No. NE-313(MZ) 2006-2008VOL - XLVI Aizawl, Thursday 2.11.2017 Kartika 11, S.E. 1939, Issue No. 663 NOTIFICATIONNo. B.12021/2/2001-TRP, the 1st November, 2017.T he following dr a ft of certa in rules fu r ther to amend the Mizoram (Regula tion and Contr ol of Vehicles Parking) Rules, 2000, which the Government of Mizoram proposes to make in exercise of the powers conferred by sub-section(1) of section 138 of the Motor Vehicles Act, 1998 is hereby published as required by sub-section(1) of section 212 of the said Act. For informa tion of all persons likely to be affected thereby; and notice is hereby given that the said draft shall be ta ken into consideration after expiry of a period of ten days from the date on which the copies of this notification a s published in the Gazette of Mizoram are made available to the public. Any objections or suggestions received from any person with resp ect to the said draft rules within the expiry of the period so specified will be consider ed by the Government of Mizoram. Objections or suggestion, if any, may be sent to the Secretary to Government of Mizora m, Transport Depa rtment within the period specified above. DRAFT RULES 1.Shor t title, extent and commencement:- 1) These rules may be called the Mizor am (Regulation a nd Contr ol of Vehicles P arking) (Amendment) Rules, 2017. 2) They sha ll have the like ext ent as the P rincipal Ru les. 3) They shall come into force on the date of publication in the Official Gazette. 2.Amendment of Enabling Pr ovisions :- In the Enabling Pr ovisions to the Mizor am (Regulation and Control of Vehicles Parking) Rules, 2000 (hereinafter r eferred to as the Principal Rules), a fter the word “under” a nd before the word “clause (e)” the word “ sub-section (1)” shall be inserted and the words “clause(e) and (j) of sub-section(2)” shall subs titute t he word “cla use(e)”. 3.Amendment of rule 2:- In r ule 2 of the Pr incipal Rules, after clause (d), the following clauses (da) and (db ) shall be added, namely:- “(da ) Garage: Garage means and includes the following: (i)A building meant for housing a motor vehicle; (ii)enclosed structure built next to or as part of a building for housing a motor vehicle; (iii)any area/ar eas maintained for pr ivate use or a ny area including but not limited to Fields, Parks etc generally fr equented by the Public officia lly acknowledged to be a Garage by the Designated Govt. Author ity; (iv)enclosed space of Private Premises meant for housing motor vehicles, whether on rent, lease or otherwise subject to fina l acknowledgement to be a Ga rage by the Designated Govt. Author ity; (v)spaces in a Multi Level C ar Parking building run by the Government/PSU/Co-operative Societies or a ny other organization of such nature officially acknowledged to be a Garage by the Designated Govt. Author ity. “(db ) illegal parking: Without pr ejudice to any other r elevant provisions of law, statutes/ notifica tions, etc, a vehicle shall be deemed to be parked illegally if it is par ked in any pla ce other than a garage or private premises, but including any place encompa ssed within roa dside, lane, b ye-lane, street etc. declared from time to time by the Government or any authority authorized by the Government on this behalf as par king areas for a continuous period of 5 hours or overnight without prior permission from the Government or appr opriate authority designated by the Government for this purpose. 4. Amendment of rule 8:- Rule 8 of the Principal Rules shall be substituted by the following, namely:- “8 (1) No vehicle whether serviceable or unserviceable, Government or private, shall be allowed to be parked in a manner as specified in clause (db) of rule 2 of these rules and in the instance of any contravention thereof, such defaulter (owner or driver of the vehicle) shall be liable to pay a fine or fines which will initially b e as detailed below until altered by the Government by notification in the Official Gazette: (i)Rs. 500/- for the contravention committed dur ing 6 A.M. to 5 P.M. (ii)Rs. 1000/- for contravention arising out of overnight parking. (iii)Any subsequent cont ravention will entail a fine double the amount of each previous fine levied irrespective of whether the contr avention is consecutive or not”. (2)The authority for enforcing this provision shall be the Traffic Police by observing all codal formalities or procedur e thereof.” 5.Amendment of rule 10:- Sub-rule 1 of rule 10 shall be substituted by the following namely: “(1) If the Owner or the Driver of any vehicle refused to pay the fine for illegal parking the Vehicle ma y be seized by the near est Tra ffic Police on duty, after observing all codal for malities of such seizures. If situa tion dema nds, such seized vehicle shall be removed to the nearest Police Station or to a place to be specified by the Government under section 117 of the Motor Vehicle Act, 1988 at the cost of the owner of the vehicle. A vehicle so seized may be relea sed on payment of additional fine which will initially be as detailed below until altered by the Government by notification in the Official Gazette: Ex-663/20172 1.Rs. 1500/- with regard to vehicle seized for contravention of clause (i) of sub-rule (1) of rule 8. 2.Rs. 2000/- with regard to vehicle seized for contravention of clause (ii) and (iii) of sub-rule (1 ) of rule 8. 6.Addition of new r ule 12-A:- After rule 12 of the Principal Rules, the following rule 12-A shall be added, namely “12-A : These r ules shall be without pr ejudice to any of the provisions of the Aizawl Municipal C ouncil (Control of Par king and Collection of Parking Fees) Regulations, 2012 a nd accordingly be deemed to supplement the said Regulation with regard to Aizawl Municipal Council ar ea.” Lalthangpuia Sailo, Secr etary to the Govt. The Mizoram Parliamentary Secretaries (Appointment, Salaries, Allowances and Miscellaneous Provisions) (Repeal) Ordinance, 2017 (Ordinance No. 2 of 2017) Promulgated by the Govenor of Mizoram on the Sixty Eight year of the Republic of India An Ordinance to repeal the Mizoram Parliamentary Secretaries (Appointment, Salaries, Allowances, and Miscellaneous Provisions) Act, 2009 WHEREAS the Mizoram Parliamentary Secretaries (Appointment, Salaries, Allowances, and Miscella- neous Provisions) Act, 2009 came into force on 29th December, 2008 retrospectively; AND WHEREAS PIL No. 51/09 was filed in the Hon’ble Gauhati High Court wherein the Constitutional validity of the Mizoram Parliamentary Secretaries (Appointment, Salaries, Allowances, and Miscellaneous Provisions) Act, 2009 was challenged and the Hon’ble Gauhati High Court has in its Order dt.06.11.2009 deferred the hearing of the matter so that it can have the benefit of the decision of the Hon’ble Supreme Court on the matter since similar enactments in Assam & Nagaland are under challenge in the Hon’ble Supreme Court; AND WHEREAS the Hon’ble Supreme Court in its Judgment & Order dated 26th July 2017 in Transferred Case (civil) No. 169 of 2006 Bindangshu Roy (Dead) through LRs Vs State of Assam & Another has declared the Assam Parliamentary Secretaries (Appointment, Salaries, Allowances and Miscellaneous Pro- visions) Act, 2004 as unconstitutional; AND WHEREAS the Legislative Assembly is not in Sess ion a nd the Governor of Mizoram deems it expedient to immediately repea l the Mizor am Parlia mentary S ecretaries (Appointment, Sala ries, Allow- ances, and Miscellaneous Provisions) Act, 2009 in light of the ruling of the Hon’ble Supreme Court in Transferred Case (civil) No.169 of 2006 Bindangshu Roy (Dead) through LRs Vs State of Assam & An- other, and in the process of being a responsible Government which upholds the Rule of Law; NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Governor of Mizoram is pleased to promulgate the following Ordinance, namely :- 1.Short title and commencement :(1)This Ordinance may be called the Mizoram Par- liamentary Secretaries (Appointment, Salaries, Al- lowances, and Miscellaneous Provisions) (Re- peal) Ordinance, 2017 (2)It shall commence from the date of its publica- tion in the Official Gazette. 2.Repeal and Savings:(1)The Mizoram Parliamentary Secretaries (Appoint- ment, Salaries, Allowances, and Miscellaneous Provisions) Act, 2009 is hereby repealed.
