THE MIZORAM RIGHT OF CHILDREN TO FREE AND COMPULSORY EDUCATION (AMENDMENT) RULES, 2015 PART 1 - PRELIMINARY Short title, extent and commencement :- 1.(1) These Rules shall b e called the Mizoram Right of Children to Free and Compulsory Educa tion (Amendment) Rules, 2015. (2) It shall come into force from the date of its publication in the Official Gazette. No. NE-313(MZ) 2006-2008VOL - XLIV Aizawl, Thursday 12.3.2015 Phalguna 21, S.E. 1936, Issue No. 106 1.After sub r ule - 3 of Rule 1 of the Principal Rules, the following sub-rule shall be inserted, na mely-“(4) Subject to the provisions of articles 29 and 30 of the Constitution, rules framed under the provisions of this Rules shall apply to conferment of rights on children to free and compulsory education.” 2.(a) in clause (c) of sub-rule (1) of Rule-2 of the Principal Rules, after the word “means”, the words “a child with disability or” shall be inserted; (b) after clause (c) of sub-rule(1) of Rule 2 of the Principal Rules, the following clause shall be inserted, namely :- ‘(cc) “child with disability” includes,- (A) a child with “disability” as defined in clause (i) of section 2 of the Persons with Disabilities (Equal, Opportunities, Protection of Rights and Full Participation) Act, 1995. (B) a child, being a person with disability as defined in clause (j) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. (C) a child with “severe disability” as defined in clause (o) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. 3.In s ub-rule (6) of Rule-4 of the Principal Rules the following clauses shall be inserted namely- “(a). Every child of the age of 6 to 14 years, including a child referred to in clause (c) of section 2, shall have the right to free and compulsory education in a neighbourhood school till the completion of his or her elementary education. (b). A child with disability referred to in sub-clause (A) of clause (cc) of section 2 shall, without prejudice to the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, and a child referred to in sub-clause (b) and (c) of clause (cc) of section 2, have the same rights to pursue free and compulsory elementary education which children with disabilities have under the provisions of Chapter V of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. (B) a child, being a person with disability as defined in clause (j) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. (C) a child with “severe disability” as defined in clause (o) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. 3.In s ub-rule (6) of Rule-4 of the Principal Rules the following clauses shall be inserted namely- “(a). Every child of the age of 6 to 14 years, including a child referred to in clause (c) of section 2, shall have the right to free and compulsory education in a neighbourhood school till the completion of his or her elementary education. (b). A child with disability referred to in sub-clause (A) of clause (cc) of section 2 shall, without prejudice to the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, and a child referred to in sub-clause (b) and (c) of clause (cc) of section 2, have the same rights to pursue free and compulsory elementary education which children with disabilities have under the provisions of Chapter V of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. (2) They shall come into force with effect from the date of publication in the official Gazette of Mizoram. Sub-Rule (1) of Rule 6 of the Principal Rules shall be substituted by the following, namely :- ‘1. Recruitment : Recruitment to the Service a fter the commencement of these Rules sha ll be done by the following methods, namely :- (a ) Sixty percent (60%) of the sanctioned posts of Junior Grade shall be filled-up by Promotion in accordance with Rule 8 (b) Twenty five percent (25%) of t he ssa nctioned posts of Junior Grade shall be filled-up by Direct Recruitment through Competitive Examina- tion in accordance with Rule 9, 10 and 11. (c ) Fifteen percent (15%) of the sanctioned posts of Junior Grade shall be filled-up from the grade of Inspector of Statistics with not less than five (5) years of regular service in the grade, holding Bachelor Degree or above through Limited Departmental Examination in accordance with Rule 8A.’ 1 . Short title and Commencement 2 . Amendment of Rule 6 Rule 8 of the Principal Rules shall be substituted by the following, namely :- ‘8 : Recruitment by Promotion : As provided for in clause (a) of Sub-Rule (1) of Rule 6 of the Principal Rules, Officers substantively appointed to and who have served a minimum period of seven (7) years of regular service in the grade of Inspector of Statistics will be eligible to be considered for appoint- ment to Junior Grade of the Service by means of selection method.’ After Rule 8 of the Principal Rules, a new Rule shall be inserted namely :- “8A : Recruitment by Limited Departmental Examination: “Limited De- partmental Examination” means examination conducted by the Commission for filling up of fifteen percent (15%) of the sanctioned posts of Junior Grade of the Mizoram Planning, Economic & Statistical Service. (1) As provided for in clause (c) of Sub-Rule(1) of Rule 6 appoint- ment to the service against 15% of the sanctioned posts in the Junior Grade of the Service shall be made through a Limited De- partmental Examination to be conducted by the Commission in the manner as specified below (2) Inspector of Statistics with not less than 5(five) years regular service in the grade and holding Bachelor ’s degree or above shall be eligible to appear at the examination. (3) The date on which and the venue at which the examination shall be held will be fixed by the Commission and it shall be conducted at such intervals as the Governor may, in consultation with the Commission, determine from time to time. (4) The decision of the Commission as to the eligibility or otherwise of candidates for admission to the examination shall be final, and a candidate to whom a certificate of admission has not been is- sued by the Commission shall not be admitted to the examination. (5) The Commission shall prepa re list of selected ca ndidates who appeared in the examination in order of merit and send it to the Government. (6) Inclusion in the list shall confer no right of appointment to the posts of Junior Grade of the service unless the Government is satisfied to appoint him. (7) The list of successful candidates shall ordinarily remain valid for a period of one (1) year from the date of recommendation. (8) The examination shall be conducted by the Commission in accor- dance with the syllabus as per Schedule-IV of these rules.” Clause (c) of Rule 10 of the Principal Rules shall be substituted by the follow- ing, namely :- “(c) Educational Qualification: The minimum Educational Qualification of the candidate shall be at least 2nd class Master Degree in Statistics/Economics/ Econometrics/Mathematics and Commerce of recognized University.” Rule 15 of the Principal Rules shall be substituted by the following, namely:- 3 . Provided that any other member of the Service may also undergo such training and for such period as the Government may prescribe in any established training institute within or outside the State.” Rule 18 of the Principal Rules shall be substituted by the following, namely :- 7 . Amendment of Rule 18 “Time Scale of Pay : The time scale of pay admissible to the Service shall be as follows, subject to revision by the Government from time to time : (1) Senior Administrative Grade:Rs. 37,400-67,000+8,900/p.m (2) Selection Grade:Rs. 37,400-67,000+8,700/p.m (3) Junior Administrative Grade:Rs. 15,600-39,100+7,600/p.m (4) Senior Grade:Rs. 15,600-39,100+6,600/p.m (5) Junior Grade:Rs. 15,600-39,100+5,400/p.m.” Rule 21 of the Principal Rules shall be substituted by the following, namely:- “Promotion to Higher Grades : (1) Subject to the provision of sub-rule below, promotion of the members of the Service to the Senior Grade, the Junior Administrative Grade, the Selection Grade and the Senior Administrative Grade shall be made in consultation with the Commission through a process of selection. (2) A member of the Service in the Junior Grade shall be eligible for promo- tion to the Senior Grade after he has put in regular service in the Junior Grade for a minimum period of five (5) years, and after confirmation in the Junior Grade. (3) A member of the Service in the Senior Grade shall be eligible for promo- tion to the Junior Administrative Grade after he has put in a minimum period of five (5) years regular service in the Senior Grade, failing which Officer on regular service in the Senior Grade at least for a period of two (2) years but have completed not less than ten (10) years regular service calculated from the date of entry into the Service. (4) A member of the Service in the Junior Administrative Grade shall be eligible for promotion to the Selection Grade after he has put in a mini- mum period of five (5) years regular service in the Junior Administrative Grade, failing which Officer on regular service in the Junior Administra- tive Grade at least for a period of two (2) years but have completed not less than fifteen (15) years regular service calculated from the date of entry into the Service. (5) A member of the Service in the Selection Grade sha ll be eligible for promotion to the Senior Administrative Grade after he has put in a mini- mum period of three (3) years regular service in the Selection Grade or Officers on regular service in Selection Grade at least for a period of 1 year but have completed not less than 20 years of regular service calcu- lated from the date of entry into the Service”. 8 . (2) A member of the Service in the Junior Grade shall be eligible for promo- tion to the Senior Grade after he has put in regular service in the Junior Grade for a minimum period of five (5) years, and after confirmation in the Junior Grade. (3) A member of the Service in the Senior Grade shall be eligible for promo- tion to the Junior Administrative Grade after he has put in a minimum period of five (5) years regular service in the Senior Grade, failing which Officer on regular service in the Senior Grade at least for a period of two (2) years but have completed not less than ten (10) years regular service calculated from the date of entry into the Service. (4) A member of the Service in the Junior Administrative Grade shall be eligible for promotion to the Selection Grade after he has put in a mini- mum period of five (5) years regular service in the Junior Administrative Grade, failing which Officer on regular service in the Junior Administra- tive Grade at least for a period of two (2) years but have completed not less than fifteen (15) years regular service calculated from the date of entry into the Service. (5) A member of the Service in the Selection Grade sha ll be eligible for promotion to the Senior Administrative Grade after he has put in a mini- mum period of three (3) years regular service in the Selection Grade or Officers on regular service in Selection Grade at least for a period of 1 year but have completed not less than 20 years of regular service calcu- lated from the date of entry into the Service”. 8 . In ex ercise of t he powers conferr ed by the proviso to Article 309 of t he Constitution of India, the Governor of Mizoram is pleased to make the following rules regulating the method of recruitment to t he post(s) of Compositor under Higher & Technical Education Department (Mizoram Hindi Tra ining C ollege), Government of Mizor am, namely :- 1.Shor t title and (1) These Rules may be called the Mizoram Higher & Technical Education Commencement Department (Group ‘C’ posts) Recruitment Rules, 2015. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application These rules shall apply to the posts specified in Column 1 of the Schedule annexed hereto. 3. Number of posts, The number of the said post(s), their classification, pay b and and grade classification, pa y ba nd pay/pay scale attached thereto sha ll be as specified in columns 2 to and grade pa y/pay scale 4 of the aforesaid Schedule. 4. Method of r ecruitment, The method of recruitment to the sa id posts, age limit, qualifica tion age limit, and other matters relating thereto shall be as specified in columns 5 qualifications, etc. to 14 of the aforesa id Schedule. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram, from time to t ime. 5. Disqualification No person- (a ) who has entered int o or contracted a marr iage with a person having a spouse living; or - 2 - Ex-117/2015 (b) who, having a spouse living, ha s entered into or contracted a marriage with any other person, shall be eligible for appointment to t he said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for doing so, exempt any such person from the operation of this r ule. 6.Training and Departmental Every Gover nment s ervant recruited under these rules s hall undergo Examination. such training or pass such Departmental Exa mination(s) as may b e pr escribed from t ime to t ime. 7. Powers to trans fer Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest , shall have power to transfer any officer so r ecruited under these rules to a ny other post or position which is equivalent in rank or gr ade. 8. Power to relax Where the Governor is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing and in consultation with the Department of Personnel & Administrative Refor ms, relax any of the provisions of these rules with respect to any class or category of persons. 9. Reservation and other Nothing in these rules shall affect any reservation relaxation of age concessions and other concessions required to be pr ovided for the Scheduled Castes/the Schedu led Tribes and ot her ca tegor ies of persons in accordance with the orders issued by the Central Government or the Government of Mizoram from time to time in this regard. 10. Repea l and Sa ving All rules pertaining to these posts fra med by the Gover nment of Mizoram issued under Notification No. A. 12018/10/82-APT(B) dated 30.11.1995 and published in the Mizoram Gazette Extra-ordinary Issue No. 256 dated 10.07.1995 stand hereby repealed. Provided that any order made, or anything done or any action taken under the rules so repealed or under any general orders ancillary thereto, shall be deemed to have been made, done or taken under the corresp onding provisions of these rules.
