No. NE-313(MZ) 2006-2008Re. 1/- per page NOTIFICATION No. K. 12011/20/2010-REV, the 3rd May, 2012.Whereas it appears to the appropriate Government (Hereinafter referr ed to a s the Government of Mizoram) that the land specified in the schedule there-to (her einafter referr ed to as the “said land”) is likely to be needed for public purposes viz., Acquisition of land for construction of Border Out Posts and approach roads within Lawngtlai Distr ict. 1.Now, therefore, the Government hereby notifies under sub-section (i) of section 4 of the Land Acquisition Act, 1894 (Central Act of 1894) hereinafter referred to as the said Act that the said la nd is likely to b e needed for the purpose specified ab ove. 2.Any person interested in the land being notified may submit his/her objection to the acquisition in writing to the Deputy Commissioner/Collector, Lawngtlai District within a period of 20 days from the date of publication of this Notification in the Mizoram Gazette, who will dispose of the objection and claims as per provision of section 5-A of the La nd Acquisition Act, 1894. 3.All persons interested in the said land are hereby warned not to obstruct or interfere with any Surveyor or other persons employed upon the sa id land for the purpose of the said acquisition. Any cont ract for the disposal of the sa id land by sale, lease, mortga ge, assignment exchange of the status of pass or otherwise or any outlay commenced or improvement made therein without the sanction of the Collector will, under clause (seventh) of section 24 of the said Act, de disregarded while assessing compensation for such parts of the sa id land as may be finally acquired. NOTIFICATION No. K. 12011/18/2010-REV, the 8th May, 2012.Wher eas by the Government Notifica tion No. K.- 12011/18/2010-REV, dt. 12.3.2012 published in the official Gazette and two daily newspapers, it was notified under section 4 of the Land Acquisition Act, 1894 (Centr al) Act 1 of 1894 (hereinafter referr ed to as the “said Act”) that the land specified in the schedule appended t o the said Not ification was likely t o be needed for the purpose namely - Acquisition of Land for establishment of Assam Rifles at Zemabawk (Zokhawsang). Now, therefore, the Government declares under section 6 of the said Act that the said land is required for the public pur pose specified above and as per schedule indicated below. The Government now appoints the Deputy Commissioner, Aizawl under clause (C) of s ection 3 of the said Act to perform the funct ions of a Collector for all p roceedings hereinafter to be taken in respect of the said land and directs him under section 7 of the said Act to take order for the acquisition of the said land. The Collect or shall there upon ca use the land to be measured and make a plan of the same under Section 8 of the sa id Act if not already done as per section 4 of the said Act, and dispose of all object ions and claims after ca using a public notice for not less than 15 days to the persons int erested stating the Government’s intention of taking over the possession of the sa id land as per section 9 of t he said Act. T hen, the Collector shall submit Draft Award to the Government of Mizoram aft er fulfilling t he provisions under section 11 of the said Act. A plan of the same can be inspected at the Office of the Deputy Commissioner, Aizawl till the final awar d is made under section 11 of the said Act. (ii)The Charges shown in Annexure-I includes service charge and Government fee which is required to b e deposited in the Trea sury/Gover nment exchequer. (iii)The timelines shown in the Annexure-I a re maximum time that may be taken for delivery of the service. (iv)The Information & Communication Technology Department may revise the Annexure-I from time to time. (v)For the G2C Services, the user cha rges and timelines sha ll be applicable for every district in the state unifor mly. (vi)The SCA shall ensur e that every VLE prominently displays the Annexure-I in the CSC premises for the benefit of the citizens. (vii)The Deputy C ommissioners and the S DOs (Civil) sha ll ensur e that the Annexure-I is displayed prominently in the Public Facilitation C entre of their respective offices for the benefit of the citizens. 2.Manner and Pr ocedure of Delivery of the G2C S ervices : (i)A citizen ca n file an application for any of the G2C services as per Annexure-I in the nearest CSC of his/her district a long with a ll requisite documents mentioned in the Annexur e-I and pay the requ isite fee/user cha rges a s shown ther e under. (ii)The VLE/SCA shall be responsible for transmitting the application along with the required documents to the concerned Government office as per the Annexur e-I. (iii)The VLE/SCA shall also be responsible for delivery of the Service in form of Certificate etc. to the citizen at the concerned CSC where the citizen deposited the application. (iv)The Informa tion & Communication Technology Department would issue a separa te notification on electronic accepta nce of a pplications fr om citizens and delivery of services through digit ally signed certificates concerning the G2C services. -- - 2 - Ex - 245/2012 3.Deposit of Govt. Fees a nd C har ges by the CSC/SCA : (i)In case any of the G2C Services r equires deposit of any Gover nment fee/charges, the same shall also be collected by the VLE from the citizen. (ii)However, before collecting such fee, the SCA shall sign and SLA with the concerned Govt. Department/Agency. (iii)Deposit and other terms a nd conditions of the said G2C Service shall be governed by that SLA. (iv)Any such service, including collection of fee or charges of any Department of the State Government, or a ny of its agencies, for the delivery of which the SCA has signed an SLA with the concerned Depa rtment or agency, sha ll be deemed to be a G2C Service. (v)The SCA shall submit to the Information & Communication Technology Department and the SDA a copy of a ny such SLA signed immediately. 4.Remittance of Service Charges and other prescribed charges (i)Remittance of the amount collected through CSCsa)Of t he tota l amount of service charge collected through the C ommon Service C entres, the shar e of DeGS shall be remitted by the concerned Service Centr e Agency (SCA) on a fortnightly basis with the head of account of District e-Governa nce Society (DeGS) in lieu of services provided by the Distr ict Administration. b)Likewise, of the total service charge amount collected through the Common Service Centres, the share of Principal Office sha ll be r emitted by the Service Centre Agency (SCA) on a fortnightly basis with the fund of the Principal Office concerned with the particular Notified Citizen Service tra nsaction to which the service charge relates. In respect of transaction relating to the Sta te Government offices, the aforesaid amount shall be credited with the Government treasury in the appropriate head of account. c)The SCA shall also deposit the prescribed charges other than the service charges, as mentioned in sub-section (b) above, as collected through such C SCs managed by such SCA, on a fortnight basis with the Government treasury in the appropria te head of account. d)However, the aforesaid remittance shall not apply in respect of applica tion status enquiry services. (ii)Remittance of the amount collected through e-District Centresa)Of t he tota l service charge and other pr escribed charges amount that has been collected through the e-Distr ict centres, the kiosk operator so appointed by the Principal Office to run the e-district centre shall hand over the total service charges as well as the prescr ibed char ges amount collected, a long with the system generated transa ction details a t the end of each working day to the Nodal Officer so appointed by the Principal Office. b)Such amount shall be depos ited by such Nodal Officer to the concerned head of account of the DeGS or the Principal Office, as the case may be, on a fortnight ba sis. 6.Services Rela ted to the Revenue & Disaster Mana gement Department : (i)The respective SCA shall approach the concerned authority for issue of the requisite License in favor of the VLEs and execute necessary documents on behalf of the VLEs including security deposit etc. (ii)The applicable rates for the G2C Services which are related to the Revenue and Disaster Management Department shall be revised by the Information & Communication Technology Department in consultation with that Department. (iii)In case any VLE ceases to be a VLE, he/she shall have to surr ender immediately his/her License to the License Issuing Author ity. S.S. No. NE-313(MZ) 2006-2008Re. 1/- per page NOTIFICATION No. A. 12018/20/2003-P&AR(GSW), the 17th May, 2012.In ex ercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following Rules to amend the Mizoram Health Service Rules, 2009 notified vide No. A. 12018/18/ 2003-P&AR(GSW) dated 16th February, 2010 and published in the Mizoram Gazette Vol. XXXIX, Extra- ordinary Issue No. 33 dated 17th Februa ry, 2010 (hereinafter referred to as the Pr incipal Rules), namely :- 1.Short t itle & (1) Thes e r ules may be called the Mizor am Health S ervice (Amendment) commencement Rules, 2012. (2) They shall come into force from the date of their publication in the Officia l Gazette. 2. Amendment of T he age limit for direct recruitment to the service under Rule 13 (3) sha ll be Rule 13 substituted, namely :- “Provided that the upper age limit for entry into the service by direct recruitment shall be 35 years relaxable by 5 years in the case of candidates belonging to Scheduled Castes/Scheduled Tribes”. 3. Amendment of Rule 26 of the Principal Rules, the following shall be substituted, namely :- Rule 26 “Promotion to Higher Gra de : Every promotion from lower grade to the next higher grade after the commencement of these Rules shall be made by the Governor from the confirmed members of the service on the basis of the recommendation of the Commission; Provided tha t all promotions shall be made strict ly as prescribed in Scheduled V of these Ru les; Provided further that members of the Service belonging to various Sub-Cadres except in the Supertime Grade may be considered for non- functional promotion within their respective Sub-Cadre to the next higher Gra de without linkage to vacancies to ensu re quality in service aft er completion of 5(five) years in the relevant grade according to seniority, subject to satisfa ctor y perfor mance; -- - 2 - Ex - 247/2012 Provided also that by virtue of this provision, they shall not be entitled to t he benef its of existing ACP S cheme; Provided further also that the Time Bound Promotion given with retr ospective effect by counting the period of approved service from the date of entr y into the Service is for the purpose of determining the date of Time Bound Promotion to the next higher grade only and not for any retrospective monetary benefit for those incumbents who attained Time Bound Promotion on or before the date of publication of the Principal Rules”. 4.Amendment of In the Principal Rules, for Schedule II, the following shall be substituted, Schedu le II namely : “SCHEDULE - II Authorised Cadre strength of Mizoram Health Service (See Rule 7) I.Supertime Grade - 3 posts Sl.
