Hra ngzuala S/o La lbuanga (L) and his wife Nuzingi of Diakkawn, Kolasib. In t he plaint the Plaintiff submitted that he was born out of the wedlock of S hri Kalachand Singh @ K. C Singh and the Defendant Smt. S.Imamoti. However, since the - 3 -Ex-497/2016 said natural father passed away when the Plaintiff was of tender age, he has been brought up and looked aft er by the above-mentioned Shri K. Hrangzuala and his wife Smt.Nuzingi and his natural mother, the Defendant has been looked after by the Plaintiff till date. The P laintiff further submitted that since he has been nurtured and brought up solely by the said Shri K. Hrangzuala and his wife Smt.Nuzingi, he would like to embrace them as his parents. The Plaintiff also submitted that the said Shri K.Hr angzuala and his wife are of now aged and without any issues bor n between them, he would also like to render help and take care of them as a duty of a son. At the same time the said Shri. K. Hrangzuala and his wife Smt.Nuzingi has also expressed their willingness to embrace the Plaintiff Shri Sapkhuma Hmar as their son, to have a nd hold all the r ights as a natura l son would have had. The prayer of the Plaintiff in the concluding submissions r eads as- 1)To pass a decree declaring that S hri K. Hrangzu ala S/o Lalbanga (L) a nd his wife Smt. Nuzingi Resident of Chawngbawla S ection, Diakkawn, Kola sib, Mizoram are the legal a nd natural par ents of the Plaintiff. 2)To pass any other decree in the interest of just ice. The Defenda nt filed her written statement and stated that she has no objection to the pr ayer of the Plaintiff and to pass an Order as pr ayed by him. Order 12 Rule 6 of the Code of Civil Procedure refers to J udgment on Admissions. It states as follows :- (1) where admissions of fa ct have been ma de either in the pleading or otherwise, whether orally or in writing, the Court may at any sta ge of the suit, either on the application of any p arty or of its own motion and without waiting for the deter mination of any other question between the parties, make such Order or give judgment as it may think fit , having regard to such admissions. (2)whenever a judgment is pr onounced under sub-rule (1) a decree shall be drawn up in accordance with the judgment a nd the decree shall bear the date on which the judgment was pronounced. In t he insta nt case there is a clear, unequivocal and unconditional admission of the Defendant in resp ect of the cla im of the Plaintiff. As such the nature of admission made by the Defendant can be held to be conclusive so as to invite an Order under Rule 6 of Order 12 CPC. Accordingly it is hereby Ordered and decreed that Shri.K.Hrangzuala S/o Lalbanga (L) R/o Diakkawn and his wife Smt N uzingi are the natural and legal parents of S hri. Sa pkhuma Hmar. No. NE-313(MZ) 2006-2008NOTIFICATIONNo. B. 11021/11/2016-FST/35-51, the 21st November, 2016.Whereas, para 3.1 (i) of the Handbook of Forest (Conservation) Act, 1980; Forest Conservation Rules, 2003 and Guidelines & Clarification published by Government of India, Ministry of Environment & Forests clarifies that compensatory afforestation is one of the most important conditions stipulated by the Central Government while approving proposals for de- reserva tion or diversion of forest land for non-forest uses; Wher eas, pa ra 3.4 (i) of t he Handbook stipulates that equivalent non- forest land identified for compensator y afforestation are to be tra nsferred to the ownership of the State Forest Department and declared as reserved/protected forest, so that the plantation raised can be maint ained permanently; Whereas, Ministry of Environment & Forest vide letter No.2-l/2003-FC dt.20.10.2003 stipulates that “The non-forest la nd which is tr ansferred and mutated in favour of the Stale Forest Department for the purpose of compensatory a fforest ation should be decla red as RF/PF under the India n Forest Act, 1927 prior to Stage-II approval.” Wher eas, the Ministry of Environment & For ests, Government of India vide F.No.8- 84/2002-FC dt.3.02.2004 amended para 4.2 (i) of the guidelines issued on 20.10.2003 under Forest (Conservation) Act, 1980 that “ the non-forest land which is transfer red and mutated in favour of t he State Forest Department for the pur pose of compensatory a fforesta tion, should be decla red as RF/PF under the Indian Forest Act, 1927. T he land sha ll be handed over to the User Agency after the sa me has been mutated in favour of Forest Department.
