And whereas the Council of Ministers in its meeting held on 12th December, 2012 (Wednesday) gave its approval for inclusion of Kawnpui ‘W’ and Darngawn ‘W’ village lands in the Thorangtlang Wildlife Sanc- tuary in view of conservation needs and in accordance with the villagers’ prior informed consent and initia- tives. And whereas, as required under Section 19 of the Wildlife (Protection) Act, 1972 and as directed by Government of Mizoram, the District Collector, Lunglei District carried out an inquiry into the existence, nature and the extent of rights of any person in or over the land comprised within the limits of the proposed extended area of “Thorangtlang Wildlife Sanctuary”; Now, therefore, in exercise of the powers conferred under Section 26-A (1) of the Wildlife Protection Act, 1972, the Governor of Mizoram hereby declares the area specified below as “Thorangtlang Wildlife Sanctuary” with effect from the date of publication of this Notification in the official Gazette. THORANGTLANG WILDLIFE SANCTUARY Name of the Area: Thorangtlang Wildlife Sanctuary Location: Thorangtlang and its adjoining areas comprosing Kawnpui ‘W’ and Darngawn ‘W’ village areas under Bunghmun ‘W’ RD Block, Lunglei District Area: 180 Sq.km BOUNDARIES OF EXTENDED THORANGTLANG WILDLIFE SANCTUARY North:The boundary starts from the point where Zawlpui lui meets Mar lui and followsZawlpui luiupstream till it reaches Rawthingkawn (the boundary of Zopui and Darngawn villages).Thence, it followsSekam lui down stream eastwards up toR.Tut. East:From Sekam luioutlet, the boundary follows R. Tutupstream till it meets the outlet of Tlubing lui. South:From the outlet ofTlubing lui, it followsTlubing lui upstream and crosses Vaawk Kawn (s addle.) T hence, following down theCharte luiandTuichar westwards till it meets Lungpum lui (Existing northern boundary of Thorangtlang Wildlife Sanctuary). No. NE-313(MZ) 2006-2008VOL - XLIV Aizawl, Tuesday 10.11.2015 Kartika 19, S.E. 1937, Issue No. 597 ELECTION COMMISSION OF INDIA Nirvachan Sadan, Ashok Road, New Delhi-110 001 DIRECTION No.576/3/2015/SDR the 21st May, 2015.Whereas, under Rules 22, 30 and 49B read with Rule 70 of the Conduct of Elections Rules, 1961, the ballot paper to be displayed on the balloting unit of the EVM, ordinary ballot papers, and postal ballot papers shall contain such particulars as the Election Commission may specify; and 1.Whereas, in terms of above mentioned Rules, the Commission has specified the particulars to be printed on the ballot paper to be displayed on the balloting unit and the postal ballot paper, and on ballot papers for elections from Council Constituencies and at elections by Assembly members; and 2.Whereas, the Commission has noted that there are many cases where candidates with same or similar names contest from the same Constituency, and although appropriate suffixes are added to the names of candidates in the event of two or more candidates having same name, the Commission considers that additional measures are required for removing confusion in the minds of electors at the time of voting, and further, the Commission considers that photographs of candidates on ballot paper will facilitate the electors in casting their votes and also the candidates in their campaign : 3.Now, therefore, after having considered all aspects of the matter, the Commission, in partial modi- fication of its existing directions under Rule 22, Rule 30 and Rule 49B read with Rule 70 of the Conduct of Elections Rules 1961, issued from time to time, hereby specifies that for all elections to be held from 1st May 2015 onwards, the postal ballot papers, the ordinary ballot papers and the ballot papers to be dis- played o n the balloting unit of EVM shall, in addition to the particulars as per the existing direct ions, also contain the photograph of the candidates printed thereon. The photograph of the candidates shall be printed in the panel for the name of the candidates and shall appear to the right side of the name in between the name and symbol of the candidate or the column for marking vote/preference, as the case may be. (ii) The pho t ograph sho uld be of st amp size 2 cm. X 2.5 cm. The photo may be in colour or black and white as may be convenient for the candidate. (iii) Photograph should be in normal clothing. Photograph in uniform is not permitted. Caps/hats should be avoided. Dark glasses also are to be avoided. 4.The above direction shall apply in relation to all elections to the House of the People, Council of States, Legislative Assembly and Legislative Council to be held hereafter. THE MIZORAM PRIVATE PLACEMENT AGENCIES (REGULATION) ACT 2015 AN ACT To provide for the regulation of Private Placement Agencies and for matters connected therewith or incidental thereto. It is enacted by the Mizoram Legislative Assembly in the Sixty sixth year of the Republic of India a follows :- CHAPTER - I PRELIMINARY 1.SHORT TITLE, EXTENT AND COMMENCEMENT (1)This Act may be called the Mizoram Private Placement Agencies (Regulation) Act, 2015 (2)It extends to the whole of the State of Mizoram. (3)It shall come into force on such date as the State Government may, by notification in the official Gazette appoint. 2.DEFINITIONS :- (1)In this Act, unless the context otherwise requires,- (a)“Appellate Authority” means an officer or Authority authorized by the State Govern- ment to hear appeal under Chapter III of this Act; (b)“Controlling Authority” means the Controlling Authority appointed under Section 3: (c)“Domestic Worker” means a person engaged through Private Placement Agency, to do domestic work; (d)“Government” means the Government of Mizoram; (e)“Licence” means a licence granted under Section 5; (f)“Notification” means a notification published in the Mizoram Gazette; (g)“Prescribed” means prescribed by rules made under this Act; (h)“Private Placement Agency” means a person or body of persons other than a Gov- ernment Agency, Department or organization engaged in the business of providing works to any women as domestic worker beyond the boundaries of Mizoram; (i)“Woman” means a woman as defined under Section 10 of Indian Penal Code, 1860 (No. 45 of 1860). (2)Words a nd expressions used but not defined in this Act shall have the same meaning as defined under any other corresponding law for the time being in force. CHAPTER - II 3.APPOINTMENT OF CONTROLLING AUTHORITY,- The State Government shall by notification in the official Gazett,- (a)Appoint any person not below the rank of Sub-Divisional Magistrate to be the Con- trolling Authority for the purpose of this Act, and (b)Define the limits within which the Controlling Authority shall exercise the powers conferred on him, by or under this Act. 4.PERSONS OR PRIVATE PLACEMENT AGENCY NOT TO OPERATE WITHOUT LICENCE: No person or Private Placement Agency shall carry on or commence the business of Private Place- ment Agency, unless he holds a licence issued under this Act. Provided that a Private Placement Agency which come into existence before the notification of this Act, shall obtain licence within ninety days of the notification of this Act. 5.APPLICATION FOR GRANT AND RENEWAL OF LICENCE,- (1)Every application for grant of Licence under Section 4 shall be in such form and manner as may be prescribed and shall be accompanied by fee of rupees five thou- sand and Bank Guarantee of rupees one lakh. (2)Controlling Authority may make such investigation in respect of the application re- ceived under sub-Section (1) and in making such investigation the Controlling Author- ity shall follow such procedure as may be prescribed. (3)A Licence shall be issued on such terms and on such conditions as may be pre- scribed. (4)A Licence issued under this Section shall remain valid for a period of five years and may be renewed from time to time on payment of such fees and or such conditions as may be prescribed. Ex-609/20152 6.CANCELLATION AND SUSPENSION OF LICENCE,- (1)If the Controlling Authority is satisfied either on the reference made to him in this behalf or otherwise, that- (a)a licence issued under Section 4 has been obtained by misrepresentation or suppres- sion of material fact, or (b)that the Licence holder has, without reasonable cause failed to comply with the con- ditions or contravened any of the provisions of this Act or Rules made thereunder, then without prejudice to any other penalty which the holder of the licence is liable under this Act, the Controlling Authority may, after giving the holder of the Licence an opportunity to be heard, by an order in writing revoke the licence or forfeit the bank guarantee furnished under sub-section (1) of Section 5 by him or any part thereof and communicate the order to the holder of the licence. Provided that where the Controlling Authority considers it necessary so to do for special reasons, he may, pending such revocation or forfeiture, by order, sus- pend the licence for such period as may be specified in the order a nd serve, by registered post, such order on the holder of the licence. (2)Subject to any rules that may be made in this behalf, the Controlling Authority may vary ar amend a Licence issued under this Act. CHAPTER - III APPEAL 7.APPEALS,- (1)Any person aggrieved by an order of the Controlling Authority, made under Section 5 or 6, may prefer an appeal, in such form and manner as may be prescribed, against the order to the Appellate Authority within a period of thirty days from the date of receipt of such order; Provided that an appeal may be admitted after the expiry of the said period of thirty days if the appellant satisfied the Appellate Authority that he has sufficient cause for not preferring the appeal within that period. (2)Before disposing of an appeal, the Appellate Authority shall give the appellant a reasonable opportunity of being heard. CHAPTER - IV FUNCTIONS AND DUTIES OF PRIVATE PLACEMENT AGENCIES 8.FUNCTIONS AND DUTIES OF PRIVATE PLACEMENT AGENCIES,- (1)Private Placement Agencies shall furnish the details of employment of Domestic Worker to the Controlling Authority within seven days from the date of conveying of domestic worker(s) beyond the boundaries of the State of Mizoram. (2)No Private Placement Agency shall charge any fee by whatever means from any domestic worker. (3)No Private Placement Agency shall employ, engage or deploy any women, if she is below eighteen years of age. (4)Every Private Placement Agency shall display a signboard outside its office showing the name of Private Placement Agencies and its Licence number.Ex-609/2015 3 (5)Every Private Placement Agencies shall maintain a register containing the names and ad- dresses of domestic workers, for whom it had arranged employment and also names and addresses and verified contact numbers of persons, where the woman workers have been employed. (6)Other functions and duties of Private Placement Agencies shall be such, as may be pre- scribed. CHAPTER - V OFFENCES AND PUNISHMENT 9.PUNISHMENT FOR CONTRAVENTION OF CERTAIN PROVISIONS,- (1)Any person who contravenes the provisions of Section 4 of this Act shall be punishable with imprisonment for a term which may extend to seven years or with fine which may extend to one lakh, or with both. (2)Any person who contravene the provisions of Section 8 or any of the rules made under this Act or any of the conditions of Licence issued herein shall be punishable with imprisonment for a term which may extend to three years, or with fine which may extend to fifty thousand, or with both. CHAPTER - VI MISCELLANEOUS 10 . APPLICATION OF CODE OF CRIMINAL PROCEDURE, 1973 (Act No. 2 OF 1974); The provisions of the Code of Criminal Procedure, 1973 (Act No. 2 of 1974) relating to any search or seizure shall be, so far as may be applicable to any search or seizure made under this Act. 11. ACT IN ADDITION TO ANY OTHER LAW,- This Act shall be in addition to and not in derogation of any other laws for the time being in force. 12 . POWER TO MAKE RULES,- (1)The State Government may, by notification, make rules for carrying out the provisions of this Act. (2)In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:- (a ) the form and manner in which the licence is to be issued under sub-section (1) of Section 5; (b) the investigation to be conducted under sub-section (2) of Section 5; (c ) terms and conditions subject to which such licence is to be issued under sub-section (3) of Section 5; (d) fees and conditions of renewal under sub-section (4) of Section 5; ( e) cancellation and suspension of licence under Section 6; Ex-609/20154 (f) the form and manner of appeal under sub-section (1) of Section 7; (g) other functions and duties of Private Placement Agencies under sub-section (6) of Section 8; and (h) any other matter which may be necessary to achieve the objects of this Act. (3)Every rule made under this Act shall be laid as soon as may be after it is made before the Legislative Assembly. 13 . PROTECTION FOR ACT DONE IN GOOD FAITH,- No, suit, prosecution or other legal proceeding shall lie against the Controlling Authority or any other person in respect of anything done or intended to be done in good faith in pursuance of this Act or the rules ma de thereunder. 14.OFFENCES TO BE COGNIZABLE AND NON-BAILABLE,- Notwithstanding anything contained in the Code of Criminal Procedure, 1973, all the offences pun- ishable under this Act shall be cognizable and non-bailable. 15.PENALTY FOR ABETMENT,- Whoever abets any offence punishable under this Act shall be punished with the punishment pro- vided for in this Act for such offence. 16.POWER TO REMOVE DIFFICULTIES,- If any difficulty arises in giving effect to the provisions of this Act, the State Government, may, by order, published in the Official Gazette, make such provisions not inconsistent with the provision of this Act, as may be deemed necessary for removing the difficulty. Provided that no such order shall be made after the expiry of a period of two years from the date of commencement of this Act. PROTECTION FOR ACT DONE IN GOOD FAITH,- No, suit, prosecution or other legal proceeding shall lie against the Controlling Authority or any other person in respect of anything done or intended to be done in good faith in pursuance of this Act or the rules ma de thereunder. 14.OFFENCES TO BE COGNIZABLE AND NON-BAILABLE,- Notwithstanding anything contained in the Code of Criminal Procedure, 1973, all the offences pun- ishable under this Act shall be cognizable and non-bailable. 15.PENALTY FOR ABETMENT,- Whoever abets any offence punishable under this Act shall be punished with the punishment pro- vided for in this Act for such offence. 16.POWER TO REMOVE DIFFICULTIES,- If any difficulty arises in giving effect to the provisions of this Act, the State Government, may, by order, published in the Official Gazette, make such provisions not inconsistent with the provision of this Act, as may be deemed necessary for removing the difficulty. THE MIZORAM APPROPRIATION VOTE ON ACCOUNT) ACT, 1978 & 1979 (REPEAL) ACT 2015 AN ACT TO REPEAL 1.The Mizoram Appropriation (Vote on Account) Act, 1978 2.The Mizoram Appropriation (Vote on Account) Act, 1979 It is expedient to repeal the Mizoram Appropriation (Vote on Account) Act, 1978 and the Mizoram Appropriation (Vote Account) Act, 1979 upon the recommendation of the Law Commission of India on account of the Acts becoming redundant and obsolete; It is enacted by the Legislative Assembly of the State of Mizoram in the Sixty-sixth Year of the Republic of India as follows, namely :- 1)This Act may be called the Mizoram Appropriation (Vote on Account) Act, 1978 1979 (Repeal Act, 2015. 2)It shall come into force from the date of its publication in the Official Gazette. The Mizoram Appropriation (Vote on Account) Act, 1978 and the Mizoram Appropriation (Vote on Account) Act, 1979 are hereby repealed. Notwithstanding such repeal, anything done or any action taken under the said Acts shall be deemed to have been validly done or taken under the said Acts. 1. Short title and Commencement 2. No. NE-313(MZ) 2006-2008VOL - XLIV Aizawl, Thursday 19.11.2015 Kartika 28, S.E. 1937, Issue No. 613 ELECTION COMMISSION OF INDIANir vachan Sadan , Ashoka Road, New Delhi-110001 NOTIFICATIONNo.576/3/VVPAT/2015/SDR-Vol.I, the 18th November, 2015.Wher eas, Section 61A of the Rep- resentation of the People Act, 1951, provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commis- sion of India may, having regard to the circumstances of each case, specify; and 2.Whereas, as per the proviso to rule 49A of the Conduct of Elections Rules, 1961, a printer with a drop box of such design, as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof as the Election Commission of India may direct; and 3.Whereas, the Election Commission of India has, vide its notification No.576/3/EVM/2015/SDR-Vol-I dated 12th November, 2015, already specified under the said section 61A of the Representation of the People Act, 1951, 12-Aizawl North-III (ST) Assembly Constituency in the State of Mizoram as the constituency in which the votes shall be given and recorded by means of voting machines at the poll to be taken for the current bye-election; 4.Now, therefore, the Election Commission of India, in exercise of its powers under the said proviso to rule 49A of the Conduct of Election Rules, 1961, hereby- (i)specifies 12-Aizawl North-III (ST) Assembly Constituency of Mizoram as the constituency in which a printer with a drop box shall be attached to every voting machine to be used for the giving and recording of votes at the current bye-election to the Mizoram Legislative Assembly from the said constuency; (ii)approves the design of the printer with the drop box as developed by the Bharat Electronics, Ltd., Bangalore, as the printer which shall be attached to the said voting machines to be used for the giving and recording of votes in the above said Assembly Constituency. Power to transfer Notwithstanding anything contained in these Rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these Rules to any other post or position which is equivalent in ra nk or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be recorded in writ ing, through the Department of Personnel & Administrative Reforms, relax any of the pr ovisions of these Rules with r espect to any class or category of persons. 9. Reservation and Nothing in t hese Rules sha ll affect any r eservations, relaxation of other concessions age limit and other concessions required to be provided for the Scheduled Castes/the Scheduled Tribes and other categories of persons in accordance with the order issued by Centr al Government or Government of Mizoram from time to time in this regard. 10. Repeal & Savings All Rules pertaining to the posts framed by the Government of Mizoram notified vide No. A. 12018/14(i)/82-APT(B) dated 12.05.1988 shall stand repealed with effect from the commencement of these Rules. Provided that any order ma de or a nything done or any action taken under the Rules so repealed or under any general order ancillary thereto, shall be deemed to have been made, done or taken under the corresp onding provisions of these Rules.
