General Election to 63-Tuisentlang Village Council Constituency under Lai Autonomous District Council

NOTIFICATION No. B.12011/1/55/2014-SEC/VC/LADC, the 27th March, 2014. WHEREAS, the State Election Commission vide its Notification No.B.12011/46/2012-SEC/LADC/VC, dt. 24.2.2014 issued the Schedule for holding General Election to 63-Tuisentlang Village Council Constituency under Lai Autonomous District Council along with others wherein 10th March, 2014 was fixed as the last date for Withdrawal of Nominations and 25th March, 2014 (Tuesday) as the Date of Poll; and WHEREAS, the Election Observer a nd Sector Officer concerned brought to the not ice of the Commission that following the belated withdrawals of candidature by Independent Candida tes on 24th March, 2014, the Returning Officer of 63-Tuisentlang Village Council C onstituency declared candidates of one party elected ‘unopposed’ without following the procedures laid down in Rule 12 of the La i Autonomous District Council (Election to Village Councils) Rules, 2011 and without obtaining prior permission of the State Election Commission; and WHEREAS, on the basis of t he unauthorized decision taken by the said Returning Officer, no election was conducted by the appointed P residing Officer of the 63- Tuisentla ng Polling Sta tion without obta ining prior permission of the State Election Commission; and WHEREAS, the State Election Commission, after taking the aforementioned facts and circumsta nces into consideration, is of the view that the said Returning Officer and Presiding Officer performed their duties without following the procedures laid down in the Rules ibid and in disregard of the directions of the State Election C ommission and the decision of the said Returning Officer is liable to be declared null and void; and NOW, THEREFORE, the State Election Commission, in exercise of the powers conferred under sub-rule (5) of Rule 3 of the Lai Autonomous District Council (Election to Village Councils) Rules, 2011 and other powers enabling in this behalf, hereby orders tha t election process in respect of 63-Tuisentlang Village Council Constituency should be initiated afresh and the said Returning Officer and Presiding Officer should also be replaced forthwith in the interest of fr ee and fair elections. The land shall be handed over to the User Agency after the sa me has been mutated in favour of Forest Department. No. NE-313 (MZ) 2006-2008Re. 1/- per pageVOL - XLIII Aizawl, Thursday 17.4.2014 Chaitra 27, S.E. 1936, Issue No. 158 NOTIFICATION No.B. 11021/11/2010-FST/331-354,the 9th April 2014.Wher eas, pa ra 3.1 (i) of t he Handbook of Forest (Conservation) Act, 1980; Forest Conservation Rules, 2003 and Guidelines & Clarification published by Government of India, Ministry of Environment & Forests clar ifies that compensatory affor estation is one of the most important conditions stipulated by the Central Government while appr oving pr oposals for de-r eservation or diversion of forest land for non-forest uses; Wher eas, pa r 3.4 (i) of the Handbook stipulates that equivalent non- forest land identified for compensa tory afforestation are to be tr ansferr ed to the ownership of the State For est Department and declared as reser ved/ protected forest, so that the plantation raised can be maint ained permanently; Whereas, Ministry of Environment & Forest vide letter No.2-l/2003-FC dt.20.10.2003 stipulates that“The non-forest land which is transferred and mutated in favour of the State Forest Department for the purpose of compensatory afforestation should be declared as RF/PF under the Indian Forest Act, 1927 prior to Stage-II approval.” Whereas, the Ministry of Environment & Forests, Government of India vide F.No.8-84/2002-FC dt.3.02.2004 amended para 4.2 (i) of the guidelines issued on 20.10.2003 under Forest (Conservation) Act, 1980 that “ the non-for est land which is transferred and mutated in favour of the State Forest Department for the purpose of compensatory afforesta tion, should be decla red as RF/PF under the Indian Forest Act, 1927. The land shall be handed over to the User Agency after the sa me has been mutated in favour of Forest Depa rtment. Stage-II cleara nce sha ll be given aft er the land is mutated in favour of the Forest Department but the Nodal Officer must repor t compliance within a period of 6 months and send a copy of original notification declar ing the non-for est land under Section 4 or section 29 of the India n Forest Act, 1927, as the case may be, to the Centra l Government for infor mation a nd record.” Whereas, the State Revenue Department has transferred and mutated to State Environment & Forest Depa rtment an area of 5380.78 ha. of non-forest land located at the under mentioned places in lieu of forest land diverted for construction of Tuiria l Hydro Electric Project vide notification No.K.12011/1/96-REV dt.4.12.1997 (2349 ha) and No.K.15011/31/2009-REV dt.3.8.2011 (3031.73 ha) in accordance with the provision of section 8(a) of the Mizo District (L and & Revenue) Act, 1956 to be treated as Reserved forest under section 2(4) of the Lushai Hills District (House Site) Act, 1953; section 3(a) of the Mizo District (Land & Revenue) Act, 1956 and section 3(a) of the Mizo District (Agriculture Land) Act, 1963 and as assigned under sub-paragra ph 2 of the pa ragraph 3 of the Sixth Schedule to the Constitution of India. Pillar No. 1 the boundary line goes along the road of N. Khawbung in the direction of 5 degree and fixed pillar No. 2 on the stream ba nk, known as Rawmi lui at the distance 1000 metres. Northern S ide :From B. Pillar No. 2 the boundary line goes down along the str eam of Rawmi lui in the direction of 95 degree and fixed pilla r No. 3 on the bank of Tuipui River at the dista nce of 1 ,500 metres.Ex-158/2014 7 West ern Side ‘A’ : From B. Pillar No. 3 the boundary line goes along the following direction of Tuipui River, in t he direction of 178 degree and fixed Pillar No. 4 on the ba nk of small stream/nullah at the distance of 1,000 metres. Area: 290 Hectares Northern Boundary: Boundar y line follows the up stream of “Bawptliahlui’ which start from the junction point with the Tuimarul Lui (Tuichang R) upto its spring points.
