C Singh and the Defendant Smt. S.Imamoti. However, since the - 3 -Ex-497/2016 said natural father passed away when the Plaintiff was of tender age, he has been brought up and looked aft er by the above-mentioned Shri K. Hrangzuala and his wife Smt.Nuzingi and his natural mother, the Defendant has been looked after by the Plaintiff till date. The P laintiff further submitted that since he has been nurtured and brought up solely by the said Shri K. Hrangzuala and his wife Smt.Nuzingi, he would like to embrace them as his parents. The Plaintiff also submitted that the said Shri K.Hr angzuala and his wife are of now aged and without any issues bor n between them, he would also like to render help and take care of them as a duty of a son. At the same time the said Shri. K. Hrangzuala and his wife Smt.Nuzingi has also expressed their willingness to embrace the Plaintiff Shri Sapkhuma Hmar as their son, to have a nd hold all the r ights as a natura l son would have had. The prayer of the Plaintiff in the concluding submissions r eads as- 1)To pass a decree declaring that S hri K. Hrangzu ala S/o Lalbanga (L) a nd his wife Smt. Nuzingi Resident of Chawngbawla S ection, Diakkawn, Kola sib, Mizoram are the legal a nd natural par ents of the Plaintiff. 2)To pass any other decree in the interest of just ice. The Defenda nt filed her written statement and stated that she has no objection to the pr ayer of the Plaintiff and to pass an Order as pr ayed by him. Order 12 Rule 6 of the Code of Civil Procedure refers to J udgment on Admissions. It states as follows :- (1) where admissions of fa ct have been ma de either in the pleading or otherwise, whether orally or in writing, the Court may at any sta ge of the suit, either on the application of any p arty or of its own motion and without waiting for the deter mination of any other question between the parties, make such Order or give judgment as it may think fit , having regard to such admissions. (2)whenever a judgment is pr onounced under sub-rule (1) a decree shall be drawn up in accordance with the judgment a nd the decree shall bear the date on which the judgment was pronounced. In t he insta nt case there is a clear, unequivocal and unconditional admission of the Defendant in resp ect of the cla im of the Plaintiff. As such the nature of admission made by the Defendant can be held to be conclusive so as to invite an Order under Rule 6 of Order 12 CPC. No. NE-313(MZ) 2006-2008NOTIFICATIONNo. B. 11021/11/2016-FST/35-51, the 21st November, 2016.Whereas, para 3.1 (i) of the Handbook of Forest (Conservation) Act, 1980; Forest Conservation Rules, 2003 and Guidelines & Clarification published by Government of India, Ministry of Environment & Forests clarifies that compensatory afforestation is one of the most important conditions stipulated by the Central Government while approving proposals for de- reserva tion or diversion of forest land for non-forest uses; Wher eas, pa ra 3.4 (i) of t he Handbook stipulates that equivalent non- forest land identified for compensator y afforestation are to be tra nsferred to the ownership of the State Forest Department and declared as reserved/protected forest, so that the plantation raised can be maint ained permanently; Whereas, Ministry of Environment & Forest vide letter No.2-l/2003-FC dt.20.10.2003 stipulates that “The non-forest la nd which is tr ansferred and mutated in favour of the Stale Forest Department for the purpose of compensatory a fforest ation should be decla red as RF/PF under the India n Forest Act, 1927 prior to Stage-II approval.” Wher eas, the Ministry of Environment & For ests, Government of India vide F.No.8- 84/2002-FC dt.3.02.2004 amended para 4.2 (i) of the guidelines issued on 20.10.2003 under Forest (Conservation) Act, 1980 that “ the non-forest land which is transfer red and mutated in favour of t he State Forest Department for the pur pose of compensatory a fforesta tion, should be decla red as RF/PF under the Indian Forest Act, 1927. T he land sha ll be handed over to the User Agency after the sa me has been mutated in favour of Forest Department. Area of land : 58.28 Hectares. Starting Point : The Starting Point BP No.l was fixed on the eastern end of Sasaw tlang, locally known as Chhek hmun on t he south east corner of the land. Northern S ide : From BP No.7 the boundary line runs eastward along the stream in the dir ection of 70 degrees, and BP No. 8 was fixed at a dista nce 550.00 meters on the junction of two streams. Eastern S ide : From BP No. 8 the boundary line r uns southwards along the str eam called Arlei kawr, in the direction of 160 degrees, and BP No.9 was fixed at a distance of 350.00meters on the bend point of Arlei kawr. From BP No.9 the boundary line runs southwards along the stream “Arlei kawr” in the direction of 178 degrees, and meets the starting point BP No. l at a distance of 350.00 meters, thus closing in traverse. 2.Chhanchhuahna Location: It is located in t he adjoining a rea of Tuirial Riverine Reserve on the east of R. Tuirial and on the north of R. Tuipui on the western side of Chha nchhuahna Village. Area: 184.62 Ha. Starting Point : The starting point , BP No.l was fixed a t a sha dle called Kelzam Kawn on the corner of the area. Eastern S ide : From BP No.l, the boundary line runs Southwards a long the ridge in the direction of 212°, and fixed BP No.2 at a shadle with a distance of 1050.00 m. From BP No. 2, the boundar y line runs southwards along the str eam called Lawikai lui in the direction of 200° and fixed BP No.2 on a bend point of stream at a distance of 840.00 m. If the condition in these provisions are not fulfilled by the applicant or applicants t he Boar d shall have to reject outright. 3.The Board shall ha ve its sitting at least twice in a year or as may be required and TA sha ll be given to the members of the Boar d if t he pla ce of sit ting is mor e than 8 (eight) kilometer from the headquarter of the member. In ca se, C hair man of S AAB is S DO (C ) or BDO or P r es ident, Village Cou nc il t he a pp lica t ion for land allotment of any category must be submitted to the concerned Chair man. 5.The Board shall make initial screening of the a pplication with regard to location of the applied site. After a summary scr eening, the Board shall place the ma tter for demarcation of land by Surveyor, Revenue Depa rtment in the presence of the applica nt the concerned VC and neighbouring land holder, if any. Measurement of land should be a ccurate and NOC sha ll be obtained from the neighbouring land holder, if existent. Format of NOC is as prescribed by Revenue Department. 6.The demarcation report of S urveyor duly vetted by Assistant Survey Officer shall be scrutinized by the Board carefully. The recommendation of the meeting of Board shall be submitted to the concerned District Revenue Officer for fur ther submission to the Government through the Dir ector, Land Revenue & Settlement, Aizawl Mizor am for decision of the Government. 7.In case, there are more than one a pplicant for one plot or one area SAAB will make recommendation of such names in order of prior ity. 8.The SAAB shall have to exa mine whether a llotment of land will interfere or infringe upon public safety and security or general public health or public inconvenience or adverse impact on environment or natural beauty of the area or potential obstruction to fu ture infrastructure development wor k of the Government. It shall also take into account that the allotment of land shall not violate the provisions of the Mizoram (Prevention of Government Land Encroachment) Act, 2001 as amended fr om time to time. 9.The term of the Boa rd shall be three year s. The Government may, however, dissolve at any time or extend as it may deem necessary in the interest of public.
