AN ACT to amend the Cha kma Autonomous District Council (Village Councils) Act, 2003 a nd C ADC (Village Councils) Amendment Act, 2011 (hereinafter called the Principal Act and CADC (Village Councils) Amendment Act, 2011 respectively) and to provide for establis hment of Villa ge Councils and for other matters relating to Villa ge Administration. PREAMBLE : Whereas, it is expedient to provide for the establishment of Village Councils and their powers and for other matter relating to Village Administr ation including Village Police, Public Health and Sanitation; and Whereas, by clauses (e) and (f) of sub-paragraph (I) of paragraph 3 of the Sixth Schedule to the Constitution of India, the District Council for an Autonomous District is empowered to make laws in resp ect of the esta blishment of Village or Town Committees or Councils or any other matters relating to the Village or Town Administration, Village or Town Police a nd Public Health and Sanitation. Now, therefore, the Chakma Autonomous District Council; in exercise of the powers conferred on it a s aforesaid and of all other powers enabling it in that behalf is pleased to enact and it is hereby enacted as follows: 1.Shor t title, extend and commencement: (i) This Act ma y be called the Chakma Autonomous District Council (Village Councils) (Amendment)Act, 2014. (ii) It shall have like extend as the Pr incipal Act. ( iii) It shall be deemed to have come into for ce fr om the da te of its publication in the Mizoram Gazette. 2.Amendment of Section 3: Sub-Section (2) of section 3 of the Principal Act shall be substituted by the following: (A)“A Village Council shall be composed of members accor ding to the number of Households that it contains a s specified: - (a) for a Village having not more than 50 households there shall be 3 members; (b) for Villages having 51 houses or more but less than 101 households, there shall be 5 members; (c) for Villages having 101 but less than 151 households, there shall be 6 members; (d) for Villages having 151 households and above there shall be 7 members”. Pr ovided that the Execu tive Committ ee s ha ll ha ve the power to inc rea se or decrea se t he composition of seats in the Village Council(s) if and when it deems necessary a nd shall determine/ allot the number of seats in each and every Villa ge Councils. (B)Subsequent to the determination of seats by the Executive Committee, the St ate Election Commission shall along with the Election Notifica tion; declare the number of seats to be filled by election in each and every Village Councils before every Election”. 3.Substitution of Section 3: Sub-Section (7) of Section 3 of the Chakma Autonomous District Council (Village Councils) (Amendment) Act, 2011 shall be substituted as follows, namely- - 3 -Ex-39/2015Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. C/150 “The State Election Commission shall be vested with the superintendence, direction and cont rol of preparation of the Electoral Roll(s) for, and conduct of a ll elections to Village Councils. The State Election Commission may appoint Election Observers, the concerned Deputy Commissioner as Distr ict Election Officer, such other officers and employees of the State Government and employees of the District Council, as may be necessa ry, to assist the Sta te Election Commission/ District Election Officer and perform all such duties as ma y be directed by the State Election Commission from time to time. 4.Amendment of Section 6 In Section 6 of the Chakma Autonomous District Council (Village Councils) (Amendment) Act, 2011, after Sub-Section (3), the following Sub-Section (4), shall be added, namely- “(4) The Ex ecutive Committee shall have the power to extend or shorten the term of the Village Council(s) by not more than six months at a time”. Now, therefore, the Chakma Autonomous District Council; in exercise of the powers conferred on it a s aforesaid and of all other powers enabling it in that behalf is pleased to enact and it is hereby enacted as follows: 1.Shor t title, extend and commencement: (i) This Act ma y be called the Chakma Autonomous District Council (Village Councils) (Amendment)Act, 2014. (ii) It shall have like extend as the Pr incipal Act. ( iii) It shall be deemed to have come into for ce fr om the da te of its publication in the Mizoram Gazette. 2.Amendment of Section 3: Sub-Section (2) of section 3 of the Principal Act shall be substituted by the following: (A)“A Village Council shall be composed of members accor ding to the number of Households that it contains a s specified: - (a) for a Village having not more than 50 households there shall be 3 members; (b) for Villages having 51 houses or more but less than 101 households, there shall be 5 members; (c) for Villages having 101 but less than 151 households, there shall be 6 members; (d) for Villages having 151 households and above there shall be 7 members”. Pr ovided that the Execu tive Committ ee s ha ll ha ve the power to inc rea se or decrea se t he composition of seats in the Village Council(s) if and when it deems necessary a nd shall determine/ allot the number of seats in each and every Villa ge Councils. (B)Subsequent to the determination of seats by the Executive Committee, the St ate Election Commission shall along with the Election Notifica tion; declare the number of seats to be filled by election in each and every Village Councils before every Election”. 3.Substitution of Section 3: Sub-Section (7) of Section 3 of the Chakma Autonomous District Council (Village Councils) (Amendment) Act, 2011 shall be substituted as follows, namely- - 3 -Ex-39/2015Published and Issued by Controller, Printing & Stationery Department, Government of Mizoram Printed at the Mizoram Government Press, Aizawl. C/150 “The State Election Commission shall be vested with the superintendence, direction and cont rol of preparation of the Electoral Roll(s) for, and conduct of a ll elections to Village Councils. The State Election Commission may appoint Election Observers, the concerned Deputy Commissioner as Distr ict Election Officer, such other officers and employees of the State Government and employees of the District Council, as may be necessa ry, to assist the Sta te Election Commission/ District Election Officer and perform all such duties as ma y be directed by the State Election Commission from time to time. 4.Amendment of Section 6 In Section 6 of the Chakma Autonomous District Council (Village Councils) (Amendment) Act, 2011, after Sub-Section (3), the following Sub-Section (4), shall be added, namely- “(4) The Ex ecutive Committee shall have the power to extend or shorten the term of the Village Council(s) by not more than six months at a time”. Pu C .Rosiamliana entered into Government Service as Assistant on 21st November, 1988 in the office of Regis trar, F ir ms & Societies. He was transferred to Dir ector at e of Land Revenue & Settlement Department on 21.09.1998. After that he was transferred & posted to Taxation (Secretariat) w.e.f. 28.11.2010. He was promoted to Junior Grade of MSS on 30th September 2014 and posted as Superintendent, Vigilance Department where he served till his final day. He served the Government of Mizora m for 26 years, 02 months and 12 days with ut most sincerity and devotion, a nd endeared himself t o all his colleagues. He alwa ys proved himself to be a cons cientious officer. The Government placed on record its deep appreciation of the sincere service rendered by Pu C.Rosiamliana and convey its he artfelt sympathy and condolence to the bereaved family. Amendment of Rule 5 Rule 5 of the Principal Rules shall be substituted as follows, namely, “COMPOSITION: The service shall have the following Grades, namely:- GradeName of posts1. Grade-IAddl. Registrar of Coop. Societies 2. Grade-IIJoint Registrar of Coop. Societies 3. Grade-IIIDepu ty Registrar of Coop. Societies 4. Grade-IVAssistant Registrar of Coop. Societies 5. Amendment of Rule 6 Rule 6 of the Principal Rules shall be substituted as follows, namely, “CLASSIFICATION: Members belonging to Grade I to IV mentioned in Rule 5 of these Rules shall be classified as Group ‘A’ Officer s and Grade V as Group ‘B’ Gazetted Officers or as may be determined by the Government from time to time.” 4. Amendment of Rule 9 Rule 9 of the Principal Rules shall be substituted as follows, namely, “RECRUITMENT TO THE SERVICE: Recr uitment to Gra de-V of the Service, after commencement of thes e Ru les, s ha ll b e 40 % b y pr omot ion, 3 5% b y Limited Departmental Examination (LDE) and 25% by direct recruitment through the Commission in accordance with the conditions laid down by the Government from time to t ime” - 2 - Ex-42/2015 5.Amendment of Rule 10 Rule 10 of the Principal Rules shall be substituted, as follows, namely, “CONDITIONS OF ELIGIBILITY FOR CONSIDERING APPOINTMENT: In or der to be eligib le for a ppointment to Gr ade-V of the ser vice, a ca ndidate must sa tisfy the following conditions, namely:- 1. Nationality : He/She must be a citizen of India. 2. Method of r ecruitment: (a ) 40% of the sanctioned posts in Grade-V sha ll be filled up by promotion from Junior Inspector of Cooperative Societies with not less tha n 5 (five) year s of regular service in the gr ade by Selection method. (b) 35% of the sanctioned posts in Grade-V sha ll be filled up through Limited Departmental Examination from a mongst Junior Inspector of Cooperative S ocieties with not less than 5 (five) years of regula r service in the grade. (c ) 25% of the sanctioned posts in Grade-V sha ll be filled up by direct recruitment through open competitive examination from graduates of recognized University” 3. Promotion: (a) Grade-I: Vacancy in this Grade shall be filled by promotion from members of the service in Grade-II who have rendered not less than 5 (five) years of regular service in the Grade failing which officer s on regular service in Gra de-II who have completed 25 (twenty five) years of regular service calculated from the da te of entr y int o Gr ade-V of the service. T he method of p romotion to this Gra de shall be “SELECTION”. (b) Grade-II: Vacancies in this Grade shall b e filled by promotion from members of the service in Grade-III who have rendered not less than 5 (five) years of regular service in the grade failing which officer s on regular service in Grade-III who have completed 20 (twenty) yea rs of r egular service calcula ted from the date of entr y into Grade-V of the service. The method of p romotion to this grade shall be “SELECTION”. (c) Grade-III: Vacancies in this Grade shall be filled by promotion from the members of the service in Gr ade- IV who ha ve r endered not less tha n 5 (five) year s regular service in the grade. The method of promotion to this Gra de shall be “ SELECTION”. (d) Grade-IV:75% of the sanctioned posts in this Grade shall be filled by promotion from amongst the members of the service in Grade-V who have render ed not less than 5 (five) years of regular service in the grade by Selection method whereas 25% of the sanctioned posts in this Grade shall be filled through Limited Depa rtmenta l Examination from a mongst the members of the service in Grade-V who have rendered not less than 5 (five) years of regular service in the gra de” 6.Amendment of Rule 11 Rule 11 of the Principal Rules shall be substituted as follows, n a me l y, “APPOINTMENT TO THE SERVICE: After commencement of these rules, all appointments to Gr ade- I to Grade-V of the service shall be made by the Governor through the Commission and notified in t he Mizoram Gazette after fulfilling the conditions la id down in Rule 10 of these rules” 7. Amendment of Rule 12 Rule 12 of the Principal Rules shall be substituted as follows, n a me l y, “PROBATION AND CONFIRMATION: (1) A person appointed t o the Service by direct recruit ment shall be on probation for a period of 2 (two) years, which may be extended for good and sufficient reasons by the Government for a fur ther period as may be determined by the Government. (2) Wher e a probationer has successfully completed his/her probation period or any extension thereof to the satisfaction of the Appointing Authority, he/she may be confirmed in service. (3) If during the period of probation referred to in sub-rule (1) and sub-r ule (2), as the case may be, the Appointing Authority is of the opinion that an Officer is not fit for regular appointment, he/she may, in consultation with the Commission through DP&AR, dischar ge the Officer from Service or pass an order as deemed fit Provided that a person who has been already confirmed in any of the posts u nder the State Government before being appointed as a member of the Service shall be deemed to ha ve been confir med in Service” 8. Amendment of Rule 14 Rule 14 of the Principal Rules shall be substituted as follows, n a me l y, “INCREMENT: The first increment of pay in the time scale of pay in respect of a member of the Service in Grade-V appointed by direct recr uitment shall accrue on confirmation in the Service and the incr ement shall be regulated in accordance with Government of India’s Decision No. (6) a nd Audit instruction No. (4) below Rule 26 of Fundamental Rules” 9. Entitlements:3.(1) A Retired Judge of the Gauhati High Court shall be entitled to the service of s tenogra pher (G rade II) in the employment of the Gauhati High Court. Provided tha t a Retired Judge, in lieu of service of a S tenogra pher (Grade II), may get Rs. 9000/- if he was Chief Justice and Rs. 6000/- otherwise per month to enable him to get secretar ial service of any private Stenographer. (2) A retired Judge of the Ga uha ti High Court sha ll also be entitled to a Residential Orderly (Sevak/Cook) in the employment of the Gauhati High Court. In case a Ju dge pre-decease his or her spouse before or a fter his or her retir ement, this facility shall be available to the spouse and his or her family during his or her life time. - 2 - Ex-46/2015 Provided that a Judge or his/her spouse, as the case may be, in lieu of the service of a Residential Orderly (Sevak/Cook) may opt to receive Rs. 6000/- if he was Chief Justice and Rs. 4000/- otherwise per month to enable him or her to get the service of P rivate Residential Orderly (Sevak/ Cook). (3) Wher e, however a r etired Judge has been re-employed, the pr ovisions of these Rules shall not apply during the period the judge receives, or is entitled to r eceive, any emolument or benefits by virtue of such re-employment. (4) A retired Judge shall be entitled to transport to the extent of 1000 Kms. in a month on payment of Rs. 5/- kilometer at Aizawl, Delhi and Kolkata where the State Government has its Establishments. And wher eas in the Chief Justices’ Conference it was r esolved tha t secr eta ria l a ssistance and domestic help to be made available to r etired Judges of the High Courts and Supreme Court of India ; And whereas in pursuance of the sa id resolution it is considered expedient to make such assistance ava ilable to the retired Judges ; Now therefore, the State Government in consulta tion with the Gauhati High C ourt, hereby makes the following rules :- Title and1.These Rules may be called theRetired Judges Secretarial Assistance Commencement:and Domestic Help Rules, 2014. 2.These Rules shall come into force from the da te as may be a ppointed by the State Government by a notification in the Official Gazette. Entitlements:3.(1) A Retired Judge of the Gauhati High Court shall be entitled to the service of s tenogra pher (G rade II) in the employment of the Gauhati High Court. Provided tha t a Retired Judge, in lieu of service of a S tenogra pher (Grade II), may get Rs. 9000/- if he was Chief Justice and Rs. 6000/- otherwise per month to enable him to get secretar ial service of any private Stenographer. (2) A retired Judge of the Ga uha ti High Court sha ll also be entitled to a Residential Orderly (Sevak/Cook) in the employment of the Gauhati High Court. In case a Ju dge pre-decease his or her spouse before or a fter his or her retir ement, this facility shall be available to the spouse and his or her family during his or her life time. - 2 - Ex-46/2015 Provided that a Judge or his/her spouse, as the case may be, in lieu of the service of a Residential Orderly (Sevak/Cook) may opt to receive Rs. 6000/- if he was Chief Justice and Rs. 4000/- otherwise per month to enable him or her to get the service of P rivate Residential Orderly (Sevak/ Cook). (3) Wher e, however a r etired Judge has been re-employed, the pr ovisions of these Rules shall not apply during the period the judge receives, or is entitled to r eceive, any emolument or benefits by virtue of such re-employment. (4) A retired Judge shall be entitled to transport to the extent of 1000 Kms. in a month on payment of Rs. 5/- kilometer at Aizawl, Delhi and Kolkata where the State Government has its Establishments. The Committee will carry out its functions in accordance with the procedure laid down under the Act and Rules.
