( ) E.:- In exercise of the powers conferred by section 164 of the Mizoram Goods and Services Tax Act, 2017 (6 of 2017), the Gov- ernor of Mizoram hereby makes the following rules further to amend the Mizoram Goods and Services Tax Rules, 2017, namely:- (1)These rules may be called the Mizoram Goods and Services Tax (Fifth Amendment) Rules, 2017. (2)Save as otherise provided, they shall come into force on the date of their publication in the Official Gazette. 2.In the Mizoram Goods and Services Tax Rules, 2017, (i) in rule 3, in sub-rule (4), for the words “sixty days”, the words “ninety days” shall be substituted; (ii) in rule 17, with effect from the 22nd June, 2017, in sub-rule (2), after the words, “said form”, the words “or after receiving a recommendation from the Ministry of External Affairs, Government of India” shall be inserted; (iii) in rule 40, with effect from the 1st day of July, 2017, in sub-rule (1), for clause (b), the follow- ing shall be substituted, namely:- “(b) the registered person shall within a period of thirty days from the date of becoming eligible to avail the input tax credit under sub-section (1) of section 18, or within such further period as may be extended by the Commissioner by a notification in this behalf, shall make a declaration, electronically, on the common portal inFORM GST ITC-01 to the effect that he is eligible to avail the input tax credit as afor esaid: Provided that any extension of the time limit notified by the Commissioner of State tax or the Commissioner of Union territory tax shall be deemed to be notified by the Commissioner.”; (iv)after rule 44, the following rule shall be inserted, namely :- “44A. Manner of reversal of credit of Additional duty of Customs in respect of Gold dore bar,- The credit of Central tax in the electronic credit ledger taken in terms of the provisions of section 140 relating to the Cenvat Credit corried forward which had accrued on account of payment of the additional duty of customs levied under sub-section (1) of section 3 of the Customs Tariff Act, 1975 (51 of 1975), paid at the time of importation of gold dore bar, on the stock of gold dore bar held on the 1st day of July, 2017 or contained in gold or gold jewellery held in stock on the 1st day of July, 2017 made out of such imported gold dore bar, shall be restricted to one-sixth of such credit and five-sixth of such credit shall be debited from the electronic credit ledger at the time of supply of such gold dore bar or the gold or the gold jewellery made therefrom and where such supply has already been made, such debit shall be within one week from the date of commencement of these Rules.” (v)in rule 61, with effect from the 1st day of July, 2017, in sub-rule (5), for the words “specify that”, the words “specify the manner and conditions subject to which the” shall be inserted; (vi)in rule 87,- (a) in sub-rule (2), the following shall be inserted, namely :- “Provided that the challan in FORM GST PMT-06 generated at the common portal shall be valid for a period of fifteen days. Provided further that a person supplying online information and database access or retrieval services from a place outside India to a non-taxable online recipient referred to in section 14 of the Integrated Goods and Services Tax Act, 2017 (13 of 2017) may a lso do so through the Board’s payment system namely, Electronic Accounting System in Excise and Service Tax from teh date to be notified by the Board.”; (b) in sub-rule (3), for the second proviso, the following proviso shall be substituted, namely:- “Provided further that a person supplying online information and database access or retrieval services from a place outside India to a non-taxable online recipient referred to in section 14 of the Integrated Goods and Services Tax Act, 2017 (13 of 2017) may also make the deposit under sub-rule (2) through international money transfer through Society for Worldwide Interbank Financial Telecommunication payment network, from the date to be notified by the Board.”; (vii) for rule 203, with effect from the 1st day of July, 2017, the following rule shall be substi- tuted, namely :- “103. The Government shall appoint officers not below the rank of Joint Commissioner as mem- ber of the Authority for Advance Ruling.”; (viii) in “FORM GST REG-01” under the heading ‘Instructions for submission of Application for Registration’, after Serial No. 15, the following Serial No. shall be inserted, namely:- “16. No. NE-313(MZ) 2006-2008VOL - XLVI Aizawl, Wednesday 13.9.2017 Bhadrapada 22, .E. 1939, Issue No. 492 NOTIFICATIONNo.B.11020/1/2016 - FST, the 6th September 2017.Whereas bamboo has a very important role in a ddr es sing clima te cha nge concer ns of adapta tion and mitigation in addit ion to providing ecological, economic and livelihood security to a large number of forest dependent rural communit ies who are most vulnerable to the impacts of climate change, there is an urgent need to encourage planting of bamboos on areas outside forests including private lands, and, Whereas the Government of India is promoting bamboo pla ntation on areas outside forests including private lands through various schemes with the involvement of p u b lic es p ec ia ll y in r u r a l a r ea s across the country, and the Ministry of Envir onment, Forest & Climate Change has issued an Advisory vide letter F.No.8-14/2011-FP dated 14.5.2013 requesting all States/UTs to provide enabling environment whic h int er - a lia may include a s implified regulatory regime to the extent that bamboo growing on private la nds are exempted from the requirement of obtaining felling and transit permission. In view of a bove and in order to ensure su stainable management of bamboo on pr iva te la nds in Mizoram, the followingGUIDELINES FOR REGISTRATION, FELLING AND TRANSIT OF BAMBOO FROM NON-FOREST PRIVATE LANDS IN MIZORAM is hereby issued which will become effective fr om the date of issue and will prevail over any other guideline/ instruct ion issued in this rega rd ea rlier. 1.Registration of private bamboo plantation:The pr iva te bamboo p lantation in non-forest lands sha ll be registered in the office of the Divisional F orest Officer (DF O ) concer ned a s p er pr ocedur e laid down below- (i)A person desiring to register bamboos/bamboo plantation raised by him in non-forest private land shall make an application to the Range Officer concerned inForm — I which shall be a ccompa nied by certified copy of valid docu ment of la nd owner ship, sket ch map of the land showing the boundaries and prominent land mark for easy identification and NOC from President of Villa ge Council concerned. (ii)On receipt of the application, the Range Officer shall conduct such enquiry to verify the authenticity of documents of land ownership and location of the land/bamboo plantation to see whether the land is a forest land or not and whether the bamboos/ bamboo plantation a re actually raised by the applicant. After sa tisfying himself about the genuineness of the application, the Range Officer shall prepare location map of the land showing GP S r ea ding a nd prominent bench mark/land features and will then forward the application with accompanying documents and his verification report inForm — IIand the location map to the DFO. ( iii) The DF O will carefully examine the proposal of the Range Officer and on his s a t is f a c t ion about the genuineness of the private bamboo plantation shall register such private bamboo plantation and issue a certificate of such registration/ownership inForm — III subject to an underta king for compliance of the felling a nd tra nsit r ules laid down at para 2 of these guidelines which are also print ed on the reverse of Form - III. (iv) The process of registration of private bamboo plantation shall nor mally be completed within 30 days of the receipt of the complete application by the Range officer concerned. (v) The certificate of registra tion is liable to be cancelled if the holder is found to have violated the provisions of these guidelines and/or have committed offence against Forest/ Wildlife laws in force in the State. 2.Felling and transit of bamboo:The felling of bamboo from non-forest private land will be done only after obtaining Certificate of Registra tion from the Range Officer conc er ned a nd by complying with the felling and tra nsit rules laid down below. (i) The holder of the Registration Certificate shall cut and collect bamboo only from the area specified in this certificate. ( i i ) Only mature bamboos of thr ee yea rs old and above shall be cut at the height of 1 5 - 3 0 c m f r om the ground and no damage shall be caused to immature bamboos which are less than two year s old. In no case clear felling of the bamboo will be permitted. Ex-492/20172 (iii) In case of bamboos occuring in clumps, cutting of mature bamboo should be done uniformly throughout the clumps and at least 4-6 mature bamboos must be left standing along the periphery of the clump and not less than ten clumps must be reta ined in each clump. (iv) Cutting shall be avoided between July and September lest it destroy the young shoots (v) The operation shall be carried out skillfully so as not to disturb means of public transport and communication in any way. (vi) After completion of felling/cutting, the plantation owner or the purchaser shall apply for a transit pass from the Range Officer concerned, who, after physical ver ifica tion of the cu t bamboos a nd the area from wher e the bamboos are extracted, will issue a Transit Pass in Appendix — IIA of the Mizoram (Forest) Act, 1955 or in any other format as may be prescribed by the Principal Chief Conservator of Forests, Mizoram for transportation of the cut bamboos. (vii) For export of exempted bamboo species or bamboo products, if any, a Certificate of Origin inAppendix — 2F(i) or 2F(ii)prescribed by Director General of For eign Trade vide Public Notice No. 15/2015-2020 dt 02/8/2017 shall be issued by the Divis ional Forest Officer concerned on the strength of the transit pass is sued by the Range Officer. (viii) A certified copy of theregistration/ownership certificatea nd the origina l copy of the i transitpassand/orcertificate of origin(as the case may be) shall be in the possession of the person transporting the bamboo under it , and must be produced by such person at Forest Check-gates or whenever ca lled upon to do so by a F or es t Off icer. (ix) Transportation of cut bamboo and bamboo products will be done only with valid docu ments issued by the a uthorized Forest Officer(s) as stated at para 2(viii) above. (x ) Any bamboo in t ransit/extr acted without all the requir ed valid documents shall be c onfisc a ted to the State Government. (xi) No royalty will be levied for the bamboos extracted from a private bamboo plantation in non- forest land raised and/or maintained by a private individual on a property owned by him. 3.The DFO shall submit a quarterly report of the registration and felling of private bamboo plantation raised in non-forest areas in the prescribed format to the Conservator of Forests concerned who will submit a compiled quarterly report for t he cir cle to the Pr incipa l Chief Conservator of Forests. (ii)Only mature bamboos of three years old and above shall be cut at the height of 15-30 cm from the ground and no damage shall be caused to immature bamboos which are less than two years old. (vii) For export of exempted bamboo species/bamboo products, if any, a Certificate of Origin in Appendix — 2F(i) or 2F(ii) prescribed by Director General of Foreign Trade vide No. 15/2015- 2020 dt 02/8/2017 shall be issued by the DFO concerned on the strength of the transit pass issued by the Range Officer. (viii) A certified copy of‘the registration/ownership certificate and the original copy of the transit pass and/or certificate of origin (as the case may be) shall be in the possession of the person transporting the bamboo under it, and must be produced by such person at Forest Check-gates or whenever called upon to do so by a Forest Officer. (ix)Transportation of cut bamboo and bamboo products will be done only with valid documents issued by the authorized Forest Officer(s) as stated at para (viii) above. (x)Any bamboo in transit/extracted without all the required valid documents shall be confiscated to the State Government. (xi)No royalty will be levied for the bamboos extracted from a private bamboo plantation raised in non-forest land by a private individual.
