In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following Rules regulating the method of recruitment to the post(s) ofC.T. Scan Technicianunder Health & Family Welfare Department, Government of Mizor am, namely: 1.Shor t title and (1) These Rules may be called the Mizoram Health & Family Welfare Commencement Depart ment (Group ‘B’ posts) Recruitment Rules, 2015. (2 ) These Rules shall come into force from the date of their publica tion in the Official Gazette. 2. Application These Rules shall apply to the posts specified in Column I of the Annexur e-I her et o a nnex ed. 3. Number of posts, The number of the said post (s), its cla ssifica tion and the scale of pay/ Classification and Pay Band & Grade Pay attached thereto shall be as specified in Column scale of pay/Pay Band 2 to 4 of the said Annexure – I. and Grade Pay 4. Method of r ecruitment, The method of recruitment, age limit, qualifications and other matters relating age limit and other to the said post shall be as specified in Columns 5 to 14 of Annexure – I. qualifications Provided that the upper age limit prescribed for direct recruitment may be relaxed in the case of candidates belonging to the Scheduled Castes/ the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government or Government of Mizor am fr om time to time. 5. Disqualification No per son – (a ) Who has entered int o or contracted a mar riage with a person having a spouse living; or - 2 - Ex-316/2015 (b) Who, having a spouse living, has entered into or contracted a marriage with any person shall be eligible for a ppointment to the said post (s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other valid grounds for doing so, exempt a ny such person from the operation of these Rules. 6.Training and Every Gover nment s ervant recruit ed under these Rules shall undergo such Departmental training or pass such Departmental Examina tion as may be prescribed from Ex amination time to time. 7. Power to transfer Notwithstanding a nything contained in these Rules, the Gover nor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these Rules to any other post or position which is equivalent in ra nk or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or exp edient s o to do, he may, by order and for reasons to be recorded in writing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Refor ms, relax any of the provisions of these Rules with r espect to any class or category of persons. 9. Reservations and Nothing in these Rules shall affect any reservation, relaxation of age limit other consessions and other concessions required to be pr ovided for the Scheduled Castes/ the Scheduled Tribes and other categories of persons in accordance with the orders issued by the Central Government or Government of Mizoram from time to time in this regard. MIZORAM STATE PUBLIC SECTOR ENTERPRISES' EARLY RETIREMENT RULES (ERR), 2015 In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, The Go verno r o f Mizo ram is ple ased t o mak e t he fo llo wing Rules, namely:- 1.SHORT TITLE,APPLICATION & COMMENCEMENT a) These Rules shall be called the Mizoram Public Sector Enterprises' Early Retirement Rules. (ERR) 2015 b) It shall apply to all the regular employees of all Public Sector Enterprises (PSEs) viz. MAMCO, ZENICS, ZOHANDCO, ZIDCO and MIFCO under Government of Mizoram. c) It shall come into force from the date of its notification in the Gazette of Mizoram. 2. OBJECTIVE a) To achieve sust ainability in t he all ro und fiscal operatio ns o f the State. b) Reducing the public debt that is threatening to assume unmanageable proportions. c) Closure of chronically sick/loss making and un-viable PSEs which cannot be revived. 3. DEFINITIONS In the Rules', unless the context ot herwise requires, a) 'Competent Authority' means t he Chief Executive Officer/Managing Director of the PSE concerned. b) 'Employee' means a person employed on permanent/regular basis working against sanc- tioned graded post. c) 'Emolument' means Basic Pay (including Grade Pay) plus appropriate percentage of DA as on the date of notification. d) 'P ublic S ect o r E nt er pr ise ( P S E ) ' means an ent it y t hat is:  Created under a statute of the State Legislature; in which case the management and control vests in Govt. of Mizoram, or  Created under the companies Act, 1956 in which the govt. of Mizoram holds equity share of more than 50% of those issued. e) 'Request for early retirement' means application submitted for early retirement, as per speci- men proforma annexed as Annexure-A. f)`Rules' means Mizoram St ate Public Sect o r Ent er prises' E arly Ret irement Rules (ERR) 2015. g) 'Service' means a period of permanent or regular employment against graded post as defined in the Service By-Laws/Regulations of the P SE. h) 'Year' means a financial year commencing on 1st April and ending on the subsequent 31st March. Ex-328/20152 4. OPERATION OF THE RULES The Rules shall remain in operation for 12 (twelve) months fro m the date of issuance of notifica- tion to this effect. The Government may extend it from time to time. 5. ELIGIBILITY All existing regular employees of PSEs under Government of Mizoram and are not accommo- dated into Govt. Service will be eligible for Early Retirement Rules. However, the following employees falling in the categories as determined by the con- cerned PSE are not eligible to seek Early Retirement under the Rules: a) Specialist employees who have executed service bonds and have not completed the period prescribed therein; b) Employees appointed on Contract/Muster Roll basis; c) Any other category of employees as may be specifically debarred by the PSE from seeking retirement under these Rules. Note: In case disciplinary action is pending against an employee, who had sought Early Retirement, the Disciplinary Authority shall, after considering all facts, convey to the Competent Authority whether the request of the employee should be accepted or not. In case the Disciplinary Authority decides that the request of such an employee for Early Retirement be not ac- ce pt ed , t he same sha ll be co mmu nica t ed t o t he emp lo ye e in wr it ing a nd he shall have a rig ht to make an appeal as provided under section 9 (e) of the Rules. 6. AMOUNT OF EX-GRATIA An employee seeking Early Retirement under the Rules will be entitled to the compensation con- sisting of: a) Ex-Grat ia Lumpsum Cash Co mpensat io n: i.Amount equivalent to 45 days emoluments for each completed year of service limited t o the total emoluments for remaining years of service at prevailing level, and ii.Amount equivalent to 15 days emoluments for each remaining year of service. b) Leave encashment as per the provisions of CCS (Leave) Rules, 1972, as applicable to employees of Government of Mizoram. c) Gratuity as per provisions of CCS (Pension) Rules, 1972, as applicable to employees of Government of Mizoram. 7. OTHER BENEFITS The Rules will no t co ver any ot her benefits as may be admissible t o the employee, like EPF etc.Ex-328/2015 3 8. MODE OF PAYMENT 100% of the amount of ex-gratia payable to an employee on opting for Early Retirement under t hese Rules wo uld be p aid in c ash w it hin 9 0 d ays fro m t he da t e o f his relie ving. If o t he rw ise t he benefits could not be settled due to technical or any other reasons which is beyond control, a provisional payment of Rs. 1,00,000.00 (Rupees One lakh) only will be made, and will be ad- just e d fro m the final payment . 9.PROCEDURE a) An eligible employee may submit request for availing Early Retirement under the Rules to the Competent Authority through proper channel in a prescribed Performa (Annexure-A), whic h s hall b e ava ila ble in t he P S E . b) The Competent Authority may after considering the application and after giving an opportu- nity to the applicant of being heard, pass a speaking order within a period of 1 month, either accepting or rejecting the request. c) In case the Competent Authority fails to pass an order rejecting the request by the due date as given at sub para (b) above, the request would be deemed to have been accepted and the employee would be retired. d) A copy of every order made under paragraph (c) above shall be given to the employee. e) An e mplo yee who is aggrieved by an o rder o f rejec t io n ma y wit hin t hirt y days fro m issu ance of such orders file an appeal before the Administ rative Secretary of the Department under which the concerned PSE falls, whose decision shall be final and binding. f)In case Chief Executive Officer/Managing Director of the PSE concerned opted to retire under ERR the competent authority shall be the respective Administrative Secretary. 10. GENERAL CONDITIONS a) Arrears of salary/wages due to general revision of pay scales etc. shall not be included in comput ing t he eligible amo unt . b) For the purpose of calculating Ex-Gratia Lumpsum Cash Compensation, fraction of service of 6 months and above shall be reckoned as one year for the purpose of calculating t he ex- gratia, age, years of service rendered, and remaining years of service. Fraction of service less t han 6 mont hs will be igno red for t he purpose of calculat ing t he ex-grat ia, age, years of service rendered, and remaining years of service. c) All the retirement benefits under these Rules will be sanctioned and authorized by the respec- tive parent department after obtaining approval from Finance Dept. (FMU). d) All payments under t he Rules and any other benefit payable to an employee shall be subject to the prior settlement/re-payment in full of loans, advances, returning of Govt.'s property and any o ther outstanding due against him and payable by him to the PSE concerned. e) All payments made under the Rules shall be subject to deduction of tax at source as per Income Tax Act 1961 wherever applicable. f)In the event of the death of an employee, whose request for early ret irement under the Rules has been accepted, the compensation, which would have become due and payable to the deceased employee, shall be paid to the person nominated to receive such dues. Ex-328/20154 g) The benefit s payable under t his Rules shall be in full and final set t lement o f all claims o f whatsoever nature, whether arising under the Rules or otherwise to the employee (or his nominee in case of death). An employee who retires under this Rules will not have any claim against the PSE concerned of whatsoever nature and no demand or dispute or difference will be raised by him or on his behalf, whether of re-employment or compensation or back wages including employment of any of his relative on compassionate grounds in the service of the P S E o r fo r any o t he r bene fit s w ha t so eve r. h) T he Go vt . r eser ves t he r ig ht t o w it hd r aw t hes e Rules a t any t ime it t hinks fit a nd it s d ecis io n in t his respect will be final. i)The Government shall have the power to review, amend or modify or rescind these rules. j)All matters regarding interpretation of these Rules, the interpretation of Finance Department (FMU) shall be final and binding, k) Filling up o f any result ant vacancies shall in no case be made wit ho ut prio r permissio n o f Finance Department, Government of Mizoram. 11. ENABLING RULES a) The Public Sector Enterprises must consider the Early Retirement Rules (ERR) and pass an order adopting it. b) The Rules shall come into effect only after requisite approval as laid down in Section 4 is received. However, the PSE may circulate t hese Rules & obtain response of the employees, in order to determine the financial and other implications. c) No PSE/Administrative Department may make any change to the Rules without seeking comment s of the Finance Depart ment and obtaining prio r approval of the Council of Minis- ters to the proposed changes. 1 2 . Power to transfer Notwithstanding anything contained in these Rules, the Governor of Mizoram, in public interest, shall have the right and power to transfer any officers, so recruited under these Rules to any other post or position which is equivalent in ra nk or gr ade. 8. Power to relax Wher e the Governor is of the opinion that it is necessary or expedient to do so, he may, by order and for reasons to be recorded in writ ing, in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of t he provisions of these Rules with respect to any class or category of persons. 9. Reservation and Nothing in t hese Rules sha ll affect any r eservations, relaxation of other concessions age limit and other concessions required to be provided for the Scheduled Castes/the Scheduled Tribes and other categories of persons in accordance with the order issued by Centr al Government or Government of Mizoram from time to time in this regard. 10. Repeal & Savings All rules p ertaining to these posts fr amed by the Government of Mizoram notified vide No.A.12018/53/80-APT(B) dated 16.01.1989 and published in the Mizoram Gazette extraordinary issue No. 3(B) dated 16.01.1989 stands hereby r epealed with effect fr om the date of commencement of these Ru les. An Ordinance further to amend the Negotia ble Instruments Act, 1881. WHERE AS the Negotia ble Ins trument s (Amendment) Bill, 20 15 ha s been pa ssed by the House of the People and is pending in the Council of Sta tes; AND WHEREAS, Parliament is not in sess ion and the Pr esident is satisfied that circumstances exist which render it necesary for him to take immediate act ion; Now THE REFORE, in exercise of the powers conferred by clause (1 ) of article 123 of t he Constitution, the Pr esident is pleased to pr omulgate the following Ordinance:— 1.(1) This Ordinance may be called the Negotiable Instruments (Amendment) Ordinance, 2015. (2) It shall come into force at once. 2. In the Negotiable Instruments Act, 1881 (hereinafter referred to as the principal Act), in section 6,—NOTIFICATIONNo.H. 12017/55/2014-LJD, the 13th July, 2015.The following Act is hereby re-published for general information. Short title and comme n- cement. 26 of 1881 Amendment of s ection 6. - 2 - Ex-338/2015 (i) inExplanation I, for clause (a), the following clause shall be substituted, namely:— ‘(a) “acheque in the electronic form” means a cheque drawn in electronic form by using any computer resource and signed in a secure system with digita l signature (with or without biometr ics signature) and asymmetric crypto system or with elect ronic s ignatur e, as the case may be;’; (ii) after Explanation II, the following Explanation sha ll be inserted, namely:— ‘Explanation III. —For the purposes of this section, the expressions “asymmetric crypto system”, “computer resour ce”, “digital signature”, “electronic for m” a nd “electronic signature” sha ll have the same mea nings resp ectively assigned to them in the Information Technology Act, 2000.’. 3. In the principal Act, section 142 shall be numbered as sub-section (1) thereof and after sub-section (1) as so numbered, the following sub-s ection shall be inserted, namely:— “(2) The offence under section 138 shall be inquired into and tried only by a court within whose local jur isdiction,— (a) if the cheque is delivered for collection through an account, the branch of the bank where the payee or holder in due course, as the case may be, maint ains the account, is situated; or (b) if the cheque is presented for payment by the payee or holder in due course otherwise thr ough an account, the branch of the drawee bank where the dra wer maintains the account, is situa ted. Explanation— -For the purposes of clause (a), where a cheque is delivered for collection at any branch of the bank of the payee or holder in due cour se, then, the cheque shall be deemed t o ha ve b een deliver ed t o the br anch of the bank in which the payee or holder in due course, as the case may be, maintains the account.”. 4. In the pr incipal Act, after section 142, the following section shall be inserted, namely:— “142A. (1) Notwithstanding anything contained in t he Code of Criminal Procedure, 1973 or any judgment, decree, order or dir ections of any court, all cases arising out of section 138 which were pending in any court, whether filed before it, or transferred to it, before the commencement of the Negotiable Instruments (Amendment) Or dinance, 2015 shall be transferred to the court having jurisdiction under sub-section (2) of section 1 42 as if that sub-section ha d been in for ce a t all mat eria l times. (2) Notwithstanding anything contained in sub-s ection (2) of section 142 or sub-section (1), where the payee or the holder in due course, as the case ma y be, ha s filed a complaint aga inst the drawer of a cheque in the court having jurisdiction under sub-section (2) of section 142 or the case has been transferred to tha t court under sub-section (1 ), and such complaint is pending in that cou rt, all subsequent complaints arising out of section 13 8 against the same drawer shall be filed before the same court irrespective of whether those cheques were delivered for collection or presented for payment within the territorial jurisdiction of that court.21 of 2000.
