FOURTH REPORT OF THE ASSEMBLY PAY COMMITTEE, 2017R E P O RT T he accountabilit y of the Executive to the Legislature is a basic principle of a Pa rliamentary Democracy without which there cannot be an efficient a nd transparent Government. Every S tate Legislature, irrespective of its size, has a distinct sanctity and importance because of its distinct nature of works and not the volume. There is no denying the fact that the Legislature of a State in its present status is hard to be portrayed as a body to which the Executive is accountable in administrat ive and fina ncial matters. As a result , the p ossibility of the s anctity and impor tance of the Legislature dwindling in the eyes of the Executive looms la rge in the horizon. Under the circumstances, upgradation of the Legislatur e of a State to a status higher than the one it has been enjoying is the need of the hour. In order to upgrade the sta tus of the Legislature, upgradation of the post of Secretary of the Legislature is the first prerequisite. 2.The All India Conference of Presiding Officers and Secretar ies of Legislative Bodies in India, being awar e of this fa ct, had been engaging its expertise in the discussion of the subject for some years. The Conference, in its meeting held in Delhi in 1998 a dopted a resolution for upgradation of the status of Secretary of State Legislatures in India in terms of rank and pay in the pattern of Parliament and re-designation of the post as Principal Secretary. However, the resolution has not been implemented by Mizoram State Legislature till date. 3.In exercise of the powers conferred by Article 187 of the Constitution of India, the Government of Mizoram has made separ ate rules for the employees of the Mizoram Legisla tive Assembly Secretariat i.e. The Mizoram Legislative Assembly Secretar iat ( Recruitment and Conditions of Service) Rules, 1995. Since then, recruitment and condit ions of service of the Mizoram Legisla tive Assembly has been governed by separate rules. Thus, the officers and staff of the Mizoram Legislative Assembly have been appointed by the Hon’ble Speaker and the Secretary by the Hon’ble Governor on the recommendation of the Hon’ble S peaker. The position and authority of the Hon’ble Speaker in the matter of recruitment, terms and conditions of service of the officers and staff have ever since been recognized by rules and conventions. 4.The budget estimates of Mizoram Legislative Assembly a nd its Secretariat, prepar ed by the Assembly Secretariat are scrutinized by a Budget Committee constituted under Rules 285 to 287 of the Rules of Procedure and Conduct of Business in Mizoram Legislative Assembly under the Chairmanship of the Deputy Speaker, and submitted to the Hon’ble Speaker for his approval. After the appr oval of the Hon’ble Speaker, the estimates are forwar ded to Finance Depar tment for incorpora tion in the State Budget as a matter of course. The estimates are not subject to scrutiny by the Finance Depa rtment or any other Commit tee of the Government. If the Finance Department has any observa tion to make, it shall be submitted to the Hon’ble Speaker for his consideration. In the event of any difference of opinion between the Committee and the Finance Department, the decision of the Hon’ble Speaker in consultation with the Leader of the House shall be final. 5.Owing to t he independent na tur e of the Ass embly Secretar iat, the quest ion of revis ion of pay scale of officers and staff of the Secretariat was kept outside the purview of the State Pay Commission constituted from time to time and the rules made thereof. {Par a 5.28 of t he Fit ment Committee, 2009 and Rule 2 (2) (i) of the Mizoram (Revision of Pay) Rules, 2010 } 6.Legislative Assemblies discharge specialized function and the job requirements are quite distinct from those of the State Government or other bodies. T he pay structure, designation, etc may not be identical with those of other Depa rtments under the Government of Mizoram and other bodies. The upgrada tion of the post of the Secretary, Mizoram Legislative Assembly to that of the post of Commissioner and Secretary will also necessitate the filling up of the said upgraded post from the Officer s of the Legislative Assembly itself who ar e well ver sed and exp erienced in pa rliamentary practices, procedures and legislative matters. The appointment of Officers other than that of the Legislative Assembly cadres to the post of Commissioner and Secretary would defea t the very purpose and underlying concept of the need for upgradation of the post of Secretary. The then Lok Sabha Speaker Mavalankar, while considering the conditions of services of both Secretariat of Lok Sabha and Rajya Sabha had rightly observed in 1948“Every officer, su bor dina t e or other wis e, serving in the S ecretariat of the Legislatu re must be in a position t o carr y out his duties without fear or favour of the Executive Government, and obviously this cannot be done if persons in the employ of the Legislature Secretariat have to look upon such bodies as Selection Board, consisting of the officers and nominees of the Executive Government, for their chances and career in the Secretariat of the Legislature.” 7.Convinced of the urgent need for the said upgra dation, the Hon’ble Speaker cons tituted an Assembly Pay Committee to exa mine the matter thoroughly and take steps for ear ly implementa tion- 2 - Ex-635/2017 of the resolution adopted by the All India Conference of Secretaries of Legislative Bodies in India. The Commit tee held a sitting on 5.10.17 wherein the ma tter was thoroughly examined with members freely expr essing their views a nd opinions. 8.During the sitting, relevant information like resolutions adopted by the All India Confer ence of P residing Officers and Secretaries of Legislative Bodies in India held in 1998 and the orders issued by other State Legislatures for the upgrada tion of the post of Secretary in their respective Legislative Assemblies to that of the post of Principal Secretary were examined and considered. The Minutes of the Executive Committee Meeting of the North East R egion Commonwealth Parliamentary Association held on 15.01.2005 at 7:30 P.M. at Circuit House, Agartala, Tripura on the eve of the 8th Annual Conference of the NERCPA held at Agar tala, Tripura during 16 –17 January, 2005 attended by 17 (seventeen) members and 1 (one) Observer was also examined in details by the members. The said minutes had st ated that the following resolution would be adopted by the 8th Annual Conference of North East Region Commonwealth Parliamentary Association to be held at Agartala on 16th and 17th January, 2005 : “The resolution passed by the Gandhinagar Conference of the All India Conference of Secr etaries of Legislative Bodies held at Delhi on 21 .9.1998 regar ding independent and sepa rate Secretariat for State Legislature is again pursued vigorously by this Conference. It is further resolved that all State Legislatures of North East States should initiate step to upgrade the status of the Secretary of State Legislature by re-designating the post of Secretary as Principal Secretary in terms of rank and pay on the pattern of Parliament except Sikkim L.A. which had already re- designated the post as Principal Secreta ry”. 9.The Assembly Pay Commit tee is of the opinion that the resolution adopted by the All India Conference of Presiding Officers and Secretaries of Legislative Bodies in India was of utmost necessity taking into consideration the three pillar s of Parliamentary democra cy i.e. the legislature, the executive, and the judiciar y. The Committee also opines that the legislature, which is a distinct and sepa rate entity should be accorded due sa nctity and importance . 10.Keeping in view the relevant factors outlined in the preceeding paragraphs the Committee recommends that the post of Secreta ry of Mizoram Legislative Assembly (PB-4 37400-67000+GP 9500) be re-designated to the post of Commissioner and Secretary with a pay of PB-4 (37400-67000+GP 10000) 11.The proposed re-designation of the post of Secretary, Mizoram Legisla tive Assembly as Commissioner and Secreta ry with said upgrada tion of pay shall not be constr ued as revision of pay and will be applicable only to the Secretary, Mizoram Legislative Assembly . No. NE-313(MZ) 2006-2008VOL - XLVI Aizawl, Friday 27.10.2017 Kartika 5, S.E. 1939, Issue No. 650 NOTIFICATIONNo. No.J.21011/1/2017-TAX/Vol-II/Part, the 23rd October, 2017.In exercise of the pow- ers conferred by section 164 of the Mizoram Goods and Services Tax Act, 2017 (6 of 2017), the Governor of Mizoram, hereby makes the following rules further to amend the Mizoram Goods and Services Tax Rules, 2017, namely :- (1)These rules may be called the Mizoram Goods and Services Tax (Seventh Amend- ment) Rules, 2017. (2)Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette. 2.In the Mizoram Goods and Services Tax Rules, 2017, (hereinafter referred to as the princi- pal rules), in rule 3. (i) after sub-rule (3), the following sub-rule shall be inserted, namely :- “(3A) Notwithst anding anything contained in sub-rules (1), (2) and (3), a person who has been granted registration on a provisional basis under rule 24 or who has applied for registration under sub-rule (1) of rule 8 may opt to pay tax under section 10 with effect from the first day of Oct o ber, 2017 by elect ro nically filing and int imat io n inFORM GST CMP-02, on the common portal either directrly or through a Facilitation Centre notified by the Commissioner, before the said date and shall furnish the statement inFORM GST ITC-03 in accordance with the provisions of sub-rule (4) of rule 44 within a period of ninety days from the said date. Provided that the said persons shall not be allowed to furnish the declaration inFORM GST TRAN - I after the statment in FORM GST ITC-03has been furnished.”; (ii) in sub-rule (5), after the words, brackets and figure or “sub-rule (3)”, the words, brack- ets, figure and letter “or sub-rule (3A)” shall be inserted: 3.In the principal rules, after rule 120, the following rule shall be inserted, namely:- “120A. Every registered person who has submitted a declaration electronically in FORM GST TRAN-I within the time period specified in rule 117, rule, 118, rule 119 and rule 120 may revise such declaration once and submit the revised declaration in FORM GST TRAN- I electronically on the common portal within the time period specified in the said rules or such further period as may be extended by the Commissioner in this behalf.”; 4.In t he principal rules, in r ule 138, in sub-rule (1), t he fo llo wing pro viso s shall be insert ed, namely :- “Provided that where goods are sent by a principal located in one State to a job- worker located in any other State, the e-way bill shall be generated by the principal irrespec- tive of the value of the consignment ; Provided further that where handicraft goods are transported from one State to an- other by a person who has been exempted from the requirement of obtaining registration under clauses (i) and (ii) of section 24, the e-way bill shall be generated by the said person irrespective of the value of the consignment. (viz. Social Welfare Department, etc.) for running the Welfare Institution as seen at Annexure - II. 1.3Assistance or subsidy of any similar nature with regards to supply of foodgrain/foodstuff must not be availed by the institution. 1.4The nos. of inmates/population should be reviewed yearly or after every two years by the DCSO concerned as deemed necessary by him. 1.5All eligible institutions selected by the concerned DCSO will be registered under Food, Civil Sup- plies & Consumer Affairs Department, Govt. of Mizoram as beneficiaries under the Scheme by the concerned DCSO, who shall maintain a separate register in this regard. The selected institutions will be issued a special Welfare Institution Beneficiary Ration Card by the DCSO concerned, a prescribed format of which is given atAnnexure - IV. The Beneficiary Ration Card may be simulta- neously utilized as Registration Card for all purposes under the Scheme. Numbering of the card may be done as follows- District Code*/Year of Issue/Serial Number/Name of Scheme i.e. ‘WI’ for Welfare Institu- tion. Incomplete application be summarily rejected. 1.6.3 The application will be received by the DCSO concerned of the District. 1.6.4 Verification of theapplicant institution and authenticity of the application must be con- ducted by officer of FCS&CA Department not below the rank of IFCS jointly with a repre- sentative of the local authority (Village/Local Council) of the locality where theapplicant institution is located. 1.6.5 The verification report in writing will be received by the DCSO concerned and inclusion/ selection of the applicant will be based upon the said verification report. 1.6.6 In case of any complaints regarding selection of applicants, the matter will be settled by the DCSO concerned. If the case is not possible to be settled at the level of DCSO, it may be referred to Director, FCS&CA for final decision. 1.6.7 Information regarding the Welfare Institution thus selected must be conveyed to the appli- cant in writing by the DCSO concerned. Copy of the same may be given to the Administra- tive Department of FCS&CA, Directorate of FCS&CA, concerned Department (i.e. Social Welfare Department, etc.as the case may be) and DC of the District. 1.6.8 Selected List of Welfare Institutions with their full address and nos. of inmates will be posted in the Department’s websitewww.fcsca.mizoram.gov.in and at the Notice Board of the concerned DCSO’s Office. 1.7The institution must be certified by the local authority that the same is smoothly run in the past two years with public interest in view. 1.8In the event of the institution engaged in any unlawful/anti-social activities, if the con- cerned DCSO is satisfied with the repor t of State Police and loca l authorities tha t the Ex-658/20172 institution is engaged in unlawful/anti-social activities, then, by issuing an order in this regard the DCSO shall make known that the institution shall immediatelycease to be a registered(ref. para. 1.5 above) Welfare Institution under FCS&CA Department and that all benefits from the Scheme to the Institution shall stop forthwith. 2.For Hostel : 2.1The institution must be a recognized and established Hostel where 2/3 (two-third) of the inmates/ students must belong to ST/SC or OBC category. 2.2The institution must possess registration or permission or certificationfrom concerned Depart- ment of State Govt.
