Entitlements on Accommodation:The upper ceiling for room entitlements shall be limited to :- Pay Level in the Pay MatrixEntitlements per Night 13 & above-2,000 or act ual char ge whichever is less 10 to 12-1,000 or act ual char ge whichever is less 7 to 9-700 or actual charge whichever is less 6-500 or actual charge whichever is less 1 to 5-300 or actual charge whichever is less 1-200 or actual charge whichever is lessFor patient s refer red out side the State, the u pper ceiling shall be double the amount fix ed above in each category. Any charge of accommodations beyond the entitlement shall be paid from the Government Serva nts’ own pocket a nd will not be reimbur sed. In the Case of patients treated in ICU, reimbursement for all cases, irresp ective of the category of Government S ervant shall be permissible. No. NE-313(MZ) 2006-2008NOTIFICATIONNo.H. 11018/4/2018-REV, the 16th January, 2019.Wher eas ther e is a need to ensure proper la nd recording a nd smooth running of land administr ation, the Governor of Mizor am, exercising the powers conferred by section 128 a nd 129 of the Mizoram (Land Revenue) Act, 2013, is pleased to hereby issue the following orders, with immediate effect and until further order : 1.Settlement or conversion of land allotted by other competent authorities: 1.1No land sha ll be processed for settlement, except with prior approval of t he Government, unless the land was pr eviously allotted by t he Gover nment a s per procedur es of the relevant land law in force, and recorded-in the Recor d of Rights or General Register of the La nd Revenue & S ettlement Depa rtment, Government of Mizoram. 1.2In case of land which is claimed to have been validly allotted by any competent authority other than the Government of M izoram, the genuineness and validity of such allotment shall be confirmed against the records of the allotting a uthorit y, and such allotment of land may, thereaft er, be converted into appropr iate type of land allot ment under the Mizora m (Land Revenue) Act, 2013, subject to prior appr oval of the Government a nd the provisions of t he said Act. 2.P ar titioning, ar ea-cor rection a nd extens ion of la nd holding: 2.1Whenever it appears that the area of a land holding which is intended for partitioning needs correction, the required area-correction shall be completed first before processing the application for partit ioning. The two proceedings, being different from each other shall not be taken up at the same time. 2.2Extension of area of an allotted land towards adjacent public road or any other public place or property sha ll not be processed without obtaining from the authority controlling such public property a certification that such public property is not encroached or overlapped by the intended extension. 2.3No land holding sha ll be extended so as to include the a rea occupied by existing drains or str eams or a ny existing structure such as culver t, bridges and masonr y works constructed by the Government or loca l body a cross or along such dr ainage or stream or public roa d on a public land.VOL - XLVIII Aizawl, Friday 18.1.2019 Pausha 28, S.E. 1940, Issue No. 34 3.No-Objection from land holder beyond adjacent footpath, etc.: 3.1Whenever there is a proposed step or footpath, or existing dr ain or stream (kawrte),etc. adjacent to the land applied for allot ment or extension, whether the land beyond such stream, etc. is vacant or not s hall be indicated on the sketch map. 3.2If the land beyond is not vacant, the land holder concerned shall have to be informed to be present with a copy of his land document during the demarcation, and the signature of the land holder shall be obta ined by the Surveyor on the NOC form. T he land document No. and Year and the holder of such neighbouring land holding shall also be indicated on the sketch map and Surveyor ’s comment for the land so demarcated. 4.Na me of pr oposer of footpath or r oad, etc. to be indica ted in survey ma p: If there is any pr oposed step or footpa th or r oad beside the land applied for allotment, the name of person or authority who has proposed such road or footpath shall also be indica ted by the Sur veyor in his repor t. The proposed roa d or footpath shall also be r ecorded in the land record/la nd document of t he neighbouring land holding concerned. · 5.Updating G.I.S Data: 5.1All demarca ted land maps for applications for allotment of land shall be routed through the GIS Section for confirming the vacancy of the land concerned, and for monit oring overlapping application, and appropriatetemporary markingshall be ma de on t hedatabase mapfor the ar ea being applied, if the said area is vacant. 5.2Whenever the site applied for allotment of land is found to have already been allotted earlier, the application shall be returned immediately to the Section concerned with appropria te rema rks. 5.3After the competent authority gives his decision on the application, the sa me sha ll be r outed through the GIS Section in each LR&S Office forfina l updatingof t he data base if the application is approved, or forcancella tion of the tempora ry markingon the database map in case of rejection of the same. 6.Updating of Land Record: 6.1The General Register or Record of Right s and the GIS/Database Map, a s the case ma y be, shall be updated on every instance of - (a)New a llotment of land, or (b)Sett lement of temporary allotted land, or (c)Relinquishment of land holding, or (d)Cancellation of allotment, or (e)Mutation, or (f)Alteration of area, or (g)Diver sion of land-use, or (h)Renewal/extension of Lease period incase of temporarily allotted land holdings , or (i)Mortgage of the land.- 2 - Ex-34/2019 6.2The Revenue Officer concerned shall furnish full updated information on any land to any bona fide citizen of India who requests for such information on the sta tus of the land concerned, in the ma nner and on payment of a ny fee prescribed therefor under the law. 7. Relocation of allotted land 7.1Inspite of the fact that t here is no provision in the Mizoram (Land Revenue) Act, 2013 for reloca ting the allotment of land, there may be instances where relocation may b e resor ted to. In such a sit uation, the relocation of existing land allotment may be proposed to the Government by the Revenue Officer concerned, giving full clarification and justification therefor, along with suggestion as to where vacant land is available for the purpose. 7.2Since relocation involves cancellation of the allotment at the existing/original location and allotment of land at a new location which is the sole purview of the Government, no allotment of land shall be relocated by any subordina te authority without prior a pproval of the Government. 7.3Any relocation ma de without prior approval of the Government, if any, is null and void; however, the allotment so relocated as such shall remain valid for the location as originally approved by the Government unless the same has been cancelled by competent author ity.
