FUNCTIONS AND TERMS OF REFERENCE OF THE SAAB1.The Site Allotment Advisor y Board will be the S creening Board in the matter of application for allotment of land for agricultural and non-agricultural purposes. 2.The Board sha ll have to judiciously examine the applica nt’s originality with reference to sub-section (16) of Section 2 of the Mizoram (Land Revenue) Act, 2013. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board shall ha ve its sitting at least twice in a year or as may be required and TA sha ll be given to the members of the Board if the place of sitting is more than 8 (eight) kilometer from the headquarter of the member. The S ecretar y SAAB shall issue Meeting Notice in consultation with the Chairma n by giving at least 10 (ten) days in advance to the member of S AAB. - 2 - Ex-502/2014 4.All applications in prescribed Form for allotment of land in Village Plan area as referred in Explanation to Sub-rule (1) of Rule 14 and Rule 16 of the Mizoram (Land Revenue) Rules, 2013 read with Section 39 and 40 of the Act for any ca tegory or purpose must be submitted to the Settlement Officer or Assista nt Settlement Officer if Chairman of SAAB is the Deputy C ommissioner of the Dis t r ict . In ca se, C hair man of S AAB is S DO (C ) or BDO or P r es ident, Village Cou nc il t he a pp lica t ion for land allotment of any category must be submitted to the concerned Chair man. 5.The Board shall make initial screening of the a pplication with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land by Surveyor, Revenue Depa rtment in the presence of the applica nt, the concerned VC and neighbouring land holder, if any. Measurement of land should be a ccurate and NOC sha ll be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. The recommendation of the meeting of Board shall be submitted to the concerned District Revenue Officer for fur ther submission to the Government through the Dir ector, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to fu ture infrastructure development wor k of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended fr om time to time. 9.The term of the Boa rd shall be three year s. The Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public. In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules fur ther to amend the Mizoram Forest Service Rules 1999 (hereinafter referred to as the Principal Rules) notified vide No.A.12018/5/90-P&AR(GSW) dt. 26.8.1999 and published in the Mizoram Gazette Vol. XXVIII Extra-ordinary Issue No. 236 dated 17.9.1999, namely :- Shor t title and1.(1)These Rules may be called the Mizoram Forest Service commencement-(Amendment) Rules, 2014. (2)They shall come into force from the date of their publication in the Mizoram Gazette. Amendment of2.Sub rule (2) and (3) of Rule 4 of the Principal Rules shall be substituted Rule 4-by the following, namely:- “(2)The number of posts in the Selection Grade (Non-Functiona l) shall be 5% of the total sanction strength of the service in the Senior and Junior Grade in the service. (3)The number of posts in the Junior Adminis trative Grade (Non- Funct ional) shall be 8% of the total sa nction strength of the service in the Senior and Junior Gra de”. Amendment of3.Clause (a) and (b) of rule 6 of the Principal Rules shall be substituted Rule 6-by the following, namely :- “METHOD OF RECRUITMENT (a) 50% of the total sanctioned posts in the Junior Grade of the service shall be filled u p by pr omotion in the manner specified under Rule 8 of these Rules. (b) The rema ining 50% of the sanctioned st rength of posts in the Junior Grade of the service sha ll be filled up by direct recruitment in the manner specified under Rule 7 of the Principal Rules”. Amendment of4.Rule 8 of the Principal Rules, shall be substituted by the following, Rule 8-namely ; “PROMOTION TO HIGHER GRADES(1) The promotion of officer from one lower grade to the next higher grade shall be ma de by the Governor fr om the eligible member of the service by Selection method on the r ecommendation of the Commission. (a)JUNIOR GRADE:For promotion to the Ju nior Grade of the service, Forest Rangers having at least Higher Sta ndard C ertificate in Rangers Course with at least 5 years continuous regular service in the grade in Environment & Forest Department, Mizor am shall be eligible for consideration of promotion to this grade by Selection method. (b) SENIOR GRADE: A member of the service in the Junior Gra de of t he service shall be eligible for consideration of promotion to the Senior Grade by selection method after he/she has rendered a minimum continuous regular service in the Junior Grade for a period of not less than 5 years. (c) JUNIOR ADMINISTRATIVE GRADESubject to the provision of Sub rule (3) of Rule 4 of the Principal Rules, a member of the service in the Senior Grade sha ll be eligible for consideration for a ppoint ment to the Junior Administr ative Grade(Non-Functiona l) by selection method after he/she has put in a minimum period of 5 years regular service in the Gr ade. (d) SELECTION GRADESubject to the provision of Sub rule (2) of Rule 4 of the Principal Rules, a member of the service in the Junior Administr ative Grade shall be eligible for consideration for a ppointment to the Selection Grade (Non-Functional) by selection method after he/she has rendered a minimum period of 5(five) years regular service in the Grade, failing Ex-507/20142 which, a member of the service in the Junior Administr ative Grade who has rendered not less than 20(twenty) years regular service calculated from the date of entr y into the Junior Gra de of the service. The method of promotion to the Selection Grade shall be by selection method. Amendment of5.Sub Rule 1 of Rule 15 of the Principal Rules, shall be substituted by the Rule 15following, namely:- “Scale of Pay- The scale of pay admissible to the members of the service shall be as follows, subject to revision by the Government from time to time. (i)Selection Grade-PB-4, 37400-67000 + GP - 8700 (ii)Junior Administrative Grade-PB-3, 15600-39100 + GP - 7600 (iii) Senior Gr ade-PB-3, 15600-39100 + GP - 6600 (iv) Junior Grade-PB-3, 15600-39100 + GP - 5400”. Amendment of6.Schedule-II to the Principal Rules shall be substituted by the following, Schedule-IInamely :- “The author ized permanent strength of t he service and particular of the posts included therein are as follows:- A. SELECTION GRADE (NON-FUNCTIONAL): 5% of the authorized permanent strength of the Senior Grade and Junior Grade of the service. B. JUNIOR ADMINISTRATIVE GRADE(NON-FUNCTIONAL): 8% of the authorized permanent strength of Senior Grade and Junior Grade of t he service. C. SENIOR GRADE: Sl. In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules fur ther to amend the Mizoram Forest Service Rules 1999 (hereinafter referred to as the Principal Rules) notified vide No.A.12018/5/90-P&AR(GSW) dt. 26.8.1999 and published in the Mizoram Gazette Vol. XXVIII Extra-ordinary Issue No. 236 dated 17.9.1999, namely :- Shor t title and1.(1)These Rules may be called the Mizoram Forest Service commencement-(Amendment) Rules, 2014. (2)They shall come into force from the date of their publication in the Mizoram Gazette. Amendment of2.Sub rule (2) and (3) of Rule 4 of the Principal Rules shall be substituted Rule 4-by the following, namely:- “(2)The number of posts in the Selection Grade (Non-Functiona l) shall be 5% of the total sanction strength of the service in the Senior and Junior Grade in the service. (3)The number of posts in the Junior Adminis trative Grade (Non- Funct ional) shall be 8% of the total sa nction strength of the service in the Senior and Junior Gra de”. Amendment of3.Clause (a) and (b) of rule 6 of the Principal Rules shall be substituted Rule 6-by the following, namely :- “METHOD OF RECRUITMENT (a) 50% of the total sanctioned posts in the Junior Grade of the service shall be filled u p by pr omotion in the manner specified under Rule 8 of these Rules. (b) The rema ining 50% of the sanctioned st rength of posts in the Junior Grade of the service sha ll be filled up by direct recruitment in the manner specified under Rule 7 of the Principal Rules”. Amendment of4.Rule 8 of the Principal Rules, shall be substituted by the following, Rule 8-namely ; “PROMOTION TO HIGHER GRADES(1) The promotion of officer from one lower grade to the next higher grade shall be ma de by the Governor fr om the eligible member of the service by Selection method on the r ecommendation of the Commission. (a)JUNIOR GRADE:For promotion to the Ju nior Grade of the service, Forest Rangers having at least Higher Sta ndard C ertificate in Rangers Course with at least 5 years continuous regular service in the grade in Environment & Forest Department, Mizor am shall be eligible for consideration of promotion to this grade by Selection method. (b) SENIOR GRADE: A member of the service in the Junior Gra de of t he service shall be eligible for consideration of promotion to the Senior Grade by selection method after he/she has rendered a minimum continuous regular service in the Junior Grade for a period of not less than 5 years. (c) JUNIOR ADMINISTRATIVE GRADESubject to the provision of Sub rule (3) of Rule 4 of the Principal Rules, a member of the service in the Senior Grade sha ll be eligible for consideration for a ppoint ment to the Junior Administr ative Grade(Non-Functiona l) by selection method after he/she has put in a minimum period of 5 years regular service in the Gr ade. (d) SELECTION GRADESubject to the provision of Sub rule (2) of Rule 4 of the Principal Rules, a member of the service in the Junior Administr ative Grade shall be eligible for consideration for a ppointment to the Selection Grade (Non-Functional) by selection method after he/she has rendered a minimum period of 5(five) years regular service in the Grade, failing Ex-507/20142 which, a member of the service in the Junior Administr ative Grade who has rendered not less than 20(twenty) years regular service calculated from the date of entr y into the Junior Gra de of the service. The method of promotion to the Selection Grade shall be by selection method. Amendment of5.Sub Rule 1 of Rule 15 of the Principal Rules, shall be substituted by the Rule 15following, namely:- “Scale of Pay- The scale of pay admissible to the members of the service shall be as follows, subject to revision by the Government from time to time. (i)Selection Grade-PB-4, 37400-67000 + GP - 8700 (ii)Junior Administrative Grade-PB-3, 15600-39100 + GP - 7600 (iii) Senior Gr ade-PB-3, 15600-39100 + GP - 6600 (iv) Junior Grade-PB-3, 15600-39100 + GP - 5400”. Amendment of6.Schedule-II to the Principal Rules shall be substituted by the following, Schedule-IInamely :- “The author ized permanent strength of t he service and particular of the posts included therein are as follows:- A. SELECTION GRADE (NON-FUNCTIONAL): 5% of the authorized permanent strength of the Senior Grade and Junior Grade of the service. B. The dignitaries who are entitled for use of red, amber or blue light may fit such light on their official vehicles and not on their private vehicle(s). The light on the vehicles of all personages/officers/Agencies mentioned in the notification shall be covered with a black cover when they are not occupying the vehicle or are not on duty or when outside their jurisdiction. All other unauthorized persons using such light in their vehicles shall be liable to be prosecuted as per provision of law.” This Notification shall supersede all previous notification issued in this regard. No. NE-313(MZ) 2006-2008VOL - XLIII Aizawl, Friday 24.10.2014 Kartika 2, S.E. 1936, Issue No. 514 NOTIFICATIONNo.B. 12012/17/2014-HTE, the 21st October, 2014.In view of the needs of proper procedures for the establishment and running of new Private Self-Financing College / Institutions within the territory of Mizoram, the Governor of Mizoram is pleased to notify the Guidelines with the following terms and conditions for obtaining permission:- 1.All new colleges proposed and promoted to be established by any society or body duly regis- tered under the Societies Regulations Act, 1860 (Act XXI of 1860), shall require to apply before the State Government, in appropriate format and in a prescribed form for the purpose of obtaining permission for running a college on self-financing basis within the territory of Mizoram. 2.That the applicant shall submit an application containing the proposal and five copies of the Detailed Project Report for establishment of a self-financing Under Graduate Degree College to the State Government under the Higher & Technical Education Department well in time before the academic year from which it proposes to start such College. 3.That the State Government shall, for the purpose of giving permission to establish any new College conduct a verification to this effect and after satisfactory examination and scrutiny of all physical as well as other requirements may, allow such colleges to be established within Mizoram. 4.That the College obtaining affiliation for under graduate examination from the Mizoram Uni- versity should not apply for affiliation beyond the under graduate standard till such time the Government decides. 5.That the college authority should undertake to construct a suitable college buildings on their own land (a) Class rooms (b) Administrative building (c) Library (d) Toilets for Boys & Girls (e) Facilities for person with Disability within a period of 2 (two) years in accordance with the requirement of the University authority. Total land required as per UGC norms - (a) Cities - 2 acres (b) Town - 5 acres or appropriate land. 6.That the college shall have a governing body duly constituted in accordance with the statute of the affiliating university and duly approved by the Government. 7.That the college shall follow courses, curriculum, syllabi and text books for various stages of education as prescribed by the affiliating university. 8.That the college shall take effective steps to promote discipline and orderly behavior on the part of the students and staff. 9.That the college shall be opened to inspection by any officer authorized to do so by the Govern- ment of Mizoram. 10. That the college shall not employ teaching staff or any other allied staff having qualification less than what UGC Prescription / Regulations. 11. That the college authorities undertake to run the college without any recurring or non-recurring grants from the Government and, as such, undertakes to build their own financial resources adequate to meet the salaries of teachers, non-teaching staff and other contingent expenditure from fees of the students and donation etc, from the public. 12. That the college authorities undertake to abide by the rules a nd instr uctions issued by the Government of Higher & Technical Education, Government of Mizoram in regards to the main- tenance and administration of the college. 13. That the college authority shall maintain Bank Deposit at least Rs. 20 lakhs in the Nationalized Bank which will be kept as reserve fund for development of the college. 14. That the college shall submit copies of the detailed project report including details about pro- posed teachers, books, journals, teaching aids, equipments, non-teaching staff etc, for running the proposed college.
