gr ade. 8. Power to relax Where the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing and in consultation with the Department of Personnel & Administrative Refor ms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and other Nothing in these r ules shall affect reservation relaxation of age limit concessions and other concessions required to be pr ovided for the Scheduled Castes/the Scheduled Tr ibes and other categories of persons in accordance with the orders issued by the Central Government or the Government of Mizoram from time to time in this regard. P.Singthanga, Secretary to the Government of Mizoram, District Council Affairs Department. THE CHAKMA AUTONOMOUS DISTRICT (MOTOR VEHICLES TAXATION) REGULATION, 2013. A REGULATION to provide for the levy and collection of Road Tax on motor vehicles within Chakma Autonomous District. In exercise of the powers conferred on it by clause (b), Sub-paragraph (3) of paragraph 8 of the Sixth Schedule to the constitution of India, the Chakma Autonomous District Co uncil is pleased t o make t he fo llo wing regulat io ns in t hesixty fifth year of the Republic of Indiaas follows:- Short Title, Extent and Commencement:- This Regulation may be called the Chakma Autonomous District Council (Motor Vehicles Taxation) Regulation, 2014. It shall extend to the whole of Chakma Autonomous District. It shall come into force on and from the date of publication in the Mizoram Gazette. Definitions. (1) In this Regulation unless the context otherwise requires:- “Check post” means the Check posts set up under Section 10 of this Re gu lat io n; “District” means the Chakma Autonomous District; “Executive Committee” means the Executive Committee of Chakma Aut o no mo us Dist rict Co uncil; “Licence” means a permission granted to the Motor Vehicle to ply within the District; “Licensing Officer” means an Officer appointed by the Executive Committee as such for the purpose of this Regulation; “Prescribed” means prescribed by the rules made under this Regulation; “Tax” means Tax leviable under this Regulation; “Transport Department” means Transport Department of the Chakma Aut o no mo us Dist rict Co uncil; “Year” means the financial year. (2) Words and expressions used but not defined in this Regulation, but defined in the Motor Vehicle Act, 1988 shall have the meanings assigned to them in this Regulation. Levy on Tax: On and from the commencement of this Regulation road tax shall be levied and collected on the Motor Vehicles used or kept for use and plying within the District at the rates specified as follows: (1) All Motor Vehicle described in Column(1) of Schedule I and used or kept for use and plying within the District a tax at the rate specified in the corresponding entry in column (2) of the said Schedule; Ex-70/20142 (2) All motor cycles, not being Transport Vehicle, described in Part ‘A’ of Scheduled- II and used or kept for use and plying in the District, A tax at the rate specified in the corresponding entry in column (2) of the said Schedule. (3) All motor cars, not being transport vehicle, described in part ‘B’ of Schedule-II and used or kept for use and plying in the District, a tax at the rate specified in the corresponding entry in column (2) of the said Schedule. Payment of tax and grant of Licence: (1) The tax levied under section 3 of the Regulation shall be paid in advance and in the manner specified in section –II by the register owner of the vehicle or any other person having possession or control thereof, at his choice either quarterly, half-yearly or annually on a licence to be taken out by him for the quarter, half- year or year, within fifteen days from the commencement of the quarter, half- year, or year as the case may be. Tax for a half-yearly licence shall not exceed twice and the tax for an annual licence shall not exceed four times the tax for a quarterly licence. The Executive Committee may grant such rebate as may be prescribed in case of half-yearly or annual licence. (2) Notwithst anding anything contained in sub-section (1), no person shall be liable to pay tax in respect of a motor vehicle for a particular period, if the tax due in respect of those motor vehicles for that period has already been paid by some other person. (3) Where a tax in respect of a motor vehicle is paid by any person for a particular period or if no such tax is payable therefore, the Licensing Officer shall grant to such person a licence, in such form as may be notified by the Executive Committee to use the motor vehicle in any public place in the District during the said period. (4) Every licence granted under sub-section (3) shall be valid throughout the District. (5) Notwithst anding anything contained in section 3, the Executive Committee may, by notification from time to time, direct that temporary licence for a period not exceeding thirty days at a time may be issued in respect of a motor vehicle of any class on payment of such tax, and subject to such condition as may be specified in such no t ificat io n. (6) No motor vehicle shall be used in any public place in the District at any time after commencement of this Regulation, unless a licence permitting its use during such time has been obtained as specified in sub-section (3) or sub-section (5). 5. Motor vehicle to stop it on demand by certain officers. (1) Any officer of the Transport Department not below the rank of Enforcement Inspector or any police officer in uniform not below the rank of Sub-Inspector, or such other officer as may be prescribed may require the driver of any motor vehicles in any public place to stop that motor vehicles and cause it to remain stationary so long as may reasonably be necessary for the purpose of satisfying himself that a licence has been duly obtained in respect of such motor vehicles. (2) Any person who will fully fail to st op a mot or vehicle when required t o do so by an officer under sub-section (1) or resist such officer, shall be punishable with fine which may extend to one thousand rupees.Ex-70/2014 3 6. Penalty for failure to pay tax. If the tax due in respect of any motor vehicles has not been paid as specified in section 4, the registered owner or the person having possession or control thereof shall, in addition to payment of the tax due be liable to penalty which may extend to twice the quarterly tax in respect of the vehicle, to be levied by such officer, by order in writing and in such manner as may be prescribed. Provided that if the lumpsum tax under t his Regulation has not been paid by the registered owner or the person having possession or control thereof shall, in addition to payment of the tax due, be liable to penalty which may extend to twice the lumpsum tax payable under sub-section (1) of section 4. 7. Recovery of tax, penalty or fine. Any tax, penalty or fine due under this Regulation may be recovered by way of detaining or selling such Motor Vehicles or such accessories which are in the possession or control of the person liable to pay tax, penalty or fine as the case may be. 8. Power to seize and detain motor vehicles in case of non-payment of tax. Without prejudice to the provisions of sections 6 and 7, where any tax due in respect of any motor vehicles has not been paid as specified in section 4, such officer as may be prescribed, may seize and detain the motor vehicles in respect of which the tax is due under this Regulation and for this purpose take or cause to be taken any steps he may consider necessary for the temporary safe custody of the vehicle, until the tax due in respect of the vehicle, is paid. 9. Exemption, reduction of other modification of tax. (1) The Executive Committee may, by notification:- (a) grant an exemption. Make a reduction in the rate or order other modification not involving an enhancement in the rate of the tax payable:- (i)by any person or class of person: or (ii)in respect of any motor vehicles or class of motor vehicles or motor vehicles running in any particular area; and (b) Cancel or vary such exemption, reduction or other modification. (2) No motor vehicle o ther than motor vehicles belonging to the three Autonomous District Council of Mizoram, State Government or Government of India, shall be exempted from payment of tax if not specifically exempted by the Executive Committee for certain periods not exceeding six months. Such exemption or reduction of tax; if any shall be notified in the Mizoram Gazette. 10. Setting up of check posts:- The Executive Committee may by Notification set up Check post at any suitable place and no vehicle shall pass through the check post without payment of tax, unless exempted under section 9 of this Regulation. 11. Manner of payment of dues:- Payment of every amount due under this Regulation shall be made in cash to the office of the Licensing Officer or in such other manner as may be prescribed. Ex-70/20144 12. Appeal:- Any person aggrieved:- (a) by an order of levy made under section 6. (b) By the seizure made under section 8 may, within a period of thirty days from the dat e o f communicat ion t o him of t he order of levy o r t he date of seizure, as the case may be, appeal to the Executive Committee in such manner and so payment of such fees as may be prescribed. 13. Protection of Acts done in good faith:- No suit, prosecution or other legal proceeding shall be instituted against any person for anything which is in good faith, done o r intended to be done under this Regulation or under the rules made there-under. 14. Trial of offences:- No court inferior to that of a First Class Magistrate shall try any offence punishable under this Regulation. 15. Procedure in certain cases:- Where an accused person pleads guilty and remits the sum specified by the court, no further proceedings in respect of the offence shall be taken against him. 16. Power to make rules:- (1) The Executive Committee may, by notification make rules for carrying out all or any of the purpose of this Regulation. (2) In particular and without prejudice in general of the foregoing provision, such rules may provide for all or any of the following matters, namely:- (a) Levy of tax under section 3. (b) Payment of tax and grant of licence under section 4. (c) Penalty for failure to pay under section 6. (d) Recovery of tax, penalty or fine under section 7. (e) Exemption, reduction or other modification of tax under section 9. (f) Any other matter relating to the provisions of this Regulation or for carrying out all or any of the purpose of this Regulation. 17. Power to amend Schedules:- (1) The Executive Committee may, by notification in the official Gazette, increase or, as the case may be, decrease from time to time, the rate(s) specified in the Schedule –I and Schedule –II in relation to any motor vehicles. (2) When a Scheduled so amended, any reference to the schedule in this Regulation shall be construed as a reference to such schedule as so amended. 18. Category II (a) Tenants of persons in Category I who have resided in the locality as a family and also deemed as ordinary resident(s) of the locality for at least six (6) months prior to the day the building in which they were tenants/residing was destroyed by landslide. (b) Persons who possess land (LSC/House Pass holders) in the landslide affected areas of Ramhlun Sports Complex and Ramhlun Vengthar, and do not have lands and buildings anywhere else within Aizawl Municipal Area, and are also residing as a family in Aizawl c i t y. Category III Persons located elsewhere within Aizawl Municipal Area other than Ramhlun Sports Complex and Ramhlun Vengthar areas who have lost their lands and buildings due to landslides since August 2012. Conditions for Allotment Prior to allotment of house site plots to any person in any of the categories mentioned above. (a ) He or she must surrender his or existing LSC/House Site/House Pass to the Government of Mizoram if they possess any within the landslide areas. (b) Only those eligible and willing to settle at the Rehabilitation Centre may be allotted land/house site plot. (c) Persons inCategory I may be allotted plots first by draw of lots. Short title and commencement.- 1.(1) These rules may be called the Lai Autonomous District Council (Group‘A’,’B’,’C’&‘D’ posts) Recruitment Rules, 2014. 2)They shall come into force on the date of their publication in the Mizoram Gazette. Application.-2.The Rules shall apply to the posts specified in column 1 of the Schedules hereto annexed. Number of posts, classification and scale of pay/pay band and grade pay.-3.The number of the said post(s), their classification and the scale of pay, pay band and grade pay attached thereto shall be specified in columns 2 - 4 of the said Schedule. Method of recruitment, age limit and other qualifications etc.,-4.The age limit, qualification and other matters relating to the said post shall be as specified in column 5 to 14 of the aforesaid Schedules. Provided that the age limit prescribed for direct recruitment may be relaxed in the case of candidate belonging to the Schedule Castes/ the Schedule Tribes and other special categories of persons in accordance with the orders issued by the Central Government or Government of Mizoram from time to time. Disqualification.-5.No person.- (a) Who has entered into or contracted a marriage with a person having a spouse living, or (b) Who, having a spouse living has entered into contracted a marriage with any person shall be eligible for appointment to the said post(s). Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to other party to the marriage and that there are other grounds for doing so, exempt any such person from the operation of this rule. t Training and Departmental Examination.-6.Every person recruited under these rules shall undergo such training or pass such departmental examination as may be prescribed by Executive Committee of the Lai Autonomous District Council from time to time. Power to relax.-7.Where the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing and in consultation with the concerned Executive Committee relax any of the provisions of these rules with respect to any class or category of persons. Reservation and other concession.-8.Nothing in these rules shall affect any reservationor other concessions required to be provided for the Scheduled Tribe/ the Scheduled Castes and other categories of persons in accordance with the order issued by the Central Government or Government of Mizoram from time to time in this regards. Repeal and savings.-9.(1) The Lai, Mara and Chakma District Councils (Group A,B,C&D Posts) Recruitment Rules 1992 published in Mizoram Gazette vol-xxi E.O. Issue No – 142 dt. 5.8.1992, is hereby repealed for the Lai Autonomous District Council areas. (2) The Lai Autonomous District Council Private Secretary to Chief Executive Member Recruitment Rules, 2002; and any other Recruitment Rule, or Recruitment Rules framed by the Lai Autonomous District Council which were in force and continued to be in existence shall stand hereby repealed.
